K-1 Fiance(e) Visa Process & ProceduresCanada to US, now US to Canada. Help?
Ok, here is the scoop and I need big help if you have ANY experience in this particular matter. Thanks in advance!

Canadian husband decided to immigrate here via K-1 in 04. We have followed ALL the rules and did everything leading up to AOS timely and correctly.

As of August of this year he received an EAD denial based on the fact our I-485 was denied. We called USCIS that day to figure out what was going as we had never heard anything of a denial going on. (We check periodically to see how our case was moving along - we had always been told "It looks fine, everything is pending".)

The immigration officer we spoke with that day jokingly said it could take forever to be approved and that of course 3 years wasn’t a ridiculous amount of time for NO correspondence. He also mentioned that our case did not show denied but that it was still pending.

Being the pessimist that I am we decided to make an appointment at our local office. The immigration officer that checked us in said that any denial would have gone back to the original address that we put on the I-485. We currently reside at that address and have not received a word.

Of course when we went back to sit down with an immigration officer she had a completely different story to tell. Without even looking at our paperwork she said "There is nothing I can do for you." My husband asked her kindly to at least look at our documentation. She said your case is denied and I don't know why - you will have to ask for that in written format. I said to her no offense but all of your correspondence seems to get lost in the wind, which is the whole reason we are here.

She offered up that we could file a motion to re-open the case but then she stated that we only had 30 days to do it and that clock started ticking on 9/14/07 even though our paper says we were denied in '05??? Then she continued to say that it would cost $400 and there is no guarantee at all that it would make a difference b/c we don’t actually have "the" denial letter.

Our second option is to totally start over and re-apply at a $1000. And she went on to say that because we have a previous "denial" that it brings our case possibility down largely.

At this point, we have trekked the US immigration path for 4 years and are absolutely no closer than we were.

Our idea is to turn around and try for me to immigrate into Canada.

I’m not sure what will involved and if it will be any harder or easier but I would rather take a new path at this point than travel down the same old one.

ANY comments, advice, etc would be IMMENSELY appreciated.

Hello, everyone! I am new here!!! Today, I had my interview at the US embassy in Manila,
I was interviewed by a filipino consular officer everything went fine asked me some question personal question about my husband,after that she asked me to sit down and wait for my no. then i saw my no. another window,asked for my name and date of birth and i had my finger prints scanned.

got another interview did not asked much,did not even asked for pictures,emails, or joint bank account (proof of genuine relationship ) he just told me to wait for my no. @ window 72, saw my no. went there and just asked me to fill up this paper 2go courier with my mailing info. and said go window 69 and wait for your visa..
i was just wondering if im approved? i dont know because i have not received any slips or no one said im approved can somebody tell me so my husband and i can decide when to buy ticket.. thank you so much!!

The US immigrant data summary was accidentally detached from my yellow packet. It is intact meaning not lost, just detached from holding the documents. But the yellow packet was not opened or tampered with. I was told to go to the US embassy to report it,my flight is on august 7..

can i just attached it?by myself? or i have to go to embassy, for them to stapled it again

Ive downloaded Form DS-156 & DS-156K from the USCIS website. there is one thing i need to ask again for the nth time ( i keep on asking about everything on here ..sorry:( ) the question about is if i enter the US do i have the plan to work in the future, if yes please state the name of the company,..i do have plans if when i get there, but no company name yet, what should i put there? thanks

I tried to follow the shortcut lists and cannot do the I864. :wacko: I had issues with the barcode website they recommended. I thought it was my computer so I went to the public library and same issues. Every time I do it, the next page comes up unable to display picture. I was hoping someone has a different site or assistance or could do it for me and email the pic so I could paste it in my application. I am hoping to have it done this weekend so I can mail it Mon or Tues when my packet is mailed to me. :help:

I want to send in a DS-230 application as soon as possible but my wife is still waiting for her passport to be processed in the Dominican. I called and the NVC said I could write a letter stating we don't have it yet but it will be ready prior to our appointment. Any one else have any experience doing this? :help:



Another question....I know the paperwork says DON'T SEND DS230 UNTIL PACKET IS GENERATED AS IT WILL CAUSE DELAYS....but will it or is it just they want us to play their game and wait and wait and wait.... :help:

Hi guys,

I have a question for you guys..i'll be a May 2012 filer so I was estimating times by looking at the forum...I just finished ROC..
when I apply in May it'll be 90 days before the date of my Temp GC issue date. From what I understood, we can apply for naturalization yet interview will be scheduled only after 3 years of the GC issue date (which is Aug in my case). is this right?
another question, can you change the interview date? I plan on traveling during the summer.

