May as well reconcile yourself to waiting. RFE means two looks at the file so you have extended the time to approval by having an RFE. It's tough, but you can make it easier on yourself by just waiting till 60 days after you got notice they had recieved the RFE. It's a bit like starting the clock again. You can't compare your timeline with those who did not get an RFE.

Relax and enjoy getting to know your future spouse on the phone/skype while you wait.

I have continued searching for an answer to my situation and I came accross this -


For DOS:

This is where you will be able to find out if your case was received at the Embassy/Consulate. They will not see your case in their system until the NVC has logged it in and applied a case number to it.

Back in July 2010 Dodi posted this info and I used it today and got through to a really lovely operator. And I can call her again everyday till my case is receieved...it's nice to have a human to ask sometimes.

and I'm stuck somewhere in the middle...

We called the NVC today and reconfirmed the date it was sent. 13th Jan.

EXP 13 JAN 2012A through DHL shows a package being collected 17th Jan and delivered Friday 20th, signed for by Ian.
I sent an email to the Consulate last week, before I found the DHL information. I got a standardised response and then I got another one...
The reply was dated Monday 23rd.

I haven't recieved packet 3 either. So now I'm not sure what to do. The NVC script says it takes about 2 weeks to put the file into the system at the Embassy, but I've seen lots of timelines where the next day packet 3 has been sent. hmmmmmm

Has anyone got any suggestions for me? Anyone had to deal with this? What happened?

Hi, what you have is your USCIS reciept number. A case number is asigned to you when you get the the NVC stage, which is AFTER vermont and before the Embassy. Your receipt number might bring something up and it might not. It'####### and miss. I know it seems like you have a long wait, but Vermont is going really fast at the moment. I got approved and my NOA2 issued in 126 days, less than the average at that time. Keep trying the USCIS website periodically, but don't worry if it doesn't show up.

I am not expecting to or saying I'm going to. I'm just hoping for it. I completely understand the whole process, I'm not assuming anything. I'm sorry if this is out of line but I felt like your response came off a little rude.

I am a US citizen and my fiance is from Australia. Was just looking for some advice on gathering the next round of information so once I do receive my NOA2, I can send everything off right away.

I had an easy entry and was not pulled aside. I was also not issued with and I94. This is apparently no problem, but I'll have to wait to see if I get an RFE during AOS. Coming from Aus through LAX they don't worry too much because we are a Aussies.

You may have up to another 12 months to wait till you receive your conditional greencard. It is quite a long wait, some are getting done sooner, but if you expect it sooner you may get disappointed. If you haven't applied for the EAD card, you may want to do that while you are waiting, it is usually processed in under 3 months and will allow you to work and in some states get a driver's license. You can also apply for the AP card, which is for travel, in case you need to go back home in an emergency, while you are waiting for the greencard. If your case is not transferred to CSC, then you will probably process through faster and also have an interview. Most cases that go through CSC do not get an interview, but the wait is longer as USCIS send many cases to CSC for 'faster' processing... :rofl: :rofl: :rofl:

You will have a biometrics appointment soon, but that is not an interview and your husband will not be asked any questions. It is just so they can take your fingerprints and photo. After that you will be informed if your case is transferred to CSC, if not...wait and see.

Ask about interview prep in a little while when you closer to that possibility. :star:

If I have understood you correctly...the petitioner signs that little blank line to indicate that they REALLY understand that portion, then signs again at the base of the oath. That's what we did anyway.

Things have been looking gor for us...but now I'm in no man's land. My file has left NVC, but not been received by Embassy... :blink:

Not sure what to do...ah well, waitn waitn waitn :whistle:

Got my NOA2! No text or email or anything. Checked Monday morning and it said approved! Got the letter in the mail- it is dated December 13!

I also just received my NOA2. No text or email was received but it was approved Dec 17 at VSC. Also, the USCIS website was not updated to show the application as approved until tonight. There may be more of you out there with approvals, but no way of knowing.

Today was the 22nd of Decemeber, and was really really down seeing a whole lot of aug filers being approved, and noticed on of the posts submitted by a user, that they got their NOA2 in mail, without and e notification or text! So then, I thought of calling USCIS , and spoke to an operator and she basically read the whole script of a "case being under proccess" which is the same thing you read when you check your status online..

So, as I ended my day , hoping it may get approved tomorrow or day after tmrw, raising my hopes and to get this thing off from my head , I got busy shopping for new yrs buying gifts for whole family... And as soon as I entered my building, I opened the mailbox.. And there I saw an envelope from USCIS !!!

AND GOT MY APPROVAL!!!!! Thanks Allah!!!

So the summary to all my VSC filers,,, keep checking your mailbox and be patient!! the whole notification system is unreliable!!!

