germanangel, you seem to have a grasp. What are the implications of pursuing the K3? I assume you enter the U.S. faster but do many forms and waits once you get here. What happens to the I-130?


Persuing the K3 will get you to the US faster. However, you will not be able to work, get a social security number (which means no bank accounts etc) or win the lottery :P

Once in the US you will have to file for AOS and EAD, the wait times vary from local office to local office.

The I-130 can be cancelled at NVC stage or later if you know you will go with K3 and then AOS. If you want to continue the 130 (CR1 process), you simply follow the guides and return to your country for the interview, should you have entered on the K3.

your K3 is uneffected by 130 approval. Only if they were at the embassy at the same time would the K3 be cancelled.
CR1 visas take a lot longer at the NVC and it will be a few months before it reaches the embassy and an interview date will be scheduled.

There are 3 options for you now:
1. Cancel K3 and go with the CR1
2. Get K3, go to the US and file for AOS, abandon CR1
3. Get K3, go to US, continue CR1 and go back to Ethiopia for the interview

First what you should do is read the guides to get a slight overview of the visa types.

K1 is for fiances, K3 is a non-immigrant visa and you will have to adjust status in the US to obtain resident status. CR1 gives you conditional permanent residency for when you are married for less than 2 years. IR1 is an immigrant visa for residency if married for 2 years or more.


We have read all the visa types and are still discussing which will work best for us. We are curious though what the difference is between the K3 and the CR1...we are currently trying to decide whether to get married before or after the visa process....

like said before, K3 is non-immigrant visa to get families together more quickly. It requires Adjustment of Status once you enter the US. You need to apply for Employment Authorization also.
CR1 is immigrant visa which gives you conditional (because married less than 2 years) resident status upon entry to the US

If you have many things that show you will return to Japan, there are chances you will be let in at POE. Employment letter that they expect you back or college letter, rent obligations, etc.

as hard as it may be, try to stay positive because if you come to the embassy all freaked and scared,they will think something is wrong.
If you have proof of a bona fide marriage, you will get through. Even if they put you on AR, which of course I hope they will not, you will make it. Because you are married for love, not for the visa. It will be okay, sweetie!
We are all worried before the interview, it is normal and okay to be. But don't let it rule your life.
I know you miss your hubbie, but just think that it'll all be over and nothing can part you after all this process is over.

Hi, just wanted to throw in a general advice. You might not want to address specific people. You get more help by leaving it to anyone and sometimes people don't like to be asked for help specifically on a thread. They will answer you if they have an answer for you.

Now to your question: if your income exceeds and has exceeded the poverty guidelines, you will most likely not need a co-sponsor. However, it is in the consular's hand to request one if he/she feels this is necessary. Also depending on the consulate, if you need tax returns. I didn't need one, just had to turn in employment letter and bank statement, but other consulates or embassies require the returns.
As far as I know you won't need a new G325A if you updated your address with USCIS. They will change it in their system.

For K3 you will need I134, for CR1 I864.

they are supposed to keep your stuff. You will have to give it to them or contact Chicago to send it there. I think most people this happened to have gone back to the airport to give them the pkt.
But if you live far away, that might not be an option.

same happened to me. I called NVC just for fun one day and they told me they sent it to embassy already. 3 days later I got mail from consulate. Boy, would I have been surprised, had I not called NVC!
SOmetimes this happens. So calling NVC after processing dates have passed yours a while or others with your same timeline have been approved can be good.

It sounds somewhat like this:

It's quite simple and straightforward, it has to include start date, profession and salary and if it full-time or part-time.

Hey there, I don't know if in the UK you get the visa right after the interview or not.
If you do he just needs to go to the interview and that's it. If the visa issuance takes a few days he will have to stay as long as that takes. here in Germany it takes about a week, if you have all documents together.

When he goes to the medical for his K3, have him ask for a duplicate so he can use one for K3 and one for CR1. The medical is valid for 6 months so CR1 should be done within that period. It worked for me!

If you decide not to go back for CR1 interview, you have to cancel at NVC, your fees, however, are gone forever. You will have to pay them again for the AOS process. Don't send any more forms if you cancel.

hey, it is possible to do CR1 after K3. You simple complete the process through NVC as you would without K3 and it'll all be okay.
If you have questions, you can PM me, I did it that way and it was way faster than AOS.

But you wouldn't have to apply for advance parole with K3 anyways, as it is a multiple entry visa which does not require AP to travel to and from the US.

there won't be any problems during the interview. It is not illegal to visit your spouse while waiting for the visa. However, the officer at the POE decides whether to let someone in or not so if he or she suspects an illegal immigrant intend, your wife might not be allowed into the US. So make sure she has proof that she will go back. There's always some gambling involved, but many have been successful in visiting their spouse/fiancé(e).

Your petiton will not be abandoned unless you call the NVC and tell them that you want to abandon it. If the I-130 makes it to the embassy first, your I-129F will be abandoned by them. K3 goes through NVC really quickly, for me it was only a few days.
CR1/IR1 has a long ways to go, once it is at the NVC. Forms have to be filed, fees paid, more paperwork, and then after a while, it will get forwarded. So there is still a fat chance that your I-129F will make it to the embassy first. Also, in Germany, you will get an interview rather quickly after they get your stuff
