In the CR1 process (I say CR1 now because you guys have been married for less than 2 years...a CR1 visa is for spouses of US citizens that leads to a conditional green card after your spouse enters the US), your spouse does not undergo medical examination until much later in the process...and the I-693 is not used at all. The I-693 is for K visa holders who are adjusting from temporary resident status to permanent resident status; the form is filled out in th US by a designated Civil Surgeon, and is placed in a sealed envelope for submission with an I-485 application (for adjustment of status).

I suggest you give it a read then if you have any questions, feel free to do a search here, and if you cannot find the answer, post a question in this forum.

Based on what little information you have provided, you and your wife are still waiting for the NO2 approval notice for your I-130 petition. You may want to update your profile and your timeline so that other members may be able to help you better.

Even if you are currently unemployed, you still have to fill up an I-864 form; you will need a co-sponsor whose current income meets the 125% poverty guideline requirement. There are different I-864 forms depending on the petitioner and co-sponsor's situation...am sure the other members can help sort this out with you.

If you are planning to bring the children with you, the younger child (below 18) needs a separate I-130 petition filed; in this case, you may file the petition in a stepparent-stepchild relationship since you married this child's mom while the child was under 18 years old. The older child will have to be sponsored by his mother after she arrives in the US; you cannot file a petition for the older child because s/he was already over 18 when you married his/her mom.

We have been married for about 6 months. I'm not sure what to do now. I really hate to take a risk and make things take even longer but on the other hand I'm worried about getting the process done living over here and not in the U.S. Is that even possible? I'm going to try and talk to someone at the embassy tomorrow. I'm going to need a co sponsor (my mom) if they won't accept me being unemployed but my taxes will show an income above 125%. Not enough assets to get above 125% for three years with 4 household members. (two children from another marriage, one is now over 18 but from what I read the age has to be over 21)
So filing the I-485 is out of the question? An attorney is the one that told me about this during a phone interview. Is he wrong? Maybe he was confused as to where we were living? I'm not cancelling I-130 petition filed in the U.S. until I find out the best thing to do.

Today was another surprise. We flew to Jakarta for the medical exam and vaccinations but they did not recognize the form I-693. They showed me another form that they said the embassy has them fill out regularly and it's updated June 2010 so I let them use that form since they seem to know the system. The doctor said that he can't give me a copy of what's in the sealed envelope. Only the lab results of the tests. I am told that the exam will be valid months from now for the interview and to pick up the envelope the day before it. The doctor said that even though I'm jumping ahead, there should be no problem. She had an xray and it looks clean. I'm not expecting problems unless he filled the form out wrong.

You may just want the current I-130 petition to run its course. If you have the NOA1 already, you cannot refund the fee. If you are decided in pursuing DCF there, you may want to check first how fast they are able to process the I-130 at the US Embassy in Jakarta...also if it takes too long to put the brakes on the current petition, then you will have lost time as well as the fee you have already paid.

If you guys have been married for less than 2 years, after your spouse enters the US, she will be issued a conditional green card, good for 2 years. Within 90 days before her conditional green card expires, she must apply for removal of conditions.

If you guys have been married for 2 years or more, after your spouse enters the US, she will be issued a regular green card, good for 10 years. No need to file for removal of conditions.

In either case, she may apply for US citizenship 3 years after receiving her green card.

I think I understand now, thanks. I think it's best that I somehow cancel my current I-130 and file with the embassy here. I should qualify since I've been here over six months and now have a KITAS. So by taking the CR-1 path, which means file the I-130 again with the U.S. embassy here, she would get a green card at POE right? Good for 2 years? And then apply for AOS? According to an email from the embassy here, their process is expected to take six months to complete.

Do I send a letter to Chicago to cancel the I-130 or call? Would they refund my original fee?

If you want to claim your spouse on your taxes, and s/he doesn't have his/her SSN yet, you can submit your taxes with an application for an ITIN (with your spouse's information; supporting documents need to be attached). You won't be able to file electronically, however...this stuff has to be mailed. You can visit the IRS website for more information.

I just noticed Timeline Data moved back a month.. It went from 3-11 to 3-25 now it's 3-21 to 4-15
Hmm just when the IRS has its deadline.. I just was able to sign into with USCIS registration number so this also probably udated..

If you get married in Canada, then you will become ineligible for K1 (which is for applicants who are planning to get married in the US). You'd have to file for CR1 after you are married.

You're a US citizen, you'd just need to present your passport at the border.

