It took month for me to transfer case from one embassy to another. I got new NVC case number when they transferred it. So just giving info about how long it might take.

I guess I don't follow what you are saying. If they can say the case went to Paris, then there must be a case number they can also see. Or is the "case went to Paris" a hypothetical answer because she asked where cases with French addresses go? You actually don't know if the case went to NVC or left NVC? Normally a call to NVC can tell you when the case arrived, departed, and the new case number. So maybe you are saying they can't pull up anything on you and there is no specific information where your actual file went to Paris. Yes, the NVC notifies the petitioner with a letter. It takes a while to be issued so that's why eager beavers call to find out in advance of the letter.

 

I?m as confused as you are. They specifically said our case got sent to Paris on the 3rd of Feb. My Fiancé then asked if they had our case number (I listened to the whole conversation as she put it on loud speaker and I was on skype). The guy at NVC then responded with ??we cannot tell you your case number as you gave me the wrong birthday of the beneficiary?? (they messed up, she told him my correct birthday but I guess it got changed somewhere along the line). My fiance asked him what we can do about this and He then said ??email us with the beneficiaries birthday and a copy of his passport so we can amend his birthday, and in the email also request your case number??. So she has done that. Therefore i'm assuming that we do have a case number but they are unwilling to give it us because of the birth date issue.

Call the NVC (have fiancé call) and ask what is our case number. If the case is gone, there is nothing they can fix for you so just ask for the case number. Then you can track it on CEAC. If it says "ready", it is in Paris.
But how do you know it went to Paris? Did your fiancé get a letter from NVC saying so? The letter would have the case number.

She already has called NVC and they told her our case has been sent to Paris. He said because she gave my incorrect date of birth(which they messed up, she did tell them the correct date)  he can't give us our case number and said to email them requesting my birth date to be changed. She hasn't received a letter saying it has been sent to Paris though. Is it standard too receive that? Thanks!

The transfer protocol is for your desired consulate London to make the request to Paris to have the case released to them. London uses a contact form. Give them your new Paris case number...did you get it from NVC yet?

How long did you live with your mum? Do you need a French police certificate?


super! thanks a lot! No we tried but have had some complications with getting our case number. My fiance has emailed NVC about the issue so we should hopefully get it soon. I lived with her a a couple of months but went back to England in that time as well. Is it 6 months you have to live somewhere to get a police check for that county? Thanks again!

If Paris embassy refuses to take the case, then They have to contact the london embassy and they have to accept it. Did you get a case # from NVC.

ah ok i dint't know that. Well that's another problem we've got, somewhere along the line my birthday got changed so NVC wouldn't give us our case number. They asked my fiance to email them with a request to change my birthday to my real one with an attachment of my passport page, so she did that yesterday.

Contact Paris Embassy. Your situation is bit complicated. Contact them before they start processing. Since you are from UK, you need UK PCC anyway. Typically you have to be a citizen or a legal resident of that country to use that consulate.

Thats why they sent it to Paris because you put a french address. They go by whats on the form. You can contact the embassy and try to have them send all of your casefile but be warned this has been tried many times and you are looking at months of delays and I do mean months.

I know, but i also though that as they ask which embassy you want it sending to, they might take that into consideration too. I wonder what the point of asking is. I'm fine having it in Paris as long as that's acceptable for me to do. We would rather avoid the hassles of transferring it.

Hi everyone!

 

Our approved K1 petition has been sent to the Paris embassy but we wrote we wanted it sent to the London embassy. We half expected this to happen because at the time I was between homes so had to put my mums French address down, as that?s where I was temporarily living. I now live back in England. It would be no real inconvenience for me to have my interview in Paris as i could stay at my mums and this would save us the hassle of transferring our case to London.

 

Is it ok for me as a UK citizen to have my interview in Paris? And if so how does this effect things like my police check (do I get this from the UK still)? Would the medical take place in France too or England?

My friend is going through this same process except from Paris to Tunis. I highly suggest you confirm with Paris that they sent your packet via the appropriate TRACKED courier (DHL, I believe). They did not do this in my friends case and although the embassy in Tunis has the electronic file, they will not proceed without the hard copy. I don't mean to alarm you but it seems the Paris consulate does not always do their due diligence. Better to get on it now than wait. Good luck!

Hi! We have been in touch with both the Paris and London embassies via email to sort out the transfer of our approved K1 petition. We got told the process would take approximately 6-8 week. We are coming towards the end of this timeframe now but still haven?t heard anything from London. Paris has confirmed that they sent our file electronically and via mail so hopefully it wont be long. I have sent a message to London on their contact form enquiring as to the status of our case but no reply so far. I was wondering if anyone has been through this process between these two embassies and how long it took to complete. Thanks for any help!

processing resumed Nov 7,07. Now it is Jan 24/08 ! Still NOTHING! So I hear your pain.

wow... thanks. good vibes back to you. We are are about on the same timeline. Only difference looks like you applied in Vermont and we applied to Texas then it was sent to California. I called and they said they are doing a security check on me, the petitioner. Any idea how long this takes? They also mentioned that this "should" be last step before approval. Lets hope so.....

Have you received your NOA1 (I-797C)? All I-129F petitions are sent to the Texas lockbox. If your case was transferred, the bottom left-hand corner usually states to which service centre.

