When you petition the boy for an IR-2/CR-2 visa, the sponsoring relative will have to prepare an I-864 for him.

So assuming your husband, down the road, will meet the poverty guidelines for a family of 3 (you, him and the boy), then he may file the I-130. Otherwise, you can file the I-130 as the boy's stepmother (since you and the boy's dad married while the boy was under 18 years old).

Thank you for your prompt response. I did list my fiance's child on the I-129 F petition. Yet, it seems that one year (K2 to follow) would be too soon for the child to permanently move in with us since we are both thinking mostly of visits and vacations, for at least the first few years of our marriage. If we decide to file the I-130 on behalf of the child after we get married (and more than a year after my fiance receives his visa), who would file the paperwork? I, the US citizen, or my husband?

hi, i need some advice.to start with. the heading of this topic is to only catch the attention. i did not kill my fiancee for the record.

please help me with the girlfriends situation.

She was married before to an american while she was working in korea. They got married in korea.
he got her a visa because of that. but the marriage did not last for long and she went back to phil.
before they have filed the divorce, the ex husband luckily have processed her immigrant visa.
while she was in the philippines and did not know that she has an ongoing immigrant visa, she got married
again here in phil to a filipino. the marriage did not last very long, for only days ( i know it sounds very ridiculous )
she left thet guy. and few days after that, she learned that she already have an immigrant status..
she flew back in the US. she then again got married even if she was still married in the phil.
the relationship lasted for 9 years.. they got separated and filed a divorce. technically shes now single in the US
but she has also an ongoing annulment case in the philippines for almost 10 years now.
the anulment process is almost at the end but we felt that the ground for nullity is very suttle.
i would like to ask your opinion regarding this sensitive matter., Just in case that her anulment will be deny,
can she still be able to petition me via fiancee visa to the US knowing that she is technically divorced in the US but has a valid marriage her in phil?

Doesn't matter if you write it or prepare a label for it as long as the information is legible (read easily).

What do we write on the envelop in which we place the folder for the k1? Do we use labels or just write on the envelop itself?

Hi fellow VJ'ers,
I want to file a change of address for my fiance who is not in the US. So the AR-11 is out as it only prompts for living in the US.
I saw another post that a letter to your respective service center with receipt#, former address, current address etc......
The problem is .... Where do I find the address to send this letter to?" It is Vermont Service Center and I have looked and looked and just became more confused.
If anyone has a link or knows the address that I should use, or even better information that I can view, it would be greatly appreciated.

In case they lost anything, having extra copies of the application and supporting documents on hand save you time when they request for another copy. If you don't have them on hand, they will either ask you to come back or mail/courier items to them...which delays the visa issuance.

Also, in preparation for the interview, you should be familiar with the information that appears on the forms, and what documentation was submitted. Sometimes questions are based on the forms, and if you need to clarify anything, then you know what was sent or written/typed.

This is possibly a silly question, but why Make TWO copies of the entire package?
I understand one is for security reasons, in case it gets lost in the mail, but for the interview, will I have to hand over an exact petition package replica besides all of the originals? (like my divorce certificate, k2 birth certificates, etc.)

Pick an address and stick with it. Ideally it should be where he can receive his mail reliably, and where he will be able to attend the interview and get his medical examination completed.

He's insisting on Morocco, though it seems to me like it would be easier coming from Italy. I just don't want to be dishonest on the forms, or have it a reason for them to deny us because we were "dishonest" when we really just don't know what is the more honest answer!

That only applies if someone else, like a lawyer (preparing the form for a client) or a parent (filling up for a minor child) is filling out the form. if you are filling out the form yourself, you can put N/A.

Yes, the corner is usually cut to expose part of the documents (only the Embassy is allowed to do this). Any other cuts or tears are not ok...big no-no to open it up yourself.

Unfortunately, there is no module to help you download call logs.

What I did was I scrolled the list for selected call times to be displayed, pressed the Ctrl button and PrtScr button (Print Screen) at the same time (this is important), then opened a new Word document and pasted the image captured. I scrolled down to different dates and times (and captured them using Ctrl PrtScr) to show we talked to each other on many separate occasions.

Texas is the drop off point, California is the service center that is processing your petition.

What do I put for my service center in my timeline? I put Texas, because that is where everyone mails it now. But my NAO1 came from California. When I looked at the timelines of other people, some put Texas and others still put California or Vermont even after the change. So I am confused. Do we all put Texas now? Or do we put which service center they send it to?

If you can get Adobe Acrobat (not the reader), then you can be able to open them and save the information.

Otherwise, try downloading PDF995.

What it does is it converts any file into a PDF. You can fill out your form and then "print" it as a PDF (when you're ready to "print" it, select PDF995 as your default printer, then click on Ok, as if you are printing a document on your printer)...the only hitch is you cannot edit the form...but all the data you typed can be saved.

Is it possible to save forms DS-230 and DS-156K on your computer? They download just fine, and I can save them to my computer. But the forms always remain blank, and a message says that if you can't save any data you enter and should instead print it. It's a major hassle, as we don't have a printer at home.
Any advice?

