Good Day Everyone in VJ :)

Greetings!!
Me and my hubby talked last night and we came up about our k1 visa application. It was denied in the US embassy in Manila and was sent back to USCIS last September 2011. Then USCIS received the returned petition November 2011. Since then we never heard anything from USCIS about our case. But we keep checking the site and it says below:

On November 10, 2011, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

My fiance (my husband now) came to the philippines together with his two wonderful little boys (now my boys too) last August 2011. We got married January 2012. We were done getting his temporary resident visa here in the Philippines and now working for the boys visa. We haven't plan to apply any US visa for now yet. But just last night it crossed in our mind about our previous visa petition. And we would like to email USCIS to ask about our case. My question (asking for help);

1) Anyone knows the email address of USCIS?
2) Is there a format on how to email USCIS? If so; kindly share some format...please...

Any help would much much appreciated. Thank you.. and many; many; many thanks to everyone.

Yes you need to have a return ticket. Its one of the requirements when you apply for an extension of stay in Bureau of Immigration Philippines. My husband first purchased a ticket only one trip and no return because he doesn't know when he will fly back. And he applied for a two months extension in BI Philippines while he was still is the State but his application was return back because he didn't gave a return ticket. So he was forced to get a round trip (If only we knew that we can just bought a ticket from philippines to nearer country like Malaysia or singapore just to exit the country it would be much cheaper for us but too late for that he already purchased a round trip). And even when he apply for another extension in the philippines his return ticket was still asked in the Immigration. Good luck and GOD bless!! :)

Sorry that your past relatonship didn't work out but anyways congratulations for finding new one. I wish you the best and lasting love. You can still bring her in the US through K1 visa and marry her as your first k1 already past two years. Mostly USCIS ask for waiver to file second k1 petition when the previous k1 didn't reach two years from the new application.

Required documents & "OTHER DOCUMENTS" they ask for at CFO: copies of; marriage certificate, CEMAR, certified birth certificate, bio page of passport, visa page from passport, pictures together. From USC - bio page of passport, birth certificate, divorce decree (if been married before) are the most common requests. The "other documents" clause can be ANYTHING with those nit-wits at CFO.

** From the Family Code of the Philippines: it's 21-25 years old for advice and 18-21 years old for consent. (Some are posted on VJ that they were not asked for this, yet others have been asked, so be prepared)

Art. 14. In case either or both of the contracting parties, not having been emancipated by a previous marriage, are between the ages of eighteen and twenty-one, they shall, in addition to the requirements of the preceding articles, exhibit to the local civil registrar, the consent to their marriage of their father, mother, surviving parent or guardian, or persons having legal charge of them, in the order mentioned. Such consent shall be manifested in writing by the interested party, who personally appears before the proper local civil registrar, or in the form of an affidavit made in the presence of two witnesses and attested before any official authorized by law to administer oaths. The personal manifestation shall be recorded in both applications for marriage license, and the affidavit, if one is executed instead, shall be attached to said applications. (61a)

Art. 15. Any contracting party between the age of twenty-one and twenty-five shall be obliged to ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefor.A sworn statement by the contracting parties to the effect that such advice has been sought,together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement.

Hello Lai. There is nothing to stop them from filing a petition. The age gap would be looked at but many have been approved and I never heard of age gaps being a reason for denial. Her education background does not matter. If they can meet the filing requirements there good to go. You look alot younger than your Fiance'. LOL. I'm 50 and Mav is 34. But, please tell your friend: She will need Parental Consent from Tatay or Nanay or the closest relative due to her age. (That won't be required until a later date) 19 and 44 is a huge gap. But, I seen it happen here. I just hope they realize what their doing and the challenges ahead.

Does the corrected birth certificate already in the US embassy? If not try; to called the embassy and inquire if they got the corrected NSO birth certificate. And if ever they got it always follow-up them 2 to 3 times a week to make sure that it is being forwarded to the CO. In that case the CO will review the document and that your visa will be approve and release.

The time frame depends on how fast the needed documents being sent and receive in the embassy and how often you follow up the embassy about the status of your visa!! Good luck and God bless!!

Some cases the mnl case number doesn't work in the site or it could be that the visa is not yet forwarded to the 2go office. But the site is sometimes late in updating. Best thing to secure parental consent encase they will ask. Once you get to Manila get your certificate of free to marry in US embassy. Then get marriage license. Requirement for this :

1) certificate of free to marry (US citizen)
2) Birth Certificate of both parties
3) Certificate of No marriage of both parties (you can get this in NSO - both are required to submit this to determined neither were married before) 3) payments
4) seminars (some requires you to attend seminars.)

Note : Made extra copy of the certificate of free to marry (xerox copy is okay) and other documents.

Once you get married to the civil its okay for the US citizen not to wait for the marriage contract to come because some instance it will take time to get a copy certified from NSO. Your wife can work to get the marriage contract from NSO and advice her to send it to you via dhl or any courier of your choice.

Thank you so much momoaz. I hope and pray that this AP thing we are facing right now will be done so that they will issue our visa. Waiting is really a stress. Making my hair turn to gray, giving me wrinkles, making me old fast..

This is why I started this post. Good news for us if we have MikelanNida case. More painful if we are stuck in AP hell for 3 months like jameugiekaxavilon. I will be praying for you jameugiekaxavilon and hoping I see it in the next few weeks.
