RFE is request for evidence. You will get that if the reviewer thinks that there's something missing on what you've submitted. Say incomplete pages of the Divorce Decree, missing form, no signature or missed out question. You will be instructed what to do via mail.

NOA1 or Notice of Action 1 is what you get when the USCIS received your application. Just received.

NOA2 or Notice of Action 2 is what you get if the USCIS approved your application. From this point on, the application will be forwarded to Manila Embassy and Manila Embassy will notify you that you can go ahead and schedule your medical and interview. You can't get on this point if you didn't respond to the RFE, if there's any.

NOA is just a term that people have come up here on VJ. I am not sure if USCIS if aware of it but we all understand each other.

NOA 1 : Where you can find the receipt that you can use for checking your visa status in the USCIS website.
NOA 2 : Where you are being notiified that your application is being approved and will be sent to NVC. Once the NVC received the approved application, they will send the petitioner a letter containing your mnl case number which you can use for your medical examination and interivew scheduling.

Thank you for the suggestion. Me and my fiance want to get married here in the philippines that is why we want to stop the k1 application. We already have a lawyer, we already told him that we want to stop the K1 process. But we havent heard anything from him yet. I was wondering if we can withdraw the petition and write a formal letter to the USCIS since we have no plan to continue the process because we will be getting married here in the philippines.

OP be ready to respond to any NOIR (Notice of Intent to Revoke) or NOID (Notice of Intent to Deny) should you get one.
You have a pending 212(a)(6)(c )(i) in the your file. If you (the petitioner that is) fail to respond, USCIS will revoke the approval of the petition. If that happens it becomes a finding of misrepresentation in the beneficiaries file.

Even if you get married, this will result in a denial at the interview for your CR1.


Hello Leatherneck, is it okay if we will write a withdrawal letter to the USCIS although we dont receive the letter of NOIR/NOID yet? I assume its still in the process since the USCIS is still reviewing our application.

The letter I received was from the US embassy in Manila. What I read was USCIS will send letter to the petitioner about the case then its our time to reply to the letter. All I know USCIS review for the returned petition takes so much longer than those who are still in the first stage of the application. Is it okay if my fiance will write a letter of withdrawal of the petition and not wait for the letter?

Thank you teapotgurl. We already applied for a marriage license here in the philippines and the registrar person told us to return by next week to get the license.

And oh, when I received my passport back, I also received a letter from the US embassy in Manila, a letter of refusal. The reason was the CO was not satisfied of our relationship.

We want to really close the current k1 petition so if ever we will apply for a visa in the future, it wont affect so much.

My fiance received the email below from the USCIS. After almost 2 months of visa issuance refusal from the US embassy in manila, USCIS received my returned K1 petition. Me and my fiance decided to not continue the process because we are planning to get married in the Philippines and will be styaing here for awhile. What I heard is that, USCIS will send us a letter either - Reaffirm the case or a letter of NOIR/NOID.My question is, do we need to wait for the decision or letter from the USCIS before we write a letter to withdraw the petition?

Hello Phladetroit, Thank you for the best wishes.. :) :) we haven't heard anything from the USCIS. We didn't bother to contact and inquire about our returned petition. We are living here in the Philippines right now, and as of now we don't have plan yet to when we will process for another paper. And yes we are already married. We contacted our lawyer that if ever He will receive any notice from the USCIS to let us know about it then. We are planning to just abandon the processed paper since it doesn't applied to us now because we are married. But I keep checking the status online in the USCIS site. GOD bless you too as well!! I really do understand your confusion and "pain" right now. I and my Fiancee are in the same "black hole" situation. She is a Filipina working in Hong Kong...so we went through the HK Consulate. We have been in AP since August 19th,(her 1st interview date), with a total Visa Journey of over 14 months. Today, I learned through an email, after an inquiry, that her application was returned to USCIS on 10/21/2011! To date, I have no specific reason for the "administrative processing" or "Visa Denial". Although, I have not talked to her since yesterday...perhaps she received a notice in the mail. I can only surmise their reasoning for denial of her visa! She is the niece of my ex-wife, that I "sponsored" in 1997 and is now a US Citizen. Goes against Asian Customs?? Makes Elisa and I bad??
Did you receive notice from the Philippine Consulate in writing with "as full an explanation as possible of the legal and factual basis for the visa denial and petition return"?
Good luck to you in your future together...not sure what avenue Elisa and I will pursue now....I do have a Senator "kind of" involved.

USCIS will do one of the following 3 actions:

  • allow the petition to expire
  • reaffirm the petition and send it back to the Embassy for another interview
  • issue a Notice of Intent to Revoke (NOIR)

If USCIS lets the petition expire (a high degree of probability), then that will be the end of that petition. If they issue a NOIR, it must be responded to and it must be responded to by the deadline on the notice. Failure to respond to an NOIR could result in a mark of misrepresentation being placed in the file.

My two cents is this; go ahead with your plans to pursue the spousal visa route (you don't need to wait on USCIS). At the same time, keep tabs on the current petition to see if USCIS lets it expire or issues an NOIR. If you get married and USCIS happens to reaffirm the current petition, then you would have to withdraw it based on now being married and no longer eligible for a fiancee visa.

Sorry to not getting back here lately. I wanna say big THANK YOU to everyone. We will be going to Cebu to visit his late wife family and that they will meet their nephew/grandson. And whatever will happen to our case, me and my fiance will get married here in the philippines. We are willing to live here, the little boys are getting so attach to my family. We are happy living in simple life. I know, not everyone understands how the life story of my fiance goes. Who would believe that a young man married twice but also widowed twice in just 3 years, and was left alone taking care of his 2 sons?" I understand, because I did feel the same thing as first. I even asked him before, why move on so fast? He said he needs to start moving on and not think so much of what had happened because it only made him think to wanna die. But because of his sons, he need to be strong. His one heart desire is to have someone to love and someone who will love him for many years. He also doesnt want that his sons will grow up without a Mommy.

Right now, the little boys are thinking that I am their Mommy. And I love them as they are my own. And in time (the right time) I will never forget to tell them about their real Mommy. I talked to them about it as their angel mom for their little minds. I show them the love of the mother. And I love my fiance as well. I can see and feel how the happenings traumatized him, He always have this fear that he might lost me again. I so wanna make him feel that nothing will happen, that we will be okay.

My fiance doesnt look like disabled in the picture but once you see him in person you can tell. His right leg was broken and a metal rod was put on there so he can be able to stand and walk but not fast, he walk like a drunk. A skin was taken in his left leg to cover the metal rod in his right leg. His right arm was broken too and that he cant carry heavy things for few minutes. Although there are times he do things beyond of what he can but it shows after, the pain he feel then.

Your fiance can withdraw it but you've gone a long way just to withdraw the petition. Remember, spousal visa takes longer to process. Just a thought. I'm sorry about this, just need the right person to ask, we don't who that is.