You don't have to report it now, but when you get to the Embassy part of your application, in the affidavit of support, it will reflect his new company (if he decides to switch jobs). As long as he will still meet the poverty guidelines, it should be ok.

I have a question to ask. My fiance has an opportunity to change his job, but we already sent in the I 129F package with information about his old job. We got our NOA 1 and now we are waiting. We were wondering on how this may influence the whole case? Do we need to report the switch of jobs to USCIS? And if so, how do we do it and how it may affect our case? Will it make it slower?

After he has found a more permanent address, he will have to report the change in his address (especially if there is an ongoing petition).

Hello everyone,
We are filing for our K-1 and the space for our answers on the forms I-129F and G-325A is too little for our long addresses and names... We are attaching additional paper sheets to the forms (with heavy clips) as we were told to do in the instructions. Yet we feel there is lack of important information about how these additional sheets should be done!


1. We are writing them on microsoft word. Do we need to use a specific font or size?


There's no specific size. But for readability, I would recommend font size 10, 11 or 12. (Depending on what font you use, a size 10 Arial Narrow is too small...but if you use Tahoma or Verdana, it's ok at size 10).


2. These sheets have to be named. I read they should all be called first "I-129F Supplement". Do I put a number after that? We have about three of them. Then on the next lign I would naturally write: "Form xxx, Part A, Question 1: [full name of the question]." "[Then on the next line, the answer.]" Is this the right way to go?

The top of the form, ideally, should display the name of the petitioner and the beneficiary.


The rest of the information you are planning to put in is a great way to go! :)

What about the Cover letter's Contents -part, should we just list them as "I-129F Supplements 1, 2 and 3", or should we write the full questions there? Like this: "I-129F Supplement Number 1 - Form I-129F, Part B, Question 1: Name of alien fiancée."


No need to get into too much detail, you can just list them as Supplements to the I-129F or Appendices to the I-129F and indicate the number of sheets you used.

3. We are asked to date and sign all the sheets. Sure, but does it matter in which way? Horizontal, vertical? First signature, then date, or the other way around? Any ideas?

Signature and date at the bottom right is common.

Okay, I feel like I am being way too pedantic now. Perhaps there are no instructions at all for this and everyone just does something and they are ok with that. But I want to be sure that nothing goes wrong. Please try to understand and thank you in advance! :)

Just so you know...you can also handwrite information that doesn't fit in the spaces (if you don't want to deal with extra sheets)...this is allowed also. Just print the form with the typewritten information, then write down the answers in the blank spaces where you couldn't type the information previously.

USCIS needs a few days to inspect your package and see if everything is in there. When they've determined that the package is completed, then they will inform you by e-mail and/or SMS (if you included a US mobile number in your G-1145) that it is accepted for initial review.

So was it a stupid move to mail in my application package during the holidays? I sent mine on Dec. 27th. No email notification yet. Does this increase the chances my application will get missed or ignored? Maybe I am just being too anxious.

From checking out other people's timelines and some recent posts, the check is cashed a day or two before your NOA1 is sent.

The e-mail notification is merely that....your application package was received in the mail.

If there is a problem with your check, the entire application package will be returned to you and you will be asked to send it again with a new check. When that happens, in your cover letter mention the circumstances why the previous check was on hold.

Hi All - I can't seem to find a definite answer to this question. Does USCIS cash the check first or send the NOA1 first?

The reason I'm asking is because I sent my K1 application on Dec 24th and it was rec'd in TX on Dec 27th. I just rec'd the NOA1 email notification this morning but don't see the check has cleared the bank.

And now I'm worried b/c I am out of the country and my car was stolen while I've been away. There were blank checks in my car and I had to call my bank and have them freeze my account until I get back. Therefore, no funds can go out at this time. And my online access doesn't show the USCIS check has cleared my bank at this time.

So I'm just a bit worried. Should I contact them and see if I can overnight a new check to them? I just don't want our packet to be returned due to this.

Getting the paperwork and the forms together can be daunting, but you can definitely do it on your own...we initially hired a lawyer, but not only did they take their sweet time doing everything, they actually gave us incorrect advice, which set us back about 5 months.


Everything you need to know to do it yourself can be found on VJ.

It's a big/long process but I found it to be pretty easy and fun.

I am really lucky to have found this page and to know that i am not alone on this.
My name is Eliana and I am from Argentina, with my fiance we are just starting to fill the I-129F application.
When we filled the forms G-325 and printed them the it does not show the whole date.Its like the last number of the year is missing in the form.so it will print it like 01/07/201 intead of 01/07.2011.

Just type it as 1/7/2011 so that the year can be seen as a whole.


