K-1 Fiance(e) Visa Process & Proceduresletter of intent to marry

wow I feel dumb, in our letters of intent to marry, we wrote why we wanted to marry. I made these statements about how we have spent time finding if we were compatible on several levels and how we are happy and in love...but I didnt say in 90 days, I assume that is understood.

His letter....oh my god, I cried when I read that letter. I plan on keeping a copy so when we get into an arguement I can re read it. It was really heart felt.

Bobbie

I believe it should say something about intending to marry within 90days of entering the US. I would not worry so much about it, I didn't send in one with my petition, for either of us and had no problems, 0 rfe's. We plan to make them up for the interview though, as the CO may be looking for them. Do you live in Tampa, I see that is your local office? I live in Tampa, so just curious. Best of luck, Lisa

K-1 Fiance(e) Visa Process & ProceduresFiguring out where your packet is
after getting the email notification of noa2, I called nvc about a week later to find out when I would receive a letter from them. They said they had not received anything yet from CSC. A few days later I called nvc back and they said when they received my petition from CSC and when they had mailed my petition to Ghana. Using the date the nvc told me they mailed it, I went to DHL website and tracked it
go to track
select: track by reference
in reference section put: CORRESPONDENCE
seclect the approx dates your package was shipped, based on what nvc will tell you.
in origin postal code put: 03801 (which is nvc's zip)
thats about it, you wont be able to see exactly which one is yours, but it will give you a real good idea. I hope this helps you

K-1 Fiance(e) Visa Process & Proceduresusing whiteout etc on the forms?

I always heard the opposite, that you should not use white out. Instead they say you should draw a line through the mistake, write the correct thing in and initial the change.

that's what we do in the medical field, I recommend you do the same thing. If you use white-out they might be wondering what you are trying to hide or cover up.

K-1 Fiance(e) Visa Process & ProceduresDo they even know what they are doing???
are you sure you read all the papers they sent back? I got mine sent back as well and I was using old forms. When they sent me everthing back, I was over looking somethings and thought that was all they wanted me to do, was make the check out to uscis. (Which was what I already did.) I read more carefully and saw they marked on a second paper, that I need to fill the current forms. Anyway, check everything again. maybe you over looked what they really want. I hope you figure it out. Good luck.

K-1 Fiance(e) Visa Process & Proceduresdeclaration of how you meet in person in last two years
I only wrote a small sentence, as much as the space on the petition would allow. It really was a short statement. I said we met through a friend, I did not provide a date. I said after that I traveled to met him in person and that was about it. I had no problems with it not being enough. No RFE,, dont worry yourself over it.

K-1 Fiance(e) Visa Process & Procedurestimeline..can be like this?
I would definately believe the timelines you read, I see people on here all the time getting visas fast, that went through VSC. But you should keep in mind everyone is different. You can probably count on getting an approval very soon. Once it goes to the NVC, it should not stay there longer then a week. At least that is what I was told when I called the NVC, they asked me what kind of petition was I filling, I told them K1. They said K1 petitions get sent out to the embassy in no longer then a week. And my petition was not there but a couple days before they sent it to Ghana. I wish you the best of luck and a speedy visa.

K-1 Fiance(e) Visa Process & ProceduresDenials
I'd like to say my fiance and I met through his mom. She was not setting us up or playing match making. We were the ones who decided that. Anyhow, our interview is July 9th, we'll keep you all posted on how it goes. We know that there will be a red flag once my fiance mentions how we met, but we have plenty of proof that our relationship is real. But we'll see how true statement 10 is on your list.

K-1 Fiance(e) Visa Process & ProceduresEvidence Photos
I think we sent 5 pictures total. They were scanned on the computer and printed out 2, to a page. We didn't use photo paper, just regular paper. There were no problems, the interview is July 9th and my fiance can bring real photos with him there. Like someone else said you shouldn't believe everything you hear. Do what you feel is best for you.

