Removing Conditions on Residency General DiscussionAfter 15 months..... we get
The reason in the letter was that our petition Did not span the entire period of our marriage in sufficient detail. When reading the documents we sent them i.e. Travel documents of when we went to visit his family together (why would I take a vacation with someone I don't have a relationship with?!?!) Copy of our Auto Insurance with him listed as a named insured (he had just recently gotten his license in 2006) I sent copies of my 2007 policies, Affadvaits from my family members certifing we have an ongoing loving relationship, my pay stub claiming my status as single (only so we can have the max taxes taken out when we file for our refunds, which we included copies of our tax returns) and an old lease. The main problem we will most likely come across is we cannot provide proof except leases from we first got married in 2004. We never had joint bank account until just recently, the same with utilities they have always been in my name....

We haven't moved since we filed the I-751 in Jan 2008. We are going to flood immigration with so much evidence they won't know what hit them.

Well after over 15 months of waiting we get an RFE!!!!!!!!!!!!! ranting33va.gif

My husband and I are seriously thinking of moving to the UK.

We previously provided copies of our tax returns, pictures, affadavits from family members, our lease, copies of bills, proof that we visited the UK together. I honestly am at my wit's end.

Approved 5/7/2009.

Removing Conditions on Residency General Discussion14 Months and counting,
Sorry about the delay. I would make an appointment at you senator/congresswomans office if you can. When I was dealing with the liason at our congresswomans office she let it slip (i think) that they have a direct # to VSC. After she called we got an RFE within the week and an approval about 10 days later. I hope if anything that this may help. If not you could always drive to VT wink.gif

You need to do this asap! You are required to change your address with USCIS within 10 days of your move. You can do this online now at https://egov.uscis.g...i/go?action=coa. Hope this helps!

Removing Conditions on Residency General Discussionany help from......CONDITIONAL RESIDENT CARD MARRIED FROM U.S CITIZEN
Yes you can apply for citizenship while your I-751 is processing (i believe) as long as you meet the requirements, however imo you should just wait for your GC. Have you applied to renew your passport yet? If not I think that would be the next step, you need a new passport anyway. If you don't receive an approval by the time your passport expires (and you have the re-newed passport) I would make another info-pass appointment explaining you need another I-551 stamp because your old one expired, and if you still have it bring your old passport with you that way they can see the old one is expired. good.gif

Did you get the I-551 stamp in your passport? I am not sure if the same rules apply in PR as they do in the states but sometimes from my understanding they do take your GC away when you get the I-551 stamp. The old GC card isnt good anymore anyway. I hope this helps! I would make sure you keep any documentation USCIS sends you regarding your case.

We got our approval the same day you did and my husband got his on this past monday. I know this may not help but I would think if the approvals got mailed the same day it should be around the same time you get your card.

Quick suggestion:

Resend your previous evidence and add anything you might have missed.

I completely agree. They may have 'misplaced' the original documents. Like others have said include this years Tax return and any other evidence you may have acquired in the last year like Christmas/Thanksgiving pictures.

Good luck!! good.gif

Update: Congresswoman's liason with USCIS called the Vermont Service center directly and they agreed 15 months is a long time waiting for a decision (HELLLOOO?!?!? tell me something I don't know) The USCIS officer told the liason they would physically go find his file to see whats going on and that they would contact the congresswomans office within 10 days.

Thanks for being angry for me... I wish our anger would get things moving faster but it doesn't sad.gif

My husband is going to England/Wales in about 2 months to visit his family and see Blur, I just want it to be sorted by then so it isn't hanging over his head. I am also concerned because I won't be going with him and I am afraid something will happen and he may get held up or something on his way back in to the US.

Update: We have been assigned a Consitituent Service Representative that with our local congresswoman. She sent an email to USCIS on our behalf and their response was 'The case is currently with an adjudicating officer and pending at this time (as of 4/8/09) and you are welcome to periodically check for status.'

I explained to her we were well out of the processing times and we received a letter in Febuary stating our case would be resolved within 60 days, then another letter (after we hadn't heard anything within 60 days) this past week stating the exact same thing word for word what the first letter said.

If we don't hear anything in the next few weeks I may contact the Ombudsman. Has anyone had any experience with that service?

Removing Conditions on Residency General DiscussionYear + waiting club
Well, we contacted USCIS around the end of January once it had passed a year waiting, they said it would be forwarded internally and we should hear back from Vermont within 45 days. We then got a letter about a week later saying that our case was still pending and we should wait another 60 days. Well 60 days passed and my husband (the GC holder) called USCIS to find out what was going ontter. They said they would forward another request to Vermont to find out what was going on, that was on March 27th.

I tried contacting the idiots at USCIS on 4/2 myself and was told the request he had submitted on March 27th couldnt be expited because it was already in their system and I would have to wait the 45 days.

I sent a request to my Congresswoman Ginny Brown-Waite on 4/3 to see if she could contact USCIS on our behalf to find out what the heck is going on. We got a letter from her office yesterday saying they had assigned someone to work on our case.

Based on the USCIS website there have been no touches on our case since 3/2008 which I assume is when they received my husbands biometrics. We have not received a request for RFE or Interview since his case was filed.

Hello out there I started this topic as a way to vent our frustrations out if you, like myself have been waiting over a year for your I-751 to be approved.

I would also encourage those who were approved and waited a year or more to explain what you did if anything to get uscis to move your case along.

