To be honest, I DO find this interesting. Gosh, I should have signed my letter, LGG!!!

ANd don't you all find it funny that the head guy is working? IT'd be like where I work, having the head of marketing trying to pull out a script and design it
and then send it off to press -- no way would that happen.

Sort of impressive and makes me wonder, how short handed are they...

OH NO!!!
You misunderstand, you did NOT offend me... no, no, no... the very notion that they would even say anything got me filed up. I'm speaking as someone who is prepared and has done the paperwork and will arrive fully armed and ready to go and if it that were NOT the case, I would be fine with the denial, reprimand and egg on my face... as it were. And it's not directed at a "human" specific emotion or one person, I realize that they are people doing a job -- my frustration is aimed at the consulate in general and their poor dealing and processes regarding immigration.

No, no, no... you did NOT offend me at all, that's silly.

lgg, the "stung" wording was mine, not theirs...and that observation was mostly based on the fact that the lady even mentioned it while we were talking. I'm not trying to downplay the wait times or the frustration, just sayin the employees are humans too.

I think some of the things that got them weren't people's frustration with weight times, but rather the anger from people who don't follow directions or come prepared for the interview process and lash out at them because the documentation wasn't correct. I'm sure there have been some not-so-nice confrontations on-site, and I've read some nasty reviews on here blaming consulate workers for things that weren't necessarily their fault.

Sorry if I offended you.

Congrats you guys! That is amazing!

On another note, however, They've been stung??? If I may say, Poor them! Really? They're hurt by how frustrated we are with waiting for months and months with no reason given for our interview? I call B.S. on that one. I don't plan on saying a single thing about all that to them, I will be nice and deferential and stuff but hearing that they've been 'stung' by our very valid frustration is a crock of shvt to me. Call a freaking Wahmublance then...

Not aiming all that at you ScooterMac but how dare the consulate be 'stung'. We're here waiting yet another month for an interview, us CR1s, some us from June and July -- on this site, they only scheduled a couple of interviews for December. How can they expect that we're going to sit here waiting endlessly when Obama said that immigration is to reunite families. When a ton of other consulates are pushing CR1 interviews at a rate of a few hundred a month. Brother...

They're stung? I'm freaking stung...

Geezus...

Canadak1 switch to AOS???
So are you working in family law? Are you a lawyer? Do you work for USCIS or NVC? If no, then you're spraying this whole thread with noxious hearsay and hypotheticals that may or may not stand to be true. Sure, maybe someone can bilk the system and sneak on through -- no one said it couldn't be done. Should it be done? Should we/you be telling people it can be done? No. You're remiss not only because you're spouting hearsay that may or may not be true but you're advocating that doing something illegal is the correct way to do it lest you get caught.

So, I'd advise that think you're right to yourself and go ahead and gloat mightily to your wife/husband but don't disseminate half truths and blatant ways of circumnavigating the law on a board that simply states do it the RIGHT way or get out off this site.

Okay?
Thanks.

QUOTE
Read my previous post to the end. Especially the part where I mentioned the court tested exceptions for immediate family members of USCs. I explained. I didn't say it wasn't wrong to do it that way. I said it has been tested in court. The case law decisions relating to this topic indeed declare that such actions are wrong and are negative factors when adjudicating adjustment. However in their rulings they determined that being the immediate family member of a USC was a significant positive factor to the extent that it outweighed certain adverse factors. The adverse factors that were outweighed were the 3 that I mentioned earlier--prior intent, working without authorization, and overstays.

Just saying "what you think should be the outcome" doesn't help anyone and perpetuates bad information.

Canadak1 switch to AOS???
That makes NO sense at all. The whole point of the AOS in this manner is that you unintentionally end up getting married on a visit and there was no preplanning of a marriage before hand as if so, it is considered fraud...

John and Marlene... you're USC/Philippine? Maybe the laws are different there, I'm not sure but I am pretty sure that if you file for a K1 visa, it's a fiancee visa, and then try and get married and adjust status, you could end up in a whole world of trouble....

