IR-1 / CR-1 Spouse Visa Process & ProceduresForm Ds-230, Item 33 Question
You should still include the information, even though the beneficiary didn't graduate; it's part of their personal record.

If the beneficiary is not currently enrolled, I'd think you should write the month/year the beneficiary stopped going to school...then under Degree/Diploma Incomplete or Didn't Graduate (if it doesn't fit when you type it, you can leave it blank, print it and then handwrite your response).

Yeah, I'm sure is a 'reason' for the timeline of every single case...but we'll probably never know what it is. Our I-130s went into a big black box and nobody outside of that box knows when it will spit out a result.

IR-1 / CR-1 Spouse Visa Process & ProceduresSIMPLE CR1 Question
Yes, he requires a separate I-130. No, children who are 14 years old or older require G-325As :)

Hello All, We just got married, I am the USC and am preparing to file the I-130 to bring my wife and her son to the US. Her son is 8 months old, does he require a separate I-130? Also does he require a G325A, seems senseless for an 8 month old, but I work for the government so Im used to senseless.

Thanks for your help.

IR-1 / CR-1 Spouse Visa Process & Proceduresis very confuse of the process please help
Are you the beneficiary or the petitioner?

My husband is Presbyterian, and I am Catholic. We opted for a Christian ceremony instead of a civil one. It was almost like a church wedding with a minister, but not quite. :) I did the wedding arrangements myself, with the help of friends.

You will get the Legal Capacity to Marry document the same day as the appointment. Keep watching for when the appointments are available in February...since your fiance will only be there for 12 days (my husband was here for the same amount of time when we got married in the Philippines...it was a really tight schedule!)

Since you guys are getting married, you will not be applying for K1 anymore, right? Who needs the parental consent/advice? Certainly not USCIS or the Embassy. Was it the church asking for it? That left me kind of confused.

The 10-day waiting period, as the previous poster mentioned is standard. No way around that...and that refers to 10 business days...if there are any holidays in between the the time you applied for the marriage license up to the time it is issued, they will not be counted as part of the 10 days.

Try talking to the civil registry to see what you can get done in advance. I tried with ours (Paranaque) but they refused, they really want both of us there in person. Perhaps your local civil registry office will be more lenient.

hi guys, i need some advice..

i and my fiancee is getting married this february 2011 here in the philippines, I read from the website of US embassy in Manila about the process of obtaining a legal capacity to marry. and they said, its by appointment. My fiancee would like to have a reservation as early as now but the problem is february 2011 is still not available. my first question is, how soon should she do some reservation via the website?. and How long will it takes? can she get the documents the same day when she ask for it? ..

my second question is. she will only be staying here for 12 days. since i am a catholic, i would like a church wedding, but she is not a catholic. shes a lutherans, and i read the requirements for a church wedding and it says that she needs to have a consent coming from her parish that she will have the wedding to another parish.. though, shes not a catholic.

my third question is. My fiancee is 27 years old. does she needs to have a written consent coming from her parents for her to marry me?
my fourth question is. i am 23 years by time of our marriage. i read that I will be needing a parental advice. how will i be able to get a parental advice? i mean, my parents is supporting me for the marriage. the fact that they will contribute even to the expenses.lol.. do i still need to write a statement telling that they did advised me about marriage?lol.. i dont know what does it mean..

my fifth question is. how long is the approximate time for processing a church wedding? could it be possible that i will process everything here while shes in the states ? or do we need to both process everything? i read that they have some sort of seminars a month prior to the wedding, can we do a proxy on that? as she will not be able to come a month prior to the wedding, and it would be so expensive also on her part.

my sixth question is. if we plan to have a civil wedding, is there anyway to waived the 10 day waiting period? if there is, please let me know.

looking forward to all your help... thank u in advance...

IR-1 / CR-1 Spouse Visa Process & ProceduresCFO Sticker in Manila
If she completed the counseling session (she has the blue certificate of completion, yes?), then she is eligible to receive the CFO sticker and the green certificate. Where did she go for counseling? CFO, PRISM or SMEF-COW?

My Wife had the counseling when she had to change passport to married name in March 2009, I hope she just needs sticker as I am told, her plane is for October 27 and she will arrive in Manila on Oct 25 at night, get hotel with sister, go to CFO at 6 am for sticker, then spend another night at hotel and Catch plane to New York at 6:45 am on Oct 27. Do you know anything that we might be doing wrong with CFO sticker ???

