Sometimes it takes over 2 weeks to be entered into the system and cash the check...I'd wait a little longer before sending everything back in again.
Nothing about the USCIS or this process is "timely", that is one thing you'll have to get use to quick.
This is a long and hard process, nothing is for sure or easy about it.

So when you come over to the States, you file for AOS and included in that fee is Advanced Parole.
It takes about 3 months to get.
If something happens before you get AP you can file for an Emergency Advanced Parole document...you'd have to show proof of the death by some sort of documentation.
I've seen people getting emergency AP within a matter of days.

Wishing that something as horrible as being denied after months of waiting and waiting and finally being given a document stating you can be together is horrible and is something I wished didn't happen to some people.
There is nothing wrong with that at all. I'm not denying it happens and it is a good thing to know.

Not everyone can be super strong and stress free during this time. Some people are more sensitive than others, that's life. I was just looking out for someone's feelings.

If you met after she last entered on the B2 or just decided to marry after her entry, then you would have been safe. If the intent to marry existed before that entry, then I think you were wisely cautious. Intent at entry is the key issue.

My lawyer was very good. He kept in constant contact with us, regularly updating on our case. He was very efficient with all the paperwork and very reassuring. I know we were very lucky as there have been some horror stories about some supposed immigration lawyers. We might attempt the removal of conditions ourselves though !

We did use an attorney. We are both very organised people and although quite capable of doing the paperwork ourselves, we both felt we wanted a dedicated immigration lawyer to oversee our paperwork. We also used the same attorney for AOS. Our case was very straightforward and our timeline was very short indeed both for K-1 and AOS. Whilst I think the timeline was just good fortune and pure luck on our part, I have no regrets using an attorney.


If you had a straight forward case like you say, a good attorney would have told you you could do it yourselves instead of wasting that money on something you could have done together.

I just can't fathom spending up to 2,000 dollars for something you can do yourself for free. Oh well.

To the OP: My opinion is to save your money, but reading RebeccaJo's post...it seems you may have a battle on your hands with the consulate. If you believe a lawyer will increase your chances, go for it.

I would say the majority of people on here did not use a lawyer and were just fine.

To answer your questions:
Most people simply put everything in order as they have it based on their cover letter, paperclip it together and mail it off.
Nick and I punched the top of each page with the ACCO punch and then paperclipped...just so they didn't have to at Vermont.
Other people go into quite a lot of detail and actually purchase the ACCO fasteners, etc and put it together...I think this is fine, although, the adjudicator will be taking your entire package apart anyway so...it's more work for them, IMO.
I would never use binders or those plastic sleeves to hold things in...wayyy too much time spent getting everything taken apart...NEVER USE STAPLES!!! laughing.gif

As for your trips, you only have to show you've been together once in the last 2 years, but since you've seen your fiance many times, I would show them all, it's good for your case.
You don't need to send in your tickets and receipts, I would simply mail in copies of your boarding passes, that shows you actually got on the plane, anyone can get a ticket but not use it, etc.

We had 8 or so visits between us when we filed so I took all of my boarding passes, put them in order and photocopied them onto 2 pages. He photocopied his on his own sheet, in order. Then we highlighted our names and the dates.
It was only about 4 sheets total.

Yes, $131 for the interview. $325 for the medical exam in Vancouver.

I hope you get your NOA1 soon!!!
When you receive your NOA1 there will be a receipt number that starts with EAC. This is your case number.
You can go to USCIS.gov and create an account (Check case online, the link is on the left)
Add your case to your profile.
You will see a "Last Updated" date, if that date changes, you know you've been touched, which simply means that someone has done something to your file. They have moved it, looked at it, etc.
They will not email you when you have been touched. They will email you if you receive an RFE (request further evidence) or they have approved your petition.

Don't even worry about the date on the USCIS website....they give themselves a 6 month cushion. We have seen November filers from Vermont being approved just this past week!!!
Don't worry, you are looking at 4 to 6 months (Closer to the 4 month mark though) They seem to have worked their way through the huge amount of files that were sent before the fee increase in July.

Sometimes RFE's only put petitions behind by a couple of weeks. If you mail off the evidence to them asap, it shouldn't take a month or two.
The date on VJ is just an estimate.

I'm not sure about that.
I know that if they have received it and it's been cashed, there is no refund. You'd have to cut your losses.
You could possibly call the bank and see if it's been cashed and perhaps cancel the money order so it won't go through.
If the money order is canceled and the USCIS got your petition and was unable to get the money, your entire petition would be returned to you and you wouldn't have to contact them at all.
