If the answer to both those questions is yes, then divorce him, stay in the country, and file for the 10 year green card without him. You don't need to stay with him to become a citizen.



But what do you mean by saing she doesn't need him. He has to give her Affidavid of Support again for 10 year GC?!?!?!?!

As far as I know with having Green Card you have to live most of the year in US (so it would be over 175 days/year or so?) but am not 100% sure how it works. My husband and I are also thinking to move o my home country sometime in the future, but probably after I will get my citizenship...

Tatiana and I have a similar situation (described in my signature), and I know about the frustration. And honestly, there is no reason obtaining any document or permission to marry someone if you are a citizen of this country should take as long as it does at times.

And I understand where Manuel is coming from. I try to be the voice of patience when it comes to disheartening news (or no news at all) during this process....but there are many times I just want to scream. Having a voice of reassurance is always nice and it seems Manuel is doing that for you.

the hardest aspect is that we are powerless during the wait-there is no definitive light at the end of the tunnel to focus on. So the wait seems to take forever. If I had the option, I would take days off my career and drive up to Vermont and sit in the lobby, waiting to walk the petition to the right desks and see that it gets out of there in one day. I'm smiling at the thought of that actually being a possible course of action. But it's not, so all I can do is reassure her, that in 30 years, we wont remember the months and months of waiting because there will be a lifetime of great memories that will cloud this time - so when the wait really gets bad, to just focus on those times that are ahead (your life together).

I read in an interview that one of the directors of the USCIS said there just isn't enough manpower to answer calls about each petition - but you'd think they could take calls on the petitions that are under RFE or review status. That would be nice.

Hang in there - each day is a small step forward to your life together.

@Dacko, I disagree that the USCIS is not concerned with our pursuit of happiness. My fiance and I received a hand written note from our adjudicator with the words "Good job, thank you. =) =)" It might seem trifle to most, even silly, but the fact that this person took time just to drop us something like that is encouraging. It's a reminder that there are REAL people who work for the USCIS, and at least some of them do care. There are people who care within that giant, horrible bureaucracy. But, I'm not so naive to think all of them are like this (undoubtedly, some of them could be jacka$$es), and to think that cases don't fall in between the cracks sometimes.


I always did imagine there were good people working in the USCIS - and it looks like you did the equivalent of striking oil, in having one of them take your case. For the most part, I am sure they are like every other government office, very cynical and not pressed for working class terms such as "productivity" and "efficiency".

What my gripe is - is that the entire USCIS system is against that pursuit of happiness in that it relies too much on human error/employees will to go the extra distance. Too many middle men, and the customer service (even the immigration officers) have no access to active cases or petitions. It would be like calling your cable or phone company with a complaint about your bill, and their operator's would say "I'm sorry, I don't have access to your account" Then what's the point!?!?!?!

That is the basis of my post.

I am, however, relieved to see that you found at least one who took the time to see your petition to the next level. That was very nice of them.

There should be a rant and rave section in this forum - the good Lord knows I'd have one heck of a post in there.

All kidding aside - every journey is different. The range of emotions we must go through in this process is as vast as the distance some of us are from our significant others. and yes, we can all search for the good in the bad - it makes us stronger, etc, etc. But at the end of every night, I always come to the fact that not one citizen of this country should have to wait as long, jump through as many hoops, and fear/worry/hope/guess/pray as much as we do, just to marry the person he/she has chosen to wed. Life, Liberty, and the pursuit of happiness is guaranteed in this country by our laws, but from what I have seen in this process - the USCIS doesn't care much about our pursuit of that happiness.

But that is another rant.

Stay strong, and find the good in the bad, it will help a little.

It is different for everybody from what I have seen on this site.
Some are extremely fortunate and the time flies, others have to wait and wait.

I wish I knew a trick to make the wait easier, but the fact is, all of my life, no matter what the goal, there was always an end-time as to when you could set your sights and focus on. From a military enlistment, to starting my own business - all I had to do was focus on the end-date, work hard, and eventually I would reach it.

This is the most difficult wait of my life because there is no exact end-time to focus on and the wait just seems much worse. It's a mental work-out of the highest order.

Hang in there - the light at the end of the tunnel eventually gets closer.

I have filed a K1 visa, and now I need to fill out my I-134. My 2008 tax return income level is not 125% of the poverty level, so I will need to prove that I have assets worth 5 times the difference. I do have this amount of money, but I have it invested in stocks. I also have an annuity (I think that is what it is called) where I receive a sum of money every month from a lawsuit from when I was injured as a child.

So, my question is: What documentation do I need to prove these assets? I can just send along the most current, formal looking paperwork I have, but should it be signed or notarized or anything? Can I just print out my latest stock value report?

The woman in the US Visa Center said I needed to contact Bangkok's US Embassy, as every country has different requirements, and the Bangkok US Embassy secretary gave me an email address to contact which, not surprisingly, has never responded to my inquiries.

If your check was cashed, then they should have you on file, so I wouldn't be worried, BUT, you should have gotten your NOA1 by now. I would (try to) call them. I have no idea how easy/difficult it is to get a person on the line at the VCS....

