So, she enters the States, you get married and apply for AOS. At the same time you apply for AOS, you apply for Advanced Parole which usually takes about 3 months to get. Once she receives her AP document, she can travel outside the U.S. If she does not have this document, she will not be allowed entry back into the U.S. and in order to be allowed back in to stay, she'll need a spousal visa.

Has she entered the States yet?
How long are you planning on working outside the States?

Once she enters the States, you have 90 days to get married.
If you leave with her before you file for AOS, she is abandoning the process and if in the future you would like to come back to the States with her, you'll have to start all over with a K3/CR-1 spousal visa.

Also....if you decide to stick it out in the States and she files for Adjustment of Status, she receives her Green Card and then abruptly leaves and moves to another country....depending on how long she lives out of the States, its also viewed as abandoning and her Green Card would be void.

I don't know the exact amount of time before this happens...I believe it's a year. I'm sure someone knows for sure the length.

Also...What country are you planning on working in? You have the ability to go there through work but what about your fiance? She will have to apply for a visa for that country to be able to live there with you...unless that's covered under your work. If you are married by that time I believe she is covered but before then, I'm not sure.

Technically the standard is that both parties need to be "free to marry" at the time of the petition filing... for a previously married individual, divorce is the most common but anullment also fits the definition


sigh...do you have to always be so particular?
I was simply meaning that she has to get divorced (not married) in order to file.

Since you have been separated for over a year, you have reason to file the papers. Mine took about 3 months from filing to divorce paper in hand.

When you sign up on the USCIS.com to check your case online there is a "Last Updated" date.
If that date changes, you know you have been "touched"
Touched simply means that someone has done something to your file. Moved it to another desk or box, looked at it, etc.

It all depends. Photographs and emails are secondary evidence. What the USCIS wants to see with the intial petition is proof that you have met in the last two years.
That would be things like:

Boarding passes
Stamps in your passport
Hotel receipts
Car rental receipts
Travel Itineraries

Pictures do help, especially if they are taken with both of you with a landmark or something recognizable in the background from each other's country, or with family members, etc. etc. but again, that's secondary.

Emails and pictures are usually saved for the interview.

I would relax. If you get an RFE, just send them what they request of you. It shouldn't put your petition behind too much, maybe just a few weeks at the most.

Usually you get NOA1 within a couple of weeks of filing. Sometimes longer, sometimes shorter. We got our hard copy in just over a week.
They send hard copies.
NOA2 is taking anywhere from 4 to 6 months from filing.
If you sign up on USCIS.com with your case number, you can get email notifications but they just notify you on what they plan on sending you in the mail.

Welcome to VJ!
I know it seems scary and unknown but you are not alone and you have come to a GREAT place!!!!

First..you should have a look at the Guides here at VJ...Click here.

You'll see at the top it says "Begin Here" in bold red letters...that's a great place to start!
It shows the comparisons of the different visas available.

Because you aren't married yet, you will probably want to go with the K1 visa which is a visa for US citizens wanting to bring over their foreign fiance (you!! smile.gif ) to get married and live. Click Here for an outline of the K1 visa and what is required.

I would suggest taking some time with your sweetheart and read over all the information, take a break, then come back again. It took me a few days to wrap my head around the whole process.

A wedding is one day, marriage is a lifetime.

I think it's risky.
Not only from the money aspect but the stress aspect as well.

The K1 process can take anywhere from 6 to 12 months to be approved. Lately, it's been at the higher end of that scale.
November is 9 months from now.
Not saying you won't have your visa by then, you more than likely will...but there is a chance that you may not.

Once the visa is issued, the beneficiary has up to 6 months to enter.
Some people begin planning the wedding then because it's in hand, they know they can enter and everything is good.

You could certainly estimate the time of year you'll be getting married...but booking the date and making deposits on church's and halls, etc. etc. etc. etc. could be a costly mistake, especially if you can't change the date.

I'd wait until you at least had your NOA2 before you book anything.

We are estimating a September wedding...but we aren't putting anything in stone. We are also having a very very small ceremony with about 12 people total and just going out for dinner afterwards. Won't take that much time to plan at all.
Many people go the small wedding route with this visa simply because of the timing issue.

Just saw this.

He still has the interview and everything to go through.

Once he goes to the interview and receives his visa, he has up to 6 months to enter the country using the K1 visa.
Then you must get married within 90 days after entry.

You are still looking at a few more months of stuff before he can come to the states.

Congratulations on NOA2! That means that your petition has been approved and they will be forwarding it to NVC and then to the Consulate in your Fiance's country.

Package 3 contains a checklist of everything your fiance needs to complete for the interview.

Create a customer account
Then add your case number that is on your NOA1...it begins with EAC.