IR-1 / CR-1 Spouse Visa Process & Procedureshelp!!! question on EMBASY MANILA
You guys, unfortunately, are experiencing administrative processing, which can take anywhere from less than 2 weeks to several weeks.

The petitioner has to contact either the US Embassy Manila or the Department of State.

Embassy number is 632-301-2000, press 7 then 5184/5185 and only the petitioner can call them to ask what is going on.

hello VJ's

im new here and i need help!!

my wife had an interview last 09/03/10 the CO approve her but asking additional document the (I-864A Contract between sponsor and household member) wich is NVC didnt ask for it.

does anyone experience like this?
does anyone know whats the no# to call?
does anyone know how long will be review and get her visa?

thanks! all replied will be higly appriciated

IR-1 / CR-1 Spouse Visa Process & ProceduresMarried to filipina with 3 kids, need help ith process!
Each child needs a separate I-130 petition; you may file the petition on their behalf as their stepfather. You'd just need to show proof that you married their mom while they were all below 18 years old.

Hi
I am us citisen and live my whole life in Wisconsin. I lived in The Philippines for 9 months after my wedding there.
I read the I-130 instuctions and my wife's kids fall into the part of the form for unmarried children under 21 and so no seperate I-130's needed for the 3 kids. I dont think I qualify to file DFC cause i was not philippine resident for the required time as per their guidlines. Any help is very welcome as we want to be together asap. IR-1 / CR-1 Spouse Visa Process & Proceduresi-130 question
Ok, so that means at the NVC stage of your application process, he will be asked to provide an I-864 affidavit of support.

If he changes address before your petition is approved and forwarded to NVC, your beau should send in an AR-11 Change of Address form, which he can send online or by mail within 30 days of moving to his new address.

If he changes address after the I-864 Affidavit of Support is turned in (during the NVC stage and beyond), then he sends in an I-865 Change of Address form within 30 days of moving to his new address.

After you arrive, the I-864 is still in effect until you apply for citizenship or until you can show you have made 40 quarters of SSN contributions (worked in the US for 10 years); so within that time, every time you guys move, he has to send in an I-865 (within 30 days of moving), and you have to turn in an AR-11 (within 10 days, not 30 days of moving).

Thank you for all the information, I was waiting until we had sent the first lot of paperwork away before starting the timeline. We are going down the CR1 route. Lucky for us he just exceeds the poverty guideline requitements.

IR-1 / CR-1 Spouse Visa Process & Proceduresi-130 question
During the application process, if he changes address, he can mail or submit a Change of Address form online within 30 days of moving to his new address, no biggie. If anything, his family should make sure he gets all his mail!

You guys may want to update your profile and your timeline so that other members can be able to help you better. :)

What kind of visa are you applying for?

As far as any kind of assistance from his family, if he is unable to meet the poverty guideline requirements for the application, you'd need a co-sponsor.

Sorry he is the petitioner USC and im the beneficiary non USC and im in the UK. Would we need anything from his family member for this?

Thank you for the quick reply

IR-1 / CR-1 Spouse Visa Process & Proceduresi-130 question
Yes, he can put his family member's address. Is he the petitioner or the beneficiary?

Hi everyone,

Sorry to ask a question I am sure has been asked before, but I cant find it.

I am still trying to get everything together to send to my hubby so he can file the I-130. One of the problems we have is that his house burnt to the ground a few months ago and he has been staying with family until the insurance pays out. The insurance still hasnt paid out yet and im itching to get the paperwork sent in.

So my question is can we put in his family members address as the address we will all be living in when we move over? Or do we have to wait until he has his own house again?

Thank you in advance for any help you can give.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow often do people fail the interview?
Hi, I applied for K3 last year, and we have been living in Florida for almost a year now (we moved here October 21st, 2009...and my interview was just over a year ago, October 8th...ahhh, the memories!). :)

I wouldn't worry to much about the interview. You guys are already married, and the only reason I could think of where your wife can get denied is if she had a criminal or civil conviction (based on NBI records) or if she was ineligible due to her medical results. She should just be relaxed, and know how to answer basic questions about you and your relationship (like how you met and such). She should also have with her a copy of the petitions and the supporting documents that came with them (sometimes Embassy people lose stuff and you just want to be prepared...I walked in there with a briefcase chock-full of stuff in case they needed anything...never underestimate the value of a piece of paper. :) )

Click here and scroll down to give your wife an idea about how our interview went and the questions the Immigration Officer asked me and my daughter: http://www.visajourn...le.php?id=64018

It's all a formality...the IO even apologized that we had to wait so long (during the whole visa process, that is). lol God bless you both, I'm sure your wife will pass with flying colors and bring home the pink slip!

