I'm wondering, we filed a CR1 and our case was completed last week -- will the AVR at NVC change to reflect when it's been sent to the embassy? I'm sort of lost as to how this last process works.

The NVC assigns us (if they ever do!) an interview and then forwards our files to NVC? Will the AVR reflect this? Otherwise i can probably stop calling every couple of days or more often...

I've been following your case from the very start and I wanted to start off by saying that I wish you tons of luck -- your story broke my heart.

My humble opinion? Bring all your ties to Finland with you, anything you can muster, letters from parent's as a sort of rental agreement, bank account statements, anything, anything at all that ties you to your home in Finland. Then, bring a copy of your NOA1, get your husband to scan it and email it to you. Pack light. Even for 90 days, pack light. Don't bring anything that makes it look like you're going to pre-establish yourself in the US. When you're at customs, start small, answer their questions honestly but don't elaborate unless it's asked of you. "Holiday." "Visiting Family." When you'll be back and all the others. If they open up the line of question that entails you to bring up husband say so, and go from there. Your notice of action letter and ties to Finland and return plane ticket are key here. Remember mrsB, you're not doing anything illegal or wrong. You're allowed to go, you just have have to show that you plan to return to Finland. Do NOT lie to the POE officer, but start small and follow their lead as to what they want/need to know. Be calm, make eye contact and keep in mind, you're not a criminal, you're not doing anything wrong here.

I wish you all the luck and I hope you make it and get to spend 90 days with your husband. Please let us know how it went, okay?

PS This is how I have travelled from Canada to the US dozens and dozens of times. Of course, it may be different coming from Canada but they have just as much right to turn me back as they do you -- maybe more as it would be easier to transpose my life from here to there across the border. For what it's worth? This method has always worked for me and when I'm standing in the customs line, I have always had the mantra of, I'm not committing a crime, I am not doing anything wrong and well, it's gone pretty good.

Due to this, I've planned to go to USA with the visa waiver my country has with them and stay for the maximum amount, which is 90 days. I'll come back to Finland earlier, should our visa case see some progress. Since November 2007 I've lived at my parents' as I haven't had any kind of stability in my life due to this visa process. So I don't have an apartment here or a job which doesn't really help me here. However, I do have possessions in Finland AND my dog and obviously I'd need to come back to Finland for several reasons, such as my asthma check up later this year and for the fact that I don't want any troubles with the visa.

I've never overstayed in the USA and I've been there several times before we got married, for a total of about 10 months - give or take. I plan to have a reasonable amount of money with me and I'm staying at the apartment my husband got us 2 years ago.

Now to the actual QUESTIONS...

At the airport in USA... They'll check my passport, ask for my fingerprints and ask me why I'm there and how long I'm staying. What do I do at this point? Obviously I will have a return ticket with me or at least the proof that I have a flight reserved to take me back to Finland at the end of my stay. The honest reason for my visit is that I'm visiting my family (my USA-family) and friends and we plan to have a "2nd wedding party" among other things. We want to get some more pictures of us at various places etc. in case we'll need the proof for later and obviously just spend some time together finally. Do I go into detail about our visa process? Do I go into detail about the marriage? Or just keep it short and sweet and say I'm there for a vacation and to visit family & friends? Any tips? Ideas? What have your experiences been if you've traveled while your visa is being processed?

There might be more questions as we go...

Not sure what you mean by that second question, really... I do believe that once you get your visa that yes, you are required to cohabitate... you mean your CR1 visa right? If so then yes, I believe that is mandatory or else they'll have an easier time citing you for marriage fraud even if that may not be the case.

I don't believe that the USCIS/NVC are well versed in atypical domestic set-ups you know? Like a couple not living in the same house and such.

am totally happy to be corrected by someone else more in the know...

Just wanted to say that I read this and I feel for you. It's so hard, the waiting. You did what I want to do, move, sell my stuff, ship it down to the US but I'm afraid that I'll be left in the lurch due to the possibility of a very long wait and for who knows why?

From what I read, and we have sent all that stuff, it said 'original divorce decree OR a certified copy. The certification certifies it as a true copy of the original.

His divorce lawyer sent him a copy of the certification as well. I know it won't be a huge deal. I was just wondering. Our lawyer's letter is the original as is our Statement and the marriage application.

Well, I guess we'll have to wait and see as it's sent.

Hi all...
I'm in Ontario and my guy is in the US. He was divorced about 2 years ago and thusly, now that we're trying to get married, we have to send all our papers to the Registrar General. You only have to do this in ONtario to prove that a foreign divorce is valid.

So, got all the documents done, got the letter from an Ontario lawyer and his divorce decree with a letter of certification.

My only concern is this... the actual certification from the county clerks office is photocopied, as that's what his lawyer sent him. I'm just wondering if anyone knows anything? They only want a certified photocopy of the divorce decree, I just dont' know if the certification was allowed to be photocopied or not.

This will not prevent us from getting a license, it might just delay it. It's just really annoying as we just want to start the first step and we're already experiencing red tape and such.

It's not a huge deal, as he can just go and get the original and all but i'd just like to get some feedback and get our stuff going. As this is only step one.

Hi there... about to get married finally and begin this huge process. I would like to take my husband's last name. Since we haven't filed yet, I'm assuming that will be okay? In Ontario, a spouse can assume a last name based on marriage which means that the name on my birth certificate won't change but using my marriage cert. or even the solemnization, I can change my name everywhere else including passport and whatnot.

