USC's who have previously petitioned for an alien spouse sometimes find their cases go under more scrutiny. I'd say unfortunately that's what happened to yours.

There is no need for your fiance to notify NVC. They are just a processing portal for cases to flow to and from consulates. Have him wait until he knows the case has been returned to the Service Center. Then write a letter formally withdrawing the case. It might not hurt for that letter to be notarized and sent certified mail.

Background checks. the embassy maybe seen redflags about my fiance life. Life of my fiance is uncommon today.
My fiance had been married twice but was also widowed twice. His first wife was an indonesian, they met in the NY since they both work there. They got married and had a son. But they were engaged in a car accident. After a year he was married again to a wonderful filipina and had another son. But he didnt expect that what had happened to his past will happen again. So for the second time he was widowed again.

I remember during my interview, the CO asked me if he is working I said no because he is disabled from the 2 accident he had been. But we have his Daddy as our CO-sponsor. For now he is dependent on his Disability Insurance.

Plus earlier after my interview, we received and email from the embassy telling us that the CO was not satisfied to our relationship, so sent additional proof, like emails, pictures, chat logs.

Still they made us wait until today they sent us this email. So we will be getting married here in the philippines and my fiance will be living here for awhile.

Have your American fiance' withdraw the petition once it hits the Service Center.

Then have him file for a spousal visa later on.

It's already 1 year since we filed the petition and waiting for 5 months since my interview and was put in AP and today I received an email from the embassy. This is what the email said:

But they still have my passport, they haven't send it back to me yet. I'm just worried if they lost it since last month the embassy got flooded. Then Me and my fiance are going to get married here in the philippines. What are we going to do since we have K1 petition pending? Nothing is put in my passport when I received it. No sticker or stamp at all. Just the passport I gave them during my interview.

Your situation is the same as mine. I received a 221g paper right after my interview. They didnt asked for additional documents. They did keep my passport and other documents. We did contact our senator and lawyer but both had no help. I have been put into AP for almost 6 months. We called and emailed the embassy but still the same reason "under review". I called the embassy and talked to an agent, she asked for my medical date (which is about to exxpire). After that, she told me to wait for a call or email on the following week. So, i waited. Then I received an email on the next week, telling me that my petition was sent back to USCIS for already 1 month past from the date I called.

my thoughts to you is keep calling or emailing the embassy because part of our mistake was that, we stop calling the embassy after almost 4 months of bugging them and yet we received the same reason. So we let them jsut do what they need to do, but we shouldnt did it.

There are some cases also who were the same situation as ours, the same received 221g form, no documents were asked, and now approved and got their visa. They waited 2 to 3 months.

I hope and pray that you will receive your visa soon. Just call the embassy once or twice a week. GOD bless and GOOD luck.

It's not consistent that it is logged in a fashion that shows up at the USCIS status portal, though - some get that touch, some do not.



I agree. Its a good sign that the USCIS is working on your case, checking all the documents you send, if they still need some docs, they will send you an RFE.

We didn't call US embassy in Manila since then, and we didn't bother to call the USCIS as well. My hubby came over here in the philippine and we got married. I received my passport back one month after they sent it back to the USCIS. As what I have read k1 visa expires after one year from the approval (NOA2) date. If the embassy denied your visa they sent it back to USCIS, they will review the application back and the USCIS could approve it again and send it back to the embassy for another interview, or deny/revoke the application. If they deny/revoke it, the petitioner will received NOIR/NOID. There are some cases that the application stays long in the USCIS and reaches the expiration date, and the USCIS will send a letter to the Petitioner telling him that his application is already expired but he can re-apply again (do the whole k1 process all over again) but still there is no guarantee that you will pass this time.

In my understanding, any petition that a petitioner applied in USCIS, either denied/revoked or expired, when the petitioner receive a letter, he must reply to the letter telling them his plan about the application. Its either continue the process, do the process all over again, or withdraw the petition. Abandoned petition must be canceled by the petitioner even it was expired to make it closed. Any petition with no formal letter of withdrawal from the peptitioner will remain active in the USCIS system even its expired.

Our petition was sent back to the USCIS. I was already interviewed in the US embassy in Manila but my case fall under administrative processing of the embassy. So they gave me a piece of paper (221g form) telling me to wait till I hear from them. After many months of waiting (ofcourse we keep follow-up our case) they denied our application and sent it back to the USCIS. The reason was "Failed to establish a bonafide relationship to the petitioner". The CO was not satisfied of our relationship though during my interview I was loaded with proofs and documents. But its a case to case basis. Our case is kind of an unusual.

Is the petitioner the only one who could cancel the petition? When they decided to send back our petition to USCIS-CSC, I wrote USCIS-CSC a formal request to cancel the first petition (2009) and told them what happened. Would that help? I am the beneficiary.

Passport Stamps, Trip Itineraries, Dated Receipts, and Copies of boarding passes are what they want to see. You don't even have to include a single email if you don't want too (although most include some example of communication). USCIS has the job of determining that a meeting took place and just some very basic evidence of an ongoing relationship. The consulate has the job of looking at the relationship at a deeper level...Primary evidence is what they need for that meeting.

What does the form (221g) said? There must be a checked box in that paper? If the paper checked something needed to submit, you should submit the documents needed as early as you can. But if it checked the "Wait till you here from the embassy" make sure to call the embassy once or twice every week to follow-up your case to make sure they are working on it, not to be put in the bunch of files.

And you must write your fullname in all forms that you fill up for the immigration. US embassy doesn't look on FB. So it doesn't matter if whatever you use in your fb. I am not certain on which address you should send your letter especially those on VSC. I'm sure someone had experience the same. We will wait for further comments from others. Additional info: I assume you dont have case number yet since it still in initial review so instead the case number put on your receipt number; your name as a petitioner and beneficiary's name as well.

Yeah, its been four months passed but I dont know if this will keep going till it reaches 1 year. But still hoping it wont reach that long, me and my fiance really need a decision from the embassy because we are planning to get married here in the philippines. I emailed the embassy and asked if we can get a chance to have a second interview but until now no good news from them.

Your situation is the same as mine. I was interviewed last May 13, 2011 and was refused to issue a visa and was given a white paper (221g) and until now Im still waiting. No document needed but they only checked the box "Wait till I can hear from them". I dont want to discourage you, Just be strong and maybe prepare yourself as well. WE have different cases, some cases will take long time and some case will take only short time then APPROVE. Just keep strong and hold on to each other. And dont forget to email the embassy once or twice a week to inquire about your case. Good luck to all of us. Hope we will receive our VISA APPROVAL soon.

One of the requirements of k1 visa is to meet each other within 2 years prior to the petition. Since your last meeting was 6 years ago that means your fiance needs to visit you again in order for both of you to qualify for the application!! God bless!!
