I had a sort of similar case. My case was forwarded to the embassy in Yaounde on January 26. My fiance was actually called and went to pick up his packet. When he got everything together (mid-March, because he had been out of the country), he was given an interview date of April 13. When he got there, he was told there was "no record" of him in the system. To make a long story short, I was told to call the NVC too, but they also told me that they embassy needed to notify them. The official story that I got was that there was a problem with the satellites and transmission of information. Whatever. The real trick is to get in contact with your senator or representative's office. My congressman's office was super helpful, plus I think my fiance then got a note in the file that they were following his case--couldn't have hurt this morning when his visa was approved :) Keep records of EVERYTHING--every phone call, email, anything. And keep on it. Call and email everyday if you have to, because the squeaky wheel gets the grease. Just make sure to be gracious; I found that people at the embassy were much more likely to be helpful when I complemented them on how nice they were. I don't think they would have been as apt to help if I had been a raving lunatic. Feel free to send me a message if you any more questions. Good luck!!

I was an au pair as well (10 years ago) and did also stay couple of weeks over the 12 months. It is "common knowledge" i would imagine that J1 visa for au pairs has a clause and also that we're not the first ex- au pairs that have gone through the K1 visa process, so i do hope there shouldn't be any problmes with this.

I don't think it means that your fiancé would have to go back to Ukraine and live there for two years - i think they just need to live outside of the USA following their departure from the States (expiry of J-visa). Basically if he was in the States for some time on J-visa he wouldn't be able to re-apply for the same visa and perhaps K visa within the first two years of his leaving the States. I would be worth to find a document to corroborate it though as i'm not entirely sure.

I think it's a wonderful idea and i'm sure your fiancée and her family will appreciate the opportunity to be part of your wedding celebration. As you said the church wedding is not recognised as marriage (even in her country) until official ceremony in the government/civil office, therefore i do not think it would be deemed valid/official by US immigration officers. This is how it used to work in Poland up to recently - now the wedding in church is reported to the civil office and deemed valid. I guess it would be worth double checking, whether the church would forward the information about your wedding to the government etc.

I am new to VJ but am very eager to learn more about the K1 process. My bf and I have been together over 6 months now and know we want to spend the rest of our lives together. We met while I was on holidays in Barcelona and have been doing the long distance thing ever since. He has visited me in FL and I have returned to Barcelona. Next step is for him to come to USA for longer . We plan him coming for 90 days at a time on the visa waiver while we begin the K1 process. Does anyone know for how long he must leave the country (USA)?? And will he be harassed by immigration upon entering for staying with his gf for 90 days at a time. ( He said they asked a myriad of questions when entering for 2 weeks!) How many times can we do this process before actually committing to get married? Any help would be greatly appreciated regarding VWP and K-1. Our bottomline is that we want to get married on our own terms and are willing to doing the VWP procedure until we are exactly ready for this comittment. If you rent(ed) an apartment together, a copy of that lease agreement would be a good start. Joint bank account records would be cool as well. Any kind of mail addressed to either or both of you at the same address might be helpful. Don't worry too much about detailed phone records if you can show that you are signed up for an int flat-rate plan. Private communication such as e-mails is nothing that you need to present either. Pictures of the two of you together would be good. Wedding pics?

Just bring what you have. Anything. I'm not sure thay they won't dig too awefully deep seeing that this is a long-term relationship (and that you're going through the Consulate in Fft). But testing the bona fide nature of marriage based on which you apply for the visa is precisely what you go to the Consulate for. :yes:

...and from all that I've read, that does not seem to be an option that's on the table from her point of view. Since it takes two to tango, seems that working towards his "desired" outcome would be a rather futile undertaking.

I still can't see how one can be that blind. Surely there were enough warning flags. Bright red ones. Hell, some were even on fire. :wacko:

We got the same thing, but a pink colored form. RFE for joint sponsor to send in current W2. We did not send it with the initial package. Our letter said the same thing about the EAD, but from what I gathered after calling them, they said the only thing that was delayed was AOS. Although my husband is still waiting for his EAD card and has had to stop working, as far as uscis time frames go, ours is processing normally. Hope this helps.

I believe uscis gives it a file number after you send them the paper work.
Alien registration number will be given to him once this whole process is done and they are going to give him a visa(unless of course he has been to the US before), until then he doesn't have one.

Ive researched a bit, and noted that the Employment Authorization Document can take somewhere from 30 to 90 days to get approval....but my question is....can you expedite this? I really need to work, earn some money, get out of the house, but most importnatly there are some really great jobs being advertised right now and i want to apply for them!!!
Can I somehow contact USCIS and get my EAD application expedited so that I can receive it within 14 days ????
(ps: I filed the I-130 and AOS docs on April 20, notice date April 24, NOA received April 27).

Hi Everyone - this question concerns the Biometrics. I heard from a friend that, you can actually go to get your biometircs done BEFORE the date that USCIS gives you, and you may not have any problems, rather this will most likely help speed things up. Is this correct?
I am still waiting on my letter telling me when my Biometrics is to be done - do i really have to wait til that date? or can i go earlier?

