I haven't been ringing USCIS,so I can't speak on the veracity of the information, I have just figured we all just gotta wait. Most folks wait till the 5 months mark, when the website advertises that they are processing within the 5 months goal time. Then they ask for a service request, as in, why is it over 5 months. :crying:
VSC is currently operating on target, within 5 months, according to the USCIS website. There are still people on here who are over 6 months and wondering...So it is not likely that the wait is 9 months, but it isn't impossible either. Read around on the forums for a bit and start to get a feel for how long others are waiting. then you can add a pinch of salt, and guess at when yours might come through...

Hi All,
I happened to find out yesterday that the ONE Dr in Tasmania who does Am/visa exams is not doing them anymore. So I emailed the embassy asking for a list of who is doing them. They responded within an hour (Impressed) but the list is shorter than it was (not impressed).

The info on here is now quite out of date, not sure of how to fix it up. I'll be flying to melbourne for my medi exam now, OUCH! Dr Poppenbeek is no longer examining, only Dr Okringal and the cost is $346.

Will attach the file when I can, so you can all see the list.

Does anyone know the correct floor level to send packet 3 to for the sydney consulate when they first sent me packet 3 via email it was this address, with all my other correspondence with them they are listing level 10 instead of

So it's been 6 months and we finally got word back, now theyre sending a request for evidence! I am BEYOND frustrated! I sent them pretty much everything they could have asked for!
So how long do you think this will set us back? I really miss my fiancee :(

An RFE at least means your file is moving. When you know what it is, send it back asap and you will possibly get it all sorted around 14-21 days after that. Now I only speak from observation, but an RFE is better than NOTHING happening and still waiting after 8 months. So take heart, you are getting closer. I'm sure you will get it all cleared up in a jiffy!

I'm still waiting for my NOA2 so at the same stage as you, but I have done some reading.
1. I set a tentative date 8 months from date of filing and a 2nd one 9 months, and when the NOA 2 arrives, I can sort of firm things up a bit, as venues and family need to have some idea of a wedding date. It is NOT a solid date though.
2. Yes there is the $350 fee, plus $346 for your medical done by Dr Okringal, Port melbourne. You will also need a police report with fingerprints, over $120 but less than $200.00. Also the AOS that needs to be applied for has a cost as well, I think it is $1050, but you don't pay it till you get there and are married.
3. YOUR assests will be taken into consideration if it is ACCESSIBLE CASH.
3. Sydney Embassy processes ALL K1 applications.
4. Jump on to the Canberra Embassy website and look in the link for Immigrant Visa instructions. Within there you will find a prototype 'Packet 3" listing EVRYTHING that a standard application needs. There is also an email address. I have requested information a couple of times from the embassy in Sydney via that email address and the response is speedy and accurate.

While you are there you can get her signature on some docs you will need. Also take pics that have some of her family in them as well. Keep records of the two of you being physically present. All this will support your relationship as bona fide and will be beneficial when you get back home to file. Have a look at the Islamabad consulate webpage and see if the instructions differ from your instructions recieved by email. If not then just follow those instructions, or have your fiancee call or email the embassy and ask them. Best to stick with what the embassy wants, not just advice from others.

I have a daughter coming with me and my medical is tomorrow. Because I live on an island we are spending 960 pounds, I ocnverted it to your currency so you would see the amount. This will cover our airfares and medical expenses but not lunch...OUCH! And the costs just keep getting bigger. Immigration is VERY expensive. But I decided he is totally worth every penny, and he thinks I'm worth it too :thumbs:

I have a few questions I have filed for my fiance and recieved my noa and now our 5 months is up and now they are requesting evidence due to when i filed me and my fiance had not seen each other for over two years and now they want to know why well i have good reason , however i just came back from visiting him but it was after i filed.
I have medical reasons and am getting proof from all my doctors can anyone give me any advice on what i can do and if they deny us how do i appeal the action or will i have to refile again and i also would like to add we have a daughter together who will be 6 years old this coming year. I am at my wits end and very confused.
I would like to also add i am on disability but have a sponsor i am working as an independent avon rep and some hours at a macys store but that is hard on me and i would like to leave the position but scared if i do that will they count that against me. I really need advice any and all will help

Do a google on marriage licence conditions for the petitioner's state. My petitioner is in NY and the rules state both parties must be present at the application for the licence.
Tim/Mav is right. Prepare your required docs and proof of relationship. A licence is not proof of anything other than intent. You need photos, phone logs, email proof etc etc...

I've been working for several months without a day off, and I am still very unsure about doing the paperwork myself for a K-1 Visa. I've decided to hire an Immigration Attorney. I did a Google search and found several at prices ringing from $995 to $2495. I'm not certain who to use or who to trust. They all promise results.

set a timer for 15 minutes...sit down and start working on getting it all done...FOR 15 MINUTES ONLY. Then get up and do something else. Each day, get 15 minutes of work down on the forms until they are finished, then do the same for gathering info and docs etc. Done in small chunks it is a breeze. You'll be amazed at how simple it is and how good you will feel for knowing that you have the mosy trustworthy person working on your case.

Assets are ranked differently for the poverty guidelines so make sure you are reading the guidelines correctly. Her Dad should know how to prove his taxable income. Have you included statements from the bank showing account details and balances? You ask the bank to provide a letter on their letterhead with the date the account was opened and the balance. The details are listed in the guides on the site here. I think there may be information on USCIS for filling in the I134 that also addresses details required for self-employed. Happy prepararing.

from what I understand the address you put down on the I129 form is the address used to send you your notices and also the UCSIS centre. So if you have the CA address listed I think it will go to CSC. The I-134 form gets sent into the embassy not USCIS. Yes, you send it to your Fiance. He will need to check and see what the guidelines are for his embassy and whether they want it prior to or during the interview.