Hi all. Just received word that my wife has an interview in November, so pretty quickly I need to start making arrangements (bigger apartment, flight plans, etc.) First of all, how common is it for someone to have their visa denied through the interview process? If some of you that have been denied could explain some of the circumstances so we don't repeat them, that would be wonderful! Thanks in advance and God Bless.

A US Passport Size photo is a Philippine 2" x 2" ID picture. That's what you need for the application.

IR-1 / CR-1 Spouse Visa Process & ProceduresGreencard middle name
You may want to straighten out your green card to reflect the same name as your passport...problem is, that requires filing an I-90, and if it was your mistake, you have to pay the fee, which is $370.

So...if you review your papers, what name did you put on your documentation when you adjusted status? (First Name, Middle Name, Last Name) If you were the one who wrote the middle name (corresponding to your mother's maiden name), then it would be your error, not USCIS's error...and you will have to pay the fee. Otherwise, USCIS should correct it for free. (You'd have to show them proof that it was their error.)

Here are the instructions for filing an I-90 Application to Replace Permanent Resident Card: http://www.uscis.gov...m/i-90instr.pdf

do you think it will be an issue when I travel in the future for different middle name in my passport and my green card? In the Philippines we usually used our maiden name as middle name you get married. So when i renewed my passport I used my Maiden name as my middle name but when USCIS issued me a green card they used my middle name when i was still single as my middle name. Do you think I will be in trouble?

Hi everyone!!

IR-1 / CR-1 Spouse Visa Process & ProceduresG 325A
I wouldn't worry about it, it's a minor error compared to let's say...forgetting to sign the G-325A.

Hi everybody.

I guess we made a mistake while filling the G-325A.
We are applying for CR 1 and on the part:
This form is submitted in connection with an application for: Status as Permanent Resident.

I saw some models on filling this form and K3 for example shows that I had to mark the option "Other" and then specify (I-130).

What should we do now since we've sent the package ?
Thanks !

IR-1 / CR-1 Spouse Visa Process & ProceduresWife and kids visas...will they be issued at same time?
Everyone will receive instructions and approvals at the same time. The kids cannot complete processing unless the mother's application is approved...so the NVC will not forward their packets to the US Embassy piecemeal. And yes, everybody undergoes medical examination, no exceptions.

One more question for my VJ friends...

NVC has been asking my wife for for several more documents (police certificates, birth certificate...)my question is: if NVC sends my daughter's and son's files to Rio de Janeiro embassy before they send my wife's...will they wait to give an interview date and/or continue with process until they get my wife's file? will they set the interview date until they have all three files in Rio? My son is 7 and daughter 16...will they need a medical/phisical exam also?

Thank you so much to everybody here!

IR-1 / CR-1 Spouse Visa Process & Proceduresis there such rule as who should pay for the plane ticket?darn! please help
No, he paid for his ticket when we got married in the Philippines. We both shared in the expenses for our wedding. it wasn't a big wedding, but an intimate gathering with 60+ people very close to us. His mother came also.

I paid for my ticket and my daughter's ticket before we moved to the U.S. last year.

In any case, we were never asked where the money came from.

The post you read was from an applicant in Egypt. Was this the part of the post that is worrying you?

Provide proof that the petitioner paid for the airline ticket. This evidence must come from the petitioner's credit card Statement, or any other verifiable document. If the petitioner used cash to purchase the ticket, please explain why she used such a large amount of cash for the purchase of the ticket, Also, the origin of funds must be shown for all cash ticket purchases. If the petitioner did not pay for the airline ticket, who did? Provide a notarized statement from the individual indicating why they paid for the petitioner's airline ticket.

They were given a very long RFE...we don't know the details of their case or their background but this is NOT something everyone goes through...we will never know the NVC's reasons for issuing such a list, but that is their list...not yours.

