IR-1 / CR-1 Spouse Visa Process & Procedureshow to get your tax returns
I know my hubbie spoke to an operator to get his verification of non-filing. I know that last time I tried to order over automated system, they said it can't be sent so talking to an operator is a safe way.
You can also request a verification for non-filing per fax

IR-1 / CR-1 Spouse Visa Process & Procedureshow to get your tax returns
if you talk to an operator, yes, but the person on file has to request them then, I guess you want them for your grandpa?
Also, what I forgot in my other post, you can talk to an operator and request an evidence for non-filing from the IRS as you didn't file any.

So on Aug 2 it is back to the US with CR1.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is gained by Emailing choice of agent to NVC?
as beneficiary has to send choice of agent form so depending on the country it can take a while to get it to NVC. Emailing can save lots of time

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical report already at embassy but has no case number
It is different in each country. In Germany, you don't need your case number to get the medical. Also, you don't get the stuff, they send it directly to the embassy.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 Questions
I think it used to be 6 pages, am they didn't change the instructions for that. Staple together all pages on the left upper corner. Remember to put your case number on ALL pages.
The form is fine, as it is valid till 9/30/2006.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhats the difference? IR-1 CR-1
you receive a CR1 if you were married for less than 2 years at the time of entry into the US. Your green card will be valid for 2 years. You are then a Conditional Permanent Resident and will have to file for Removal of Conditional Status 2 years after entry. (to be exact 90 before the 2 years are over)

you receive an IR1 if you were married for more than 2 years at time of entry into the US. Your green card will be valid for 10 years.

IR-1 / CR-1 Spouse Visa Process & ProceduresUsing K3 medical for CR1?
yes you can use the K3 medical for the CR1. However, it is only valid one year so your interview and also the entry to the US will have to be before the year is up. I used my K3 medical for my CR1 and instead of the visa being valid for 6 months, it was only valid until the medical expired (one year after it took place). All this means is that you have to enter the US on this visa before the visa expires. Once it has the stamp on it after immigration, you can use it as a temporary greencard till the real one arrives in the mail.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS 230 Q.3
if your native alphabet is the latin alphabet, as your country is UK I'd asume so, then either put n/a or print the name in the latin alphabet again but usually that's not necessary. If however, the non-US citizen was born in a country where the native alphabet is not the latin one, write it down in that alphabet.

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Schedules
It really depends. After your case leaves the NVC and arrives at the consulate it can take anywhere between 3 weeks to a few months, depending on the country. UK should be one of the quicker ones.
Late September might be wishful thinking, but October sounds very realistic

IR-1 / CR-1 Spouse Visa Process & ProceduresCan I travel with my CR1 Visa ?
your visa with the stamp will work as a temporary green card for one year or until the real one arrives. It says so on the visa if you take a look on the bottom.

CR1 of course doesn't need AP. You are free to leave and return as you please, you only have to make sure you are not out of the country for longer than 364 days a year. That's what I was told at the consulate and have it in writing.

So you are definitely good to go!!

IR-1 / CR-1 Spouse Visa Process & ProceduresHuh? Another DS-230 Request from NVC
same thing happened to me. I had sent the DS 230 and they wanted it again.
What happened was that they has reviewed the AOS but not yet the DS 230. The two departments do not always check with each other so they didn't know my paperwork was already there and sent out another one.
Call NVC, talk to an operator and ask if they have DS 230 and all that's needed with it. It is prpbably just a mistake from NVC.

IR-1 / CR-1 Spouse Visa Process & Proceduresare the case numbers being sent to petioners the same centers first sent ?
I can only agree with simple_male. USCIS does not actually assign a case number, only a receipt number. Once the files make it to NVC, they assign case number (3 letters, 10 digits). This will be the case number for the rest of the application. As he said, those letters and numbers all have a meaning.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS230 Part 1 and Part 2
You should be told in your interview package.
I only had to send in part I and brong Part II with me to the interview to sign it there. definitely do not sign it until you are there!! Different countries are different though, I know some where you had to send Part II along with the rest. India I am not sure of.

