What most beneficiaries (and many petitioners too) don't realize is that they are already approved for the visa. IMO, the interview is really just a formality for them to meet you and ask you a couple of questions.

Unless they see evidence that you are lying or are already married (like pictures of your ceremony headbonk.gif ), they will approve you. Answer their questions truthfully and you'll be ok.

Many have been denied at the interview. Just because you have NOA2 does not mean you are automatically approved and are guaranteed a visa.

I agree with what you said after that though...if you have all or evidence organized, proving you have a bona fide relationship, an approval is likely to follow. There are other circumstances like overstays, etc that can effect the outcome which usually aren't brought up until the interview. Nothing is for sure....It's only when you have visa in hand that you know you have been approved.

Don't forget that you have up to 6 months to enter using the visa, then 90 days to get married once there so you have some time to work with after receiving the visa.

We are having a tiny and I mean tiny ceremony with just close family and friends, a simple ceremony in a park somewhere and dinner out afterwards.

What happens is that all the K1 petitions arrive at USCIS and are boxed up in the order that they're received. They're put into a warehouse. They do process by dates they are received.
Sometimes cases get delayed, caught up in a background checks, RFE's, etc. and then the adjudicator moves on to more cases while they wait for the RFE's and other snags to be cleared up.
So it may look like they are going out of order, but they really aren't.

I think with California, you are cutting it a little close.
You may get lucky and get your NOA2 in like 4 to 5 months...It's really a guessing game.
Also, I don't know how long Bulgaria is taking to give out interviews.
Montreal (my consulate) is taking 3 to 4 months to book.

I wouldn't make any definite plans, don't put anything in stone until you are much closer to getting your visa....
I'd even wait till you had your interview date, and even then, things can get backed up so it's better to wait till Visa in hand.

As far as I know there have been military expedites when the USC is being deployed overseas.

There are no others I am aware of.

7 months for Vermont is an atrocity. We were approved after 3 months of filing at VSC (Sorry, that doesn't help, I know) sad.gif
I think it's the combination of having a third party person and the RFE that's holding up your petition.
All the information would have come straight to you but instead, went to your lawyer who obviously dropped the ball on a few things in your case.
There could be other unforeseen things that are also delaying your petition, I doubt the children have anything to do with it though.

I hope you get it all sorted out and receive your NOA2 very soon so you can move on to the next step!

Mine got to NVC from Vermont in 3 days. Vermont is generally WAY faster than CSC because they are closer, they mail petitions out probably on a daily basis.

I'd give it up to 2 weeks though...shouldn't be longer than that for Vermont.

Some points that may help or complicate the situation...
1) I do not make enough according to the guidelines so a long time friend of mine will be sponsoring Mark, instead of us going by my income

2) Mark currently works for a company in the UK that has it's major branches here in the USA. We are hoping he can transfer to the USA... but will that mess up our K1-Visa process if he comes over first on a work visa? How long does it take to get a work visa?

Please read the K1 Flowchart here. It gives you a step by step list of what is coming up and what to expect. It's under the Guides at the top of the page which are super helpful.

You are waiting on your NOA2 (Notice of Approval 2) Basically, waiting for the USCIS to approve your I-129F Petition.
Then it is sent to NVC (National Visa Center) and then onto the UK Consulate where they send you package 3, then they issue an interview date. That is where they approve the K1 visa for Mark.

Having a co-sponsor is fine as long as they meet the requirements.

Work visas are hard to get and completely different from a K1. A K1 is for someone who is wanting to come to the U.S. to marry a U.S. citizen and then apply for a green card. Work visas are simply for people working for a period of time in the U.S., then returning to their home country.

If he does get the work visa he'd have to go back home to have his interview in the U.K. then re-enter to activate his K1...I don't even know if you can have both at the same time...I'm sure you can, I'm not too knowledgeable on work visas so, I'm sure someone else can help you.
