UPDATE: I just got a response from the US Embassy in Athens, and after explaining that we had already sent the I-134 with the I-129F petition back in July, I asked if they wanted a more recent and updated I-134.
Their response was: " documents provided with the I-129F are included in the case file. There is no need to provide a new I-134".

I agree with what TJandJR and Ning said. It cannot hurt to redo the I-134 documents and gather all the required information for it when you have the interview. If they ask for updated I-134 documents then you have them, if they do not ask for them well it is better to be safe then sorry. In dealing with immgration issues it is better to be safe then sorry because the sorry could lead to not getting the visa or not getting the visa when you thought you would get it. Good luck.



I agree with you too, completely! I am a control freak and I wouldn't risk my visa process for anything.
But if I do actually have to fill in a new I-134, and the lawers say that they cannot send it to me due to private financial info of their client, what about then? Can I just directly ask for permission from my fiance and his dad since he's our co-sponcor?

Guys...I wasn't trying to offend anyone or not accept your help. That's exactly the reason I started this thead.
It seemed strange to me that the laywers were so sure about not having to get an updated form of the papers (that's why I posted their response as it was, and you thought I agreed with them).
I had done some research beforehand and knew that all the papers had to be as up to date as possible and your answers justified it as well, so I confronted them and still waiting for their response. I also sent an email to the Embassy and it's up to them now to tell me what to do next.

No you dont. You just realised you arent the lawyers client so they dont care about you. You want the opinions of independent people but when you get it you dont want to accept it. You cant be helped in this way.
Just go to your interview and see what happens. You can then adjust from there. The worst that can happen is the loss of time or I suppose an outright denial.

I started this thread to share what my attorneys told me even after I questioned their tactic of the I-134 form. If I had completely accepted their opinion and way of action, then obviously I shouldn't been writing this post right now, just of the sake of posting something here. I said that the attorneys told me that there wasn't any point in sending an updated form of the Affidavit, because that's exactly what their answer was, without saying anywhere if I agree or not. It was just what they told me, therefore I was asking for some opinions from members of the VJ forum.

Hello everyone.

Weeks ago, I received the instructions from the US Embassy here in Greece. Amongst other documents, they asked for the I-134 form too (my partner's dad is our co-sponsor). Our lawyers though, told me that they sent the Affidavit of Support when they sent the I-129 package at the beginning of the process. Reading the instructions, I understood that I will need to have that form with me during the interview.
The lawyers though told me that it doesn't matter if I don't have it with me that day, since they will already have it in their system plus the fact that they can't send it to me since it is confidential between them and their client.
What's your opinion on that? I'm planning to call the Embassy and schedule my interview pretty soon and I don't want to have any kind of problems.

So this is a hypothetical question. I know that having HPV isn't a reason for denial.
I'm freaking myself out though since I'll be having my medical exams soon and I although I'm pretty sure that I don't have it, I wanna ask something.
I know that the doctor at some point asks " do you have any STDs?". What if I, for example, have HPV but don't know it because I have no symptoms?
Will that be concidered as a lie to the doctor and therefore will cause a denial, or they don't even test for HPV, but only for HIV, syphilis etc?

As far as I know, the consulate sends you to specific doctors that are somehow "authorized" to perform medicals for K-1 or other types of visas.
So when the time comes, you should expect a letter guiding you where to go and how to book the exams.

So, my ESTA will expire on March 15th or something, but I am planning to move to the US a little later.
I did some research here and found out that an ESTA in not necessary since you'll be entering the US with a valid visa. I also read that someone was admitted with the ESTA instead of using the K-1 (not his/her mistake) and didn't receive a I-94.
From what I understand, I won't have to apply for a new ESTA since I'll have my K-1, but every time I checked-in at the airport before my flights, they always wanted to see my ESTA. I'm just worrying that I will stumble upon an employee that won't know a lot about this and will give me a hard time. On the other hand, having an ESTA, might confuse them even more.

Does anyone here have a recent experience?

Generally, K-1 Visas aren't Immigrant visas but they are being processed as Immigrant ones. That's what confuses me.
Hopefully, we don't have to pay the new fee, although to be sure, I'll probably email the Embassy and ask.

From what I understand, applying to the Diversity Lottery thing, only gives you a chance to enter the competition and if you are actually selected, then you apply for a Visa.

Hey guys, I need your help and advice here.
Me and my fiance filed for K-1 Visa a few months ago and have already received NOA 1.
I visited the States in December of 2011 and left early February 2012(stayed for 2 months). In that period, he proposed and shortly after, we began to searching for immigration lawyers and such.
It's been almost 6 months since my last visit there and I was thinking about going again in late September and for only three weeks.
The problem is that the attorneys said that it wouldn't be a good idea since they can only give me 40-60% chances of getting in even if I have a character letter from them saying that I am their client and we've been doing things legally, have my return ticket, lawyer's card so they can call him if they want and proofs of the NOA1.

