Like you when I first came on this website, Nicholas and I had decided to hire a lawyer. After finding VJ, we changed our minds completely. If you have a straight forward case...you can totally do it yourself.

Just look under the Guides up top and it tells you step by step everything you have to do and when you have to do it. Then, if you have more questions, you simply ask on these amazing boards. The people here are so super helpful!!!

A lawyer costs a pretty penny and then once you enter the U.S. to adjust your fiance's status, it's over $1000.00! Save your money for that.

If you work together, take it slow, you can totally do it on your own.

How long was this period of time?
I don't think that matters. As long as you had an address back home that was yours, had all your belongings there and you were still receiving mail at that address, it was still your home, even though you were traveling away from it for a period of time.

The only way I would put any other address was if you moved to a certain location and were not returning to your previous address.

I would just put your address.

If I'm wrong, I'm sure someone will correct me smile.gif




It was from November 06 through to February 07.But I didnt actually have a permanent address.My belongings were in storage and my mail waas going to a friends house.

First, I hope that you and your fiance have a wonderful visit.

I don't think that getting pregnant will harm the process in any way and I know for a fact it won't accelerate it. They don't care. If you have the baby before you enter the states I've read that your baby and your fiance will have to take a paternity test to prove that it's really his. I could be wrong on this but I remember reading that somewhere.

On a personal note, I would wait. Don't you want to be with the father of your baby while you give birth and live together as a family during that very special time? I guess he could come over there while you give birth but then you'd have to apply for the K2 for the baby to enter the states as well and that means more money.

It's your decision though.

Do you pay for your skype service?
I believe the area you are talking about "calls and SMS" is not for the free account.

I have tried this, logged into "my account" and there are no calls there because I don't pay for skype, I'm on the free service.
If the OP is on that as well, it's difficult to print off the skype records other than print screening the entire screen. I've heard of exporting to excel but I haven't tried that as I don't have excel on my computer. I've heard of people trying it and the contents is all scrambled when it's opened in excel.

Sigh, I really wish Skype would allow the free users to print off their entire log simply by copy and paste.

Also the USCIS asks that the police check be no older then a year from the interview date...but I would actually have it under 6 months old to be safe....so if your interview is like 8 months from now...I would have another police check done closer to the interview date.

The answer to your question is just 'it depends.' It would completely depend on the reason for the denial as to whether a second petition would face additional scrutiny. And also what would be meant by 'denial.' It's actually a pretty long process with plenty of places to turn around or challenge an incorrect finding, or to waive findings of inadmissibility.

No, because you are there on a visitors visa...coming in to the country on one of those and getting married (even if it's spontaneous) is frowned upon. They could even consider it fraudulent. You will have to return home and file for the K-3 Spousal visa....

I don't even know if they will let you in the country on a visitors visa once you have started the K-1 process without showing strong ties to your home country and your plans on returning there.

What if by accident your petition gets lost in the mail? What if you need to travel outside of the states for an emergency...do not do that.
You can also visit your fiance in her country during the K-1 process..this is good to show an on-going relationship which is needed at the interview...you can't travel there without a passport wink.gif

Send photocopies of your entire passport, that's what it asks for...copies.

Scroll down and view the section "What to send to your fiance(e) once the I-129F is approved (Receive NOA2):"

"Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy." Would mean your birth certificate, original pictures, boarding passes, plane tickets, etc, etc.

Basically anything you photocopied, send your sweetie the originals.

Welcome to VJ....

As YuAndDan has given you links to the answers to your questions...I'm going to suggest not going with a laywer.
If you and your fiance have a straight forward, non-complicated case, I highly recommend doing it on your own. Lawyers fees can be in excess of 1500 bucks...I feel they are just glorified proof readers...you have to do all the work anyway, you gather all the info together and mail it to them...you could easily do that on your own.

When I first came here, my sweetie and I were really considering using a lawyer but once I came here and saw all the help you get with these boards and the step by step instructions and downloads you get from the Guides here at VJ, we were both amazed. Save your money for the AOS when the time comes (it's over $1000!) If you take your time, read and follow the instructions, you should be fine.

Noll - I think it's kinda weird that you are getting ready for the whole K1 process, and your girl doesn't seem that interested in you, and emails once a month. Maybe you should fill her in on the details of your plans to see if they match hers. Maybe she "really likes you" and wants to be friends and not necessarily thinks a K1 is in line, while you are consulting with attorneys on how to coach her to write emails... all weird to me that's all.

If you want to talk with her more, and she cant get to internet cafe, maybe you can arrange for her to have internet at home? If your only communication with her are these once a month emails, I dont know what kind of a strong relationship you can be building. The interview at the consulate is to test the strength & validity of the relationship, and if she seems "coached" you guys are going to have problems. My personal recommendation would be to lay off the lawyers and invest in your relationship to see if this girl wants you, wants to marry you, has any idea what a K1 is, and wants to move to the US.

Most girls are not going to write a lot to one man until they are falling love with him, especially if they don't have their own computer and they struggle with English. This is where I am at in the process. But it looks as though no one has been denied because of too few e-mails. So I am less concerned about it now. Who are these lucky guys that actually have their girls write frequently to them?

Wow..ok...now that I know your full situation I guess I see where you are coming from.

...I don't quite know what to say.

I write my boyfriend daily, we text message non-stop, email, voice and web cam chat and talk on the phone...all...the...time.

I wish you much luck with the girl in your life and I hope that both of you can discover this journey together.

Noll, I think email is important but it's not as important as you think it is. Emails can be faked.

Pictures of the two of you together that are dated, passport stamps, boarding passes, phone records from your phone company showing the number which is being called, or text messages, Letters mailed to each other with the stamp mark on them, etc. These are the types of things they are looking for.

Having to coach your girlfriend in to emailing you...again, I find odd.
I understand you are afraid of being denied but like I've said, if it is a bona fide relationship and you have been in contact with her daily in some way that you can show...you'll be fine.

I'm sorry but I find this so bizarre. Why you are needing to coach your girlfriend in to writing you more is beyond me. If you have communication on a regular basis, telephone, email, instant chatting online, letters, etc. you should be fine.

The fact that you are saying you actually have to ask for emails is a little strange.
