K-1 Fiance(e) Visa Process & ProceduresProof of relationship...please help
My sweetie is in New Jersey too!!!
Rypoli..you are looking at anywhere from 6 to 9 months from filing to interview...it varies.
Check out the GUIDES here at VJ, super helpful!!!
Also you may want to check out the Immigration Timeline for Canada/Vermont Center users on VJ to see how long it took them from start to finish to get an idea.

You can send in photo's of the two of you together, boarding passes, stamps in your passport, receipts from rental cars, etc etc.
Stuff like emails and text messages and phone bills, save for the interview. Some people do throw those in to the initial package but that doesn't prove that you have met in the last two years, that just shows an ongoing relationship...save it for the interview.

Best of luck!!!
~Laura

P.S. Make sure you fill in your profile to show your fiance is from Canada and fill in your time line when the time comes, it helps others help you! smile.gif

Yes, one of your family members can be your co-sponsor as long as they are a USC and meet the 125% above poverty line rule.

Past few years, was just that, a few years ago. They are looking at your current financial situation upon return to the US. They want to make sure he'll be able to support himself and his fiance/wife and not end up on welfare.

Agreed good.gif
When you return home and you start your new job, if you don't make above the 125% poverty line then have a co-sponsor lined up.

K-1 Fiance(e) Visa Process & ProceduresNeed advice with Mexican fiancée
QUOTE (Math Man @ Nov 3 2007, 08:50 AM) <{POST_SNAPBACK}>
Hi Laura and Len,

Sorry for my delay in responding--I've been on the road for business and have had only sporadic Internet access. Thank you both for your replies. It looks like the best option for us is to have the civil wedding in Mexico and then immediately apply for a K-3 visa while we plan the Catholic wedding (which will also be in Mexico). I was initially dreading having to obtain permission from the Mexican government to marry my fiancée, but her father knows an immigration attorney in Mexico who's going to help us through the process (apparently at no charge!). Once I have that Mexican marriage certificate, I think I'll be able to handle applying for the K-3 myself, without the help of a lawyer.

Again, thanks so much for your help. I'm sure I'll have more questions as I get further along in the process!

Matt

You are very welcome smile.gif
I hope the K3 process goes as smoothly and quickly as possible for you and your loved one.
You'll totally be able to do it on your own...just follow the Guides for the K3 here at VJ and you'll be set!

K-1 Fiance(e) Visa Process & ProceduresNeed advice with Mexican fiancée
Hi Matt smile.gif
Welcome to VJ smile.gif

I'll try to answer some of your questions but I'm sure other people will have more information for you.

First off, if you go with option 1, she comes to the U.S. and you get married here, she is not allowed to leave the country before she has her green card unless she has advanced parole. You apply for advanced parole when you file your Adjustment of Status after being married. It can take up to several months to be granted the advance parole.

Your second option is to have a ceremony in mexico but it wouldn't be a legal marriage. I don't really know too much about this topic. I have read that some people have had ceremonies outside of the U.S. but weren't technically married and so they were fine with the K1. If it is a legal and binding wedding ceremony then she is no longer your fiance, but your wife and you will be denied.

As for your third question, I have no idea but I'm sure someone else will be able to help you.

Best of luck!!!

I don`t feel that it is OK to lie about anything. It is just that I would like to see my fiance sooner. I don`t have any intention of staying in USA illegally. That`s why I am going for a fiance visa.
It is just this whole birocracy thing that doesn`t make any sense...
And stepping over human rights.

But that's just the way it is.
As I said before, you can attempt to visit her but you must show strong strong ties to your country. A letter from your employer stating you will be returning home on such and such date, property that you own, bank statements, etc, etc.
Even then, it comes down to whoever is on the other side of the counter. They could deny you and you are out the flight money.

It's hard to be apart, she can come visit you though...why don't you try doing that if possible?

Don't do anything that could mess up your chances of being with her in the long run. It's not forever, it's only a few months to a year...hopefully much less and then you'll be together the right and legal way.

It's worth a try, my fiance' got a 5 year Toursit Visa and she visited me in the US in May, but that was before I applied for the K-1 Visa, which I did in July. I think as long as she sounds honest about going back, the Immigration desk at the airport will let her into the US. We have yet to try this. One immigraton lawyer told us not to state anything about the K-1 submision, unless they ask about it. Why complicate a situation when it is not necessary.

I really don't advise this at all.
Just being honest and stating that you will return back home is NOT enough...you must show proof that you will return. Do you think they will just take your word on it?
What if they find out you have applied for a K1 visa but you simply "forgot" to mention that? Big trouble.
Yes, people have been let in to the U.S. for visits while the visa process is occurring, but lying and not mentioning things? not a good idea at all.
It's such a huge risk because you never know what they may find out while you are standing there at their counter waiting to get in to the U.S.

Btw, couple of months ago I tried to get a tourist visa before we applied for a fiance visa, and I was denied because I mentioned I have a girlfriend in USA so they were afraid of my illegal stay.
The only way I see I could get it is to lie not mentioning my fiance at all but saying I am coming because of something else. But I am wondering if they have records me where they can see I do have a fiance there.
It is all so complicated, and I just want to see my girl while waiting for his long sad.gif

You were already denied even before the process? Then I highly doubt you will get one this time around.

Please get the idea of lying completely out of your head...it would totally mess up any chance you have to be with your girl.

Yes, they have ways of finding out....don't risk it.

It's hard, I know....so many of us are going through it. Focus on saving money, focus on your relationship, talk every day, send emails and cards, support each other through this hard time and before you know it, you'll be together.

Be honest and patient and everything will be ok.

Good Luck!

robably it is hard to get a tourist visa if mentioning that one has a fiance in USA. So , what if one lies at embassy about that and they discover it. Can it have an influence on the fiance visa that is being processed?

