Congrats on your engagement!
This is an exciting and crazy time, work together through the process, you'll be fine!

First, Pictures are secondary evidence, they don't prove anything. Pictures can be faked.
You have the best proof in your possession. Your boarding pass and stamp in your passport showing you went to India. Photocopy those and put them in your petition.
Any examples are in the K1 Guide here at VJ.
They show examples of the Letter of Intent and all the other forms needed to file.

Phone conversations are also secondary evidence at this point, save those for the interview. Sending a few won't hurt your petition but what you really need to prove is that you have met at least once in the last 2 years prior to filing.

Any visits will help your case....visit as much as you can! smile.gif

You both write one.
One for each of you.
You both would address each letter to the service center where you are sending the petition to.
You don't send the I-129F Petition to the consulate in Australia...you send it to either Vermont or California based upon where you live:

Once the interview comes, yes you would then use the address of the Australian consulate because that's who is receiving the letter of intent.

It's showing you that because at the time of the interview, you and your fiance have to re-write this letter with the current date, stating you still intend to marry. Because you are just filing, you don't need that information just yet.

Just leave that out and put:

United States Department of Homeland Security
U.S. Citizenship and Immigration Services

Then the address of the Service center (Either Vermont or California)

Then the date

Then the contents of the letter

Yes, this is very normal.
Things have been working a little crazy lately. Super fast VSC approvals, etc. etc.
There have been some December CSC filers approved lately.
You may see yours very soon!
Usually from NOA1 to NOA2 it's a 4 to 6 month wait...Just prepare yourself for that.
You could call but they probably won't tell you anything until you have been waiting the 6 months. If you've been waiting that long, call away.
I know it gets very exciting seeing people around you who filed getting approved but stay calm..you will just cause yourself added stress.

To be fair there are others on here that have been expedited due to family members and health. It took much longer for USCIS to make a decision (about 60 days) and they had to involve their congressman. It probably came down to the strength and tact of their plea, IE. for cultural reasons it is very important that the mother in law meet the spouse, the mother in law has 6 months to live etc. etc.

Though expedites for the past year or so have been very rare. Basically for the past year USCIS isn't respecting its own rules. (Not that your situation necessarily fits exactly inside their criteria i'm afraid anyway)

In package 3, it says you receive:

IV-15 Checklist
Information on how to book your medical
Medical Questionnaire

Request download and filling in of:
DS-230-I Part I
DS-156 x2 (Fill out online to generate barcode http://www.usembassy...electronic.html - Do not sign)
DS-156K (Do not sign) (K1/2 Only)
DS-157 (Male only)


and here it says what to mail back:

IV-15 and all forms in packet 3.

The consulate will not issue an interview date without receiving the IV-15 (checklist) so make sure to return it once you have procured all the forms.


2 copies of the DS-156 are needed and are not to be signed.
Also, the DS-156K is not to be signed.

Hi I'm back with an update lol!! My fiance misheard what our lawyer said wacko.gif so the big confusion is now a big sigh of relief wink.gif My lawyer basically said to me fiancé "I can not disclose information about you via public records, you would have to do a check for yourself" so I really don't know where my fiance got that from about the 'don't tell me' part.. I think it's overtime hours he's done in the last week. Sorry for the 'waste of time' post... I really wished I sorted it first before posting on here. no0pb.gif

It makes me feel uncomfortable that we are paying for a service which appears to be less than what I would expect from a lawyer.. It's really bizarre but I will keep you posted. Exactly, anyone can fake photos. It doesn't really prove anything and who knows really when they were taken.
They want to see the hard evidence, like stamps in your passport, boarding passes, etc. etc.

Well, we're assuming that's the case since the OP mentioned a lawyer had filed for them. The OP's girlfriend may even have a problem getting a B-2 or even getting past immigration at the POE on the VWP if she cannot prove adequate ties to her home country.


Again, I agree, I was just clarifying what was posted about getting married on any visa is fraud.
I'm not suggesting they stay and file AOS after getting married, I'm saying she'd have to go back home and get a spousal visa.
If they want to do this in one shot, come over, get marry and stay they would need to refile the K1. good.gif

It's not visa fraud if you come over on a visitor visa and get married. It's only fraud if you do that and then intend to STAY.
You can get married at any time, it's the staying and living part where the fraud comes in.
The new spouse would have to go home and file a spousal visa in order to come back to the USA and live.

Say if you went to the USA on a student visa, you are there for 4 years. Halfway through that, you meet an American, fall in love, get married and adjust status, there is nothing wrong with that because there was no intent to marry upon entry, you didn't even know the person at the time of entry.

I wouldn't plan a thing until you know the date of the interview and even then, I would just start estimating on when the wedding might happen. I wouldn't set anything in stone until you have the visa in hand.
Some cases take longer than others....yes, Vermont is moving very fast but you just never know.

As long as you have lots of evidence that you have met in person: Boarding passes, stamps in your passport, hotel receipts, car rental receipts, some pictures, etc... you should be just fine.
