Have you tried calling the embassy? You should be able to find out the answer on approval by calling them at their standard number especialy since you have been complete since the 17th.

It's 10 days ago and should reach copenhagen by now.
Maybe I will get a letter tomorrow from copenhagen

Couldn't stop to check the list in London and see that they still haven't updated today friday.

Last friday I had my approval and embassy still not recieved our documents from London.
It takes about 2 weeks to Denmark.
By the time they recieve them they will issue the visa.
So until now we can't make any plans of which date to buy the planeticket.
Ok we know this will be in Marts.
So today I will send them my passport to not delay anything further.

I received a letter from U.S. Citizenship and Immigration Services in today’s mail, indicating that your waiver application has been approved. Congratulations!



Visa issuance should be a matter of formality now, once the file is returned to the embassy in Copenhagen. I would wait, however, until you hear from the embassy before making any firm travel plans.

A friend of mine has her permanent residence/green card in the us as well as valid us passport. However she has been living abroad in colombia for almost two years now and never applied for a re-entry permit when she left the U.S. almost two years ago. In reading it appears that she may have abandoned her resiedency status and the only thing i could find besides starting the whole process over was that she could apply for a waiver or renentry permit? Does anyone know where i can find more info re this waiver? or any other suggestions?

How can we both be so happy the same day.
It's now almost 2:30 in my morning and I am having so much energy that I can't sleep.
I opened a bottle of wine to celebrate it myself and called all my famely, friends and enemies to tell my approval LOL

I hope so for both of you to have a safe travel to Florida
My travel will be in marts because of things I need to finish first.
It's especially because of my son who has to finish his college a good way and need to have february done.

It's a very much big pleasure and happiness for me that I am with my husband now that I married April 4th.
We are still so overhappy being approved after I-601 which we waited fore in 2 years.
It was a devasting time we can tell.
So we love and enjoy everything right now as not giving for granted.

I really are so mad at thos faked weddings that is going around.
They are really so afraid at this office that you are some of those.

Can't forget this guy who had a subject.
How can my woman come into usa if she don't understand a single word English.

Hi everyone---
I just wanted to say hi to everyone and to meet some people on here who may be in a similiar situation and who might be able to give me some advice..
I recently was denied my k-1 visa and banned from the states for 10 years!! My fiance is american and in 2002-2004 I overstayed a visa- I had origionally thought that I would have been banned for 3 years but much to my surprise on Thursday a CO in dublin took my fingerprints- told me I was banned for 10 yrs and not to try and enter the states!!
He did say that I was eligable to apply for an I 601 but to me it really seems like a shot in the dark!! Has anyone on here been granted a waiver and under what circumstances??


I was denied too and should go through the I-601 thing. My reason was a very old conviction.
You should start right away to file this because it can be a very long waitingtime. :(

I was approved in London in Jan 2007 after filing I-601 and had my K-1 visa.

Until now I am so reliefed that they saw my case not being too serius.

My question is:

Will my further applying for adjustment of status still be concidered with alot of background check?
Does this I-601 situation affect my case all the way to my GC? Or is this now an ending chapter?

Will appreciate if any should have any experience.

Mary Lou can you contact the POE where you were denied to find out if you did receive a ban or anything. I would strongly suggest on getting informed before you go to your interview.



no i am not ban, they explained to me to prove strong ties to canada and i could enter the U.S, but that was before i applied for k1 visa. so did they ban you? you said your situation was similar to my TN visa.............what is your situation/ did your TN expire?

never knew about the ban till we started the process. The POE gave me no information except a piece of paper when I was at the border. I was told to fill it out and send it in and than I was going to be allowed in. What an eye opening experience cause it was not what they said at all. It was my lawyer who informed me about the ban once we started the paperwork.


Before we applied for my K-1 visa I visited my fiance alot. The 4th time they did send me back at the POE because of my intensions even my plan was to return to my homecountry. They said I needed a K-1 visa first.
What I will say is that they didn't hand me anything. It was just words from the immigration officer.
But still they told me that now I was in their system and a possibility that I wouldn't be able to enter if I tried again.
My lawyer called the POE and were told that I was not banned but denied entry until my K-1 visa was approved.
We added this in my I-129 form and I didn't dare to risk to visit under this process.

I am not sure if you really need a waiver or not.
But if you do, then it is a very good thing to be prepared before the interview.

I was denied at the interview and should start from there to submit this waiver and the reason it took me such a long time.
As I can see there is some misunderstandness between companies and I hope you can prove this. As also you are really misinformed.

I needed a waiver because I had a conviction for 2 decades ago. Nothing serius but enough for the immigration rules.
Kitkat is a person in this forum there is vey good with experiense in immigration laws. There are other persons too. But she helped me alot :thumbs:

Hey everyone. I have a question. We are waiting on our ininterview in montreal for our K1 fiance visa. Before we applied for our visa I had a situation at border crossing in Toronto. This is what happened: i was working in U.S on a TN visa, i quit the job and went working for another company( american airlines) with the same visa. American airlines said my tn was not expired so it was ok for me to work for them, my fiance also checked with a friend of his who is a custom agent and again they said as long as my tn was not expired i could work for another company. I worked for 3 weeks and my fiance and i came to canada for a holiday. When we returned to the U.S, the immigration officer looked at my visa and asked was I still working for the same company. I told him NO, i now work for A airlines. He told me i was not allowed to do this. He sent me into questioning. I expalined to them that my Boyfriend and i checked into this and also that american airlines told me it was OK. He told me i was misinformed and he also called american airlines on the spot and told them that it was illigeal for them to hire me on another companies visa.
He then explained to me that I would not be able to enter U.s that day. I came back home to newfoundland and we were devastated. We were planning on getting engaged when we went back and the purpose of our trip was to meet my family before we got engaged. a month later, chris returned to candaa and we got engaged and started our K1 process.

