Or, like the operator said, just send a letter saying you don't want to include your savings in the AOS.

IR-1 / CR-1 Spouse Visa Process & ProceduresEmail sample for ds-3032??
(Thanks, simple male.) ;)

We (I) :P initially jumped the gun and sent NVC the Choice of Agent email as soon as they assigned our case number. They ignored it. When we found out the form was generated and resent the email, they accepted it right away.

IR-1 / CR-1 Spouse Visa Process & Procedureswhat letter from employer??
You don't NEED a letter, unless they ask for one (or pay stubs either):

From USCIS:

Q. Does the final rule change the instructions for preparing the Affidavit of Support?
A. Yes. The final rule requires each sponsor to submit as initial evidence only his or her single most recent federal tax return rather than a return from each of the sponsor’s three most recent tax years, pay stub(s) covering the most recent six months, and an employer letter.

From another USCIS site:

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability tomaintain sufficient income. You are not required to submitthis evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income,or income from any other source, you may also include evidence of that income.

IR-1 / CR-1 Spouse Visa Process & ProceduresTravel between approval & interview
Well, my luck just ran out. I was going to visit my husband for the weekend and got denied. The officer said I can't visit because my CR1 and K3 are both approved and I can't be a visitor when I'm already an immigrant. (Even though I haven't gone to either interview yet.) He didn't have any explanation as to why I was able to visit a couple of weeks ago. He also told me not to go to the K3 interview in Vancouver because then I'd have to adjust status in the US, since getting the K3 automatically cancels the CR1 interview in Montreal. I told him I thought I could go back for the Immigrant Visa interview, and his response was to do that I'd need Advance Parole. When I told him I thought the K3 is multiple entry visa, he said it isn't, and I'm wrong. According to him, they get directives all the time and my info is out of date. When I asked to see something in writing, he said he'd go find the rules. When he called me in, he took my fingerprints & photo and gave me a voluntary withdrawl form to sign. I had all the usual evidence of returning, but he didn't care. I guess at some point you realize you aren't getting anywhere with some people. I think they send the slow ones to Edmonton. Back to Vancouver. :)

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 ?notorize??

Is always the best practice to make sure you have the newest forms.

For a few months the NVC was still sending out the old form but advising petitioners to follow the new rules (i.e., no need for the I=864 to be notarized).

Does his birth certificate list the names and birthplaces of both his mother and father? That's the one they need, not the wallet-sized one. I wouldn't worry about the quality; they need an original for the CR1 at the NVC stage, again for the K3 at the Embassy interview stage.

Not sure about the passport Q, but in BC at least, it's relatively easy to get a new birth certificate and it doesn't take too long.

Did you call the NVC and hear on the automated line or from an operator that the DS3032 had been generated? It usually takes a while after the case number has been assigned.

IR-1 / CR-1 Spouse Visa Process & ProceduresA question about marriage and crossing the border...

Question: How long does "secondary" take? We have a flight that leaves at 11:00 AM, and we probably won't be able to get to the airport until 8:30 AM at the earliest. We need to get our boarding passes (stupid airline won't let us print them out online...), go through regular security and then through U.S. customs.

It all depends... I've been to secondary several times, and sometimes it takes a couple of minutes, sometimes it takes over an hour. When I went through in Toronto, the waiting room was packed, and it took a long time just to get to talk to the officer. In Edmonton, it took a long time, but that was partly because I was fingerprinted & stuff. Trips to secondary in Vancouver have been very quick and straightforward. Anyway, if you miss your flight, you can re-book, for a $100 change fee, or whatever.

PS. Edited to say, It might not be a great idea for your fiancee to carry her wedding dress. :hehe:

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is the latest anyone has visted the USA during the Cr-1 process?
Well, I just got my K3 visa today and took the opportunity to ask the interviewer what was up with my being denied entry a couple of weeks ago. He reminded me that a person who's trying to enter the US needs to convince the officer that they aren't intending to immigrate during that visit, but in my case the officer must've been confused by seeing "approved" on the NOAs 2, and didn't know what to do, so he denied me. The interviewer actually shook his head and rolled his eyes when I asked about it. Also, he confirmed that the K3 is multiple entry, and it's ok to return to Montreal get the CR-1. (haha, apparently we all know that, but "butthead" didn't.) ;)

I'm normally pretty cool when I go through immigration... It was only a weekend visit, so it wasn't a big deal to get turned back.

