K-1 Fiance(e) Visa Process & ProceduresApproved but sent back to USCIS for review????
QUOTE (Gary and Alla @ Nov 22 2009, 05:21 PM) <{POST_SNAPBACK}>
Hello, welocme to VJ First enter your fiancee's information in your profile so when you sign on you can click on the "portals" above. This will take you to the Ukraine portals where those of us that appreciate the finer women in life good.gif gather and discuss Ukraine particular topics. You can also visit the Russia/Ukraine/Belarus subforum for good information.

That said...NVC has determined that they believe something in your petition is not correct. This happens sometimes, even the consulates can do it. USCIS will review the petition and either re-affirm it and send it back to NVC or notify you that something needs to be added/changed, etc.

You will not receive a notice for this, they (NVC) are not asking you for anything, USCIS will do that if needed. I do not know how long this will delay the matter

Hello and thanks for the extra info.

I added Ukraine to my profile info for my fiance. Her name is Tatiana.

You are spot on with the finer women in life thought ))))

I just hope it is nothing and the matter is resolved quickly...God only knows how happy I am with my family...and the sooner we can be together, the better life will be. I am sure of it.

You should keep on top of this Dacko - it may be beneficial for you to contact your congressman .... unless you dont mind waiting the extra time as Kimbear has.

JMHO ...

Thanks Malarie - I just might do that. I already have a contact at a NY senator's office and they helped us get the first NOA, which was great.

I might just have to send in a fax once again with this latest issue.

QUOTE (Kimbear @ Nov 21 2009, 12:49 AM) <{POST_SNAPBACK}>
That happend to my file. Basically the person who approved it did not check it properly. In my case a box was left unticked and uscis should have issued me an RFE. Unfortuneatley you wont know until you get a letter from uscis. our petition was returned on august 25 and we only got the letter on sept 10th saying that NVC sent it back for review, then it took another month before we knew about the RFE. I only just received the reapproval in November.

Hello and thank you so much for the response.

I figured it was something like this. So was there was really nothing else required as an RFE, it was just a simple box left unchecked? You didn't have to send any other evidence?

Thanks again for your response, and best of luck on the process!

K-1 Fiance(e) Visa Process & ProceduresApproved but sent back to USCIS for review????
I was sent to this site by some close friends who successfully married with a fiance visa....

My fiance is in Ukraine, we filed 129 petition for fiance visa back on May 1st.

October 9th, 2009 - Petition Approved and sent to NVC (Department of State National Visa Center)

October 26th - on the website, sent back and received by USCIS per request by the State Department for review.

Can anyone give a little advice as to what this might be all about? Also, what is the time frame for a review if you have ever heard of this happening.

In my reading on the past threads from this site, it looks like there were reviews if something was wrong with the petition or the interview process, but I have not received any letters or notices stating why there a review was called for.

Any help would give my fiance and I some very great peace of mind.

Thank you

QUOTE (Fei Hung @ Nov 23 2009, 03:21 PM) <{POST_SNAPBACK}>
We received an email from the NVC in mid October saying that in one week they will send our case to Juarez consulate, after that message we have not received any notification from any. I have been trying to contact them but I am end up confused and with the non-helping answering machines. How can I contact them? The case number that we have says is not found, is like our case was erased from the map. We sent 2 inquiries to NVC and none have been replied.
Anyone in a similar situation?

Thank you

On my NOA2 - it said "if it has been more than four weeks since you received the approval, and you have not received notification that your petition has been forwarded overseas, please call NVC at (603) 334-0700"

I was able to get in touch with an operator there and she gave me the current situation on our petition.
It appears its been more than four weeks for you so call it up.

Best of luck!

K-1 Fiance(e) Visa Process & Procedurespost-decision activity???
Say a prayer you dont end up as our petition - it was approved and everything going great until someone for no reason decided it needed to be reviewed and it was sent back to USCIS where it stalls.

Almost 90 days and nothing at all for us so far. You have to wait 90 days just to file a complaint or get a petition of expedition taken seriously.

That Post decision activity on the website is their way of saying - get in line.

I pray that you get sent right to the embassy. The NVC/State Department was unbelievable in my case.

Hello everyone, thanks for your help. We received NOA 2 in July, but I'm having trouble putting together an I-134.

I've been living and working in Bangkok, Thailand for the last two years. I just finished a two year contract at an international school. Since then I've been freelancing via my website, and at other schools.

