You cannot get married in the foreign country. The K1 is for a USC to bring his foreign fiance to the U.S. to get married.
If you are married outside the U.S. when you enter, they are no longer a fiance but a spouse and would have the wrong visa. They would need a spousal visa to enter and stay.

You have 6 months to enter the States once you have the visa and once you enter the States, you must be married within 90 days.
Then you file for AOS (Green card, Advanced Parole and Work Authorization)

You don't need to file for Advance Parole or for the Work Authorization, but since the $1,010 fee for AOS includes filing these extra forms, you may as well go for it. Especially since filing AOS doesn't mean your Green Card will be issued in a timely fashion. There are several VJers who've had their AOS Applications languish in background checks for over a year, but relied on EAD an AP to work and travel prior to green card issuance.


This is what I meant...they are included in the fee so why not file for them?? smile.gif

Yes, the filing fee for the K1 is $455 dollars.
Then there are other expenses in between, the medical for example ranging from $180 to $400 dollars depending on country.
Then the $131 is paid at the actual interview.
Then once you get married you file for AOS (Green card, Work Authorization and Advanced Parole) which costs $1010.00.

It's an expensive journey but oh so worth it.

According to your Embassy page Here it doesn't indicate that you send back the police certificate with package 3. I would just take it to the interview.

Anyone can file for advanced parole...You file for it the same time you file for AOS.
It can take 3+ months to get.
There is such a thing as emergency AP but those are only given for emergency reasons, such as a death in the family or a serious illness.
You cannot expedite the AP because you are planning another wedding ceremony or you have a party to go to, etc.
Once you have AP you are able to travel without having your green card.

I don't know the answer to your first question, I'm sure someone will.

Meeting online will have no effect on your petition. Many many many people meet online nowadays (Nick and I included!) smile.gif You are fine.

Hmm....don't have a lot of proof there. To be eligible you have to have met at least once in the past 2 years prior to filing. Your one boarding pass and credit card receipt will help to prove that. Pictures are secondary evidence....since you have none, there isn't any to put in so...
send in what you can.
I don't think they would RFE for pictures (they may in your case though), they would RFE for more concrete evidence such as boarding passes, stamps in passports, hotel receipts, car rental receipts, proof you've been together in the last 2 years.

Make sure you keep whatever proof you have here on out for the interview, including pictures, phone records, letters, more travel documents, etc. etc.

I would definitely take a trip and save all your proof and take tons of pictures.
You could get married and then file for a spousal visa..that may be more convincing than re-doing the K1. I've seen success stories where people have done just that.
Refiling now without having any more additional proof and especially not seeing one another in almost 2 years....
I think it's best if you make that trip.

Yes, self employed, any type of employment must have EAD...you will have to stop working and wait for the other EAD to go through.

But then after the 3 months you can't work until you have your EAD which you file after you get married and adjust status...so then you'll have to quit your job and wait for that as you can't work without the EAD (which can take 3+ months to get)

Nick and I don't have that problem at all. When we are "talking" for hours every day, sometimes we are watching movies together, playing on online game (this is what we do together the most) etc. etc.
I feel very lucky in the respect that we've always had stuff to talk about when we are together and it's great. Then there comes the time when we are together and sometimes....words just don't matter for awhile wink.gif

On the weekends we have "all nighters"...lol We stay up all night into the wee hours of the morning. luv.gif

I just went over on Easter weekend at the Peace Bridge.
No problems at all.
I was honest, said I was visiting my fiance, he asked when we were getting married. I told him we were doing the K1, he asked where we were in the process. He joked with my Dad about getting me out of the house...lol
He asked when was the last time I had been down and that was it, he let me go through, it was totally painless.
I did bring proof that I was returning home though,
Bank statements, letter from my employer stating I was going back to work on such and such date, pay stubs showing I'm employed there, credit card statements, etc. etc. I didn't have to use any of it.
Better to be safe than sorry though!

In the instructions it says to mail back ASAP the filled out forms..so have her do that and just hold off on sending the check list back....
Once she has all the documents on the check list, have her mail that back and they will issue her an interview date.

Sometimes it takes over 2 weeks to be entered into the system and cash the check...I'd wait a little longer before sending everything back in again.
Nothing about the USCIS or this process is "timely", that is one thing you'll have to get use to quick.
This is a long and hard process, nothing is for sure or easy about it.