That's why your evidence of ties back home is crucial. I had loads with me. i took my bank statement showing the mortgage payments for my home. I showed the contract I had signed at the Student hostel for my daughter's accommodation, including the date I was collecting her. I also had the copy of my leave application from work and could show on my bank statement the pay going in. I had the post office form for redirecting my mail and for how long.

You know what? I didn't need to show any of it, 30 odd days is not that long to them. For 83 days, you need to REALLY show that you are coming home and why. The stronger your evidence of returning the less doubt in their minds.
The other option is - go for the wedding and hold off on the 4th of July till you are living there...it might mean alot more then for having had the wait.

There is a risk of being turned away at POE. Then you have to buy a return ticket. You need to calculate the risk and act accordingly. Good luck!

I travelled in August 2011 and stayed for 31 days. I had evidence of 'ties to Aust' and they let me in no worries. how long are you planning to stay? I wouldn't worry about changing the tickets, just stay for as long as is reasonable in line with your commitments at home...

I rang NVC on Tuesday and they had just recieved my file, but not in system yet. Seems like the sending and recieivng after NOA 2 is as random as the processing for NOA 2 is...Sorry you are having all this hassle.

NOA2 doesn't actually list consulate, even though it says so. Priority date is not for K1 as Inky said. You'll notice when you get your packet 3 that you are advised to make sure your packet thre is returned in enough time to get the interview finalised before the end of your validity date. The valid date does matter, but only effects you in terms of how long you take to get packet 3 complete and returned. It effects the NVC/Consulate process as it limits how long they can keep the file hanging around. Congratulations...you are much closer to the end now!

Well packet 4 came in at lunchtime today and the time and date were exactly as DOS had told me. DOS were also able to see the emails I had sent and their erratic replies, so i guess they have a copy of all the activity for the cases, but can't actually DO anyting, other than to advise what is happening. Don't know how the system works, but it has been good to have the access to DOS at least to get some sort of update on the info...
Yep, consulate only answer emails as they want...ah well.

I have now spoken with a lovely person at DOS and had my interview time and day confirmed for the 3rd time, and apparently packet four was sent to me on Feb 1. Still not here! Not getting any answers from emails to the Consulate in Sydney, so going ahead and booking my flights anyway, while I wait for the packet to be resent!
Sydney seems to be erratic in sending emails, which I do not understand. Packet 3 took 36 hours to come through to my email address...
has anyone else had trouble with recieveing emails? as in, sent but not recieved? It doesn't make sense, but then not much does... :whistle:

Hi there everyone.

My fiance and I got engaged recently while I was on a 3-month visit to the US on the VWP. We're now planning to apply for a K-1 visa, and I had hoped to visit him again soon, until I learned of the possibility that I could be refused entry at the POE. I read some very disturbing stories of people being intimidated, having their emails read, etc., and even one person who said he was taken off in handcuffs to a county jail cell overnight since the next available flight was the following day. I dearly want to visit my fiance again as it sounds like it could be many months before we have our K-1 visa - but I'm uncertain about what sort of risk I'm taking if there's a possibility of being 'sent home'.

Does anyone know exactly what happens, with a refusal of entry?

Specifically: Who pays for the return ticket? I read in some places that you pay for it yourself, and others said that the airlines that brought you in is responsible for taking you back at their own expense. Now, if it's you who has to pay for the return ticket, can you use the ticket you already have, and somehow get the date changed? (difficult to do last-minute I imagine) If I had to buy a last minute ticket back to Australia it would cost $3500 (!!!)

Secondly, is it normal for someone denied entry to be placed in detention, and does this really involve being locked in a cell or taken to a regular prison???

Thanks in advance for any insights/advice! It's so good to have a place to read about and share experiences with others who understand the joys and hardships of this journey.

I recently heard a story of an Aussie who was denied entry at LAX, they found the experience pretty bad and yes they were detained for 12 hours. Virgin Airlines had been the airline and they allowed them to use the return ticket to get back home and were very nice on the return flight. Apparently Virgin see that happening quite a bit, but not sure what frequency that means.

Hello everybody. I'm currently applying for a K1 visa to get to my beautiful fiancee in the US. We have gotten back our NOA2, and I'm now going for the police report and medican examination. Now, here's the question.

Originally, I lived in Adelaide, and then went to live in the US on a J1 visa for 12 months. Upon returning late september last year, I've been living in Melbourne with my family. Now, I was told for Victoria you didn't need a police report if you've only lived there for less than six months (though by the time of my interview, it will no doubt be for me). However, I have heard I also need a report for when I was living in Adelaide. I want to ask if this is true, before I make my trip to South Australia to get it done.

Ask the Vic polce for a NATIONAL FINGERPRINT report. Must include fingerprints. It will be for all of the time you have lived in Australia...ok?

It is very important for AOS. You need it. Find Los Angeles on the list from the link below, or whichever CBP inspection station is nearest to you, contact them and let them know you were not given an I-94. You should be able to go there during their business hours with your passport and get one.

I entered USA through LAX. The CO put a stamp in the passport with the date of expiry etc, but did not give me an I 194. When I went to get my SSN they asked if I had an I 194, I said no and they accepted the stamp in the passport. Is this a new procedure? I was a little to hesitant to ask the CO at LAX if he should be giving me something, now I wonder if I should have. Anyone got any clues? How important is the card when applying for AOS?