Hello!!! I am getting ready to apply for naturalization on the basis of marriage to a US citizen. As I was going over the required documents, I got confused with an item on "If you were married before, send: Proof that all marriages ended (divorce decree(s), annulment(s), or death certificate(s). Is this referring to marriages after having granted permanent residence? I had an annulment of my previous marriage in my own country and that was prior to meeting my US citizen husband. My husband & I submitted my annulment papers & his divorce papers to USCIS & US Embassy as one of the requirements in securing my K1 visa and adjusting my status to permanent resident. I got my permanent resident card (valid for 10 years) last October 2011. Do I need to submit those documents again for my application for naturalization? Sorry I am new here and my first time to inquire. Thanks for your help!!!



Yes, you need to submit the required documents. It is a different process.

I am about to apply to, I have a question about the biometrics, I thought if I did mine within the 15 months I don't need a new one. My concern is i'll be traveling after 2 weeks and i'll be away for 40 days! I was worried that I would get a biometric appointment? when do they usually send the bio appointment after sending the application?

The best one I found to use is the Royal Mail phonecard. I think they can be purchased almost anywhere... my husband used to get them from Tesco or Asda I think. good.gif

It depends on your insurance company, I work for an insurance company who deals with a lot of military personnel so it isn't unusual to have foreign spouses on the policy. I have never asked when adding a foreign spouse for their driving record. I always just ask how long they have had a license. I think it really all depends on the company. smile.gif

Alessi's Bakery (it's like a Deli really) in Tampa is awesome, esp. when they have the baklava... mmmmm. They are good for lunch.

Stonewood Grill is good too they have an excellent wine selection if thats your thing.

I saw it too, way too unrealistic as far as I am concerned. I found it hard to believe it would take less than a week for immigration to come a knockin'. If it did take less than a week I think a non-criminal from Canada would be on the bottom of the list to be deported.

Depending on if you plan on seeking a divorce prior to the approval you may need to file an amended I-751 to waive the requirement for 'joint' relationship status. I would make an Infopass appointment at your local office (if it isnt too far away) and speak to an immigration officer about your situation. You may need to do nothing. Hope things work out for the best.

My husband did get the one year extension letter (between his NOA and biometrics appointment) which I thought you automatically get (i am probably wrong though) when you file for the I-751 due to the processing times. We just recently got the stamp in his passport because it had passed the one year letter extension letter. If that makes sense.... unsure.gif

I would wait at least a few months after you filed for the I-751 to get the passport stamp, I know the processing time is different for everyone but as someone who is still waiting after filing in January 2008 I wouldn't get too soon.

California Service center is taking about 6 months or less if you look at this thread CSC I-751 Processing Times and the info on the USCIS website.

I wouldn't anticipate it taking longer than 2-3 more months. They are getting out cases faster than VSC. ranting33va.gif

We applied to VSC also in Jan 2008 and haven't gotten an approval or RFE.

I called the USCIS hotline in Jan 2009 who told me they would forward our request to VSC because it had passed the normal processing time. We recieved a letter 3 weeks ago stating it would be another 60 days before they would make a decision. blink.gif

It is very rare though to be waiting since January though.

Yeppers! Imagine how those of us feel who applied in January/Febuary feel. Pardon me saying this but don't get your panties in a twist just yet. I know you are frustrated as most of us are with VSC but IMO it's not time to be super worried just yet.

I may not have filed in April/May 08 but my spouse and I are still waiting from January 2008 sad.gif . We are in the process of contacting our congresswoman to see what the heck is going on..

If you look on the status list many from December 2007 aren't approved, I am sure a couple have dropped off and stopped coming to this site, but keep in mind if you have been waiting since April/May/June 2008 things could be much worse.....

We haven't applied for citizenship yet. My husband hasn't made the decision if he wants to become a citizen yet vs. a green card holder. I would hate to think we wasted $600 for his removal of conditions to just apply for his citizenship.

The reason in the letter was that our petition Did not span the entire period of our marriage in sufficient detail. When reading the documents we sent them i.e. Travel documents of when we went to visit his family together (why would I take a vacation with someone I don't have a relationship with?!?!) Copy of our Auto Insurance with him listed as a named insured (he had just recently gotten his license in 2006) I sent copies of my 2007 policies, Affadvaits from my family members certifing we have an ongoing loving relationship, my pay stub claiming my status as single (only so we can have the max taxes taken out when we file for our refunds, which we included copies of our tax returns) and an old lease. The main problem we will most likely come across is we cannot provide proof except leases from we first got married in 2004. We never had joint bank account until just recently, the same with utilities they have always been in my name....
