I received the second letter over the weekend and have not been able to post a reply to my situation. My Senator received a reply from the USCIS in regards to my petition. It almost seems I'm in some administration process. This is absolutely nuts.

Could anyone please read my response back and give there advise as to what further back ground checks they may be referring to?

My case is now going on 8 months this coming week with no decision. I need the best positive advise at this moment.

Aww hon I'm sorry sad.gif
It seems that your case is still in background checks.
I really don't know what takes so long to find out about someone's background...honestly.
The second letter I couldn't read very well.
I really hope you get an approval soon

I sent 2 pics of each because I HAD them. The I-129F instructions say "a photo" for petitioner and "a photo" for benefitiary. ~Laura and Nick~ has a lawyer telling him/her that 2 are needed for each. I believe that is what was required in the past, but not anymore. For safety, it should not hurt things to send in 2 pics for each.

Cool...thanks for clearing that up, I was wondering too. We'll be sending the lawyer two as that is what he requested.

K-1 Fiance(e) Visa Process & ProceduresFinally filing!!
After reading this websites outline..I see why you are required to have two copies....

"IMPORTANT!
Make TWO copies of the entire package before you send it in. This includes the money orders too. You want to have a perfect replica of the package you are sending in. All Forms that you submit must be originals with original signatures. Supporting Evidence that you submit may be photocopies. Retain ALL original supporting Evidence since the USCIS has the right to check them by issuing an RFE (Request For Evidence). If you receive an RFE, follow the direction exactly, and make two copies of what you sent back. During any future interviews the USCIS may also want to examine the original supporting evidence."

So...I think you guys are ok with sending in the one copy....but you may need a second in case.

I have read (including the start up kit from our lawyer) that you need 2 photo's EACH..one of you and one of your fiance.

"You and your fiance must each take passport type photographs for
submission with the USCIS petition. We need two photographs from you and two from your fiance for the
USCIS petition."

Ok, what do you guys think? Did I forget something? Should I take out something? All opinions appreciated!!! smile.gif
God Bless,
Kate

Have you identified (by name) the people in the pics?
Have you explained how you met thoroughly so the beaurecrats can understand? (I don't recall if this is Q#18)
Did you make copy of ALL pages of US Passport (vice just "important" ones)?
Have you made EXACT copies of the package as you will send it to the USCIS (I made 3).

Some of these are picky, but they are things that I went back and brushed up on, because when I looked at my pkg a second time I thought I should. A recommendation about sending the material is to send it both registered and return-receipt requested. Unless you send it "Express Mail" which accomplishes the same thing. The point is to make sure that you get back documented confirmation from Post Office that they delivered to USCIS. With the delays that are happening in processing NOA1s, it seems this is critical these days so that you can relax a little knowing that its "in the building" even if you don't get confirmation from USCIS about this.

Also, you mentioned "check" but just to be clear, is this a personal check that you can tell (from your bank) when its been cleared? This is another item that people have had problems with on the Forum. They send money orders that can't be tracked, so they get no confirmation from USCIS until they receive NOA1. Its not mandatory, just helps the stress level, I think.

With the copies, I made multiple and sent one off (immediately) to honey ko so that she'd be able to see what it looks like. Of course, its subject to RFE (none yet) and she will need originals of all materials when she goes for interview. But it helped us during our discussions about what's going on and at times when she had to deal with situations regarding her kids.

Does the USC really need to copy ALL pages of the passport at this stage? I thought just the page with the entry stamp to his fiancee's country or the third country is required.

My fiance is about to send off the petition now and I thought we only need one passport style photograph for each of us instead of two? Okay now I am confused.

Cheers.... wacko.gif

Here is what it says in our starter kit from our immigration lawyer about the passport and passport type photographs:

"You must send us a photocopy of several pages of your passport:
page 1 (showing your signature), page 2 (showing your photo and
citizenship data), and the page(s) where your passport was stamped upon
entering USA (and any other country where you have met Laura)."

"You and Laura must each take passport type photographs for
submission with the USCIS petition.
We recommend that Laura find a local professional company to take the
pictures. We need two photographs from you and two from Laura for the
USCIS petition.
"

Congratulations and Good Luck!!!!

K-1 Fiance(e) Visa Process & ProceduresTwo questions about K1 requirements
[quote

Could you point me in the direction of info about a co-sponsor? Again I have looked but not really found anything that explained it completely.

Thanks for your help!
[/quote]

Hi smile.gif
So from what I've been reading, I don't think it matters if he can support himself financially or not. You are responsible for him...you are his sponsor. If you don't meet the requirements, you can have a co-sponsor.

I found this link:
Sponsor Info

Key Points:
"IF the foreign spouse has LIVED IN
THE HOUSEHOLD of the U.S. spouse for at least 6 months, then his/her income CAN be counted. There are
NO situations involving fiance visa in which foreign spouse's income can be counted, as far as I know, when
interviewing for the fiance visa or when filing adjustment of status within 6 months of arrival in the US."