Illegitimate children are under the custody of the mother. If your fiance wishes to secure a visa for his daughter, he will need to secure Travel Clearance from the Department of Social Welfare and Development (DSWD). On their FAQ section:

CAN A TRAVEL CLEARANCE BE ISSUED TO ILLEGITIMATE CHILDREN WHO ARE STILL APPLYING FOR THEIR VISA IN THE EMBASSY?

Illegitimate children are under the custody of the mother. If they will be traveling with the mother, they are not required to secure a travel clearance from the DSWD. If they are traveling with person other than the mother, they must secure a travel clearance.



In case the mother refuses, there really isn't much he can do, except wait for his daughter to be older. Since you both will be marrying while the daughter is under 18, in the event that the mother changes her mind, you (in a stepmother/stepchild relationship) or your husband may be able to sponsor her as a permanent resident later.

The daughter's name should still be mentioned in all his USCIS and Embassy forms for that to be possible, even if she is unable to join her father for now.


Hi,

I seem to be a bit outnumbered. Wanting to know if there are any Female Petitioners on here, marrying a Filipino? My fiance has a child. He was never married to the mother, but has had full custody of her since she was one (she is now almost 5). There is no custody agreement, but the mother will sign a letter stating it's ok for her to come to the US.

Are single fathers under more scrutiny regarding his paternal rights? Do you think they will question the child's paternity? He has her birth certificate listing him as the father, but it was only recently registered? What kind of back up documentation do you think they will request?

I'm just trying to get an idea so we can start collecting any needed documents now. We're very close to receiving our NOA2 (hopefully) as we are approaching the 5 month mark.

Thanks for any and all help/advise. Would especially love to hear from other female petitioners.

Who is supposed to fill out form DS-230? I see some K-1 filers asking about filling out sections and it is listed in the K-1 section of the guides but is not listed as a required form on the Manila interview packet. Just need to know as I get my paperwork ready to send to my fiancée.

The first thing to log in is to go here for the start page:
Provide
a) the beneficiary's Passport number
b) the case number from the letter you received from the embassy saying you may schedule an interview (MNL000000000)
c) the beneficiary's Date of Birth
d) A password of your choosing (Password requirements)
e) Enter the same password again to confirm
f) Enter the security code as you see it in the image
g) click the Proceed Button

REMEMBER YOUR PASSWORD! YOU NEED IT TO OPEN THE APPOINTMENT LETTER THAT IS GENERATED BY THIS WEB SITE!

Now it asks for more information about your case. i don;t remember exactly the layout but there are a few pages you navigate through. They ask this:
a) Beneficiary's first and last name
b) Beneficiary's complete mailing address
c) Beneficiary's phone number(s)
d) Beneficiary's Nationality
e) Beneficiary's current country of residence
f) Where beneficiary's passport was issued, the date it was issued and the expiration date

I think that was all I had to enter.

Then you press Proceed again after entering all of that information and it will ask you if you want to save and come back later or continue or to add someone else (i.e. children) to the interview.

My fiancee has no children so I pressed Proceed or Continue (can't recall the exact name)

Then you can choose a month to schedule your appointment. There were 2 days left in December as of last night.
Then you can click one of the open days. The calendar is normal calendar grid that is color coded to indicate which days are open for scheduling an interview. You can't click on the other days.

Once you choose a day, then you see the time slots available. I clicked on every day in January and they all had the same 2 slots open. 6:45 am and 7:15 am. Choose your preference.

Click Proceed again.

You are confirmed that your interview has been scheduled. There is a link to click on to see the appointment letter that you need to print. Clicking the link will take you to another page that has a big button to download the PDF file containing the one page letter with:

A) Your UID and a bar code
B) Beneficiary's name passport number and address
C) The date and time of the appointment

The letter is called at the top:

MANILA

There is a US Department of State emblem at the top.

just want to ask to the members if anyone in here get a police clearance from malaysia? i work before in malaysia last 2001-2003 i do think that i had to submit a police clearance when my interview came is that right? i use to work in malaysia when i was still single now am already married to a wonderful american husband..we dont have a sched yet on my interview because we are still on second stage in which after 15 days we are going to have a NOA from NVC. i just want to be prepare all the documents. my question is if i ask a police clearance from malaysia do i have to ask use my single name or my married name? please give me some idea and where to get a good moral conduct? i dont havea good relation on my previous boss.. can i ask a good moral conduct from the malaysian embassy in manila?

When you are ready to get your CFO sticker (meaning hawak nyo na ang visa ninyong dalawa/visa is in hand for both of you), you just have to register her at the CFO. May form sila that you will fill up (There is a form you have to fill up). Kung ano ang fee mo for the sticker, yun din ang fee niya. (Whatever your fee is for the sticker, that is also the same fee you will pay for hers.)