K-1 Fiance(e) Visa Process & ProceduresDo I have enough evidence to file k-1 forms?
I see you have got a lot of advice and good information to help you through, to file for a K-1 visa.
I would like to tell you what I sent in with the I-129f. I had no clue about this site before sending the petition, so I had a lady help me with it, who was familiar with it. Whether or not this was the right things to send or not. I did not get a RFE, so all was good for me.
Contents sent with myI-129f (these were all copies)
about 5 pictures
airline boarding passes
my passport pages
both of our birth certificates
G-325A for both of us (4pgs)
I-134
a couple of my paystubs
proof that I own a home and what I have left to pay on it
a couple passport pics of both of us

I believe that was it. We did not include the letter of intent to marry. We plan to bring it to the interview. For the interview we will be providing a lot more information. Emails, chats, phone records, letter of intent, tax info, cell phone bills, copies of everything sent with petition, letter from bank, letter from my job. Thats about all I can remember right now.
But you have gotten a lot of good info from everyone else, as what to provide. I wish you lots of luck and relax. Follow your 3 steps :)

K-1 Fiance(e) Visa Process & ProceduresAddress change...?
I would recommend the same thing. Or if you dont have anyone's address to use, you could put in a address change with the post office, that way all your mail gets forwarded to your new address. Then when you have time you could let USCIS know about the address change. But really try to use a family members address, a lot of people do it.

Why don't you use a parent, sibling, or PO Box for mailing address? Something that wont change during the process, you would hate loosing NOA2 and have to order a replacement one for $200+, NOA2 is needed for future adjustment of status.

This is by its very definition immigration fraud. It is a serious crime punishable by a $250,000 fine, 5 years in prison, loss of residency, deportation and a permanent ban from the US.

BTW in the US it is also crime to know of or witness a felony crime and not report it. If he has not done anything yet but still plans to do so, cut all ties and walk away. If he has then you could be in trouble if you do not report it.

This is one situation where you should think with your head and not your heart.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresJust Mailed the I-129F Package Today
I just sent in our I-129F package today. I am excited and a little nervous to finally get this process started. I have been doing a lot of research on this site and with the USCIS for several months. Now that we feel more informed and as comfortable with the process as possible, we signed up for VJ to track our progress.

I mailed in our package using USPS Priority Mail with Delivery Confirmation to the Dallas Lockbox. Since I am in Florida it should get forwarded to the Vermont Service Center.

Because Japan is a low fraud country, I hope it goes quickly and smoothly. However, I am not counting on it.

If you sent it on Monday and you got that message today, it will reach its destination(Dallas, TX 75266) today. Check again in about 2 hours and you'll see. Trust me, we've been there. :P

Ok, Delivery Confirmed.

I was not panicing. At worst it would have been sent back to me in 15 days and then I would have sent it to the Lewisville location.

K-1 Fiance(e) Visa Process & ProceduresUSPS Priority Mail Delivery Confirmation
I sent the I-129F package to the Dallas Lockbox P.O. Box address using USPS Priority Mail with Delivery Confirmation. I just checked the tracking info online and this is what I read:

We attempted to deliver your item at 9:03 am on September 15, 2010 in DALLAS, TX 75222 and a notice was left. You may pick up the item at the Post Office indicated on the notice, go to www.usps.com/redelivery, or call 800-ASK-USPS to arrange for redelivery. If this item is unclaimed after 15 days then it will be returned to the sender. Information, if available, is updated periodically throughout the day. Please check again later.

Will it get delivered properly to a P.O. Box.? Should I be concerned about this? Maybe I should have sent this to the Lewisville address.

I think that someone posted this concern a few months ago. I do not know how that got resolved.

Also the ZIP Code is wrong, it should be 75266.

Any thoughts?

K-1 Fiance(e) Visa Process & ProceduresAbout to send the I-129 F packet: USPS or UPS?

This site has really been helpful. Thanks to everyone who responded to my questions before. We are ready to send the I-129F packet. Just wondering, did you send yours via UPS or USPS?

Thanks!

I sent in our package on Monday with USPS Priority Mail with Delivery Confirmation. Got delivery confirmed on Wednesday. No Problems.

If you send it with USPS then you can send it directly to the Dallas Lockbox P.O. Box address. However, if you use UPS or FEDEX then you have to send it to the Lewisville, TX office. You cannot send a UPS or FEDEX package to a P.O. Box. If you send it to Lewisville, they will just forward it to the Dallas Lockbox.

In short save yourself some money and a little time and use USPS to send it to the P.O.Box address.

Once you send it in start your timeline and join the September filers thread.

Good Luck!