The waiting is hard...even harder when there is no order to how they process. Some people wait 90-120 days, and others way longer. No idea which it will be. I've not seen any posts on NOA2 recieved this week, which makes me think that there aren't any...the service centres seem to have taken an early holiday. Ah well, wait wait wait... :crying:

I'm hoping for a departure from here in very early April...but It's getting a bit doubtful...trying not to think about it too much.

Yes I am getting ready, but not for interview, just packet 3. Getting polic reports done for me and my daughter (Just turned sweet 16), getting seriology for immunisation done. Can't make medical appointment till I have the case number cos the Doctor won't take an appointment till I have a case number !!! GRRRRR... gathering LOTS of papers...and getting phone/skype/email logs printed etc etc etc

AND

He is coming to visit for 10 wonderful days over New Years! I will get to see him in 1 month and 1 day! His first trip of longer than 6 hours... :rofl: It takes 36 hours to get here from his place!

Be careful in using financial loss as a reason to expedite, it may come back to bite you when you need to prove you have enough income to support your Fiance in order to have the K1 approved. There is a long wait for this visa, very long in terms of emotional ups and downs while you wait, jumping the line with an expedite request may not be the best idea. Maybe just plan to visit each other often while you wait...good luck

Well said M+P i was about to say the same thing. VWP will NOT allow for a change of status. you MUST return to Aus at the end of your 90 days. Also be aware that you MIGHT, but MIGHT NOT, be allowed entry at L.A.X. Especially if they think you are planning to get married and then AOS. Please do your homework while you are over there, so you can get as prepared as possible. Best of luck to you.

Question 35 on the DS-230 is a shocker: list ALL previous visits to the US! DS (French national) has visited the US literally dozens of times as a tourist since the age of 15. In France you are not allowed to keep your passport when renewing it so he has no way to know the dates, and even on his current passport it's nearly impossible to figure out from the barely legible stamps exactly what the dates of his most visits were over the past 9 years. We have the dates of the most recent visits from the past few years in our calendar, but there is really no way he can give a clear answer to this question. What to do??!?!

I would put in what information you can on the form and then attach a note explaining the situation. You could also try sending an email to the consulate and ask for their assistance in what they would expect as answer in your situation.

In Australia, you can book your medical ahead of time. I booked mine before the NOA2 arrived, and had the medical out of the way, along with the police cert with fingerprints, before I had packet 3. We, in Australia, actually include the medical in the packet 3 you will receive from the Consulate. The medical is valid for 12 months from Australia. If you haven't got records of immunisation, you'll need to visit your Dr and get some blood tests done to check immunity, then get shots for whatever is missing, if you can take that to the medical with you, it will ease your medical paperwork. I'd get that done ASAP.
Your Police report is valid for 12 months also. I booked all that in in the month I expected the NOA2 to arrive, as was lucky with my timing. If you want you can wait until the Packet 3 arrives, and just send it when it is all done, but it will slow down the process for as long as it takes to get you paperwork ready. I went onto the Canberra Consulate website and downloaded a copy of packet 3, it gave me a heads-up on what was required, and I got it all together in advance.

Hello all - while this is my first post here, I just wanted to say for starters that this website has been a great resource for my fiancee and I as we go through this process. I'm a New Zealander living in Australia, and Jane is in Chicago. We're actually quite far along with the K1 process; the initial petition was filed around May and was approved barely two months later (!!). However, even this far along, a couple of concerns have cropped up.

While we didn't receive Pkt 3 until near the end of August, the "priority date" listed is July 30. I was actually in Chicago visiting Jane when this arrived, so it was a couple of weeks before I could get on to gathering some of the things I need (a bit difficult to organise police certificates etc from another country). I needed my mum to send over my baby book (for vaccination records) and birth certificate from NZ before I could see about organising my medical examination, and only received that yesterday. So I ring the doctor listed in Canberra (where I live currently) to organise the examination, only to find that Dr Lee doesn't do that any more. I have no big problem going to Sydney for it, but I've also found out that Dr Millar has retired, leaving me only Dr Waks. So I called up that clinic today only to find...Dr Waks is on leave for several weeks. They said they'd call me back if they found there were any alternatives, but that was many hours ago now and I'm assuming I'll just have to bite the bullet and get an appointment with Dr Waks whenever I can.

I don't REALLY mind waiting a bit to get the examination done in theory, but isn't there a four-month clock on getting everything together? Did this clock start ticking on July 30, even though we didn't receive Pkt 3 until weeks after? My concern is that I won't be able to get an appointment with Dr Waks for some time, there's no alternatives to him, and given that nearly two months have passed since the priority date, that there's at least a slight possibility that time could run out.