Or if you have your USCIS receipt number, you can check your case status at https://egov.uscis.g...d/CaseStatus.do

 

No we just sent it Friday and haven't received anything back yet, just curious where it may be going to! But I guess we will find out when we get our NOA1! Thanks.

We received NOA1 on January 27th - 2 months and no word. I'm worried a couple things will affect us.

 

1. I was flagged at the US border and denied entry (I almost over-stayed my welcome and tried to go back on a passport... oops.) They finger printed me and what not and told me my best bet was to get a Visa and I shouldn't have any issues because I "have no criminal record" They were very kind. I'm worried this may somehow affect our application somehow.

 

2. My fiance doesn't have a very high income, we have enough to live comfortably but I worry this may also affect us. 

 

Any thoughts?

Hi everyone,

 

I am a little confused with the I-134. You see, my father is going to co-sponsor my fiancé because I am a student and I do not work. I know for certain that I must fill out a form, but does that mean I also have to include my W-2 and tax returns from my old job? I stopped working in 2012. 

 

Also, my father told me he submitted an affidavit of support for someone 20 years ago but is not 100% sure of her name. His memory is awful... Is there anyway I can look that sort of information up?

It sounds like you did everything right. You sent both primary (passport pages, airfare receipts) and secondary evidence (photos). Unless something has changed with USCIS procedures recently, they should have accepted your photos. I submitted the I-129F NOA on 07/11/13, and I included 20 4x6 photo prints. Like you, I wrote the names, dates, & locations on the back of each photo, & put them all in a ziplock bag. I also sent passport stamps, airline receipts, boarding pass, and we were just approved by Texas Service Center on 09/11/13 with no RFE. Sounds like it all depends on who is scanning in the initial I-129F paperwork. It's hard to imagine they don't have a flatbed scanner to scan in different size documents. If USCIS expects all documents to arrive on 8.5" x 11" paper so they can easily run them through a document feeder, then they should include that in the instructions. But that would be too logical.

Hey guys,
 
I have a quick question. When I finally file the I-129F, it will have been about a year since I saw my fiance in person due to my college schedule(senior year is evil, by the way)/new job and his new work contract schedule. I wanted to know if this will make any problems or look bad to the COs? If so is there any sort of explanation letter w need to include maybe? We have more than enough proof of relationship, probably an obscene amount, of daily communication, Skype logs/screenshots, email, photos. 
 
I don't want to wait an file after another visit, because the wait times seem to only be getting longer and honestly we are both sick of waiting as is in general. Opinions??

You provide the most recent tax return, whether that be the 2012 or 2013 by the time you have an interview. The 125% is based on current income, not past. Current income is listed on the I-134 and a letter from employer and/or most recent pay stub(s) are used to prove the current income amount listed.



I see. Do you think it's better not to present the 2012 ITR anymore since our I-134 is substantial? If the CO asks for the ITR and I showed him the current ITR (which was from 2012; below 125%) that old ITR should not affect their decision for visa approval, right?

Hi. My fiance and I are just wondering if it's still necessary for us to show his ITR on the interview at the embassy. He got his new job last year (around 3rd or 4th quarter of 2012) and his ITR doesn't meet the 125%. However, if we are to present his paystubs only (with letter of certifiction from his employer) we are definitely above the 125% requirement. My fiance said that his ITR will be updated by end of December or first part of January. Though we've just submitted our I-129 docs, I'm concerned that we might not have the ITR in case the processing of our application will be speedy. If the interview will be scheduled after first week of January, we will have no worries about the ITR. I know ITRs are not a requirement for K1 visa but I've seen a lot of posts that the manila usem is particular with that. I hope anybody can help us, especially the ones who had the same scenario. No, you didn't make a big mistake. They just want to know generally how you met (and that being when you first met face to face is fine). They don't need a detailed explanation, nor do they want to know about future theoretical plans.

We didn't also include any details about our future plans since we just answered what was asked in the form. Did we make a big mistake? I was just reading stuff here on VJ and saw how other couples answered the question. We have already submitted our packet and it makes me worry now.??

I asked my mom, and she told me that your fiancé needs to go to "Registro Nacional de las Personas(RNP)" and ask for "Rectificacion de Nombre en Acta de Nacimiento" the RNP should have a lawyer available, and It took them 15 days to get my younger sisters name corrected. So your fiancé should ask them to "correct" her name and change it to what it was previously. I am not sure in which city in Honduras is your fiancé asking for her change of name, but at least in San Pedro Sula it took my parents 15 days to update her typo.

 

I would said try again in the RNP. I was told it took 7 days to get my police certificate, but I was able to get them in 2hrs. So just go back to the RNP, and stressed the fact that you need that name updated As soon as possible. It might take  more 'tip" but It will be worth it. At least I have already reserved the place and some vendors, I cant imagine having to cancel all that.

I cant make a real statement since Im not a US Embassy final authority. But I do have an experience with my younger sister. There was a "typo" with her name since Day 1. So eventually my parents decided to go back and fixed the "typo" . Soon after we realized her Visa did not matched her new passport. We asked the Embassy and we had to go to the Embassy and get a New Visa (although the previous one was still active), We had to show them all the proof of the name change, new passport and birth certificate. I know you all must be highly annoyed but just wait and see. Wish you all the Best and keep your hopes up, eventually It will come to you! smile.png