Since my fiance heard that, got really scared and didn't want to risk spending almost $1000 on a ticket to fly me there if I had only 40-60% chances of getting in.
I am desperately trying to convince him that my chances were much much smaller last time I visited him for two months.
Think about this: I was visiting a boyfriend, for two months, I had no job and no ties back home. No matter how hard I try to convince him that in my previous trip I was way closer in being sent back, he is just saying that the attorneys know better.
Iam replying back that the attorneys know the laws and speak with chances, thing I don't believe in.

I, on the other hand, believe that visiting now with the proofs of doing things legally and most importanly having a reason to not overstay, gives me more hope than last time.

So I'm asking, in your honest opinion, am I wrong believing that last time I had less chances than I have now and that there shouldn't be a reason not to try visiting now?

PS: I should also say that I've visited the States twice so far: once in June of 2011 for 3 weeks and once in December of 2011 for two months. Never overstayed.

He is a small dog:) he can travel both in the cabin or be checked, longer flights we normally check him.. Yup passport:) always stay at hotels that allows dogs:) brought him with is to Spain this summer..

However I think our plans might have changed as my I-130 took a surprising turn and got approved today... Nvc next and it is very possible that I can get my interview booked within two months, and there won't be an issue.. However it would still put things off a little as we aren't ready to move just yet.. It will prob take us 4-6 months to get everything ready to go.. Am I allowed to leave the US if I enter on my spouse visa in end of January? Again, tons of research to be made.. Can't wait till next year this time and I can look back at this and say, thank god that's in the past.

I think everyones being a bit overzealous about the puppy thing......i didnt see if you responded about whether youre trying to come on thw VWP or a visitor visa. I have had attys say that bringing an animal on a visitor visa might look suspicious, but on a VWP uou travel on only your passports. Granted the IO will question everything but if you have everything documented and have return flights booked for all of you including the puppy AND they can see you have employment and commitments to return, unless they have some notion you're looking shady I think its not going to be as big of a red flag as everyones telling you. I would strongly suggest again to contact the embassy and or even the IO airport in Sweden and ask them directly! VJ is a group of people with a vast amount of knowledge for sure but there are some issues you need to not rely on here as gospel simply because we ONLY have experiences.



Yes vwp:) never had a problem before.. And I believe it's more commen than people think to travel with their pets:) we have nothing to hide, they can refuse me on a feeling, I get that.. But we are a regular, middle class family, and it would be a very cold person sending a family with two infant children back on the airplane.. Getting refused with the vwp is not common at all if you've never misused it in the past..

Yes I understand that our dog is a red flag, however, we travel with him everywhere, he has a pet passport and Sweden is a country free of rabies so there's no control at all, he does not even need a vet exam - he is good to go.. We don't have anyone that will look after him for that long, we love him, but his kind of a handful.. And no kennel will keep him for that long.. We are THAT family, that treats our dog like his one of our kids.. If you're used to travel with animals, it's just as easy as bringing and extra bag.. Just difficult to explain that I guess.. It would be harder for us to find someone to watch him than it is to bring him if I put it like that.

I would be very careful - esp with the dog.  You are bringing a newborn and a dog along with you and that would def. raise red flags if I was checking you into the country. Would you consider leaving the puppy at home? I do wish you luck and congrats on your soon to be newborn baby!

We are traveling over Christmas to NY to visit my parents with my 7 month old son but leaving our dogs at home here.  We are bringing proof of employment for my husband, rental contract in his name and bank statements here with us.  That should be enough, hopefully. 

 

 

Yes I do udnerstand that I will have to leave our dog at home.. it's just hard, he goes everywhere with us and is just as much as a familymember as anyone. but, yes, Ill stay behind. its hard to find a sitter for that long, thats all.

Remember that POE officers will assume that people are intending immigrants by default so the proof of burden to show otherwise is on you.

 

Put yourself in the officers' shoes, what would it look like if a woman with a pending petition was to enter the country with her husband, 2 young kids AND a puppy? Try to think like an officer to help you prepare yourself for questions that could arise.

I  think it would look more weird if I flew by myself to visist my husband. but we all live in sweden and we are all going back.

As the puppy seems to be a problem, I am about to start looking into kenneling options here in sweden, so he will have to stay behind then.. we hate leaving him for that long though, but getting back on a 14 hour flight with two infants after just getting off one is even worse..

 

so frustrating.. I dont understand why it would be better if my husband lives in the states, and I were to visit him as I see so many others with pending petitions flying into the states on the VWP visiting their loved ones all the time.. we have a life in sweden that we would have to return to.. so I honestly cant say that I would understand if I was refused entry.. we are there on vaccation..

Wait so you're 7 months pregnant? Are you even allowed to fly at that stage?

Honestly, I believe you of course but I feel like you will absolutely have problems convincing them of your story. Especially with the dog too (5 weeks isn't really that long for a lot of people), it seems like you're there to overstay and adjust status. Just my honest opinion.