The immigration slip states that i was allowed to withdrawl application per sec 212a7AiI....................I need to know will this affect me at my interview and also I am planning on visiting chris in 2 weeks. I havent tried to visit since this happened in NOV. I have waitied 8 months. Will I have a problem crossing again now. i have bill slips, letter from my employer, as well as scheduled appointment i need to return for to remove stitches as I just had surgery.

i am sorry all this was so long but could someone answer it for me especially about sec 212a.

I have not been in same situation as you, but I know that while I was waiting for my I-601 waiver to be approved I couldn't cross the border. It affected my interview for a K-1 visa and was denied until the waiver was approved which lasted me 8 month. When is your interview?

I don't have experience with appeals on I-601

But I think it is very importent that you are doing it the right way the first time because you need to emprove and come up with alot more evidence on an appeal.

Even this forum is very good to advice you, I suggest that you are hiring a very good attorney :)

Essentially this is the deal. The thing keeping my wife and I from filing an I-601 is the fact that if it is denied she will have to wait 10 years to come back. Everyone should know this by now. How do you deal with that situation. Do you just say the hell with it and do it anyway. Is that true you can keep on re-filing a I-601.

Consider if you working with an attorney. As long as you keep trying and you are serious and correct the mistakes will you eventually get an approval. Is this statistically accurate?


Finally I hear a person in here that have the same pain and thoughts we had for only 1 year ago. And it went out succesful anyways for us for only a half year ago.

It's not through that nothing can stop you from going to your spouse's country.
In my case it would be almost impossible if my husband should go to my country faster than I could go to him.
He have ties here in US that would be very hard to leave, in fact he couldn't before his son was old enough to be allowed to take him with him to another country. He has shared custedy over his son and the son lives with him.

We didn't even had an alternativ if I was denied after filing I-601.

But today where I am approved I can see that it's so much worth it to file this from the beginning and not deal with this after you finally are together.
It's a tough waiting time and a risk. But this risk you won't have later when you continue the apply for adjustment.

What is your story? :)

I do not get as much time to spend on here lately as there does not seem enough hours in the day but dwar49 was going through the waiver process when Alan and I were and I do know that his partner got denied. I was in contact with him for a short time after that and know that they were using Laurel Scott for an appeal, if anyone has any knowledge of what has happened to him and Lisa would you let me know.

They were a lovely couple and I would love to see some news that they are here in the states, finally together.

Our waivers both the I212 and the I601 were denied in the begining of August. We will appeal the decision, but honestly I am so tired of all this immigration #######, it's been all together 5 years. Anyway, at the same time we received a letter from the Islamabad Embassy that says;

Dear Sir/Madam,

We are ready to continue processing of your immigrant visa application. Please come to the Consular Section, American Embassy, Islamabad , Pakistan on any working Monday between 8-10 am.

Please bring all of your passports (current/previous) and this letter with you.

We filed for the K-3 and I-130, but only went to the interview for the K-3 which is the denial, the I-130 we did not go for the interview for, hoping that we could finish processing here in the US. I am down but not out,I and my darling wife intend to go all the way. :thumbs: It was denied because our hardship letter was not strong enough,if we had been here before we put the hardship letters in we would have done it properly,we are now doing it the way we should have done.. I was so depressed I felt like chucking it all in,they even have the audacity to enclose an appeal form asking for $385 to appeal,how low can you go when rejecting something that two ppl have there hearts set on,they break them and ask for more money,that further enhances the proof that revenue is their priority and I would go as far to say that they know the results of any case before the money is handed over,this is the case here,that to me is fraud,and to think of the many thousands of ppl who pay for their entry into the US,or denials,they know the vast majority of outcomes before they take the fee. However I and my wife are swinging into battle mode and intend to take this all the way,she is a wonderful person who`s spirit has lifted the gloom out of me and made me strong again. I do not how anyone can define seperation not being a hardship,in fact in my letter they say it is merely a form of inconvenience,obviously written by a singleton or a person who goes home every night to see his/her loved one. I am fine now and have got over the disappointment and as real love has only came along once in my life I believe that it is worth fighting,we shall be together and we will beat the red tape. Will tell you that when we should go through this d.. extra process we took a lawyer since he knew all about how to put together those hardship letters.
We were very afraid to do it ourself from the beginning.
I know that this is very expensive, but if it is possible for you I think you should consider to take a lawyer and help you out with better hardship letters.

I hope so much that you won't loose your hope's. It's always a good thing that they suggest you to appeal.
The worst thing is really that you still have to wait and this time it may be a little longer.

I believe yes that his bar is 10 years. Depends on how many days he overstayed. But some here do have more experience in this.

I would strongly recommend you to hire a very good immigration lawyer to help you out with this waiver.
It's hard to say how long the process is, but can be a very long waitingtime if you are not doing this correct from the beginning.
I don't think there are any statistic of approvals or denials.
The only thing I can read from other people here in VJ is that there are certain countries that have to go through a more tough and longer process than other countries.

I wish you very good luck and hope that you will get better and correct answer than I can give you