IR-1 / CR-1 Spouse Visa Process & Proceduressimple question !
certified copies are just as good. No need to send the original. I didn't wanna take the risk of not getting it back. My originals will never leave my side. But that's just me...
germangelFemaleGermany2007-06-12 18:40:00
IR-1 / CR-1 Spouse Visa Process & Proceduressimple question !
I always advise against sending originals. It is not hard to get copies certified at any post office or bank (at your own bank it is often even free). Keep your originals, you might need them some time. But do send certified copies.
germangelFemaleGermany2007-06-12 14:38:00
IR-1 / CR-1 Spouse Visa Process & Proceduressimple question !
I guess it can't hurt to make a copy of the original and send it in as well. I was able to get an international marriage certificate. Not sure if your country offers that or not. But like I said, it can't be wrong to send a copy. Better safe than sorry.

I know it includes all documentation you submitted during the process and your medical info.
Also not sure about interview questions, but I don't think so.
No matter how curious she might get, tell her not to open it, it might be hard but it would not be good at all.

haha, didn't mean that, was just talking about the possibility of VWP or something, where you don't need an actual visa. But yeah, that did sound funky, I admit it!!

germangel,

How about an unofficial visa?

Yodrak

..... as far as I know, an official visa would not be issued.

IR-1 / CR-1 Spouse Visa Process & ProceduresVisitors Visa
I believe that you will not be approved any visitor's visa. It would be seen as a potential try to immigrate illegally. You can visit without the visa for the time allowed, but as far as I know, an official visa would not be issued.

we had to send in the W2s as well. They looked at them during my interview, to determine in a quick way if the requirements were met. You should send copies of them, or at least the last one.

That's USCIS for you! I had some hassle with them when I had my petitions there. Never got NOA2 either, and they couldn't tell us what the status was, and by the time they sent me an email with the official information, I was already in the states on my K3.

IR-1 / CR-1 Spouse Visa Process & Proceduresssn question
you have the option to check a box so it is assigned to you automatically.
However, in the past, ther have some cases, where the SSN has not been assigned and people had to go to the SSA and apply for one anyways.
germangelFemaleGermany2007-06-16 18:36:00
IR-1 / CR-1 Spouse Visa Process & ProceduresSSN / CR1
sometimes the SSA cannot process you request until they can verify all your information. And as we all are aware that paperwork can take quite a while in this process, it could be that you will not be able to get your SSN right away. But I believe the time frame is within 4 - 8 weeks, unless it changed since last year. My sister checked yes on the form but didn't get one assigned automatically and had to go to SSA and it took about 6 weeks until she had her card in the mail...

I belive that you can change your wife's name in the US. It kinda depends on the state, but in many, it is no hassle at all.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat i should put in line 27 Part II of DS230?
does she use your name at all? If not, then you don't have to put it there. If she does, then do!
If her maiden name is the only legal name she ever used (not talking bout the future here), then say none.
germangelFemaleGermany2007-06-22 20:16:00
IR-1 / CR-1 Spouse Visa Process & Procedureswhat should I do ?
There are many different department that handle your case at the NVC so the one that received the fee might just be slow to communicate to the one sending the checklist.
Call NVC and talk to an operator, all the information is in their system. I had the same problem when I dealt with them. I had already sent DS230 and received a checklist saying I still need to submit it.
A simple call to NVC verified that I had submitted everything and my papers were ready to be sent on!
germangelFemaleGermany2007-06-23 10:02:00
IR-1 / CR-1 Spouse Visa Process & ProceduresMaiden Name or Married name: Already has passport??
the visa will be in the name that is on the passport (at least it used to) so if her passport states her maiden name you should use that. As long as her name is not changed to yours, you should keep using her maiden name. And I am sure, you want to get started asap, so I would use her old name on the forms and all that.
germangelFemaleGermany2007-06-22 20:13:00
IR-1 / CR-1 Spouse Visa Process & ProceduresCASE NUMBER,
your case number allows you to check on your case. This number will be with you until you get your visa. Any inquiries, any questions, it all will be related to the case number.
You can now call NVC hotline and check on your file, see whether they have sent the next form, received your files, processed your documents and all that. It is indeed a pretty helpful little number!!
