Wow, first...relax.

You are making this a WAY bigger issue than needs to be.

An engagement ring really has no meaning to the USCIS. It doesn't prove you are engaged, anyone can buy a ring. They want to see proof that you have met in the last 2 years, boarding passes, itineraries, stamps in your passport. Even pictures are secondary evidence.

They won't even care about an engagement ring and what it looks like.

You can bring a receipt of the engagement ring at the interview but even then, it's secondary, doesn't prove a thing.

It doesn't matter if she was married when you met, what matters is that she's divorced and able to marry you upon filing the I-129F.

You can get married at any time, as long as you plan to return back home and file for the appropriate spousal visa afterwards. It's only when you plan on getting married with the intent on staying that the fraud card gets played.

We filed at Vermont and it took 3 months for our NOA2.

4 to 6 weeks? I wish.

Some were lucky to get theirs in a month.

California also processes other types of immigration paperwork other than Vermont does so their work load is quite a bit more.

Sorry if it came across as taking offense...sometimes this subject is a sore spot when we see people wanting to just skip all the rules and do it the illegal way when we have waited and waited. Not saying you would have...I'm glad you came here and asked questions to get educated. Many don't and pay the consequences.

As for your question, yes you can visit. You just have to show ties to Canada. You are now intending to immigrate to the States so you will have to show that you intend to return to Canada after your visit. Bring with you a letter from your employer stating when you will be returning back to work after your vacation, pay stubs from that job also help show you are employed there. Bring bank statements, mortgage/rent agreements, visa statements, etc, showing that you still have financial responsibilities in Canada.

When I visited I was totally honest and said I was visiting my fiance. They asked me a few questions about when I filed, when I planned on getting married but never asked for any of my proof that I was returning back home....still...I'm glad I brought it all with me. They let me in no problem.

I just was approved for my K1 visa this past Friday and I'm moving to New Jersey too!!! It's not that bad. We filed in December so about 7 months.

You have honestly found the best resource on the net in regards to the K1 visa. The forums here are amazing. The Guides will help you step by step on how to file legally so you can be with your fiance. Why chance being banned or even barred from the U.S.? It's just a few months...compared to your whole lives together, it's nothing. Do the right thing, the legal thing and file the appropriate visa and follow the rules.

Your advice is good but this is Vietnam, not Canada. "You'll be fine" is not just a stretch, its a fantasy. This is the most difficult Consulate in the world from which to obtain a K1 visa. The good news is that bona fide relationships almost always EVENTUALLY succeed but huge numbers have to overcome 221g results at initial interview for reasons that seem nonsensical to many.

First, I wanted to say I'm so sorry people are treating you like you are an "idiot". You are the furthest thing away from that.
Welcome to VJ, a place filled with distance loves and long distance relationships, you fit right in.
Second, you didn't choose...your heart and soul did. You can't choose who you love. There are so so SO many people today who are married, engaged and dating people from other countries. I can see how people who have never ever been in a situation like ours would judge and think it's insane but it boils down to this, they don't know and they don't get it. You love Roy, yes, you could have turned your back on him simply because he is from the States, I'm sure many have given up the true loves of their lives simply because of this factor. You followed your heart and there is nothing, completely, NOTHING wrong with that!
Don't worry about what the others say, it's not their life, it's yours and Roy's.
I also see you worrying about the "what if's"...
Marie, nothing...nothing in life is guaranteed. Sure, it could end 10 years down the road, sure, you may not like it in Missouri but Marie, don't you think Roy is worth the chance? I wouldn't want to miss out on the love of my life and happiness just because of fears and the what if's.
If something changes down the road and you are unhappy, you will work at it to become happy again, such is life. There are ups and there are downs. You will face them together.

All I can say is take each day, make sure you are doing things in your life that make your heart happy and work together with Roy and make the life you want.

Ann, meeting in person is a requirement of the K1 visa. You have to have met at least once in the last 2 years prior to filing.
I suggest meeting face to face with him, save all the information, boarding passes, stamps in your passport, pictures, hotel receipts, etc. Anything that proves you have met in person.
You have to build a case proving you are in a bona fide relationship and that you have met in person.

