It is not required to include the beneficiaries birth certificate into the initial K1 package but some people have received an RFE (request further evidence) for not including it. If you receive an RFE for not having it in there, you'll have to get that document and send it off to the USCIS.
Mostly, it is needed for the interview.

I would suggest telling the truth on any and all forms you submit to them.
Get the idea of withholding evidence right out of your head.
Lying is very serious and will only make the situation worse for you. They find our you lied on the G325A (which they will)...huge trouble.
Be honest. You will need a lawyer I'm afraid, one who really knows what they are doing because you are in a very risky situation.
Just because you marry him doesn't mean it will clean your slate. You overstayed and worked in the U.S. illegally. I'm afraid you are going to have a rough road ahead of you.
I do wish you the best in this process and hope you can figure out how to straighten this out.

You have not asked a silly question! All of us are here to help one another answer any question we can.
You could start now if you like. Once he receives the K1 visa, he has up to 6 months to enter the States using it. If you filed now you are looking at a 6 to 8 month wait to get the visa. So even if you guys got it in say July, (which would be awesome!!!) he would still have a 6 month window from that time to enter the states.
I would go ahead and file now.

You can celebrate anywhere in the world but the actual marriage must take place in the states.
Because the Adjustment of Status process takes so long, many people get married ASAP after entry just so they can start it as fast as possible. Some even go to the court house that very day! Later on they have a formal wedding day with the whole she-bang, others choose not to. Once you get Advanced Parole (usually 90 days after filing for AOS), you can go home and visit with friends and family to celebrate the marriage.

Once you get your visa you have 6 months to enter the states using it. Once you have entered you must be married within 90 days.
I would not set any plans in stone until you know your interview date which could be 6 to 8 months from the time you initially file your K1 Petition.
Sometimes people are approved quicker, some take longer. You can have a time of year in mind but I wouldn't set any plans.

Nick and I would like to be married this September but that all depends on when we get my interview....we are having a very small ceremony, nothing big that takes a year to book or anything.

I don't think it's a huge deal since you mainly speak English. If you do get an RFE for it (request further evidence) you could always type out your name and address in your native language, sign and date it and send it to her to mail in.
You could even do that now just in case to eliminate the wait time of it being sent by mail and if she does get an RFE, she has it right with her and can just pop it back in the mail to them.

Yes I sent my papers to VSC.
So once you have your case number and you have created an account at USCIS and entered that case number you can check if you have been touched or not.
"Touched" simply means that something has happened to your file. Someone has looked at it, it's move to another box, moved to another desk or someone is working on it.
The way I know I was touched is the "Last Updated" date changed.
My file was received on December 10th, my NOA1 date is December 11th and shortly after my "Last Updated" date changed to December 17th. I take that as my case was simply filed into the appropriate box and there it sits waiting to be worked.

Sometimes touches mean something, sometimes they don't mean anything at all.

Whenever the "Last Updated" date changes, you know you have been touched. I only check the website every few days or so because I know I have a few months to wait until anything happens. If something significant happens, like an RFE or approval, I'll be notified by email because I requested to be notified.

Did she pay by personal check?
For me I use to get the actual check back but now they changed to a copy of the check instead.
The back of it is scanned or basically photocopied and that photocopy is sent to her bank.
Depending on her bank and if she has online banking she has the ability to look at those copied check's online or they are mailed to her with her monthly statement at the end of the month. When it's cashed by the USCIS they put a number on the back of the cashed check and that is your case number. You can check your case that way or wait for the NOA1 which also has your case number on it.

The NOA1 just comes by regular mail so it would just go into her mailbox, does she have someone collecting her mail for her? They could contact her when it comes.
You can also track your case online by getting the number off of the cashed check at your bank.
When a check is cashed it's scanned and sent to the bank. Depending on how she has her banking set up, she can look at these check's online or they get mailed to her at the end of the month.
On the back of the check will be a number. That is your case number. She would make an account at the uscis.com website and start a new case, add in that number and off you go. She can track it that way.

It's a visa intended for marrying and living in the States.
Once you leave after you are married he will be abandoning the process and it won't even matter that you filed in the first place.
You can get married anywhere. There or here. You can go live in his country, although I'm unsure about what their policies are or what you have to provide to do so. I'm sure someone will have a link.

As far as I'm concerned, it was a waste of money to file for the K1. It's a long drawn out process too. 6 to 9 months till visa in hand. Then he'd have to buy a ticket to come here, get married, then pay to fly back home. It makes no sense whatsoever.