I don't have an employment letter from an employer that will state current income. I'm moving into self-employment, but I don't have a lot to show for that either. I do have tax returns for the last two years, showing $18,500 and $17,800 respectively.

I did not know at the time I applied for the K1 visa, that I wouldn't be able to use a co-sponsor at the Bangkok Embassy. have already asked my parents to joint sponsor an I-864 and they have agreed.

When we applied for our K1 we put down my fiance's minor child on our visa. We were afraid it would be too difficult to get him on later. We do not plan on taking him abroad until we have both settled in the U.S.

1st, Does applying for the minor child mean our household income has to be 3, even if we aren't planning on taking him? If so, can I just say 'self-employed' and send in my tax returns (which should be sufficient evidence)?

2nd, What can I do to show the embassy that I do have income?

3rd, Does the support of my parents mean anything in this instance? Should they write a letter? Fill out the I-864 now?

Any ideas on what I can do? Thanks so much for your help.

This page has some of the information you're looking for:

http://www.uscis.gov...00045f3d6a1RCRD

Scroll down to the figures on meeting 125% of the poverty line (The website is not updated for 2009, but you can find those numbers by searching on google). If you don't meet the income requirement, you can prove that you have assets in the amount of 3 times the difference between your income and the income level you are required to meet. The website says 5 times the difference, but I am pretty sure that in a fiance visa request, it is lowered to 3 times the difference.
As far as whether you are working with the numbers for a household of two or three, I have no idea, since your fiance's son will not be living with you. I would try to call the USCIS and ask. Set aside 4 to 6 hours for this phone call smile.gif

I have a question, I hope this is the right place to post this. My fiancee lives in Thailand, she just went back about 3 weeks ago. She came here with the work and travel program, we ended up falling in love, and might have a baby on the way. I was wondering what is the quickest way to get her over here to the USA so we can get married? She has been looking into programs but they cost $4,000+ which we won't have for a few months, and then she will have to wait 7-8 months to be approved. I'm looking for the fastest way to get her here, we really really miss eachother, and these long-distance calls are draining my wallet. Right now we have a combined amount of $2,000 that we could drop down on visa applications, and we can quickly save up for the plane ticket. I'd do anything for this girl, please help me! Thank you.

I'm sorry that you feel the urgency to get her over here, but most options will take some time. Perhaps she can do the "Work and travel program" again??

But what option are you referring to that costs $4,000? Off the top of my head, I think the visa process has cost me a little over $1000 so far (various paperwork fees, medical examination, travel expenses), not counting a plane ticket.

I use MSN chat and we both have web cameras. It's free and works good enough. For phone calls nobelcom.com isn't bad (8 1/2 cents per minute).

Hi all. I am new hear and have just been reading to get info before I apply for a K1. My girl is in school now and will not be finished till May of next year I am trying to time this so that she will get her visa in June. All of the websites give a wait time of about 6 months maybe 7 but from reading hear it looks a lot longer I was going to apply in December of 09 maybe Nov but do you think that I should apply earlier? I dont want her to get this too early because as I said she will be in school. I am trying to time it so that her school will end I can fly over to BKK for a few weeks we can have a wedding party for her family and then leave together any advice.

Welcome to VJ! Depending on the service center you file with (Vermont is taking about 45 days longer,) you are probably looking at 6 months. Look here:

http://www.visajourn...ge=k1historical

I am in California so it looks like they are a little faster now. I was just worrired because I see a lot of people on here that have taken 1 yr or more and I would hate to wait now and have to wait on the back side too knowing that I could have done it earlyer. maybe I will apply a little earlier and then we can take our time turning in the packets if need be.

I would say you should apply pretty soon (in a month or two). If for some reason your visa process goes very quickly, you can always slow it down by waiting a bit between when your fiance receives the Packet 3 info from Bangkok and when she replies that she is ready for an interview. And then once she has the visa in hand, she has 6 months until it expires. I don't know about everybody else on here, but once I decided to prepare my materials for the I-129f, it took me about a month until I had everything prepared, collated, and copied and ready to be sent out. Including that time, it was ~7 months from the beginning until we had a visa, going through Vermont SC.

I was just approved yesterday, Alan, so now I am in the final stages of finally getting her butt over here to America to marry me. I was waiting until the final, official go-ahead before I bought her a plane ticket.

Korean Air has been one of my favorites. I like their seaweed soup. Last time I flew with American Airlines and it truly was "sorry." Even to the point where the stitching seams on the seats were coming undone. That in itself doesn't bother me, but it just makes ya wonder about the capability of the plane.