I just looked @ the processing times from Texas, which is where we sent the I-485 to and it says they are processing from August 2001.

I didn't move here, I am American Thank You. He's not. I am doing the asking, not him. I ask questions because I do not know the answers, I also made a mistake by not going to Canada. I don't appreciate ANY tone in this situation. If I can't freely come here to ask a process question - what is this site for?

John/Marlene - We filed for AOS immediately following our marriage, which was 2 years and 4 months ago. We haven't heard a word since. I asked someone roughly 6 months ago if our interview should have been scheduled and they said it could take up to 5 years.. ??

Now Im a bit more confused.

Filed a K1 then got married. I just didn't want to explain it all, it was a long process, but we did go thru it all so far, except AOS. Anyhow, why would selective services want you to register then? If someone could just atleast explain that part of things, my mind could half be at ease.

We are wanting to move to Canada for other reasons than a draft scare, we've been talking about it for a year or so now. So, what Im asking is, we've decided to go to his original country, instead of mine, whats the best, possibly faster route to take from here?

I apologize, I really dont mean to sound like a complete moron, my brain is just really stirred up over this selective services bit. I didnt explain well enough b/c I wanted a quick answer.

I am sorry.

Waivers (I-601 and I-212) and Administrative Processes (221g)Drafting/Going to spouse's orignal country.
This is a two part question.

A. Can you be military drafted if you have a green card? (I.E. - From Canada and in US. w/ GC)
If you do not yet have your green card, can you be military drafted? (Obviously, if the first answer is no, so is this)

B. We are 1/2 - 3/4 way through our process, he came here, we got married, filed K-1 and now awaiting Status of Adjust. and our interview, he's lived here for three years roughly. We now want to put it in reverse and he move back to Canada and I go w/ him. What is the most painless process to go through? Do we have any sort of headway since we have come so far in one side of the process, or are we even more behind because of it? Hearing draft rumors has got us even more motivated to go back to Canada.

Any sort of response would be greatly appreciated, thank you. :o :( :protest:

CanadaCanada to US, now US to Canada. Help?
I had heard, long before now that Canada Immigration was much much painless than US.

It was sort of ironic on the phone the other day - I was calling US & Canadian Consulates for info and I must admit the ONE Canadian officer I spoke with was 10x more helpful and polite than the 4 US officers.

It just sort of made me giggle.

Thanks for all of the forum links, there is nothing better than experience when it comes to immigration!!! innocent.gif

CanadaCanada to US, now US to Canada. Help?
Again, thank you all so much for your responses.

Today we actually found out they had the wrong A number on the denial paper, and we also happen to find the same incorrect A number on a previous document.

Hoping it might shed some clarity we frantically called USCIS and were quickly discouraged after making our way thru three "lovely" immigration officers.

Not only did they completely shrug off the errors that were found on the denial letter but said there was nothing they could do.

I pointed out that the I-765 denial letter had a 2005 denial date which NO ONE seems to know where it came from.

I also questioned how could they have possibly denied the I-765 in August because of the AOS denial if they didnt deny AOS until 9/14/07????

They of course had no clue. They just shuffled it all off as errors and typos.

At this point, even if there was a chance in hell we were still pending I would write a letter to stop all action on the application. I have had it w/ US immigration.

I have never felt so screwed over.

Thanks for listening to me ramble..

...and of course, thanks SOOOO much for the advice.

Thank you so much for all of your input so far.

CanadaCanada to US, now US to Canada. Help?
Ok, here is the scoop and I need big help if you have ANY experience in this particular matter. Thanks in advance!

Canadian husband decided to immigrate here via K-1 in 04. We have followed ALL the rules and did everything leading up to AOS timely and correctly.

As of August of this year he received an EAD denial based on the fact our I-485 was denied. We called USCIS that day to figure out what was going as we had never heard anything of a denial going on. (We check periodically to see how our case was moving along - we had always been told "It looks fine, everything is pending".)

The immigration officer we spoke with that day jokingly said it could take forever to be approved and that of course 3 years wasn’t a ridiculous amount of time for NO correspondence. He also mentioned that our case did not show denied but that it was still pending.

Being the pessimist that I am we decided to make an appointment at our local office. The immigration officer that checked us in said that any denial would have gone back to the original address that we put on the I-485. We currently reside at that address and have not received a word.

Of course when we went back to sit down with an immigration officer she had a completely different story to tell. Without even looking at our paperwork she said "There is nothing I can do for you." My husband asked her kindly to at least look at our documentation. She said your case is denied and I don't know why - you will have to ask for that in written format. I said to her no offense but all of your correspondence seems to get lost in the wind, which is the whole reason we are here.

She offered up that we could file a motion to re-open the case but then she stated that we only had 30 days to do it and that clock started ticking on 9/14/07 even though our paper says we were denied in '05??? Then she continued to say that it would cost $400 and there is no guarantee at all that it would make a difference b/c we don’t actually have "the" denial letter.

Our second option is to totally start over and re-apply at a $1000. And she went on to say that because we have a previous "denial" that it brings our case possibility down largely.

At this point, we have trekked the US immigration path for 4 years and are absolutely no closer than we were.

Our idea is to turn around and try for me to immigrate into Canada.

I’m not sure what will involved and if it will be any harder or easier but I would rather take a new path at this point than travel down the same old one.

ANY comments, advice, etc would be IMMENSELY appreciated.

Thank you! helpsmilie.gif blink.gif helpsmilie.gif