Age difference is rarely a concern, especially in your case :) St. Mary's peeps are pretty easygoing...just present divorce decrees/annulment papers, and there should be no issue. As the previous poster mentioned, it's a one-stop shop, she can get the guidance counseling requirement completed at St. Mary's (she will receive a blue certificate) then walk down the CFO satellite office at the back to get her CFO certificate (green) and sticker.

I've recently been reading a lot of posts about the 3 CFO seminar locations since my fiancée's interview is coming up soon. I've read about bad experiences in Cebu but haven't found any detailed good ones. Has anyone been to the CFO seminar in Cebu recently? I'm trying to decide whether it would be better for my fiancée to go there since she lives there or Manila since it is faster. I've also heard that PRISM is less stressful than the two that are run by the nuns. If she goes to PRISM, she'll go while she waits for her interview and then get the CFO sticker once she gets back to Cebu. It would be easier to do it all at once in Cebu and not have to face the stress of attending a seminar prior to the interview; however, if the Cebu seminar is really as bad as some people made it sound (interrogation, additional documents required, all day seminar), then I'll send her to the one in Manila. Any advice is appreciated.

I should add that neither of us have ever been married and are only a year apart in age. I'm wondering if they ask people more questions if one of them has been divorced or if there is a large age difference.

oh and about the age difference I don't think they would care at all :) as I've posted earlier it's like talking to a friend :) they are very friendly and accommodating :)they ask questions with a smile on their face :D so about the divorce thing...they will just ask when did he filed the divorce?, what year? does he have a kid with his previous marriage? why it didn't work? questions just like that. I suggest just wait for her to get her visa since the CFO seminar can be completed in less than 4 hrs. ;) then she will have everything that she needs when she leaves the compound :D the 2 certificates and the CFO sticker.

Yup, and I wouldn't worry if she couldn't secure all of her vaccination records. St. Luke's will determine based on her age what appropriate vaccines (booster shots, likely) she will need before she leaves, and they will advise her if she needs any more done when she arrives in the U.S. Usually she can get those additional shots through the state health department or through your personal physician (after she is covered by your insurance). She will need to get those done before she files for adjustment of status.

yes vaccination is included in the medical fees..which is about 9800thou...213.35usd..

Oh my goodness, ang pogi naman ng batang yan :) Ganda ng ipin!

@ chinese_mutt: baby mo ay kagaya din ni Ethan nung baby pa sya, he used to drink from his baby bottle until he fell asleep kasi ayaw rin nya sa pacifier. I also read some articles saying na masama daw 'yun sa teeth nang baby pero talagang nasanay si Ethan kaya minsan before pinapagod namin sya sa paglalaro para makatulog..hehehe. Pero 'nung nag 1 year old na sya I switched to sippy cup medyo it took 4 straight days without baby bottle bago sya nasanay. Wala namang problema sa teeth nya ngayon kasi nung nag start syang magkangipin eh I bought a tooth brush and toothpaste for baby.

@SomedaySomehow: salamat po sa compliment! ayaw na nyang magpasubo ngayon gusto nya palagi self-feeding. Most of the time talagang messy pero ok lang kasi dyan natututo si baby to be independent.

You may want to learn the Heimlich (sounds like hime-lick) Maneuver...it's good to know so save anyone from choking...there's a specific method to apply that on infants.

Waaaahhh!! Iniwan ko si Zac sa crib nya while nandun lang naman din ako sa room nya pero naglalaptop ako. Napansin ko tahimik cya so chineck ko cya at nakita kong may hawak cyang stick ng lollipop. Hinanhanap ko yung pinakacandy ng lollipop tas ang nakita ko na lang is yung wrapper at yung stick ng lollipop na hawak nya. Tas check mo yung bibig nya baka nachoke, thank God hindi naman tas yung hininga nya amoy candy so I am thinking nakain nya yung lollipop. Chineck ko talagang mabuti yung crib pero wala kahit isang piraso o yung durog ng candy. Hindi ko tuloy alam kung paano nya nakain. Malamang nadurog ng ipin nya?? Kasi yung crib nya malapit dun sa diaper organizer na may mga candies din. Naabot na nya yung mga candies dati naman kasi hindi pa eh. Ok naman cya. Naglalaro now with his cousin. Waaaahhh!! Nakakakaba, paano na lang kung nachoke cya :(

Some insurance company considered pregnancy as pre-existing condition, when I was 18 weeks pregnant my husband trying to add me in his insurance as supplemental for me because I had my own insurance from my job covered with maternity but its limited, but they won't allow him because I'm already pregnant, so how much is the cost of the C-section without insurance?

