The passport in question is just fine.

His passport was issued with a validity of 10 years, just like yours was. He doesn't need at least 5 years of remaining validity. Childrens' passports are issued for less time than adults.



Ok then the directions are completely misleading. Why would they even mention the 5 year validity since Children can't file for visas? It makes no sense.

This question has been asked many many times.
It is possible to visit your US Fiance while you have a pending K1 *BUT* you have to show strong ties to your country. Examples: Letter from your boss stating you will be returning to work, bank statements, proof of property you still own..etc. etc. Ultimately it all comes down to the officer sitting behind the desk.

Some countries it's very hard to get a visitor visa to the states....once you have filed your K1 visa it shows intent to stay in the states and the odds of getting accepted are very slim. You could always try but it's money and your sanity on the line.

Just wanted to add...don't forget that once she obtains the visa in hand, she has up to 6 months to use the visa. So she can stay in Canada and you guys plan from a far if you like, then enter the states using the visa sometime in that 6 month time frame.

You file when and only when you are divorced and are a USC. If any sooner, you will be denied.

It doesn't matter that you were still married while you had visits with your girlfriend. You were separated from your wife, it's not like you and your wife were still living together and you were off with some other woman.

You have to have been with your girlfriend at least once in the last 2 years from your filing date, you say you were with her in 2007, you are fine if you file in 2008.

Your case is complicated and I think you'll have many obstacles, maybe not but just stay strong, be honest and keep hope.

Can She be denied for the fiance visa base and her denied history at the Peruvian Embassy?

3-If for some reason , she got denied, What be the tool i can use to bring it here to the States?

Any responses will be really appreciated.

Okay...first off, welcome to VJ...

Let me try to understand...

You have permanent residency and you are still married.

First, in order to file a K1 visa for a foreign Fiancee, you must be a United States Citizen and you must be free to marry. Before either of those happen, you cannot file.

Secondly, you don't have to be in a relationship with your foreign fiancee for 2 years, you have to have met in the last 2 years from filing the K1 petition.

Previous denials for visitor visa's don't necessarily mean that your petition will be denied but you must be honest and state all denials if asked about them. 6 is a pretty high number. I don't think your petition will be an easy one but you can always try once you are a USC and once you are free to marry and have your divorce papers.

If she got denied the K1 visa, you could get married and try a spousal visa, the K3 or CR-1.

Sweetie, I totally understand where you are coming from, believe me. The only advice I can give you is, stand on your own too. Occupy your time while you are away from him by working, saving money, going out with friends. etc. I know you want to build your life around him but you must have something of your own too. It will make it a bit easier being so far.

I'm tired of the computer too, I'm tired of having to see Nick through a web cam, I'm tired of not just sitting with him in a room, watching tv and snuggling on the couch and we haven't even filed yet, we have a long way to go.

You will be with him. If this is a denial, you guys will find an alternative, work through it and you'll be ok.

Just be patient Laura and wait to see if you were actually denied. You may not be. Once you get the information you need, if there is a denial, take some time with your fiance to regroup, comfort each other and then move on to plan B.

If you lived in Egypt between the age of 16 and now then yes, you will need a police certificate from there. I would be honest and state that you have dual citizenship of both Italy and Egypt.

Personally, I would say you are going to visit friends...that's what I've always done when crossing the border. You do have to give the address you are staying at, so give his address, but I wouldn't say anything about boyfriend just yet. Just say you are visiting friends.

I know all this information is overwhelming and surprising, Nick and I couldn't believe how complicated and involved this process was when we first began researching. Once you read over the information for awhile, clear your head for a few days, come back and begin reading again, it all starts to make sense and it's easier than you think. The waiting on the other hand, that is never easy.

You can't simply go over there and stay, even though you really really want to.

You haven't even met him yet. I suggest you go over and spend some time getting to know him in person, take lots of pictures, enjoy your time and make sure you don't overstay!

Once you return home, if you still feel like this is something you want to do, begin the process. Look over the guides here at VJ, get your petition ready and send it in. There are income requirements from your boyfriend in the states to show he can provide for you, if he can't, he must have a sponsor. You have to get a medical and a police check, there is a lot involved. Remember this process costs time and money, you are looking at a few thousand dollars from Petition to Green card(For you more because of the distance you have to fly once you move to the states, let alone all your stuff being shipped) and the waiting time is anywhere from 6 to 9 months, sometimes longer.

I suggest she comes over for that week to India and you meet in person and see how it goes.
Sometimes things are different in real life than they are on the internet, see if there is a spark, if you think this is something you both want to go further with, especially something as serious as marriage. If it is, consider your options.

Having another type of visa shouldn't effect your K1 visa petition, a visitor visa for example is a great way for you to enter the U.S. and stay with her for awhile to get to really know her. Just make sure you don't get married while you are there and try to stay. Return back to India and do it the legal way with the K1 visa or if you do get married, go with the K3 or CR-1.

It could be something as simple as your file being moved from one desk to another. Some people get several touches in a matter of a few days. Sometimes that means an approval is on the way, sometimes it means absolutely nothing.
I'd imagine touches are a positive thing and sometimes can be frustrating when you see a lot of touches and then nothing happens.

Not a problem at all. In most cases the round trip ticket is cheaper than the one way so people buy the round trip and just don't return.