Hi All.

So just a question - I have received a letter requesting for the initial interview for me and hubby to go - scheduled for August 4. HOWEVER i still havent received my EAD or AP. And on the USCIS website they havent updated anything - nothing has been touched (not even showing that they have sent me the letter for the interview!).

Is this normal? blink.gif Im freaking out that perhaps they wont give me the EAD or im lost in the system! Has anyone experience this?

I placed an expedite request today because of the major earthquake in Japan. My fiancee is fine. Her region was not badly damaged. The size and devastation of this earthquake was truly horrendous. Besides the people killed or left homeless, this will be a serious blow to their already stagnant economy. I pray for those lost and those who will have a tough time ahead of them.

My concern for our case is if this expedite request will be denied because her city was not badly damaged and if so, will that have any negative effect on our case. Does anyone have any thoughts

BTW we have already been waiting for almost 6 months since our NOA1.

Standard boiler plate, USCIS is simply keeping the wording simple, they neglect to indicate it is being sent to NVC first, and NVC takes care of sending on to consulate.

Since there is no interaction between petitioner and beneficiary and the NVC, for all intents USCIS is sending it on to the consulate "through" NVC.

I received the approval letter today (dated March 30). I have a question about a statement in the notice.

It reads " The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about visa issuance, or if you would like them to forward the petition to a different consulate."

Shouldn't it go to the NVC first, or is my case different because I have a congressional expedite? Nowhere in the letter does it mention the NVC.

Any thoughts?

We are comming up on our Embassy interview (June 6). I am now looking at airline tickets. I am seeing that one-way tickets for my finacee are about 50% to 125% more expensive than round-trip tickets for me on the same return flight.

So you filed as married for 1010 even though you are not married yet? I am not very familiar with US taxes, but wouldn't that be defrauding the IRS by lying? If so, yes that could cause issues.


No no no, I filed as single for the 2010 tax year. I will be getting married this year, so next year when I file my 2011 taxes I will file as married. My taxes will be much lower so I decided to change my tax with-holdings from my pay check for this year.

My concern comes from my marital status being writen on my pay stubs as "Married".

My fiancee's interview is in a few weeks (June 6).

Back in February after I filed my taxes for 2010 I had a very large refund. Instead of allowing the government to hold such a large amount of my money over the course of the year, I decided to change my taxable filing status from "Single with 1 exemption" to my anticipated filing status for 2011, "Married with 3 exemptions" so I could take home more of my pay check.

My paranoia has set in and I am worried that some paper pusher in the Embassy will pick up on this and reject us without even asking any questions.

Should I include a letter explaining this, and by doing so draw attention to it? Or should I just stop worrying so much?

Any and all thoughts are welcome.

Ok the good news. My finacee has the VISA in hand.

Now the confusing part. The VISA has a different A# on it than what was on the NOA2. She called the embassy in Tokyo and asked them about it. They told her that it would not be a problem and there was no need to change it.

I have heard horror stories from people on here about the problems caused by mistakes on the VISA. Most of those mistakes were name misspellings. This is the first time I have encountered a difference in A#.

Does anyone have any thoughts on this?

Finally we are together. The POE in Washington D.C. Dulles airport was very quick and easy. Tomorrow we will go to the SS office to apply for her SSN. It has been a frustrating and slow process, but being together makes the rest of the process much less difficult.

I have one question for those who have also made it through the POE. Did the immigration officer attach the I-94 departure card to you spouse's passport? I though that is what was supposed to happen, but our officer just handed it to her loosely. Should I just go ahead and attach it myself? I am afraid of loosing it because it is so small.

hi guys, yeah we got our NOA2 reminder thru e-mail but have not received the hard copy yet. my fiance is very worried because of the uncertainty of our situation here in Japan. because of the radiation and random earthquakes we get almost everyday he requested an expedite and had it approved after a week or so. i am currently not in Tokyo cuz of the radiation scare but may be force to go back since i need to get back to work.

Don't get me wrong, I am happy that you made it through but I had my expedite request denied. I am freaking out over what is going on over there, but the USCIS refuses to do anything about our petition and we have been waiting for over 6 months too.

J&K, I have around 12 petitions for the case status update, the ones with the same NOA1 date as mine Sept 15th. All last touched 10/03 before today. 3 of them were approved, leaving out 9 awaiting for action. Thats to your question about not yet approved Sept petitions. Its awful how they do it at VSC, but looks like they ve been entering the updates only today, while bunch was approved last week... we filed service request on friday and heard today, might be a coincidence maybe no, but call them if you havent yet... Good luck!


I have called countless times. I've spoken to the Tier 2 people many times. I've placed an expedite request because of the Japan earthquake/tsunami/meltdowns. I contacted both of my senators and my congressman. I've contacted the Ombudsman. I have also emailed the USCIS National Headquarters. I have done everything I am legally allowed to do.

So far nothing is working. I was especially upset when my expedite request was just flat denied. Japan has some serious problems right not. Because I filed an expedite request they will not allow me place another service request until mid April.

I do not mean to point my anger and frustration at anyone here. I am just in desperate need to vent my despair.