"The US fiance is ALWAYS the primary sponsor, but may have a co-sponsor. If there is a co-sponsor, both the
US fiance and the co-sponsor will EACH have to fill out the affidavit I-134 or I-864 and EACH will have to provide
supporting documentation."
Good luck smile.gif

First, on the proof of support front I am not sure what to do. I am not working while I go to school and live off of financial aid and loans, my boyfriend though will be traveling to the US with plenty of money on which to support himself until he finds a job. Will the fact that I personally wouldn't be capable of supporting him matter if he can do it himself until he is eligible to work?

For your first question...I believe you'll need to get a co-sponsor or sponsor to help you...I don't think they will take your word on him simply having "plenty of money" to support himself...
I don't know about the second question....I'm sure someone on these awesome boards will though smile.gif

Hey people!
So I've been really reading all the info needed to file for the K-1 ourselves....(we were thinking of hiring a lawyer but I think we can do it on our own)
Anyway... whistling.gif

Just two questions:

On the I-129F application it asks the address the fiance (me) will be living in the states...Problem:
My honey still lives with his folks..we are planning on filing within the next few months and he doesn't and won't have his own place until well after we file...
What address do we put down here??? His parents???

Also how does Nick find out his G-28 ID Number? It asks for it at the bottom of the form.

Thanks!

So just wondering..I've been down to the states like 4 times since I got my new passport in January 07 and they only stamped it once...my June 21st trip.
Will this matter when I'm photocopying the pages of my passport for evidence and I don't have stamps for those dates? I have the boarding passes from all the visits, just not the stamps in my passport pages...so I'm just wondering. unsure.gif

Sigh, why can't they stamp them every time? blink.gif

I took what you wrote, "literally" because that's what your intended audience is most likely to do. Please bear that in mind when posting. If your meaning isn't literal, make sure that's clear. Otherwise, its best to choose wording that is intended to be taken literally. I took exception because "love" is not a requirement for a fiance or spouse visa to be approved or a relationship to be bona fide.

I'm sorry....I really didn't mean anything by it..all I meant was that you should make sure you can provide evidence that it's a real relationship "bona fide" as you said and to me, I just worded it the way I know a relationship to be. One of love. Sigh. Whatever.

I feel like I am being slightly attacked here and I'm not feeling very welcome. I guess I'll just keep my mouth shut and just ask questions and not answer them. Obviously you know much more about this process than I do.

Again, my apologies.

Wow, that's a bit off the wall. We romantics do like to marry for love but you do not have to prove you intend to marry for love and not some other reason. You might have more than one reason for marrying, none of which are required to be love. What is required is that your relationship is bona fide and not exclusively entered into to provide an immigration benefit.

Yes, there are other things that are factors in marriage...security, closeness, dreams, children, structure, responsibility but I believe that all of this is based on love. I'm sorry but I marry for love....all the rest just falls in to place.

Love is required for me and I believe it's a strong factor in marrying someone and sharing your life with them, don't you agree?

I'm not saying there aren't other reasons but I believe love and being in love and sharing that intimate part of yourself with someone to be very important and key in what they are looking for.

K-1 Fiance(e) Visa Process & ProceduresIs it possible to enter the United States while your I-129F is pending?
As we have been preparing to file the K-1 for awhile, this is the number one question I get from friends.

"When are you going back down to the states for a visit??"

I have decided not to while this process is going on and just wait until I move there. Not because I'm not allowed but because the permission lands in the hands of the immigration officer. You have to show strong ties to Canada. For example: a job that you will be returning to, bank accounts, etc. but it all comes down to the person allowing you in to the country for the visit. They may turn you around and say "Sorry, no"

I don't want to buy a plane ticket and be denied. If you think you have strong enough ties, go for it.

But don't forget, your spouse to be can visit you any time he/she wants!

Best of Luck smile.gif

Ok so I've been thinking about this and I still don't think you need a lawyer.

You say you'll have your divorce papers in January 08. Why don't you wait a little bit of time after that and then file.

What more can an immigration lawyer do for you, honestly? They are basically paid proof readers. When I contacted the one we were going to hire, he just wanted us to get together all the paperwork and evidence and send it to him. We still had to do the work. He just put it all together for us at the cost of 1800 bucks!

Maybe someone else has a different opinion but I think that you should still try it on your own....just be honest in your petition and I'm sure you'll be ok.

Just look under the Guides up top and it tells you step by step everything you have to do and when you have to do it. Then, if you have more questions, you simply ask on these amazing boards. The people here are so super helpful!!!

A lawyer costs a pretty penny and then once you enter the U.S. to adjust your fiance's status, it's over $1000.00! Save your money for that.

If you work together, take it slow, you can totally do it on your own.

Best of luck on your journey!!!
Hugs