If the NVC DOES ask you to explain where the money came from, you can always present an affidavit from your dad that it came from him and present proof that it came from his savings or whatever source he will use to purchase the ticket...and explain it was a gift.

Personally, I wouldn't worry about it too much. Airfare can easily be considered as part of the wedding expenses. If there is nothing in either your background or your fiancee's background that is questionable, then you shouldn't give it another thought.

here is the link by the way

That can't be right. Can you paste the link of the post you read?

I paid for my ticket and my daughter's ticket, not my husband (he is the petitioner).

hello,

i was reading some forums and i came about in one of the forums where the OP posted a letter of RFE coming from the NVC, and i read it correctly. it states that. THE PETITIONER SHOULD BE THE ONE TO PAY FOR THE TICKET.. and it should come from her credit card account..

darn.. Im just wondering because I am the GUY.. ( male) and my fiancee ( girl ofcourse) is the american citizen. My dad as he knew our plans to get marry this february offered to Pay for my fiancee and his friend's tickets. we are not rich tho, But in my country, philippines, and specifically in our family traditions, Its always the guy who pays for everything specially on the wedding. and knowing that, should it be a problem that its my dad whos paying for their airline ticket and as well as their accomodations here? I am 23 years old my girlfriend is 27. . I have never tried working, I am a Licensed Nurse and currently taking my Masteral Degree. knowing that, where will i look for money to finance for our wedding.lol.. but dad told us eversince, he and mom wants to pay for our wedding, not just to my wedding but to my other siblings also. do you think it will be a problem knowing that ? please help me.. Im kind of confused right now. lol.. i was telling that about it, that I read it from a forum that She should pay for her own tickets, and like dad told me, she cant do it. you're the guy, and I am your father and we have talked about this eversince you were in highschool...lol... i cant disappoint my dad.lol..

IR-1 / CR-1 Spouse Visa Process & ProceduresTraveling after sending I-130
Yes, you may visit under the Visa Waiver Program, however during each visit you have demonstrate strong ties back in Finland (meaning, you have to prove that you have every intention of returning to Finland after your have concluded your visit.)

It's the same deal no matter which visa you are applying for. K3 is no longer an option, btw.

Hi there!

My wife and I are about to begin with the visa application process. She lives in US and I live in Finland. I have a question though, because I was not able to find a clear response to it from the FAQ section.

Am I able to make short trips to US under Visa Waiver after we have sent the I-130 "package"? Is I-129F (K3) any different when it comes to this?

IR-1 / CR-1 Spouse Visa Process & ProceduresCan you guys help me understand?
Yes, that's correct. After 3 years of living in the US as green card holders, your wife files the N-400, and the kids need N-600s.

THANKS EVERYONE FOR ALL THE INPUT! i really do appreciate it. going through the immigration process sure isn't easy...and i am glad the members in this forum are ready to give any help they can clearing things up.

so just a recap...the wife and kids, based on the documents i've received from NVC, are under the IR-1 (wife) and IR-2 visas. they don't automatically become citizens (the kids) but....i would apply for an N-600 for them instead of an N-400. am i understanding you guys correctly?

IR-1 / CR-1 Spouse Visa Process & ProceduresCan you guys help me understand?
If you recently became a US citizen through naturalization, it doesn't automatically make your existing children eligible for citizenship. That's why they are undergoing the CR2 process with your wife now. They (wife and 2 kids) will all have to earn their eligibility through lawful permanent residency in the US (like you did) before they can become US citizens, which is 3 years. During that period, the kids will be living with you and your wife, which will satisfy the physical custody requirement.

Any future children you and your wife will have from this point on will become US citizens automatically, regardless of where they were born (if born outside the US, they undergo CRBA proceedings).

IR-1 / CR-1 Spouse Visa Process & ProceduresCan you guys help me understand?
I'm confused...what was your citizenship when your children were born?

so because i don't meet that particular requirement, they are not able to qualify to automatically become citizens upon entry to the U.S. - they would've qualified to automatically acquire US citizenship if i met the living with them provision, is that correct?

marriedtomrgFemalePhilippines2010-10-19 17:17:00
IR-1 / CR-1 Spouse Visa Process & ProceduresCan you guys help me understand?
They have to live in the US as green card holders for 3 years before they can qualify for citizenship...they'll be living with you, right? So they will qualify then.

this...
http://travel.state....types_1312.html

What Are the Requirements of the Child Citizenship Act of 2000?