I can understand how frustrating this would be for you. There is only one Dr down here in Hobart too, and there is a 2-3 week delay in making an appointment even when he is not on leave. You could consider making at appointment with a Dr In Melb, it's not that much further away than Canberra. There is a post on here, not sure but a hunt will find it, giving quite a detailed post on the Med report done in Melb.

Hi All,

I have 2 children. My daughter is 16 and coming with me, so she's easy. My son is 18 and studying at college here in Aus and won't graduate till December 2013. I estimate arriving in the US first half of 2012 and both kids are listed as K2's. I've been trying to find out what the process will be for the K2 and the time line, but can't see anything. I'm not sure if it will fit my son's circumstances, as he will need to return to study and the max time he could come over prior to the end of college would be 3 months. That wouldn't be enough time for the AOS for him I think...so maybe I should take him off the process.
Is it a problem to remove a K2 off the list? Has anyone else had a circumstance like this?

Well, miracles do happen, when you trully wish for them. We didn't lose hope in this journey, and here it is.
First small miracle happened when VSC denied expedited, but processed our case in just 3 month.
In the meantime second small miracle happened, BIA ruled on 06/21/2011 in the binding decision, that K-2 CAN adjust as long, as they enter country before 21-st birthday. So, adjustment at anytime is not a problem anymore.
Third small miracle happened, after e-mail to Embassy. They actually agreed to expedite request and did interview on September, 30 (consular section is closed on that day, last Friday of the month.).
Today Olya got passports with visas, in her hand.
Just two weeks shy of my step-daugher's birthday.
What else could we wish for?

I have a contact who works at VSC. I asked them about why the sudden explosion of approvals of K-1 visa's.

1. They were behind on K's and reassigned some people to start knocking them out. Also they were understaffed and just added about 40 positions to get the allocation of people per work load corrected.

2. What typicaly happens at the service centers, is that the Visa's that are the most time senstive and generate the highest revenue get the most attention. So if the H-1b's wich are more time senstive and generate much more revnue get behind, people get pulled off the K's. Then when they get ahead they will catch up on the lower priority Visa's like K's.

This is why you see the big cycle in processing times. It appears VSC is running 90-100 days average right now. as they have hired people and reassigned people to work on k Visa. For all of you waiting on NOA2 I hope the trend keeps up. I know how it feels to have gotten you NOA1 and settle in for the long unknown wait.

Well I had way too much time on my hands this weekend as my fiance signed up for call. He works in a hospital and so on call he gets called usually about 2 hours after he falls asleep. Anyways I went over some statistics taken from VJ. Here is what I found out from March,April. May,June.

March there were 25 entries but only 16 had any kind of records not approved.
stats on petitions approved:

March filers NOA1
they approved 1 -april, 2 - may, 30 - june, 72 - july, 25 - aug, 4 - sept, 1 - oct.

April filers NOA1 - 12 with no records showing 17 total showing no approval so really only around 5 not approved...mine being one of them...grrrrrr
3 -june, 28 - july but they didn't work on them for the first 17 days, 6 were from 18th - 21,and the rest in the last week 60 - aug

there still shows 36 to go for May, 43 to go for june,
that's as far as I got...lolol
pleeeeaaaaassssse give us our NOA2

thanks for putting up the stats...I think it is helping me at least, to let go of knowing when. I have been researching the Embassy website for Aus and reading what packet three contains. Some of their requests have caught me by surprise. So I have foccussed on getting as many thing done as I can now...things that won't be time limited. I've been downloading forms and reading instructions and getting ready. When the NOA2 finally comes through I have a list of actions to put in place immediately. By the time the packet is sent from the Embassy I should be almost ready to send it right back!!! That's the plan anyway...what are you all doing while you twiddle your thumbs?

Called USCIS helpline on friday, 10/28. Was hoping to get a hold of human being instead of the (insert obscenity) automated system they've implemented for customer service. By weird luck, got a hold of a rep. Sequence is 1-1-2. The rep kindly informed me that VSC is swamped with I-129F applicants and are going through MARCH applicants presently. Which makes sense looking at majority of NOA2 updates in immigration timelines. She concluded by saying "please call back in 2-3 months." So, if you're lucky like me, the average wait time for NoA2 for VSC is 8 months plus. I call on the lucky average NoA2 expectant to kindly follow up with your frustrated comment...

What I don't understand is why there are so many people who are in the VSC queue that are June/July filers who are getting approved in 90-100 days. Yet VSC say they are doing March...How does that work?

If you update your timeline, then you will see an estimate of when you MIGHT get your NOA2...but the dates don't mean you will...just a guess. I'm still waiting and not even expecting to recieve our NOA2 in a while yet...