Hi Everyone,

For the past four years, I've been sporadically traveling back and forth to Thailand (first to study monkeys, but then after that to visit the woman who is now my fiance). Now that my fiance has been approved at her K1 visa interview (which happened yesterday), I really need to figure out some deal where I can earn flight miles for buying plane tickets to go back and forth to Thailand for the next ~50 years. Has anybody here got some advice for how to do this/ which airline to approach about it?? I plan to buy my fiance's plane ticket this week.

Any and all help is appreciated. Thank you very much.

I had a Bangkok US Embassy K1 visa Packet 3 question that I cannot get an answer for and I was hoping someone here could help:

I need to prove evidence of my assets because my income on my 2008 tax return is less than 125% of the poverty level. I have money in stocks (which is more than 5 times the difference of my income and 125% poverty level) and I also have an annuity (I think it's called that) where I receive money every month from a lawsuit I won when I was injured as a child. My question is: What documentation do I need to prove these assets? I'm assuming just the most official looking documents I have about them, but do they need to be signed or notarized or anything???

Thanks for the help.

To Bonobo: It is up to you what you would like to do. I just told you what I think is doable based on my experience. It was more than a year or so ago, so USCIS may change its rule regarding the translation. Other people with very recent experiences should be able to tell you more accurately about this matter.

Anyway, good luck. smile.gif

Thank you very much for the help, I really appreciate it. Our I-129F is already sent, but in the future I think we should probably get the documents translated by a third party (a third party with a stamp) just to be safe.

Thanks!!

Hi Everyone,

2 quick questions, if you don't mind answering them:

1) My Thai fiance did her own birth certificate translation for the I-129F... was this a bad idea? Who should we get to do translations in the future?

2) I am in the US and she is in Thailand... Do I ever need to go to Thailand throughout this process (I-129F fiance petition for a K-1 visa)? Can she go to her interview by herself with paperwork that I send to her, or should I actually be in Bangkok for the interview?

Thank you for any advice you can give me.

Hi everyone. I just got my NOA1 for my fiance visa request. She is from Thailand.

It seems as if everybody on this board universally has trouble at the interview process. Is this true? Are I-129F's from Thailand more difficult than others?? What is the big problem at the interview stage? I feel pretty disheartened after reading the experiences you have all had. Has anybody got any advice?

We speak every day either through MSN messenger (when my internet works) or I call her. We've been dating since 2005, so would it even help for her to start calling me/ addressing emails to me?

I appreciate any advice or info anybody can give me to help us out in this process.

Thanks.

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting Married in Tegucigalpa, Honduras on Feb 17th
Hello,
My name is Kevin. I am a US Citizen and born here in the USA. I plan on marrying my girlfriend, who is from the Dominican Republic. We plan on being married in Honduras and then once married I planning on filing the appropriate CR-1 process and I-130 paperwork here in the USA to petition to have my new wife come live with me in the USA. Once I receive the NOA-1, then I would finle the appropriate K-3 paperwork and I-129F Form with the Tegucigalpa Consulate.

Question: We are getting to Tegucigalpa on 02/16 and plan to be married at some point during our stay in Honduras. We are staying there through 02/20. Can we get married 'officially' by judge in Tegucigalpa, Honduras? Any suggestions on who we contact to make arrangements? Also, do we need to have witnesses? Unfortunately, none of our families are in Honduras, so taking family to Honduras with us will be quite expensive. I am hoping the Judge that marries us, will have witnesses??? Do we need to be residents of Honduras to be married there?

Also, my finance will need to make medical/doctor arrangements ahead of our interview (once they approve our petition) and schedule the interterview. How/who does she contact (doctor) for this? I'd love for the appointment to happen on the same trip that we make back together to Honduras for the consulate visit. Hopefully arrangements can be made for doctors visit for her BEFORE the interview at the consulate. I'd hate to make another very expensive trip for the both of us.

Thanks in adavance for assistance and quick response!

Desparate,

K-1 Fiance(e) Visa Process & ProceduresMarry my Girlfriend in other country first?? Faster? Better?
I'm checking airfair for the countries that the my girlfriend in the DR can travel too right now. It looks like it's tough to fly from the DR to Mexico. I was trying to find either DR to Cancun, Mexico or DR to Cozumel, Mexico flights. As those cities are easy to get to from the USA via plane for me.