Am at 32 weeks and my husband just added us to his insurance policy last month. He approached the woman handling the account and asked about adding me and our daughter after we got married in Jan 2009...he could have done it then except we were not in the U.S. yet (we only arrived here Oct 2009), and it seemed silly to add us when we could not avail of the benefits anyway. He approached the insurance company again in Oct 2009 but was told to wait for open enrollment (Aug 2010). :(

When I had my daughter, it was via C-section...what do you guys think are my chances of the insurance company covering the cost...will they treat this as a pre-existing condition? Since we (our daughter and I) were not on the policy when I first started seeing the OB for prenatal exams, we have been self-paying for normal delivery (the thought of going through with that just terrifies me, and I really wish I could have a C-section instead)...any suggestions on what we can do?

Just go really early...their cut-off time is between 7:00 a.m. and 10:00 a.m. Bring a copy of your U.S. divorce decree, your passport, and the fee. The certificate has to be presented to the municipal hall where you guys are planning to secure your marriage license.

I have no idea how long your visit will be, but ideally it should be the first document you get when you arrive...marriage announcements at city hall have to be posted for 10 business days (excluding public holidays) before they will grant you a marriage license.

I believe you can do the same if you resided in Singapore for 6 months or more and are no longer a resident there. One of my clients was a Toyota mechanic who worked there several years back and he got his police clearance via the Singapore Embassy here in Manila.

Typically if you have lived anywhere in the Middle East countries or even in UAE, it is difficult to get police clearances there when you are no longer living there. Never known anyone to try to get a police clearance through their Embassies in the Philippines, though...perhaps someone out there has that experience also?

The OP discussed how difficult it would be for his wife to secure a police certificate from Korea, since she is no longer a resident there. Bonksnp suggested that in lieu of getting a police clearance from Kuwait (which is another country that is difficult to secure a ploice clearance when you're no longer a resident there), they submitted a letter of hardship.

The USEM requires an applicant needs to secure a police clearance from any country outside of the Philippines where s/he lived for at least 6 months or more.

Well I used to work in kUwait and I didnt get the police clearance because in my case I should be personally presence to get the police clearance. We wrote a letter of hardship instead.

Do you have to submit the letter of hardship? Or is this a one pager stating it will be a financial burden? Then just bring it to the interview?

Did they even ask for the police clearance? I thought they only need the NBI clearance?

Am so sorry you guys are experiencing this. :(

When someone's NBI Certificate states No Criminal Record, the person in question (your fiancee) has to request from the NBI a letter explaining what the notation means, and your fiancee also has to produce documents showing that the charges were dismissed. She will need to contact NBI to find out what they need to help support that letter. From what I remember, it shouldn't take long to get it straightened out (I didn't undergo it, but know of several former clients who have).

I agree, St. Mary's in Katipunan is so much easier to deal with, no appointments needed, you can walk-in anytime during their business hours. They have a CFO Satellite office at the back so you can get your CFO Stickers and Certificates of Attendance the same day (basta you have your visa with you already...or else they will ask you to return when you have the visa).

I live here in Tallahassee, and so far I have met a few Filipinos (one from VJ, a very nice girl, we just haven't met in person yet). There is an active Filipino association here, but I have not touched base with them yet. Wala pa kasi akong driver's license so hindi pa ako masyadong makapasyal. Ayaw ko namang i-bother ang husband ko masyado especially the weekends, kasi he works long hours during the week, deserve naman niyang mag-relax. :) Plus I am pregnant (over 7 months na), so I don't go out much.

The Filipinos I have met so far have been nice (on the surface)...no idea if they're anything like the other Pinoys and Pinays I've heard of na may amnesia. :P lol Sana naman, hindi. :)

Hello I hope this is the right forum.....My fiancee is from the Philippines but working in Hong Kong, and will be going thru the visa process in Hong Kong. My understanding is the embassy in Hong Kong requires you have too wait until after the packet 3 is filled out and you recieve packet 4 to schedule the physical and make appointment for the interview. My question is since we have the case number from the NVC and verified the packet was sent out today, can we go ahead and order her CENOMAR we have heard it can take up too 6 weeks before it arrives to the Embassy? Or will this be premature if the Embassy hasnt recieved the case yet. Thanks in advance

When I was at the hospital, one of the nurses came to help us with our daughter's birth certificate and getting her social security number. We got it in the mail a few days after I was discharged.

