QUOTE (Dan + Gemvita @ Nov 8 2007, 05:47 PM) <{POST_SNAPBACK}>
The question is really intent. If you decide to marry when your fiancee is already in the country on a tourist visa, you can do so and adjust status successfully.

However, if your fiancee enters the country with the intention of getting married and staying, that is considered fraud. While some have been able to do this successfully, it can come back to bite you.

Another problem is actually proving that she did not enter with intent to marry and stay..tricky situation.
I would do it the legal way by choosing either the K1/K3 or CR-1.
Best of luck to you!

K-1 Fiance(e) Visa Process & ProceduresChances of getting an RFE
QUOTE (Dr Mirage @ Nov 9 2007, 07:15 PM) <{POST_SNAPBACK}>
I thought I should ask this since its an Open forum, but what are the chances of getting an RFE?

Is there a percentage of applications receiving an RFE?

Reason why I am asking is I'm just uhm... yea.. curious.

What are your thoughts?

Really, I have no idea.
People get RFE's for many reasons, forgetting to sign your name on one paper, needing more proof of the relationship, such as pictures, boarding passes or whatever, not having all the info required, etc. etc.

There could be some statistics and if so, I'm sure someone on here will point you in the right direction.

K-1 Fiance(e) Visa Process & ProceduresCriminal Record
Hey Gang smile.gif
My sweetie (The USC) has two previous trespassing convictions. One was under the age of 18, the other was in his early 20's. He's 28 now. The first time he was in a park after hours, went to court and had to pay a fine.

The second time, him and some friends went to this abandoned building or something on Friday the 13th, again, went to court, paid a fine.

Other than that, his record is clean. He's not even sure if the first one is even on his record anymore. His mom works at the courthouse in his town and she is able to check his file to see if it's on there or not.

He has to declare these on the K1 Petition, correct?

I have no convictions whatsoever. innocent.gif

Will two simple trespassing convictions affect our petition at all?

K-1 Fiance(e) Visa Process & ProceduresAge Difference An Issue?
QUOTE (moxcamel @ Oct 31 2007, 04:54 PM) <{POST_SNAPBACK}>
I think the way I'd look at it is that there's nothing you can do about your age difference, so why worry about it? I'm reading advice like "be prepared to explain it," but what is there to explain, other than what you would explain anyway? "We fell in love, we want to marry, and not that it matters, but we happen to have been born 15 years apart."

Your age difference is what it is, and I doubt you're going to abandon your partner in order to find someone closer to your age who is more likely to please the interviewer. So focus on getting paperwork in order and preparing for the interview like anyone else would do. There's plenty to worry about without worrying about things you cannot change.

Again Mox, you are right on. Completely agree.

K-1 Fiance(e) Visa Process & Proceduresinternet attorneys
Hi smile.gif
Welcome to VJ.
If you have a straight forward case you can totally do this process together without a lawyer.
Have a look at the K1 Guide here at VJ and also check out the K1 Flowchart which shows you step by step approximately how long each step takes.

Lawyers are expensive, why spend a couple of thousand dollars on something you can do yourselves? All they do is really proof read what you send them (you do all the work collecting everything anyhow) Before I came to VJ, Nick and I had decided to get a lawyer but after seeing all the helpful and amazing info on this site, we realized we could do it on our own and save ourselves $1800 bucks!

If you have a complicated case such as, a previous overstay in the states, serious criminal background, children from a previous marriage where the biological parent is unwilling to cooperate, etc. etc., then I would suggest using a lawyer but make sure that it's one that specializes in immigration.

Best of luck to you!!! smile.gif

K-1 Fiance(e) Visa Process & ProceduresCan I extend the marriage period?
QUOTE (tsp @ Nov 13 2007, 07:34 PM) <{POST_SNAPBACK}>
More clarification: there is definitely still love in our relationship. There was a tragedy in her family back home and it caused us lots of strees; that is when the breakup happened. However, things were working out great before and we still communicate very well and want to give it another shot. My concern, however, is that she's not really ready to leave her family behind still, and I definitely don't want this kind of thing to be a problem, hence giving the relationship more time.

So, to clarify, I want to make sure she can live here happily without dying to see her family immediately every time something bad happens back home (let alone any time she feels alone). Sure, we can develope our relationship online or through visits, but that's not going to cut it in our case.

Then I would wait until she is ready for such a big step as leaving her family and her old life behind to come to the U.S. to begin a new life with you.
Maybe she should try to get another visitors visa...stay for awhile and see how it goes this time. Ask her right out if she is ready.
The K1 process costs money and time. It's emotionally draining and very stressful at times.
Using it as a way to "be sure" could cause you even more heartache in the end if she decides she's not ready.

I would file when you both know that this is it, you want to spend the rest of your lives together and you want it more than anything else in this world.

Best of luck to you on whatever your decision may be
~Laura

QUOTE (Southern_Canadian @ Nov 14 2007, 10:08 PM) <{POST_SNAPBACK}>
1- For form I-129F Petition for Alien Fiance question #18, they want me to describe the circumstances under which we met. My fiance and I met on the internet. Now, I intend to tell the complete truth as to how we met but I was just wondering if they will look at us differently because of how we met. Also, how much in detail do they want me to describe? Such as, we started messaging each other, then talked on phone then met in person on such date?

Many people meet on the internet. That is how I met my sweetie and how thousands of others have as well. Just explain how you met, you'll be fine.