I'll ask about the policy at my interview next week. Maybe they'll be able to provide us with some insight. :)

So basically....same situation, but different outcome the second time.

Yes.

Vancouver has been very cool and scheduled our K3 interview for next week, the day after the medical. We weren't going to bother with the K3, but now we will, in part because I'm curious about some of the things that officer said.

I was going by air and had all kinds of evidence of returning. The officer didn't care. On my Withdrawl form he wrote: "Subject can't enter the US as a non-immigrant when approved for immigrant status." I really think it depends on who you get...

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is the latest anyone has visted the USA during the Cr-1 process?
MPGGPM, you probably read my post.

The last time I visited the US was Sept 1. I went through the same border without any problem. I had both of my NOAs for K3 and CR1, and showed them all to the officer. He stamped my passport and wrote in B2 visitor. On Friday I had the exact same documents, but got another guy. After he said I wasn't going anywhere, I told him that I went through without any problem just three weeks ago. I think he was just a jerk. He gave me what I think is quite a bit of misinformation. Anyway, it wasn't particularly stressful because I was only planning to visit for the weekend, and I don't think I did anything wrong. :hehe: But of course it might be different for other people.

Butthead... I like it.

As a follow-up Q to Y or M or other knowledgeable VJers: Would his wife's permanent residency start AFTER the I-485 gets processed? Just wondering if that would be a factor compared to getting it immediately after the IR-1 was issued?

One thing to note: It seems like the wait time for CR-1 / IR-1 interviews is much shorter than for K-1 & K-3.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat to do??
You'll need a police report for each interview. (Not sure if UKers send one in to the NVC for the CR-1, Canadians do.) And ask your Dr for an extra copy of the medical report. The one in Vancouver gave me two for the price of one, and told me to keep the x-ray for the CR-1 interview in Montreal. :)

IR-1 / CR-1 Spouse Visa Process & Procedures130 approved before 129f
You can't predict that the OP will get an interview for the CR-1 sooner than for the K3. After the I-130 is approved it takes at least a couple of months for processing to be completed at the NVC before being sent to the Consulate. The I-129F for K3 typically moves through the NVC very quickly once it's approved. Another consideration is that some consulates schedule K3 interviews sooner than CR1s.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen exactly do you need police certficate?

Maybe this is true from "some" embassy's? The OP doesn't have any countries listed, but in Canada, while I get the police certficate done before my interview, I DON'T send it in prior, or need it prior to getting an interview. I checked it on the Package 3, and will personally BRING it at the time of the interview, as instructed.

You may want to go look on the Consulate website from your country.

Carla (F)

You're a K-1, and this person is posting in the CR-1 forum. Totally different stuff.

The police certificate is needed at the NVC stage for applicants residing in Albania, Canada, Lebanon, Philippines, Turkey, United Arab Emirates or on the continent of Africa.

Link to the NVC PDF of required documents for residents of those countries.

IR-1 / CR-1 Spouse Visa Process & Proceduresmedical exam certified copy question for ir-1
Not sure, exactly, but I got two copies of my medical at the time of the medical appointment. They only gave me one set of x-rays and emphasized that I shouldn't take them to the K-3 interview, only the CR-1. It might be worth finding out whether you'll get a set of x-rays as part of the $50 certified copy.

To continue with this then, will I need to take a copy of the pay slips and tax returns? As they have also been sent to NVC too so in theory shouldn't be needed for the interview. Am I right in thinking that in some cases you don't send the I-864 to the NVC and only take it to the embassy which is why there seems to be some confusion in the letter the NVC send out?

What you send to the NVC depends on which country you live in.

Albania, Canada, Lebanon, Philippines, Turkey, UAE, continental Africa.

Everyone else.

Everyone sends the I-864 to the NVC.

Note: Virtually all consulates require the I-134 form Affidavit of support for all K1 and K3 visas.

The I-134 was not required for K3s going through the Vancouver Consulate.

 Not if you've already sent originals or copies to the NVC.