I know this seems so very confusing at the beginning but you have come to the right place!
See above the top of this page?
There are tabs.

If you click on the Guides tab, it will take you to the VJ Guides..you could also click Here to take you to the Guides.
Where it says "Begin Here:" in red...that's the best place to start.
It shows a comparison of the visas available.
There is also a K1 Guide which shows you all the forms and information you need to send in with your I-129F petition (K1).
There is the K1 Flowchart which shows a step by step look at the process and how long it takes.
Everything you need is on the guides page.

As you stated, you cannot have your fiance come to the States, get married and then file for a K1. A K1 is for non-married couples only, it's for you, a USC wanting to bring their fiance over to the U.S. to marry and live.
If you were to marry, he would be your spouse and he'd have to go home and then you'd file a K3 which is a spousal visa.
Information on that visa is also on the guides page.

You may get married at any time, even on a visitors visa, but he cannot stay...that would be fraud. You must decide which visa is most appropriate for you and your fiance and then go from there.

This is a FAQ. Just use the search bar, it's a big help.

You can go onto the USCIS.gov website to check your case status online.
There will be a "Last Updated" date.
If that date changes, whatever the date is, that's the date you were "touched"
Remember though, touches really don't mean anything...someone has simply looked at your file, moved your file, etc. etc. It doesn't necessarily mean anything.

You don't have to leave, that's not the intention of these people's posts at all, no one is trying to run you out.
What they want you to do is look at this realistically.
Marriage is a serious commitment. It's about open communication and respect. Hiding something that important is a huge problem and I hope from now on that Vikki has learned to come to you when she has something that serious and important to talk about. Without communication and honesty, you have no where to go but down.
That being said, this is all in the past now, it's out in the open, she told you and all you can do now is mend those wounds and continue on.

Yep, I was surprised to know I could too!
You are going to get an automated message, it asks to press 1 for English, 2 for Spanish.
Then it says press 5 to talk to an operator...you can do this or you can press number 2 for Fiance visa, either way it takes you to an operator.
Then you'll wait....
I waited about 5 minutes to talk to someone. Early in the morning between 8am and 10am and 6pm and 6:45pm they are not quite as busy...
Both times I called at around 10:00pm and didn't wait that long.
They will ask for your NVC number, since you don't know if you have one yet, simply say you are calling to see the status of your petition, and that you have a USCIS number.
Give them the number, the one that starts with EAC...
Then they will tell you if they have gotten your petition or not.
They are so nice, it's awesome.

Your profile says Texas Service Center....? Did you file at Vermont or California?
California usually takes longer to get their petitions out to NVC than Vermont does....they are always slower sad.gif

*edit* I see by your time line you filed Vermont...hmm..interesting..I don't know...sometimes it just takes a little longer to get to NVC...I don't know why.

Incorrect.
I've seen people petition twice for the K1 after it not working out the first time.
Don't know where you got that information from.
I've also seen people apply for a K1, get denied, then they married, filed for a K3 and were approved.

If you do get an RFE, simply send them back what they are asking for, it shouldn't put you behind more than a few weeks.

Yes, it will affect your petition.
You'll have to start all over with a K3 or CR-1.
You can't just convert the K1 into the K3..it doesn't work that way.
When the visa is issued she has up to 6 months to enter the States and once she does, you have to get married within 90 days inside the U.S.

If we could all just "skip the K1" process and move on down..what the heck am I doing?
If you want to live in the United States and be married to the person you love, do it the legal way with a K1 visa.
You can get married at any time but you'd have to return to Canada and do a spousal visa.
Don't burn your bridges...do it the legal way.

Congrats on your engagement!
This is an exciting and crazy time, work together through the process, you'll be fine!

First, Pictures are secondary evidence, they don't prove anything. Pictures can be faked.
You have the best proof in your possession. Your boarding pass and stamp in your passport showing you went to India. Photocopy those and put them in your petition.
Any examples are in the K1 Guide here at VJ.
They show examples of the Letter of Intent and all the other forms needed to file.

Phone conversations are also secondary evidence at this point, save those for the interview. Sending a few won't hurt your petition but what you really need to prove is that you have met at least once in the last 2 years prior to filing.

Any visits will help your case....visit as much as you can! smile.gif