Why did you apply for an immigrant visa when you don't even want to live in the U.S.?
A K1 Fiance visa is for U.S. citizens intending to bring their foreign fiance to the United States to marry and live.

You can of course get married any time in the U.S. but your fiance cannot stay. They must return to their home country and file the appropriate papers. Otherwise, it is fraud.

A K3 visa is also an immigrant visa, intended for a U.S. Citizen to bring his or her foreign spouse to the U.S. to live.

Google is your friend. Type in "Moving to China" I got tons of websites.

Yes it's better to wait. The K1 visa is for fiance's ONLY. If you get married you are no longer engaged but a married couple.

Entering the States with the intent to marry without having the proper visa to do so is fraud. You could get in big trouble for this, deported and even banned.

Some people do enter the states on other types of visas (such as visiting) and end up getting married but they didn't have intent to do so beforehand and they adjust their status after they married, sometimes they'll have to return back home to their home country and apply for a spousal visa such as a K-3 or CR-1 to reenter the U.S.

If you went to adjust your status, they would see that you had previously applied for a K1 visa, entered the country and married and...bingo...trouble.

I would wait and do it the legal way.

You can visit the states if you show strong ties to your country. A letter from your employer stating intent to return back home to work, property that you still own, bank statements but even then, there is the chance of being denied because again, you have intent to stay in the U.S. because you have an American fiance.

I don't think they would issue him a visitors visa because you have started the process..if he does decide to come visit you, he must show strong ties to Japan, showing that he intends to return home. Example: Letter from employer stating he is returning to a job, property he owns, bank accounts, etc. Again, it's a game of chance...if he can't provide enough proof, he would be turned away and that's a wasted plane ticket.

If you go there for a visit, that's not a problem but if you are giving up a job...not so good unless you have a co-sponsor or have a job lined up for when you return that will provide you with the necessary income for the interview.

To give you pointers on how to keep the time wonderful...well obviously chat , talk and do video chats as much as you can- I've read about a couple here in VJ that left their Web Cam' on even when they went to sleep- so that it will be the first thing they see when they wake up....and this is really one of my favorite parts- to see Adam as I open my eyes and know how lucky I am to have him there...(even if there if far away)

besides that- one of the things we miss the most- subconsciously is the smell of our partner- so , sending a letter doesn't cost much, send her a piece of your basketball t-shirt- wrapped well in plastic...as smelly as it seams to us in the everyday life- I can tell you honestly, I even miss Adam's morning breath, when you love a person- you love every little smell about him/her.... maybe a piece of cloth soaked with your aftershave....maybe your deodorant, or Shampoo....

I still sleep with Adam's T-shirt as my pillow, (sadly it almost lost all his smell already... sad.gif )

try to think of something funny to say to her- try to stay strong for her- think that it's not easy on her either, and she is in need of your strength probably....
Don't hold crying back....I'm parting from my man for the second time now for a long period of time, and the first time I cried like a baby- and it made it easier, this time around I tried to hold it back, and my body almost collapsed physically from inside. let the sorrow out, it's important, although exhausting.

Don't Worry too much though, when she's with you finally, you'll never find yourself pondering "why am I with her" if you go through this, your heart will always know why you are with this lady out of all the woman in this world.
After all- the USCIS the EMBASSY and the NVC test you on the reason why- a million times.. laughing.gif

All I can say to you is to hold the love you have for your sweetie within you.
Cherish what you have.
I always say it's so hard to be apart but I wouldn't trade the distance or the relationship itself for something closer and easier.
Our love is too strong.

You will be with her and when it happens, look back and realize what it took to be together. You'll never take each other for granted because you know how hard you both had to work to be at that stage.

We have up days and we have down days. Sometimes it's tolerable, others, we cry and that's okay!
It's okay to feel like ####### sometimes, it's okay to be upset and heartbroken because afterall, sharing your life with someone who is thousands of miles away is hard!
I can't come home after a hard day, curl up on the couch with Nick and feel that security but I do have him in my heart and we can see each other on web cam and I can hear his voice and that is better than not having him at all!

Focus on your relationship, take each day and consider it a blessing because you have found the love of your life (not all people can say that!), it just happens she's in another country.

Yeah, she can visit, just don't be surprised if she's asked for proof of ties to Canada when she crosses the border. This won't always happen, but it may and it's best to have proof ready or she may be denied entry.