2- They want proof of having met in person in the last two years. Now, I have tons of pictures but I read somewhere that they only want pictures within 30 days of filing for the Visa. Is that true? Can I send pictures from the first time we met which is about 2 years ago? Can I send pictures from when I was there for 3 month about 2 months ago?

I have never heard of the 30 days before filing rule. They want proof that you have met in the past two years. So send pictures from that time (3 to 5), boarding passes, photocopied stamps from your passport, car rental receipts, hotel reservations, etc to show proof of being in the same country as your fiance within the last 2 years. Remember, you have to have met in the past two years from filing..if it's more than that and you haven't seen each other since then, you'll have to meet again and have proof of that meeting.

Also, I have cell phone bills to show that we talked to each other on the phone. The problem is, I use a calling card to call him to avoid the expensive long distance charges. I have highlighted the long distance number. But how will I be able to prove to them that I was calling him? One more thing, before I went to the US to visit him for 3 months, I had a different cell phone number and cancelled it. I still have cell bills from that phone with proof that I called the long distance calling card. Now, should I show statements from my old and new cell phones?

You don't really need cell phone bills until the interview, but some people do send them with the initial package. He can give you a copy of his phone bill which shows his name and telephone number on it, which shows that you were calling him.

3- My fiance is coming to visit me right before he applies for the visa so, we will use his plane ticket as proof in the I-129F Visa. Now, when I go see him in Dec, will I use that plane ticket as proof when going to my interview?

Sure, you need to show an on-going relationship from the time you filed to the interview, so that would work fine smile.gif

4- When the interview time comes around, I read that I will need to provide information of my fiance's bank statements and investments. But, my fiance doesn't deal with a bank and doesn't have any investments. How can we show that he can support me if needed? Should he just open a bank account right now and deposit money in it and get a record of the statement? How much is a good amount to show that he could support me? Would it be best to get his parents to be another "sponsor" for me?

Your fiance must make 125% above the poverty level. Click here for a chart of what 125% of that level is. He has to fill out an affidavit of support and get a letter from his employer.

Also, as for the Money order to pay for the Visa processing. My fiance usually goes to a Wal Mart to get a money order. Is that suffient? I have a bank account in Canada. Could I wrote a personal check for the filing of the I-129F Visa? Or do they want my fiance's name to be on the check or money order?

I would have your fiance send the check in himself, after all, he is filing for you. Usually people send in personal check's but in his situation, I think the money order will be ok....I'm sure someone else will correct me if I'm wrong. smile.gif

5- For the G-325A form, my fiance has moved around a lot within the past few years. But got his mail sent to his parents house to avoid having to change his address all of the time. Should we include all of the places that he lived/ stayed at? Or just include the ones that he was at for a longer period of time?

Check out the G-325A form that you both have to fill out, it asks that you list all the addresses you lived in the last 5 years. There should be no gaps.

For the same G-325A form, I was unemployed for 2 months this past Januray. Do they want me to include that in the form?

Again, just fill it out.

6- When is the best time to do the medical exam? Would it be a good idea to meet with my Doctor in advance to make sure that I am up to date on everything and to make the medical exam go much faster?

The medical exam is awhile down the road. Usually you can't even book the medical until you have the interview letter.

7- I heard that I will be required to do a test of some sort to show that I know things about the US. Is that true?!

On a side note, when I went to visit my fiance back in June, I was rejected because they thought that I was fleeing my country. They put it itno the system so, that a red flag would pop up if I was to ever try to cross the border without proper documents to show that I have ties to my country and plan to reurn. Luckily, I was able to find enough documents and was allowed entrance into the US for a max of 3 months. I came back to Canada within my time frame to avoid any complications when applying for the K-1 Visa. I was just wondering if all of this will affect our application process?

It shouldn't effect your petition.

Sorry that I have so many questions. I just want to make sure that I fill all of this out correctly to avoid any complications. Thanks to anyone who has any answers for me!

Whew! Next time try to ask separate questions...lol not everyone would try to answer all of these at once!!
Best of luck to you

K-1 Fiance(e) Visa Process & ProceduresDumb Question about using None and N/A
QUOTE (Caladan @ Nov 16 2007, 09:53 AM) <{POST_SNAPBACK}>
"None" is for when the question applies to you, but the answer is 'there is nothing to list here.'
"Not applicable" is for when the question doesn't apply to you because you don't meet some condition on the question.

The marriage example is perfect. I hadn't been married before, but the question still applies to me, so I answered "none." But when the question went on to ask for the names of the spouses, I answered 'N/A', because the question didn't apply since I had no previous spouse. (Other non-immigration examples.... suppose you're female, and the generic medical questionnaire asks for the date of your last prostate exam. N/A is the right response.)

That sounds good, thanks for the tip, I'm going to do that too. smile.gif

Be particularly sure to put "none" in the box for previous marriages. But I would argue N/A is techically the correct answer for the other boxes, as they become "Not Applicable" because you indicated no previous marriages.

I just put none in the first box asking for previous marriages and left the others empty. There is of course more than one correct way to fill out the forms, but think about each answer carefully, whether it is actaully "none" or "Not Applicable"

okay good advice I did it that way, the original question I put none and everything else for that question N/A. So I hope I'm doing it right.

I don't think it really matters if you fill in every box. Just put "None" in the appropriate boxes, if you want to but N/A in the others like you said, go ahead..but again, I don't think it matters.