Hi Everyone. This website has helped me out a great deal and I just got my NOA1 on January 30th, 2009. Thank you for starting this thread.

I had two small questions:

1) My fiance translated her own birth certificate and signed her own "Certificate of Translator" page. The rules never said that you could not translate your own materials.... Was this a bad idea?? What did other people do for the translation?

2) Are some countries more difficult for getting a fiance visa than others? Or do all countries have the same standards which the I-129F packet has to meet?

I had a decent packet of materials I sent in, but not as much as what some others have posted (no ring receipt). I am scared of getting an RFE, but judging by the dates I see on Igor's list, it looks like RFE's are addressed pretty quickly at the service center once you send them the extra material. And every RFE is followed by a NOA2... so that leaves me hopeful.

My wife recently had her interview.... they handed her a pink paper (it doesnt say anything about AP) and took fingerprints. They said they will mail the passport after some processing... does this mean we are on AP?

Did they give her a white paper with the pink slip as well? Either they give you a paper with the information on where to contact AMEX or they give you a letter stating that your case requires further administrative processing.
If they took her fingerprints and said that they will mail the passport after some processing that leads me to believe she is on AP.

i just want to scream!
i went to chk the processing dates on https://egov.uscis.g...eviceCenter=CSC
and they havent listed the timings for I 130 for spouse!
i chked on 18th may and they were processing the cases filed on 13th november 2006 and my case was filed on 30th november 2006

we filed at the california service center
now that i have chked i noticed that of out of all four service centres the only service centre showing the I 130 for spouse or child under 21 (we also filed four our son who just turned 1 (MA) ) is the Nebraska Service centre which is showing that the current cases being processed are the ones filed in September 2006

does that mean that the I 130s for spouse and child under 21 has been transfered to Nebraska Service centre??

if thats what happened then its ROTTEN coz i got pushed three months back!!!!!


Your I-130 is approved so don't worry about the processing times listed, you case is probably at or on its way to the NVC.

After getting same reply twice. I have created a TEMPLATE and sending them SAME Template again and again.lol

my husband, a us citizen, went to us in the end of november 2006.
we have been married for 2.5 yrs but decided to move to US now.
on 30 november we got a notice saying that our documents have reached them
and now after 6 months i chked the status online which said

On May 30, 2007, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

can anyone tell me what happens after this?
i mean did they send any package, or forms to my husband to fill?
my husband is almost always travelling there, so sometimes his cousin takes care of his paperwork.
but i am kind of worried if he might mess up something

any help will be appreciated!

The notice that they sent your husband is called NOA2 or "Notice of Approval"
A few weeks after you have received your last Notice of Action indicating the approval and forwarding of your I-130 application to the NVC
The NVC will send your husband a packet of forms that you and your husband must fill out before you can be given an interview date with a consulate abroad.
The packet will likely contain an Of-169 form, and an Of-230 part one and two forms that must be filled out by you.
An I-864 (Affidavit of support) form is also included that must be filled out by your husband.
The I-864 is the Affidavit of Support form that requires copies of your husband's past 3 U.S tax returns (or tax transcripts which are free from the IRS) as well as any bank or financial records available.

Is CR-1 requirement different from K-3? I thought the documents they ask are to be brought with you for interview. If you send the originals, do they give it back during the interview?

The letter I posted earlier was from a good friend (not my wife's) and it does not ask to "send" those documents but instead asks to "bring with you" for the interview.


Cr1 is sent a Packet 3.5 and then once they send all the forms in they are scheduled for an interview, With K3 you get the interview date with your packet and you do not submit it in advance.
K3 : Bring all forms and Documents with you at the time of interview
CR1: Send All forms in and then you are scheduled for an interview

Questions ...

What do we need to send the embassy back at this stage? All the documents mentioned above sans medical report (since it says schedule medical as close to interview as possible).

Do we send the original marriage certificate etc. and then they schedule interview?

Also, since we sent DS-230 as well as I-864 to NVC, so I trust we just write a statement of this effect? I am curious though, which situation would require those two forms to be not submitted to NVC.

Since it's the Cr1 Medical, make sure he takes all his vaccination records ( If any) plus takes his whole packet 3 excluding the forms and 2 photographs as well as copy of passport and original.

I see there are some others in the same situation too, NVC claims my wife's IR-1 papers were sent to ISL at the beginning of the month, but no word from embassy yet. Anybody get an acknowledgment from embassy regarding any new files lately?


It took my wife 10 days to get it after it was transfered from the NVC but that was for K3 so I don't know if takes longer for Cr1.

She also received a semi-sealed package and was told not to open it. I believe this is for the immigration officer at the POE. She can see inside the envelope and said all her checklist documents appear to be inside.

As you can imagine, I'm pretty happy about all of this. It also shows some hope to the others that were worried about their future interviews.

I know how these procedural delays and the wait kills you. Insha-Allah it will be fine and the long wait you two have endured patiently will bring it many good news. (Insha-Allah).

I am watching the timeline all those who are going through this because I will be going through these once my wife's K3 gets started.

I heard that the normal time for renewal/fresh US passport in USA is 120 days now-a-days.