I am curious about this too. I sent in our paperwork on 9/13. I got a delivery confirmed from the USPS on 9/15. Now I am wondering when and/or how I will get a case number so I can start tracking it on the USCIS website. Does this number come with the NOA1 or will I get it before? I know that it has only been a few days since they received it, but I just want to know what to be looking for.

Enjoy your trip. Make sure that you make exact copies of the final package you send in including signatures.

We fillied out all of the paperwork and had the photos made together when she came to visit me here in the US. I am planning on going back to Osaka to visit her during Thanksgiving. That will help us accumulate more evidence that she can use for the interview. I also plan on taking the I-134, tax transcripts, and updated Fiance Letter of Intent with me to hand to her personally.

K-1 Fiance(e) Visa Process & ProceduresK-1 petition process started

hello fellow members, mikeinkc here. i am the petitioner and i just started the petiton for K-1 visa process recently. i have read the guides, the example letters, and so far, i have only a few questions. in particular with the g-325a form, and the letters of intent to marry. i understand that both me, (petitioner) and my finace'(beneficiary) have to fill out a separate g-325 forms. my question is this. does my finace' have to fill out her copy and sign it in her country and then send it to me with an ink signature by mail of other courier? or can it be filled out by her, signed by her, and then have her scan it, and then send it thru email? my other question is the same but with her letter of intent to marry me within 90 days of entering the US with a valid K1 visa?

and one other question while i have the attention of the good folks that have already been there, done that!!! if during the period of waiting for word of approval of my petition after i send it off, i get an RFE, and i have to send originals of boarding passes, receipts, itineraries, etc....will i receive these items back so i can send these same original items along with the duplicate copy of my petition packet, to my fiance' once petition is approved?

because if i understand correctly, once my petition is approved, i am to send my duplicate petition packet, along with my original documentary proof, to my fiance'. if my originals are the subject of the RFE, how can i send the originals if they are in the hands of the USCIS? if i am missing something please tell me. i have the petition filled out correctly, copies of all of my boarding passes, ticketing comfirmation, baggage tags, receipts, photos, receipt for engagement ring, copies of random sampling of emails, messenger logs, cell phone calls, birth certificates, passport stamps, divorce decrees from both her and i, my g-325a, her g-325a(pending signature issue resolution), letter of intent from her(also in question because of signature issue)....

basically i have studied this process front to back and to front again many times, and i have most of my ducks in a row. i am excited to start this process and get it moving, but not until she and i are 100% certain that everything is in tip-top shape. any help would be greatly appreciated. thanks, mikeinkc.

All signatures must be originals not scans. Preferably in blue ink. Even if you scan it in color when you print it out you will still be able to tell that it is a copy and you will receive an RFE.

The only originals that you should send in with the I-129F should be all USCIS forms, Letters of Intent, and passport photos. Everything else can be an exact copy (that means front and back for the USC's birth certificate). If you get an RFE requesting an original you will have to send the original. Whatever you send them you will not get back. However they will have it in your file at the Embassy when the beneficiary goes for the interview.

The beneficiary should bring all originals of evidence to the interview.

Fill out your profile so we know what country the beneficiary is from. Many countries have their own set of rules and preferences which do not show up in the guides. If we know what country and embassy you are dealing with the wonderful people on VJ can give you better information.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Flowchart

I was reading the VJ flowchart and was wondering why it was necessary to go to the SSA office two times. Once immediately after entering US and again after marriage.
Why not just go one time after marriage?

I have to take the day off and would like to do go one time.

A SSN is required for a driver's license, bank accounts, credit cards, ect... Since many K-1 couples do not get married immediately on arrival to the US and they wait 1 or 2 months, if they want to be able to do these things they need to get a SSN before their marriage. It is not required to do before marriage, but it is suggested to have it done ASAP.

Be warned that there have been many K-1's on VJ that have been given a hard time at the SS Office. The workers at the SS Offices are not always properly trained and informed that K-1's are eligible to obtain a SSN and they may try to deny you and tell you that you have to wait until your EAD or AOS comes through. You may have to convince them that they are required to issue a SSN to a K-1 holder.

You must get the SSN before your I-94 expires. Otherwise you will have to wait until you actually get you EAD or GC.

My fiancee signed her name on her G-325A form using kanji. This is the way she has always signed her name in Japan and even on credit cards here in the US.

