hi everybody..
I am in USA with k3 visa and I came here last december.
I have a serious question here... Today I came to know from one of my friends that if I dont file AOS before 90 days of my stay here that I wont get GREEN CARD but I can just stay... This is really confusing... I cant understand this 90 DAY thing.. Can anybody explain this to me....

There is no 90 days AOS requirement for K-3. The 90 days requirement only applies to K-1. You can file for AOS anytime within 2 years of entering the US on a K-3. Your friend is incorrect or don't know about K-3.

you got it all right. It is not illegal to go to the US and get married without a K1. Just don't make it too big of a deal at point of entry as they might not let you in as they think you intend to immigrate.

K3 is valid for 2 years from date of issuance (Jan 2008)
I don't quite remember if the info was for K3 only.
But it did say I have to activate the visa within 6 months, don't need to put the x-rays in my carry-on to show at immigration and I think I recall it said that it's valid for 2 years. So I guess it was for K3 (validity suggests so)

HI,
don't worry about your cases not being touched. My 130 was never touched before approval. And my 129F waws touched after about 4 months for the first and only time.

Touched means that when you check your case online in your portfolio, the "last updated" date has changed. It doesn't necessarily mean that they did anything, it means they looked at it, put it on a different pile etc.

The forms will be signed by you or your husband, depending on whose G-325A it is. And then in the spot where it says "signature of person preparing the form if other than petitioner", your attorney will sign.
There is always need for the original signature of the petitioner/beneficiary for G-325A, the petitioner also has to sign the I-130 and there should be the signature of preparing person on each of them. That's just additional though

no, his visa will be in his name of course. But it does state the petitioner's name. It depends on which name you will use on the forms.

If he is not there when you send off the petition, you don't have to fill out that he was just there.
Only if they ask for previous vivit (can't recall exactly but think they don't), you'd have to answer that one.

you will get the DS 3032 from NVC. it asks you to assign an agent. It has an option on it that says I already have a visa and don't need to do this (not in these words of course)
Just send that back like that and you're set. No need to write a letter. You can also just call, I think but the form will come so doing that will be enough I think

If you do AOS you don't really have to do anything, right? Simply not repkying to NVC takes care of that. But of course you can always write them to let them know you won't persue CR1.

Despite the move to the USA and the reciept of the K3 visa, we will persue the CR1 visa process and will return to the Embassy in [country] for the interview.

I therefore ask you to update the information in your system and send all informatin regarding the CR1 visa for the beneficiary to the new address in the US.

We are aware of the fact that there is the possibility to adjust status in the US but we choose to follow the CR1 visa.

Thank you for your time and concern

something like that, not the exact way but that's what I remembered vaguely. Hope this helps. They accepted it, changed the address and I got everything concerning CR1 here in OK.

EAD takes about 90 days. If after 90 days you haven't received it yet (which happens to be the case at the moment for most cases) you an get an interim EAD through an infopass appointment at your local office.

I don't know about why they are writing letters using your maiden name but you should contact them and ask them/tell them you want the visa in your married name.

To obtain a driver's license, you need you social security number. You won't get this until you can show them your EAD.
Unfortunately, you will either have to get an international driver's license or get a new one from your country before you leave.
In Germany, DLs never expire so I really don't know what you should do to get a renewal license.

the K3 stays at NVC for only a few days while the CR1/IR1 is being processed mainly at NVC so plan in a few months there.
If both are approved already though, you might consider going the CR1/IR1 route just cuz it'll give you a green card after entry while K3 has to adjust status.

alright now, don't panic. you will have quite a bit of time to assemble everything. What you should get together is the tax returns or transcripts for the 3 most recent tax years (2005-2003), certified copies of your and hubbie's birth certificate, your hubbie and the co-sponsor can start filling out the affidavit if they want but I wouldn't get it certified as you really still have time to get it all done.
Your police certificate will only take about 10 days, so don't get it yet, you wanna have a current one at the interview.
All that really is for the interview.
Pkt. 3 contains forms you will have to fill out. If you want to, you can fill them out already, it'll be DS-156 (2x) and DS 157. Also, DS230 Part 1.

There is really no reason to stress, as they tell you all you need in Pkt 3 and when you have everything on the checklist together for interview, you send back the checklist and will get an interview normally within 1 - 2 months. germany is rather fast with the K3s.

For the K3 I would contact the embassy to let them know you won't need the visa anymore. You can probably call and ask them what exactly to do.
For the I-130 you can call the USCIS and ask but you know how unhelpful they are. I'd write a letter explaining the situation and that should be good.

Where is your K3 right now? At NVC or embassy? If at NVC just call them and let them know. They are pretty squared away.

I'm sorry not to be able to give you any concrete advice.

you're almost there, guys. We all know how stressful the whole thing is.
But no reason to get all freaky on someone who's trying to give you an explanation up there...it is a fact, that K3s slowed down last year and if you look at euros timeline you will notice that her K3 might have gone fast in the end, but did you see how long she waited to submit it, because it just didn't make sense to file it last year around this time??
