Well, you know, if you do get an RFE, just send it back asap. It shouldn't put your petition behind too much, maybe a few weeks or more.
Do you have your Birth certificate, the long form? If so, make a copy and send it to your sweetie now, just in case, that way he can just pop it in the mail.

This isn't necessarily true. In fact, there was a poster here last week who got an RFE for NOT including a copy of the beneficiaries birth certificate. It can happen.

Not a problem at all. Actually, someone recently got an RFE because the officer thought the black inked signature was a photocopy! We used blue ink as well. It's fine.

The car rental receipt is great too cause it shows you were in the US during that particular time.
Of course, back up photo's from that trip will also help support the evidence.
Now, the hotel receipt, it's from a hotel in London or in the U.S.? If it's in the US and it's in your name, that's fantastic!

I think you are fine. Gather up all the information you have, keep it neat and organized. I'm sure you will be fine.

What they are looking for is stamps in either passport, copies of boarding passes to each others countries, hotel receipts (if you two stayed at one), car rental agreements, etc. All copies of course.
I did throw in 2 photocopies of cards that Nick and I had sent each other as well as the envelope they came in to show it went through US Post.
I sent a couple of emails as well, only because in them we both talked about the visa process and how exciting we were, etc. etc.
Pictures, emails and phone logs are secondary evidence, they don't PROVE that you have met, however they do show there is a relationship. They are needed for the interview but it doesn't hurt to throw a couple of those in there.

Do either of you have stamps in your passport that you can copy and add in the petition? You said itineraries....that proves that you had travel plans but without the boarding passes it doesn't show you actually got on the plane...do you have even one boarding pass? All you have to prove is that you have met once in the last 2 years. If you've had a few visits, just proving one of those visits will suffice.

When you filed your petition, as proof of who you were you either showed them; a copy of your birth certificate *OR* All the pages of your passport including picture and signature page.

Basically, anything you photocopied, you are sending the originals of. Boarding passes, itineraries, hotel receipts, etc. etc. I also suggest NOT sending in your passport if you used that instead of your birth certificate.
If you want, you could order a new birth certificate online (They don't take that long to get) and send that in, instead of another copy of your passport and all it's pages.

If you did use your passport as identification, you could just copy it all again (Including blank pages) and mail that off to her instead of getting a birth certificate.

I'll try and help.

1) First, if you have no criminal record you can simply go to your local police station and get a police check, they are usually anywhere from 20 to 40 bucks and take about a week to get. Just make sure it's Canada wide. If you have a criminal record, you have to get fingerprints and a police check from the RCMP, this can take several months.

2) You need the long form of your birth certificate. You can order it online.

3) Once you have your medical, a few days later (depending on what doctor you are going to) they will send you your medical package. You cannot open this information. You take the package with you when you move to the states and give it to the POE officer upon entry.

4) Never leave anything blank. Simply write "None" or "N/A"

5) If there is not enough room, write "See Attached" and attach a sheet of paper behind stating what question you are referring to on the form and write in your information there.

It's not necessary, I don't think they even check it but many have brought it to the interview just in case. Some have rolled it up and put it in a cardboard sleeve to manage it easier. It's your call.

I don't believe it's necessary for POE either. They want to see your medical package that you get from your medical. If you had any issues with the x-ray, I would bring it for sure.

Also, I'm assuming you are talking about the I-129F Petition.
You only have to put your birth certificate number if you are a citizen through Naturalization.
Otherwise, you don't need to fill that in, just check "Birth in the US" and put N/A in the other box.
If you weren't born in the U.S. then it's required to give your birth certificate number.

No we haven't sent in our petition yet. As a matter of fact we haven't sent it to our lawyer yet. They haven't really done anything except giving us forms to fill so I am hoping I will get my money back Monday.

I was married as well, I waited for my divorce to be finalized, got the divorce certificate, copied it and put it in our petition and mailed it off.

When the foreign fiance enters the states using the K1 visa and applies for AOS (Adjustment of Status) and EAD (Work Authorization) at the same time they apply for Advanced Parole.

Advanced Parole allows the foreign husband/wife to travel outside the united states after marriage but before receiving a green card.

They can leave the states at any time but they will be denied re-entry without AP or a green card.

Usually AP is received within 90 days of filing for AOS. Sometimes sooner, sometimes later.

You won't be able to return home to her home country until she has that document or you will have to start over with a spousal visa, either the K3 or CR-1.

All you can do is apply and be honest. You will be denied though. Then you'll have to file a waiver. Again, the assistance of a good immigration lawyer would be a huge help to you.

You stated in your last post that you overstayed for 4 years.

How were you in the states before? Were you there illegally or on a visa waiver program.
You can file but you will most likely be denied. You can then file a waiver. I suggest consulting a lawyer for help with that.

It is not required to include the beneficiaries birth certificate into the initial K1 package but some people have received an RFE (request further evidence) for not including it. If you receive an RFE for not having it in there, you'll have to get that document and send it off to the USCIS.
Mostly, it is needed for the interview.