I know its a problem of the form and I am using the forms of the uscis offical site, I dont know what to do because our package can be denied for somethins like this.
Other thing I was following step by step what we have to send with the I-129 F but i want to be ready for when we get the NOA2.
and I am worry about the I-134 form, my boyfriend in the last years was working in unestable jobs so he did not pay taxes before june 2010.
In June 2010 he got a good job, he already got a raise months later in december 2010. and he is paying taxes now.
His income is of $24.000 a year right now. And in about June or July he will get a bonus of $6000 and later in December another raise.
He does not own a house and he have 3 kids,who do not live with him but they are dependant.
Well I know he will do better every year, because he already got a raise not even a year after start working,and he will get a bonus next june-july and other raise by the end of the year.
But i am afraid that him having an income of $24000 a year with 3 kids+me+him= 5 people won't be enough, plus he hasn't paid the taxes of the last years.
He thinks that with his income and knowing through the years he will do better at his job is enough,and that we do not need a co-sponsor, but i know we do.
So I would like to know if the taxes thing will be an issue??
If what is the minimun income he should have for 5 people?
and if we do find an sponsor con be this sponsor be a friend of him.(He doesn't have family).
If my fiance's friend help us, does my fiance have to be the sponsor and his friend the co-sponsor?
If the answer is yes, do they have to file the same form (I-134)????

My English is kind of broken but I hope i made this understable.

Did you submit a cover letter with your application package, or a checklist indicating what the copy of your passport stamp was for?

If not, the worst that could happen is that they ask for your biographic page...or other proof like plane tickets or boarding passes.

Even then I wouldn't worry about it.

When I submitted my I-129F I sent a copy of my passport stamp to Mexico, but did not include the biographical page. Will they not regard my passport stamp because of this?

Just to not be confused, I did send a copy of my birth certificate. The issue here is proof of having met, NOT proof of being a US citizen.

That refers to a situation where your parent(s) obtained citizenship through naturalization, and they filed an N-600 for you (as a minor), to secure a Certificate of Citizenship.

If you applied on your own, then it doesn't apply to you.

Need help in answering question number 10. I am a naturalized US citizen so I checked the "Naturalization" box and wrote the number of the certificate of naturalization, date and place. What is the second part of the question referring to?? "Have you obtained a certificate of citizenship in your name?" US Passport is not the same as "Certificate of Citizenship" right?

You can request for IRS tax transcripts for free (in case the USC petitioner cannot produce tax returns). Tax transcripts don't require W-2s. If your fiance(e) is currently employed, then you'd need am employment letter (the format is discussed in the guides) and 3 pay stubs. Best to get these ready close to the interview date so that the information is current.

I may be getting ahead of myself here (I have yet to take my medical) but I understand that I need to show proof of support in the form of an I-134 or I-864? Which form is the correct one to take to the visa interview? Is it sufficient for my fiancee to provide just 2-3 paystubs and a letter from her boss as proof?

Yes, I agree, it has nothing to do with the K1 visa process, but it does matter when you are adjusting status, since you are proving intent to live in the US permanently.

I don't understand why buying a return ticket would be an issue at AOS. Whether you arrive by air, land or sea - with or without a return ticket is irrelevant. It has nothing to do with the visa or the process. If you don't turn up for the return flight the reservation is automatically cancelled by the airline.

Thank you for this and just one other question if you dont mind, I am divorced and have a copy of the Divorce Decree, i have read this should be a certified copy. Can you confirm if the one sent with the I-129F should be certified or just the one for the interview?

Photocopies will suffice, no need to have them notarized; they are extra copies for you to keep in case the USCIS loses something, as well as for your fiance(e) to review so s/he knows what has been submitted. The packet will be forwarded to the US Embassy where you fiance(e) is based.

I am about to submit my I-129F packet and have made 2 copies of the entire packet, should i or do i need to have the copies notarized as true copies of the originals? Also does the USCIS send me the entire original packet back and then i have to send that to my Fiance?

Doesn't matter which state you are from, the Texas lockbox is merely the drop off point for all I-129F petitions (for a K1 visa). From there it will be forwarded to the service center that will process the petition (which is either California or Vermont).

Can somebody tell me if i sent my K1 petition to the right service center? I live in California, but the UCSIC webpage is telling me to send it to Texas.

On the spaces provided in the forms (Other Names), list your previous married name...it will be part of the background check.

When filling out the I-129F and G-325A forms it has Family Name...Do I put my maiden name or my ex-husbands Last name?

I'm a naturalized US citizen...So on my certificate of naturalization, I have a "A#". Is that what they are referring to in question 8B of the I-129F? Obviously my fiancée doesn't have one since she's never been to the US or ever has applied for any visa so I wrote "none" for question number 9 in Part B.

If she has had any major surgeries, she would retrieve that information from the hospital that provided her treatment.

If she was ever treated for tuberculosis, she needs to present proof that she was treated and for how long (she can also retrieve that from the doctor/hospital that treated her).

If she needs vaccination information and cannot get a hold of her former pediatrician, she doesn't have to worry. The clinic will determine what vaccines or booster shots she needs based on her age and gender. She just has to remember if she has ever had measles, german measles, mumps, hepatitis A or B, or chicken pox.

my fiance originally from the philippines now living in japan for the last 10 years....her mother died when she was young and was raised by an aunt who had a stroke...she has no idea where to get her medical records from...will this be a problem???
