I agree with the other posters.
You are doing nothing wrong at all.

You don't even need to mention the getting married part.

Just as Pushbrk said, visiting for pleasure, vacation, visiting friends, etc. will be just fine.
Bring the proof that you are returning to Canada just as back up but I doubt you'll need it.

I've visited since we started the K1 and brought a whole folder full of proof, I was honest and said I was visiting my fiance, they never asked to see any of it. They DID ask when we were getting married though, so that is where you could come into some problems, but again, if you have all that back up proof, you should be good to go!

I also wanted you to be aware that Canada doesn't have a fiance type visa for immigration to Canada so you won't be able to being sponsoring her until you are married. On the up side, she can live with you while they process her Permanent Residency but she will not be able to work.

IR ones are for married couples, the K1 is for non-married.

K1 is generally faster than the spousal visas.
You'd have to ask someone in that forum about costs...I'm not too familiar with the fees on spousal visas.

To the OP....Everything you need to know is already on this website. There is a search bar, people have asked these questions over and over again...if you can't find the answers you need, start a new thread and we will all help you.

You really have found what I believe to be the best resource for immigrating to the U.S. based on a Fiance/Spousal visa.

Read the guides over again, keep referring to them, take a break often and just relax.

You'll get through it, thousands and thousands have before you and more will continue to start their journey even after yours is finished.

You will have 8 pages in total.

I've read of a few people here on VJ who used black and the Officer working on their case gave them an RFE because he couldn't tell if it was an original signature or a photocopy.

Blue or Black ink are both perfectly acceptable.

They won't send the package back. You're just looking at a delay of a week or two while they forward it to California or Vermont. I suggest you use the guides here, for your further preparation as the process continues.

The Low down:

They filed for a K1 like 3 years ago (according to the OP)
They were in Administrative Processing for 3 years.

So, instead of waiting, they got married and filed for a K3, not telling the Embassy or the USCIS, they didn't inform anyone that they still had a K1 visa under review.

So then, hi...the embassy calls "Come get your K1 visa, we have processed it, you are good to go".

They go the embassy, say NOTHING of how they got married or filed for a K3 and accept the K1 visa, Fraud #1.

Now they are stating that a lawyer is saying it's fine, go ahead and get married again, who cares about the K3 or the fact you are already married and in fact, it's not really even the OP's situation, it's "a friends".

It is illegal. You got married and entered on a visa that was for NON MARRIED couples. You misrepresented yourself on two occasions that we know of, at the embassy when you picked up the visa and at POE, who knows if there are any others.
You entered using a visa which clearly is for non-married couples on a void visa because you are married! You had to, at one point or another, lie to Officers at the embassy and POE. What you have done is fraud.

Do you think by getting married in the U.S. and simply filing for AOS you erase the previous time you wed, plus the fact that you mailed in your marriage certificate to the USCIS proving that marriage occurred? You can't simply erase that.

Here's what I think happened in this case (from the facts as I read them).

The beneficiary was interviewed for the visa a very long time ago. At that time he/she was placed in Administrative Review, which drug on ages. Just wanted to say that the majority of people on VJ do this without the assistance of a lawyer.
It's easy and can be done when you read the guides, get everything organize and keep focused.

You are young so, you may have a few challenges ahead of you *but* if you have a bona fide relationship and can prove it, you should have no problems filing on your own with the help of your fiance.

When it comes to the income, your fiance must make 125% over the poverty line for the number of people in the household.

They would need your fiance's income taxes from the last 3 years, not yours. Your income does not really matter to the USCIS or the Embassy where you have your interview, what matters is the fact that your U.S. Fiance has enough means to sponsor for you.

Everything you need to know is in the guides at the top (See the top tab that says Guides) Start where it says BEGIN HERE in red letters.

Read everything, take a break then read more...you'll be fine.

You will get what is called "Package 3" and you fill everything out and take it with you to the interview.

    I would try to get your vaccines before the medical, they usually charge for the vaccines on top of the medical fee.

    The Mexican Embassy page here on VJ states that vaccines are not required. You may want to ask this question in the regional section.

  8. After the medical, I go to the interview?

    Yes, you have it prior to your interview and you take your medical results with you to the interview.

  9. After getting the visa, can I cross over to El Paso and that´s it? Or do I have to come back home and wait for something else?

    Once the K1 is in your hands, you have 6 months to enter. Then once you enter you must be married within 90 days.

You can only file at either Vermont or California based on the state your fiance lives in. He has to file at Vermont.

Compared to California, Vermont is quite a bit faster. We got our approval in 3 months.

They are also very timely in sending your petition to NVC after you have gotten NOA2. California is painfully slow.

Being denied entry on a tourist visa should have zero effect on your K1 petition as long as there was not an overstay or something else illegal going on.
Many on VJ have been denied entry for a visit and have had no problems getting a K1 visa.

I suggest you look over the Guides here at VJ, read over all the information, everything you need to file on your own is there.

Lawyers can be quite pricey but considering I don't know the full extent of your situation I won't suggest you not get one. I believe that if two people have a pretty straight forward case (no overstays, no criminal records, etc. etc.) they are fully capable of doing it on their own without the assistance of a lawyer. It's your call though.

Once the beneficiary enters the US it is up to you when you file AOS. Just remember that the beneficiary will be out of status until AOS and will be unable to work and travel until it is filed.

Wow, first...relax.

You are making this a WAY bigger issue than needs to be.

An engagement ring really has no meaning to the USCIS. It doesn't prove you are engaged, anyone can buy a ring. They want to see proof that you have met in the last 2 years, boarding passes, itineraries, stamps in your passport. Even pictures are secondary evidence.

They won't even care about an engagement ring and what it looks like.

You can bring a receipt of the engagement ring at the interview but even then, it's secondary, doesn't prove a thing.