Um, I really don't think lying to the embassy is a great thing to be doing. blink.gif
It could have a MAJOR effect if they find out...which they will.

You have applied for a fiance visa, which means you have intent to stay in the U.S. Lying and saying nothing about your K1 application while trying to get a tourist visa and them finding out = HUGE RED FLAG that you will just stay in the U.S. = fraud = denied K1 application and even a ban!

Why risk this? wacko.gif

You could try to get a tourist visa but be honest...show strong ties to your home country that you plan on returning, a letter from your job stating that you will be returning to it, etc. etc. even then, you have a high chance of being denied.

I know that it's so hard to be apart from your loved one...perhaps she can come visit you for awhile?

Be patient...it will be so worth it in the end.

You have more than enough really. If you want to save a tree, i would recommend that you just copy the last trip or two. You dont really want to overwhelm the adjudicator with evidence so that it takes them a long time to sort through to find the paper they are looking for.

On the copies highlight names and dates. Having your fiancee sign it, is not really necessary.

But for any addtional information, put it on a cover letter. I had a cover letter for the evidence of meeting section of the petition. It had a list describing each piece of evidence I included, and it was organized in the same order as the list, making it easy to find.

Why, thank you very much smile.gif

Ok...well perhaps I'll just do the last couple of visits...Nick also has 3 boarding passes from his trips to Canada...the last time he was here was July.

I'll just highlight names and dates and not worry about him signing it.

Thanks for the cover letter suggestion, I'll follow your example.

Much appreciated,

Hi People smile.gif

So I have one of those scanner/printers and I'm really bored tonight as Nick is out with friends so I'm going to photocopy my boarding passes and passport and stuff as we are filing in a few weeks.

I've taken 5 trips to NJ and I have all the boarding passes minus the return boarding pass from our 3rd visit (I have no idea where it went!) blush.gif
Should I just photocopy 5 of the departure boarding passes or should I photocopy all 9 that I have (Departure and Return)?

I am planning on putting them on one piece of paper so 5 would be easier then 9.

Also, should I write on the paper (beside the boarding pass) the length of each of the trips?

Of course I'll sign and date the page and Nick will also sign and date it once I mail it to him. innocent.gif

Thanks in advance!

K-1 Fiance(e) Visa Process & ProceduresLengthy visits while waiting
Nick and I have been very lucky. This past year we've had 8 visits. for about 5 months we saw each other once a month. The longest we have gone in between is 3 months. The longest visit we had was about 3 weeks when I went down in August/September.
We are 8 hours apart and only an hour by plane but still, he works full time. Up until now I had a part time job that allowed me to take off pretty much whenever I wanted. I had 3 weeks of vacation (which I used to see him) and then I would take 4 to 5 day weekends quite a bit to fly down. Nick would do the same...ask for a Friday or Monday off and come for 4 days or so.

I just started a new job and so I won't really have any more holidays until November 2008, but I don't even plan on being in Canada then wink.gif
Also, we are filing in a month so he's probably just going to come up here from now on.

He is coming up for Christmas for 2 weeks, the longest he has stayed in Canada yet.

We don't mind that it takes 6 - 9 months for this process...I mean, it sucks but at the same time, both of us really want to save more money, he wants to get a house and we don't want to get married till next September or so anyhow. We love each other completely and we both believe that nothing good comes easily and we always think of how rewarding it will be when we are finally together.

So special!

Things will happen when they happen. Seeing him is amazing and I cherish every time.

QUOTE (Tyler and Agus @ Nov 4 2007, 11:00 AM) <{POST_SNAPBACK}>
We are in a similar situation... young and poor but just wanting to be together. There hasn't been an official proposal, there's no ring (yet), and when we do get married, it will be at a courthouse-- because it's more simple than that, right? Love does not necessitate big expensive rings and beachside proposals-- we are very certain that we want to spend the rest of our lives together and if this is how it must be done, then so be it. I think the important thing is that you know that you want to be together and that this entire process is just part of the journey. A journey that is long and expensive and a test to your patience. I have found, however, that going through this process, my fiancee and I have become stronger, more trusting, and more sure of our desire to be together than ever! The important thing is to follow the procedure and not get caught up in worries (which is hard to do, I know).

Best of luck to you two on your journey.

Fantastic answer...this is exactly it...there doesn't need to be big dramatic proposals...if two people want to be married, have talked about it and are sure...that's all you need to say.

It's not a matter of us not wanting to get married. We do, and have wanted to way before we thought of the K1 visa. We're just young and poor, so cant afford a wedding and a ring yet. With work, we're also too busy to even plan a wedding. We both agreed a long time ago that we wanted to be together forever. The difference in nationality is just pushing us to make are feelings articulated legally. I was just worried if we didnt have a engagement ring, on one knee story we would get denied the visa at the interview.

You don't need an engagement story. You need proof you met in the last two years and more importantly, you need signed statements from each of you declaring your intent to marry within 90 days of the foreign fiance(e)'s US entry. You can leave out the romance and proposal story, even if there was one.

The signed statements pretty much negate the need for a proposal story. Intent is declared. Don't mistake the 90 days as some kind of trial period. If for some reason things don't work out, nobody is going to force you to marry but somebody has to go home.

"Marriage" and "Wedding" are not the same thing. You can "marry" at the courthouse or otherwise, simply and with little expense. Have a wedding or not, when you're ready.

I don't think there has to be an official proposal. You could say that you both decided to get married together.
Had you spoken about marriage before you found out about the K1 visa?

I haven't been officially proposed to either....it's coming but we will be filing before he "officially" asks. We have talked about it a lot and have been talking about getting married for awhile now..we both know this is what we want.

Best of luck to you! I don't think it sounds like a scam at all.