So, my question is, is this going to cause trouble with the whole immigration process in the long run? Has anyone else done it this way and had either no problems or a whole lot of them? I'd really like to assume his last name, change all my stuff and then get going on the long process of the CR1.

Any help regarding this would be appreciated. OH and on another note, what the heck is with the registrar taking 10 to 12 weeks to register a marriage?? Is that time line for real? Just saying is all.

Here's a question... we're getting married end of November and t hough married and having the solemnization in hand, the actual marriage won't be registered for 8- 10 weeks. Thus, we haven't even started to apply for our CR-1 visa yet and can't until we have our certificate. My question is, I'im the Canadian and he's the American, since we'll be married, when we file our income taxes this January, do we have to claim one another? Can we file separately? I haven't lived or worked there, only in Canada so... just wondering. Plus, it doesn't even look like the marriage will be registered for almost 10 weeks, well into the new year.

any help would be appreciated at all.

Okay, if my visa goes through, CR-1, and I make the move to the states and I QUIT my job to go there on my visa to be with my spouse, am I eligible for EI? Or if I'm already with green card, does this negate that?

Also, if you quit your job, are you still allowed to collect EI?

I thought I had this figured out, but he's filing t here, I'm his wife, does he claim me? Do I claim him? If so, do either/both of us pay taxes on the others income? How will we be penalized? If at all and god... this needs to be easier. It's freaking out as he thinks that if we pick the married box on our respective tax forms, we'll have to be responsible for our own income plus our spouses...

Any help will be appreciated. If we claim each other, are there advantages? We both have very good incomes so... it's not like one of us isn't a wage earner, we both are and we're in the upper levels of wage earning so...

So, I don't have to go to an acceptance agent?? We can do it all ourselves? Doesn't my passport have to be notorized? I was told I could do that at the US consolate in Toronto but from what I can tell, it looks like they no longer do this and suggest we go t hrough an agent.

Okay, so I'm figuring out the ITIN procedure via the w-7 form from the IRS.

I know that there are a list of selected agents in Toronto and that I have to go in with the completed w-7 form
my passport and a copy of my passport for them to verify. And that this is what the charge is for, right?

I have been quoted from 100$ up to 500$... what did you all pay?

i was told by one agent that I could do it at the American Consolate office in Toronto but upon looking at their website,
they say that they no longer do this anymore. Is this true? Did I misread the website?

Should I be paying for this service? If so... how much?

Saw your tax answer to me and wanted to thank you! Some more questions if you don't mind? My husband makes quite a large amount of money in the US. I do fairly well in Canada. We've not even begun our visa journey as we're waiting for our Marriage certifcate.

So... he's worried that I'll have to pay loads of taxes if I file with him or he'll lose a lot. how should be file? we haven't lived together yet or have supported one another yet?

I'm SO sorry but you're going to have to tell me what the heck MFJ and MFS mean. I'll bet it's something really s imple but I just don't know!

OKay. ANSWERS. Since no one was able to give me a sufficient answer to this questions posted everywhere.

I just got off the phone with Canada Taxation. The answer to my question is:

When filing in Canada, you'll have to give Canada Tax the name of your spouse, date of marriage an how much they earn. This may effect your eligible refundable and non-refundable tax credits but you will NOT be taxed on his income. In the US, he can file as Married, filing separately. This way, the does his tax thing, I do mine and when we're living together, then we can do our taxes together and figure out that stuff. The thing is, he makes good mine, as do I and neither of us needs the tax credits or breaks that one would get so, I was merely trying to figure out how the cross border system worked.

This was the answer I was looking for... I figure someone else might be curious about this, this is your answer.

So, to be clear as, he files HIS taxes in the US, as married but filing separately... and I file MY taxes here in Canada as married but not claiming any of his credits or anything. Is that right? His income won't effect me as I'm not claiming anything?
Is there a form to go with my taxes that will show this? I just figure that while we're not living together and sharing income, we should'nt have to have our taxes impacted.

So, we get married at the end of November and then he goes back to the US and I stay in canada and we start our immigration process. So, when it comes tax time, how do we file? Our finances are not intermingled at all and I pay for my housing and everything on my own, as does he.

So when I file my Canadian taxes, and file as married what happens? is there a form you fill out to let the government know that you're in the process of immigrating and thus, don't live together yet?

Your help is VERY much appreciated.

Still waiting for marriage certificate and thus, can't really process anything yet but I am going to see Mr. LGG tomorrow for a couple of weeks.
Anyway, just wanted to pop in and say Merry Holidays to everyone and to thank you for all the help that you've given us so far -- seriously, if it weren't for this site and people willing to answer questions this would be a way harder task to accomplish.

No, you do not have to change your passport. I still had 3 years left on mine when I got married and I darned sure wasn't about to pay another bunch of money and go through the hassle of getting guarantors, etc, until it expired! laughing.gif

You just need to make sure that all flights are booked in your passport name. I did have one CBP Officer who gave me heck for not using my married name when he looked at my passport (Pearson International), but he was a jerk anyway. mad.gif All the rest have been fine.

Sorry you have to wait so long for the marriage certificate. That sux. sad.gif