Any ideas? Here are the countries that I found that someone from the DR can travel to without a Visa

Countries with which Dominican Republic has agreements FOR DIPLOMATS and Government Officers to Travel without Visa:

Argentina, Belize, Colombia, Costa Rica, Ecuador, El Salvador, Guatemala, Honduras, Israel, Japan, Korea, Mexico, Nicaragua, Panama, Peru, and Uruguay.

Any help would be MUCH appreciated. I'd personally prefer a country closer to the USA and/or the DR as opposed to having to fly to Asia Pacific or the Middle East

K-1 Fiance(e) Visa Process & ProceduresMarry my Girlfriend in other country first?? Faster? Better?
I live in the state of New York, so according to the I-129F form I just read it will be sent to Vermont. I dowloaded the form and I'm filling it out right now. I plan on sending it out in tomorrow's mail. It looks like I might catch a break on getting the documents timely to the consulate. However, I have heard nightmares that the Dominican Republic (where my love is from) is a high fraud country and has a huge backlog of K-1 Visa requests and it could take 1 1/2 - 2 years for the whole process. Talk about testing our love ;-) Obviously I'm willing to do this but faster is always better. But like you said if it were easy lawyers that do immigration would be out of business. But it always doesn't hurt to read good message boards like this one and a few others I found in my search this weekend and do some good reading of other folks experiences that might be similar to the journey I'm about to take on. Looks like a long ride....I better fasten my seatbelt and be very patient. I wish there were faster ways. But it looks like the K-1 is the way to go

K-1 Fiance(e) Visa Process & ProceduresMarry my Girlfriend in other country first?? Faster? Better?
I am a newbie on here so please bare with me on some of my questions. My proposed spouse is from the Dominican Republic. We definitely want to marry one another, but I want to make sure what ever we do, we do it correctly so I can ultimately get her here with me to the USA (New York). I am a US Citizen and born in the USA. She is Dominican (woman), never married before and has a child. She's 23 yrs, and I'm 33 yrs. We met during my visits from the US to the Dominican Republic, as I am a professional baseball agent to contracts business in the DR. One of my baseball players introduced me to her. We have fallen in love, and I want her to live/marry with me here in New York. She wants to come over first and then after she gets here, we'll petition for her son to come (he's 6 yrs old). I heard that the wait for K-1 or K-3 Visas for the Dominican Republic can be 1 1/2 to 2 yrs (possibly longer....wow!). BUT I also have heard that there may be a 'loop hole', if my girlfriend and I were to marry in ANOTHER country (that she can travel to without a visa) and then apply for the K-3 (or K-1), but I think it's the K-3 then I heard that the approval process could be ~6 months! Is there any truth to this?? Do you know what countries we can marry in? Is there any risks to not get approved if we do this (e.g. the consul we expect fraud or something)??

She currently has an appointment with the Consul on Feb. 7th for a non-immigrant Visitor Visa - but we were thinking of canceling this appointment, as we are concerned that they will not approve the visitors visa to the USA because they will be afraid she will never return to the Dominican Republic, even though she owns a car, owns her own Beauty Salon and successful business, and has significant funds in her bank account + not to mention she has a son in the DR to come back to. The thought is that because she is so young (only 23) that the consul may not even want to look at her evidence (Car Title, Business Ownership Proof, Bank Account balance, etc)? Should we cancel this appointment, as I'm worried that if she does get denied, it will hurt our chances of filing a K-1 and/or K-3 as we know this is a much longer wait? Currently she has never in her life applied for a Visa so I want to make sure that when we do it, we do it correctly.

Thanks in advance!

I've spoken with immagration here in the states and the U.S. embassy in Ecuador. I've spoken with a lawyer although, I'm going to do this myself and done some online reading, that's how I found this sight. I'm just not used to all the abbreviations used here. I also plan to do some more reading on it all before anythin gets sent in. I do have a question regarding my fiance's address tho. He only has a street name. It is very common in Ecuador for there to be no house numbers or street names. Their mail gets sent to the post office (he lives in Puyo), but I spoke with immagraton here and she really couldn't help me much with this specific problem. We don't want to get denied for something this minute. Does anyone know what to do here?

K-1 Fiance(e) Visa Process & ProceduresJust getting started on the K-1 visa
Hi, So I met my fiance in Ecaudor while I was there this winter on a school trip. We are just getting started on this whole visa process and it is more intense than I had initially realized. Is it suggested that I get a "professional forms preparer" to do this or can I do my petition myself. I feel like I have a solid understanding of the process. I am not really worried about getting rejected but is that something I should worried about? Is it often that petitions get rejected. Our story is very plain, we are about 3 years apart and we met by chance, we fell in love and were engaged before I left Ecuador and have been on the phone every day since I've been home. It sucks because some sort of guidance would be awsome, it feels like we are kind of left on our own to go through this HUGE process. I guess that is what this site is for thought! We are hoping to have our petition in by March and for him to be here by December or January, is that plausible? Are we overshooting?