If you're going to answer so succinctly and with such assuredness, would you mind backing it up with some sort of explanation or example. Just saying "you're wrong" doesn't help anyone.

Explain why I'm/we're wrong.

I"m sorry john and marlene but huh?
I didn't understand your post. ARe you saying the AOS WILL be possible as per then a subsequent U.S. entry will most likely be successful when married to a USC.
or are you saying it is NOT possible as per It is not impossible.

I'm sorry, as someone who's read a TON about immigration, I am confused by what you're saying so I can only imagine how someone who is new to this might feel.

Thanks...

I don't think you can A.O.S once you've applied for the K1... in fact, it's impossible at this point as you've already alerted the USCIS and such that you're planning on getting married -- thus, negating the whole idea of ending up married on a visit and just adjusting from there. I'm pretty sure of this but there are TONS of very wise/knowledgeable people in this site who will give you correct advice.

It is not impossible. In fact an AOS filed from within the U.S. even after a K-1 was filed and then a subsequent U.S. entry will most likely be successful when married to a USC.

Being an immediate family member of a USC has been tested in court to be an overriding consideration for AOS that outweighs negative factors including prior intent, working without permission, and overstays.

In my humble opinion, separation and such is a flat out truth to this whole state of affairs but as Canadians, we're usually fairly lucky that we have the means and the proximity to visit. Plus I think I read that you're visiting for a few months? That'll definitely take the edge of the whole waiting process. It goes by fairly fast though...

Good luck...

I got a gift from a member yesterday, it is this hat called "Pony hat" and its a toque with the hole in the back for your pony tail.. its really ridiculous... plus I have short hair but whatever, it's the thought that counts.

But the funniest part was that this hat has kind of haunted me and my coworker because the lady who makes/sells them was a vendor at our annual 'ladies night out' shopping/fashion show on Friday.

The vendor called a few weeks ago to reserve a spot and told us about her product and I told my coworker and we laughed at the thought of it. Then she comes in on friday to set up her table, and she was wearing one of these hats. They were sooo funny looking! Like borderline terrible.

And then who gets one? ME! I do! laughing.gif

It's just sort of funny and ironic. I'm going to regift it to someone with long hair for Christmas... tongue.gif

CanadaVisiting the US while CR1 in process
Hi Kuds1...
smile.gif

Well, flying or driving is up to you -- whichever is easiest and cheapest are what you'll need to figure out. When you travel always bring your 'ties to Canada'. These are letters and documents that prove that you intend to return. Copies a rental or lease agreement/ letters from an employer stating when you're due back to work that that at date of travel your are currently employed. Copies of bills in your name, with you Canadian address on them. Enrollment letters from schools for yourself or any children. Anything and all things that prove that your live in Canada and intend/must come back.

I always bring a letters from both my jobs stating when I'm leaving and when I'm due back and how long I've been employed with each company. A letter from my landlord stating I have NOT given notice and am still living there. A copy of my rental agreement. copies of my most current phone and cable bills. My return plane ticket itinerary. And I also bring a copy of my NOA2, my USCIS approval letter. I always pack light, as in I never check a bag. I always just bring carry-on and that's it. I tell them that i'm visiting family and friends and if the questioning leads up to it, I tell them my husband and that we're going through the immigration process.
They can STILL turn you away but if you all the letteres and stuff that prove your ties to Canada, chances are slim. I think it's good too to show them your NOA2, its proves t hat you're aware of the immigration procedure.

So... anyone have anything else to add?
Good luck, Kuds1, just pack light, bring your letters and don't lie. Things should be okay...
Best,
LGG

Hello,

I'm planning to visit my husband in the US for the first time since my visa processing, but I'm kinda nervous of getting rejected at the border. So I wanted to ask everyone what the best way to go about it is.

Should I fly or drive? What do you usually tell the officer at the the border? Should you just say you are visiting family or that you are waiting for a visa interview and that you are visiting your husband?

Finally, what documents should I take with me, if I don't have a job, to prove my ties here.

I had decided to wait it out till my visa apporoval, but now that we don't have a december interview, its really forced us to reconsider. Especially with the holidays coming up and our first anniversary.

Any help??!!