The child must meet the following requirements:

-Have at least one American citizen parent by birth or naturalization;
-Be under 18 years of age;
-Live in the legal and physical custody of the American citizen parent; and
-Be admitted as an immigrant for lawful permanent residence.

does that mean that my children will not qualify for this because i don't meet the custody requirement stated above? my kids live with their mom back home, so they are not physically in my custody.

any of you immigration gurus care to chime in? TIA.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat can be the Bonifide marriage evidence?
Proof that you are still communicating with each other, like telephone bills, chats over the Internet, e-mails, greeting cards sent through mail, pictures of your visits to Pakistan to be with her, proof you are supporting her (sending her money through a bank, Western Union or other acceptable methods), proof of flights you have taken and where you and your wife stayed when you were together, notarized sworn statements from people (relatives, friends) who know one or both of you who can attest that you are married and have witnessed specific occasions when you have been together or communicating with each other.

These are just some examples.

My fiance lives in Pakistan and I live in the U.S. We don't own any property together and neither do we have joint accounts in a bank. What else can be evidence?

Don't worry, it doesn't need to be stamped, notarized or certified by anyone. It just needs to be signed by her, that's the most important signature.

my wife send me the I-864 and the 1040,,i notice the I-864 without any stamping she just fill out the papers and send me
i thought she should do that in IRS or the court
am worry to send the package waiting to see if that right because i dont want them return my papers again

You may need to request for the moderators to move your post to the IR1/CR1 discussion board. And it would be helpful if you updated your profile so that other members can be able to help you better, especially if you will need region-specific answers.

IR-1 / CR-1 Spouse Visa Process & Proceduresprocess time
Average published waiting time for an NOA2 approval notice is 5 months. Most of the veterans suggest that if you do not hear anything after 180 days, contact USCIS.

Actual complete processing times (from filing the I-130 and I-129F + NVC + US Embassy) varies, depending on where the non-USC spouse is from, among many other factors.

any one to tell us how much time to be togather
help please

Congratulations! :)

You may want to consult the VisaJourney guides for CR1 applicants (conditional permanent resident visa for spouse of U.S. Citizens; this is issued to spouses of US citizens who have been married less than 2 years): http://www.visajourn...tent/i130guide1

Hi Everyone

I am planning to go to my country (India) at the middle of december to get married. I will be back in mid-january. I am a US citizen. I have many questions regarding what to do and how to get my spouse in US:

1) Do I have to file the I-130 in India or in US?

No, you have to file the I-130 in the US when you return

2) What documents should I take it to India, if I am filing there? OR What documents should I bring from India, if I am filing in the US?

The documents are listed in the Guide :)

3) Although the girl I am marrying has a psssport, do I need to get a new one for her since she will be changing her name and marital status?

That would be prudent; she doesn't need to amend it when you file the I-130. She will need it later at the National Visa Center (NVC) stage.

4) Approximately, how long does the process take for her to come to US?

For the I-130 to be approved, it takes 5 months on the average, assuming there are no delays.

The NVC stage, maybe 1 to 3 months...but there are shortcuts you can use through certain parts of the process to save you some waiting time.

You can view the LingChe NVC shortcuts here: http://www.visajourn...he_NVC_ShortCut

The Embassy stage, depends on the non-USC spouse's county of origin. Am sure some of the VJ members from your soon-to-be-wife's home country will be able to share some inputs.

5) Besides I-130, what other forms would I be filing?

The forms are listed in the Guide :)

I think that's about it (for now!). Thanks in advance!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresI have 2 questions about whole process
You are not required to call them...if you are perfectly happy waiting for things to happen (no matter how long that is), then you are free to do so.

The shortcuts are there for some members who want to get a jump on the process. It saves them a lot of time, and helps them get to next steps days or weeks quicker.

thx for your response

Do i call them because im required to do so? Or just to speed up process?

Any chance you have a photocopy of the NOA1 or NOA2 in your files? The petition date would be on it.

Your next option would be just to ask your ex for a copy of it.

The most expensive option would be to request for a duplicate copy of the approval notice (which also has the receipt date/petition date)...you'd need to file an I-824 Application for Action on an Approved Application or Petition...the fee is $340.