Call the hospital and ask them if a SSN was requested for your child. Also, ask them what is their practice in helping obtain SSN for newborns. You might be pleasantly surprised that a SSN has already been requested for your child.

Having two different SSN can complicate things for your child. So make sure that the child does not have an active request for a SSN before you make a request at the SSA office.

Fee is $350 per person; they will receive separate visas, which will be inserted into their passports. Ideally have them in separate deposit slips...they will be attached to their respective forms.

BPI only has the K1 payment option..but my fiancee has a 5yr old child. Does she pay for 2 K1 visa fees then? BPI told her to call the embassy, cause maybe her child doesn't have to pay??? (I highly doubt that)... Any help would be appreciated.. Thanks! Wish there were more info on K2 visas...

I was at DFA today to have my machine readable passport changed to my USC spouse's family name. (I used their online appointment system to do this, and it was fairly painless...all I had to do was show up at the appointed time...the whole process took an hour and 40 minutes in my case...paid the extra Php 250 for the expedited process of 7 days plus the Php 99 to have it delivered to my doorstep.)

Two of the requirements I had to present were the blue and green CFO certificates I had to obtain from SMEF-COW and CFO, respectively. These requirements are strictly for Filipina spouses who wish to hve their foreign spouse's family name appear on their passport.

Later, when I get my visa, I have to return to SMEF-COW to attend the Pre-Departure Orientation Seminar (PDOS) so I can get the CFO sticker for me and my daughter (she is 10, I was advised that she is exempted from attending, I just have to bring her passport with the visa inserted). Luckily, if you are married to a USC spouse, the seminars are available every day (Mon to Fri)...however, due to the volume of attendees, you have to book it 5 days before the intended date.

Your girl can get the blue and green CFO certificates even before your K1 or K3 visa is issued...but she would have to return after her K1 visa is issued to get her CFO sticker...better for her to just go when she has the visa...she won't need the blue and green certificates anytime soon.

She just has to attend the Guidance and Counseling session at either PRISM or SMEF-COW (I went to the latter, I arrived before 10am and I was out by 12:30...paid Php 250 for the SMEF-COW guidance counseling and Php 400 for the CFO green certificate...got both the same day, no problem...no need to make an appointment, but she will have to set aside an average 3 hours of her time.)

If your girl is trying to apply for a passport for the first time, and you guys are not married yet, she is not required to present the blue and green certificates when she is applying for a Philippine passport.

She would only be required to present the statutory requirements for applying for a Philippine passport, which can be found on the DFA website.

Down the road, when you guys get married, and she wishes to have her Philippine passport amended to show she is married to you, only then she will she need the blue and green certificates (which she will get anyway as a direct result of attending the SMEF-COW or PRISM Guidance and Counseling session).

When I was gathering all my documents for AOS and called a few clinics how much, 2 of them told me around $300 just for one person. And if you adjust sooner, you can apply for US citizenship sooner as well. 3 years of being permanent residence even if part of it is conditional will make you and your son qualify for citizenship. My daughter and I used to be a K3/K4 holder as well.

Yes, we're aware of the validity of the medical results.

It's kinda funny...we had our medical Sep 28, 2009, so they're good until Sep 27, 2010...but our 2nd year wedding anniversary is in January 2011. 3 months difference between spending AOS+Removal of Conditions (if we file before medical expires in Sep)...or AOS+Medical (if we file after our 2nd year wedding anniversary).

In the former, we'd wind up with a Conditional GC and still have to lift conditions before getting the 10-year GC...in the latter choice, barring all other hiccups, we should get the 10 year-GC.

Any idea how much a medical exam here would cost?

I just want to let you know that if you could afford to file AOS, then do it soon because you can still use the medical paper you receive from St. Lukes. If it expires, you have to go through another medical here in the US by designated doctor of USCIS. But if you want to wait until you reach your 2-year anniversary it will save you on your fee for removal of conditions but you might have to pay your medical papers for your AOS.

We haven't applied for AOS yet (I'm on K3 and Pippo is on K4, so these visas are good for 2 years); we will file for AOS later in the year when we are close to our 2nd year wedding anniversary.

I did apply for EAD first, and just got the approval notice today. :D Hope the rest of our journey to GC (and ultimately to citizenship) is a good one.

luvtechwifey, we'll be cheering for the SAINTS in the Superbowl! :D Got a lead for you also on a Filipino store down there in Baton Rouge, if you haven't been to it already.