K-1 Fiance(e) Visa Process & ProceduresSignatures on Supplements to I-129F
I think I just wet myself. I did not sign the supplement sheets. I assumed that since they were attached to the I-129F form, that the signature on the form also covers its attachments. I am going to be extremely mad at myself if I get an RFE on this.:crying:

I submitted a supplement for question 16 (Fiancee's name and address in her native alphabet) and question 18b (Description of having meet within the last 2 years).

I clearly stated on the top of each sheet "I-129F Supplement - Question XX"

I have no one to blame but myself. I must have read the instructions and guides 50 times, but that one sentence did not stick with me. I just looked back and sure enough it was the third sentence I read. :bonk:

I really hope that this does not turn into a major delay. :(

At least it is only the supplements. All other forms and letters have their own signatures.

K-1 Fiance(e) Visa Process & ProceduresI think I'm pregnant...

Thanks for the replies...

I'm not sure about my pregnancy because I haven't take the test yet but there are symptoms that I am and if I am, I'm 3weeks on the way. Of course, my fiance(the USC) is the father :P. he just left the Philippines on Jan 29th. :)

right, expedite will not be an advantage for this case because if pregnancy will be one of the valid reasons for expedite, then every one will impregnate their fiancees. :) and one probable disadvantage is that my fiance needs to satisfy the poverty level requirements for 3persons. b-( Just Hoping our petition will get approve before I give birth.:)

Many airlines either strongly suggest against or even deny air travel for women who are 7 months or later into pregnancy. Especially for long trans ocean flights where there is nowhere to land for a medical emergency.

K-1 Fiance(e) Visa Process & ProceduresI called USCIS for the first time today
I have called these uncaring and incompetent fools every other day since our 5 month mark on Feb. 16. They have been saying that they were working on Aug. 21 every time since then. I guess that it means that K-1 petitions are a low priority for them right now.

One can only guess what their highest priority is. Maybe taking naps, or going on long vacations during the winter months, or better still granting amnesty to illegal immigrants.

K-1 Fiance(e) Visa Process & ProceduresMy fiancee is pregnant and I'm about to submit the I-129F
First off congrats on the baby.

Secondly, I wish I had something better to tell you. But I see that you list the Vermont Service Center on your filing location. Because the VSC is so painfully slow, it is almost guaranteed that your baby will be born in the Ukraine. Most people at the VSC are waiting in the 6 to 7 months range (including us) right now for approval and it is getting slower by the day. When you actually do get approved, there is still a 2 to 3 month wait until the embassy interview for most countries.

So sit back and prepare yourself for a long and frustrating process. You will need every ounce of patience you have.

When the baby is born you should report it to the US Embassy. Since you are the father and a US Citizen, the baby will automatically qualify for US Citizenship and a US Passport. So only your fiancee will have to apply for the visa and AOS.Just make sure that you are listed on the birth certificate as the father.

Hang in there.

We were officially approved the 12th. So hopefully yours is soon. Don't let the congress people give you the brush-off. remind them your taxes pay their wages. This is what they are here for!! Stay in touch with them because apparently they can get more accurate information than the 1st tier VSC people. My congressman is actually the one that gave us the news on the 13th! I called today to double check, and the 1st tier VSC people said "no, you're still in initial review, wait 36 more days." :hehe: what?!?! Had to get escalated to 2nd tier to get accurate information. I got the text/email today on the approval.
Anyway... keep your head up and stay on your congressman!!!

We plan to marry at the courthouse the day after he arrives in order to file both the I-485 and the I-765 that same day. So he should receive this EAD in 60-90 days from then and be able to work while the AOS is pending. Right? Where does applying for SSN fit into that?

K-1 Fiance(e) Visa Process & ProceduresDo we have to wait for Packet 4??
I was checking out the embassy information for Bogota and it said that once you know the embassy has your case, immediately send them via email or fax forms DS-2100 and DS-230 before we even recieve packet 3 in the mail (since you can just download it anyway).

After that, can we immediately start working on the medical exam stuff by just downloading and printing packet 4?? Or is there a specific paper called "the appointment letter" that we have to wait for to proceed? I'm just a little confused on that. It would be great to be able to go ahead and get all of that done if we can.

Thanks for the info! Any tips would be great! :star:
