Hey all, i've seen an assortment of times for the acceptance of the choice of agent thus the generation of the IV bill? It's only been 6 days with a weekend in there so should I just chill out for a few more days?

besides, my police cert only got put in the mail on Friday and my husband is on vacation so it's not like I can do much with it, just wanted to see the next step bounce up to me.

Go for the CR-1 . It's less expensive and your husband will have a green card immediately. IT does not take too much longer and is the far superior visa. File the I-130, once that's approved then you'll send a ds 230 and an AOS to the NVC and then he'll interview at the consolate in France. if approved, he'll have his visa in about a week, don't know about France though and then have 6 months to move to the US.

Please read the guides but as far as I know the K3 is becoming obsolete and you'd be far better off with the CR1. Best of luck to you. If you've filed an I130 already, you're already on your way.

This part only pertains to the beneficiary, no?
So this means that the USC does not need to send a birth cert, Police record or anything like that.

The DS230 is strictly based on the beneficiary and their information and original documents. I"m confused as to why you, the USC, are sending your birth certificate as well?

Let me know if you've some information thta I've not been made aware of.

The short answer to this is no. The CR-1 route is to be taken if you get married and then leave the US to allow the processing to take place and such (see the guides for an explanation of processing) What your friend did was illegal and they, most likely, did not get a CR1 visa. You are NOT ALLOWED to enter the US with the intent of marrying and then staying -- this is illegal. YOu can get married, but you cannot stay.

We would all like to take this route, we all dread having to come home and be apart from our partners but in order to do things legally, it is the way it must be. An FYI? Don't kid yourself or waste money on a lawyer who you think is going to tell you otherwise -- there is no way to do this legally. If you just 'happened' to pop by the US to visit your guy and just 'happened' to get marred and 'just happened' to not have ties to the UK and such, perhaps it could be settled and the US govt. would accept your attaining landed status but it's very hard to prove that you did not intend to marry. In fact, almost impossible and in in being caught doing so, you risk being banned even entering the US for a good many years, if not for life.

A lawyer will NOT help you break the law and again... we ALL hate being apart from our loved ones and if it were as easy as all this, would you not suspect that there would be far less people on this board? Or this board's existence in general?

Oh my gosh...
I'm starting to get a little impatient here, sent in my DS 3020 ON July 14 and it has STILL Not been accepted -- sent in a hardcopy on Thursday...
We just want to pay the money and get going...

Should I start to worry? Based on reading the timelines of others, 2 weeks is not so much a wait but some people got there's accepted in two days.

I'm not talking about if you have a lawyer because if you do, it's a whole different story, talking about independent filers...

Hey! That's a really good idea! Last week went I went into the USA, I could have used some sort of distraction as I was literally a stressed out cheese curd myself thinking they were going to send me back to Canada and wreck my vacation with my husband. I should bring some cheese next time. Though I'll probably end up eating it while waiting in the customs line! wink.gif

They didn't even ask me to look at any of the 8 million letters of ties to Canada I brought. Oh well, better safe than sorry.

Good call with the local beer -- Canadian beer is still the best in a US/Canadian comparison. Though, I've had some pretty good ones in the US...

Most people dont' get both bills generated at the same time UNLESS They use a lawyer.

My understanding is that you should call NVC and verify that "The DS-3032 has been generated". Then do the barcode and send it in. Alternatively, you can email. See instructions. Personally, I would not trust any email process but I guess it has workd for others.... Key is that you should not send in the DS-3032 too early.



i actually called NVC and gave all the info over the phone instead of DS-3032 and the operator took it and send me an email for the bill.
maybe i got lucky but thank god i am done with everything.

this is what I thought but that last post by whomever stating a very DEFINITE you must send, made me just decide to send it. I figure, if it's too much information, they can just disregard I hope.

But this has also made me realize, this and a few other things, that when people post very definite answers, they need to be very accurate or else submit said answer with a caveat or some such thing. I tend NOT to give definites unless I know that I am 100% correct on things otherwise you can confuse people. Adding a caveat will most likely spur someone to proceed with caution or research more but a hugely definite answer is a little daunting.

just a bit of an opinion there.

If you (the beneficiary) had a divorce before, you should send it in.
Otherwise, your spouse's divorce papers is not needed for the DS230.
DS230 package is an assessment of the beneficiary's eligibility.
You need to bring it to the embassy though.


Hi LGG,

I am the USC in my case and even though both my husband and I have been divorced, we only sent in the original certified divorce decree (and a copy) for his divorce to the NVC. The NVC is looking only for the beneficiary information, so you don't need to turn in anything relating to the USC. Good luck!

YES, she should be calling! You have to call these guys are they'll just let your file fall to the wayside and then you have to go through the whole thing again. Get her to call ASAP. I call them once every two weeks at least as like I said, they really aren't great about sending the cards and stuff.
Get her to call, man... the sooner she does the sooner she'll see some cash in her account. You can see your file online but they cannot process out of state claim cards on line, you have to do these in hard copy or over the phone. The only thing you can do online is see your account and when cards are due and stuff like that.

How long does it take to evaluate a case? Mel applied for EI over 2 months ago and received some paperwork and we sent back the requested info and a copy of her greencard. We still have not heard back anything in over 2 months. I keep telling her to call, but she tells me that it's done all online and we just have to wait. So I guess my question is, is 2 months a typical timeframe for them to decide on someone's claim? Is it all done online, or can you call a number to inquire about your status to get better information?

I replied in the vent thread but I will here too... I NEVER let them not pay me every two weeks. If cards or updates are missing, I call and get them to straighten it out. I mean, I/you/we have paid into this and I think that they should be sending you your money. Like I said in the vent thread, I call them to ensure that my payments go through every two weeks. I'm polite and such and am always told, oh yes, call us if you don't get your stuff or get paid and whatnot .So... I do.

Thanks Lgg, I just finally got through. Apparently whoever I talked to the last time I called to get a fax # didn't put any notes or requests to have my cards send out again and they were returned so they put a fail to report on my account. Now I have to email them to beg that they pay me. *sigh*

I find that they are the WORST at sending out those damn cards! It's so rare that i get them without calling first or soemthing. Most times, I've ahd to fill out my cards over the phone. Call Donna at the out of state claims office number and she'll do it for you. I find that she's not so good at getting stuff done, I have found a woman named Patty is awesome. She's on vacation though til the end of the month. But i you can reach patty, do so, she's way better and getting it all done and stuff.

there is no sample form for the reason of leaving. Just tell the head of HR or whomever does that to put that as your reason for leaving. For both my jobs that I quit, I asked them to use the phrase, quit to relocate to be with US spouse as in order to collect EI spouse needs to be American and you have to be relocating and such.

I would start the claim as soon as he has his last day of work in canada. You're right, he won't get any money until the EAD stuff but at least the file is started and he's in the system adn then once he's in the US, he can file or send or whatever the forms that they need. The out of state claims people are very helpful. I much prefer Patty to Donna btw, she's been a saint to me. They are only okay with sending out the cards so you'll need to keep an eye on that and the pay days. I have found that if I'm within a day or two of sending the new cards and haven't got them yet, I'll call. and if it's a day or two before I'm due to get paid and no cards, I call and we do it over the phone. You are supposed to get cards but they aren't that super at it but they are very helpful when you call and such.

So good luck, hope it all works out, it's a very handy thing to have as a new USA person learning the rope and job searching and such. Having a bit of your own money coming in makes a huge difference.

So, from reading the thread, my K-1 visa holding fiance' should have his employer list "Relocated for spouse/getting married" as the reason for ending employment (I thought there was a sample form, but for the life of me, I can't find it anymore and I wanted to send the link to my fiance').

I am wondering if he actually can't file a claim until he gets to the U.S.? I know he can't get money until he gets his EAD after we get married and file AOS of paperwork, but starting the claim within a short period of his arrival in the U.S. is necessary? He would like to turn in the paperwork before he leaves Canada (aka after he quits but just a day or two before he moves). Can he do that?

Then he moves, marries me, then we wait for EAD, once he gets it, sends a copy to the ïnterstate claims office then start filling out the paper cards they send or do it over the phone? He is saying something about "NO, NO, YES, YES, NO" and then his check comes (it has been 10 years since he claimed EI) as I type this message.

Do I have process for a K-1 claiming EI correct?

That's cool sdw... hope it wasn't too much of a run around. I find that they're iffy about whether or not they actually send cards so keep an eye on that and if it's taking too long, call Donna or the interstates claim office and they an help you you.

Sign up at Service canada so you can keep track of the dates and payments on line -- it's very handy that.

Claim got approved, waiting on first payment.

Mel applied for EI 2 weeks ago, and last friday, we got back in the mail a letter requesting additional information, visa type information. It requests a copy of the EAD and the visa. Should we include a copy of my wifes green card as well? I don't see any harm in submitting additional information, but I'd rather be sure about it. Any thoughts? :unsure:

Hey all... just an update, my claim was approved finally --- just a word of advice for you all, if you're being proactive and such, don't bother sending in a copy of your CR1 Visa before it has the POE stamp on it -- that was the cause of my issues at first there and because the interstate claims office isn't as familiar as we are with immigration verbiage it was a bit of a hassle. I ended up sending them a notarized copy of my visa with the stamp. It was lucky though, I was able to go into an insurance place in my town and get them to do it for free! If anyone needs a hand with this stuff, I'll be happy to help.

Now all I need is to get them to make the first deposit and then learn to drive and get a car.

This is regarding EI but no one reads that forum so here goes.

I am dealing with the famous Donna at the interstate office -- she needs me to provide proof that he stamp in my passport for my CR1 visa acts as my green card until my greencard arrives.

SO, can anyone here find a real, bonefide link to a government site that says that? Otherwise I'll be penalized for like 2 or 3 weeks until I get my green card.

It's odd, as Donna was the know all of our claims but she thought that the IR-1 visa was a religious belief based visa.

So, basically Donna, whom everyone speaks really highly of, had NO Idea what a CR/IR1 visa entails? I feel like I'm having to jump through some hoops over nothing...

man... I missed a phone call from someone named Lynn at service canada yesterday... darn phone is upstairs and I have horrible hearing -- i didn't get the message 'til like 7pm. Now I'm wondering what THAT was about? I called her back and left a message. Do you think that they're going to deny my claim? that would SO suck...

Anyone else get a call from the Service Canada office?

What'd they want to know?

No, it does not mean ur approved,lol At least it wasn't for me and a few others that were denied! It seems the sending of the cards is automatic then they review ur case, at least thats the way it was for me! i got the cards, then I got a letter or a call from them stating i was denied! I appealed and won!! But I was in the military and they stated I broke my contract--which i did--so they originally stated I wasn't eligible! But I appealed and won!

okay... so here's a pile of silly questions...

I applied for EI before I left Canada, like literally the first business day after my last day of work. All good. set up an interstate claim with Donna. before I POEd, I sent Donna an email with a scan of my cr1 visa and my ROE from my main job, my second job did electronic ROE production so... I assume that went fine.

On Tuesday I got a letter from the EI people with a couple of the cards you mark up in it, so I filled those out and mailed them in . Does this mean my claim was approved? I kind of don't want to call and ask them lest I sound so much like a moron -- I've asked a million moronic questions here so... you guys are used to it.

This is what I was thinking but just would like it confirmed -- I think they look at hours, cumulative as well as income but just want to make sure that I don't screw myself if I DO decide to leave big-time job sooner.

i think they are looking at your hours if you qualify for EI. and you're already stating that you're relocating so you shouldnt have a problem.

But Texanadian is the expert with this and can confirm whats the correct answer.

Hey...

question for you all... .
I have two jobs, one full time ( the big money maker) and a second job that's part time on the weekends.

IF I were to quit the BIG job during the week sooner, for the same reasons, to relocate to be with spouse and the smaller job later, which ROE would they look at OR
do they just want to see that I've logged the right amount of hours and made a certain amount of money over the years?

I am not sure how this works. I will probably stay at both jobs until the same time but part of me almost wants to ditch the big job a little sooner.

Not sure if I'm being clear here and if not, I'd be happy to clarify if someone were able to help/answer my questions.

Hey guys... don't shoot me as I am about to probably ask you some questions that may or may not have been answered. I just couldn't find them digging through this thread.

So. As a CR1 visa holder (fingers crossed) I am planning on quitting my jobs, I have two) about 2 weeks before my actual move to the US. I would really LOVE to collect my EI benefits.

So, I know that I am eligible to work as a CR1, but I won't have my green card just yet. So, what do I send in and when, to prove that I am eligible to work?
Also, when I quit both jobs, it's okay for me to say that I have quit but that I have quit to relocate to be with my American spouse?

Thanks a lot. I'll probably be here a few more times. Never done this before and it would be really helpful to be able to collect these benefits while I look for work and settle in in the US.