All the forms being sent in for your petition HAVE to be in english. There are no translations in any language. Fill them out for her and send them to her to sign. I also fell in love and he is in Puyo, Ecuador. We are in the process of filing our petition and I promise your questions will keep coming! Good luck and anything that your not clear on...even slightly...ask and get a 2nd and 3rd opinion before you send ANYTHING in. Don't give them reason to make things difficult.

Middle East and North AfricaInterview!
Here is a list of questions I have compiled from different posts, hope these help:

Here are some tips for the interview:

1. Do not volunteer information. For most questions, the shorter and more direct the answers are, the shorter the interview and the higher the chance of success. If the question is a yes or no question, give yes or no answers only. If the question is a simple question like "What is your name?" answer simply with your name.

2. If you do not know the answer to a question, do not lie. Say, "I don't know the answer to that at this time." or "I don't remember."

3. The answer to many questions will be in the papers that were sent in the petitions. Questions like, "what are your husband's parent's names". They will expect you to know the information given in your petitions. Review everything in your paperwork with your wife before her interview, and do a mock interview to see how the information may be applied.

4. Avoid saying "I think . . .". Women do this a lot. The examiner will expect you to know not be unsure, of your answers. Also, avoid adding "umm", "you know" and "ahh" type fillers to your speech.

5. When applicable, don't just state, demonstrate. If the examiner asks a question that can be answered with a document or photograph(s), provide it along with your answer.

For example, if the examiner asks, "What does your family think of your husband?", give them a picture or two with your answer; "They like him very much. Here is a picture of him with my mother and father at my parent's home."

Or, "How many attended your wedding?" Answer, "(give a number, then say) We have some lovely wedding photos of our guests having fun. Here are a few that I can show you."

6. Give American answers for dates and times. 12/24/07, not 24/12/07.

7. Dress well, but not overdressed.

8. Try to appear calm, well organized, and friendly. Nervousness raises suspicions.

9. Remain focused. If the examiner makes jokes, smile and enjoy, but do not make jokes too.

10. Make proper eye contact when conversing with the examiner, and try to control your own facial expressions so that your face remains pleasant and cordial.

11. Be audible so that your examiner doesn't have to ask you to repeat your answers.

12. Organize your papers in a way that will allow you to retrieve them easily and quickly. Examiners appreciate order and someone who doesn't waste their time.

13. When the interview is over, always ask for the results. "What should I now tell my husband about my visa status after our interview?" Before you leave, have them explain any papers they give to you and/or any procedures they will be taking to complete your case. Try to get the examiner's name for future reference, if needed. Write it down.

14. If the interview is in another city than the one you live in, arrive a day or two early to complete biometrics and get the results of your medical exam.

15. Arrive early to the consulate, but also be prepared to wait for a time past your scheduled interview appointment time. Be careful of thieves around the consulate if you have to carry cash. Bring ID; you cannot enter without it.

16. It is rare for the consulate to give you a visa on the spot. Be prepared to return for it, if approved.

For the interview, your SO should bring:

1. Original marriage documents, translations and certifications.

2. Formal, long form birth certificate.

3. Copies of any divorce records or death decrees of former SO(s).

4. Passport, with an expiration date of no earlier than 6 months. Try to have more than 6 months before expiration.

5. Police certificate with "Nothing" written on it, indicating no criminal record

6. Fingerprints (consulate will instruct you regarding how, when and where these will be taken). There is a fee for this.

7. Medical exam results (consulate will instruct you regarding how, when and where this will be taken). There is a fee for this. Make sure you get a copy from the medical examiner.

8. Passport type photos of each of you. (consulate will instruct you regarding these)

I made a list of what I've seen other people say their SOs were asked at consulates. Make sure that your fiancé can spell your COMPLETE name.

Congratulations Prena and Layth!!!
I am posting this at Prena's request. The usually calm and so supportive lady is way to excited to do so herself! Layth's AP is complete, he dropped his passport with Aramex today, he will have the passport and visa by Sunday, and he is expecting to be here with Prena by the following Thursday, InshaAllah.
Another success story from Amman!
Congratulations to the two of you, may life and love treat you kindly!