 

My husband and I lived in China while married, and when we left I went to the US on visa waiver for 3 months so I could help take our 2 cats (you need one adult per animal) and spend last moments with my husband before the visa wait.. Well, I was held in a little room and questioned for almost 3 hours because they believed it seemed like I was there to stay. It was very very stressful, easily the worst I've ever felt in my life.

I've seen boarder patrol shows where they've pulled up heavily pregnant women and barred them at point of entry. They said 'yeah, we find women doing that because it means they can automatically get a visa to stay' or something to that affect. Anyway I'm not sure I just worry for you going through that stress.

Please give me your input as I'm horrified of the outcome if it doesn't work.

 

We are currently waiting for our I-130 which is still in initial review. No stress about that as of now, that is allright.

 

We are living in my country in Europe, sweden, me, my USC husband and our dual citizen child, we also have another child due in a month.

As we are both taking parenting leave in january, february, and march (me eve longer) we figured that we should spend that time in the states, or actually only 5 weeks (already booked tickets), so that we can spend time with our family there and show off our new baby boy and let my husbands parents snuggle with their grandchildren.

My husband is working in sweden, and has to be back at work in middle of march, we are leaving at the end of january.

but with me as a swede, with a pending petition, and my husband as a USC and our two children both USC, entering the states, will it raise a redflag? Im so worried to get turned away at the border after such long flilght with two such young children, and we are also bringing our little puppy as we are staying for so long, cant really feed himself for 5 weeks.

 

Supporting documents we will be bringing.

 

- employment papers for both me and my husband.

- open bankstatements of income, savings and loans, and creditcards. And a letter from our bankman stating our   commitments to the bank.

- future dr appointments for the children.

- letter stating we are on parentingleave.

- lease agreement for our home.
- proof that we are registered on that address.

- and obviously we have returnticket for the entire family 5 weeks later.

- around 4000 dollars cash for vaccation spendings.

 

We have absolutely no intention of overstaying, as we wont start the process of getting ready to move until I have my visa in hand, as we have no idea how long the process might be, and I have 6 months to get ready for the move after I revieve my visa, plenty of time to pay off the loans, sell our stuff and get our savings in order and set up camp overseas with help from family.

 

Do you think we will be facing problems? we travelled to the states last november for 2 weeks, but at that time we werent married and our daughter flew in on her swedish passport and we did not have a pending I-130.

Im so scared, as getting sent back home isn't really an option with two children under the age of 2.

 

So I am not even visiting my husband, as my husband lives in sweden too, we are just visiting his family in the US and all of us is returning back to sweden after 5 weeks vacation.

 

What do you think? Pls let me know, be honest, be brutal, put it all on the table ;) better safe than sorry, be honest, what do you think? NO, fly back home or; have a nice stay?

So we are leaving for the US, my husband and our two children in 2 weeks. Me and our 3 weeks old son will fly back to Sweden for my interview as soon as it get scheduled and leaving dad and our 18 month daughter in the US.. But what if I'm not approved... I'm horrified.. I don't have all my trips to the us the last five years down to the right dates or trips, can't remember as we have travelled a lot, not do I know all my addresses since a I was 16 years old.. I guessed a lot.. I have had 3 passports in a 5 year period due to experation and name change and I haven't kept my old ones.. So worried they will ask about this and I won't know the exact answer..:/ we have been together since 2008, when I studied in the US, and 2012 he moves to Sweden to join me here as I was then pregnant with our first child. We married July last year..

So I moved here on the VWP and are flying home for the interview.. We are at the very last stage of the Nvc so I should have an interview before my 90 days are up.

It arrived 1-17 (I tracked it UPS.
I received receipt email 1-19 at TSC saying my application was being routed to the CSC.
My account shows 'last updated 1-23'
I received my I-797 1-24

My questions are:
--Why was i transferred to the CSC?
--Did I send to the wrong service Center? I thought I followed the instructions
--Should I be concerned it was sent to the CSC and not processed at the TSC?

--How will I know if it was received in the CSC?

I am sure I am stressing for no reason, but I am eager to start my marriage and I want no blips. Thank you for any and all who respond.

On 1-19-2012 I received email confirmation of receipt, a number for tracking on the USCIS website, and I was told my application was transferred to the CSC.
On 1-23-2012 I received a 'touch' on the website
On 1-24-2012 I received my I-797C NOA with receipt number for tracking

My question is, how do i know the CSC actually received my application? I have had no touches since what I listed above and I worry that it was mailed and not received.

Hello,

I am in the homestretch here and as I completed packet 3, I had the following questions and need opinions.

Form 156 asks if someone else completed the form and needs a signature. Since I am completing them for my Thai fiancee, signing it and then scanning them to her, I wondered if scanning is ok or if I need to sign and post them to her so that they are the originals.

I was married before and I have my divorce papers as required in packet 1. In packet 3, it asks for marriage papers and I wondered if a copy of my original marriage certificate is required. I do not have it and was curious how other members have handled this.

Finally, what is standard for the I-134? Do I include bank statements and employer letter only or just a copy of my tax returns? Any advice on what has been done before would be fantastic.
