I have been going through the forms I-130 and G-325a that we have been told to fill out. We looked at the G 235a form and its asking for hubbies assets.

Now we only have $10,000 savings at this time, but will come into another $20,000 (aus) by June.

Will having only $10,000 in savings now affect the application? Will they deny it on that?

We are getting a joint sponsor (Hubbies mate and wife who earn combined $40,000 USD per year), but we don't file the joint sponsor form till later on right?

Also its asking hubbies yearly income. Does that mean his income now, or his US income (none as he's worked here for 5yrs)

When filling out the i-864 form it asks for the sponsors income and current employment. Do we put down my husbands Australian job and his Australian income, or when its talking income is it USA jobs and income. I'm confused on this as Hubby is working here in Australia and has been for the past 5yrs.

Wouldn't the IRS wonder why we are only filing 1yrs taxes and havn't filed the other years? Wouldn't that be an issue for my visa, or do they just require the 1yr tax return.

Why not have the tax preparer do just 1 US tax return, then when your husband sees how it's done for his situation he can do all the other missing years himself?

Guess who's going to give the tax preparer all of the numbers needed to do the tax returns anyway?

Yes he filed his taxes every year before coming overseas, and he filed every year here in Aussie since arriving.

I agree. Just do the most recent one through a preparer and the rest you can do it using Turbo Tax or some such software. Preparing back returns are no different than preparing the current year when using software. However, once you send in the returns, IRS will asses penalties if any, and notify you to pay them. You can't file back taxes electronically, you need to send the paper returns. You can also make payment arrangements with IRS if needed.

The issue of filing isn't whether he's earned more than the foreign-earned income exclusion, the issue is whether he's earned more than the threshhold amount for filing an income tax return.

Was he filing tax returns prior to going overseas?

In any event, if it were me I would send them all in together.

He may need only 1 year for the visa, but the IRS will want a tax return for any year in which he made more than the minimum required by law to file a tax return. He may not owe any tax due to the foreign-earned income exclusion or tax treaty provisions, but he still needs to report the income.

Because they both make $20,000 USD Combined a year, that = $40,000USD. The poverty guildelines they have to meet are for 5 people. Him, his wife and two kids plus me.

So they don't have to show any other assets or financial information that i'm aware of. They can just use their pays combined.

So would all they need then just be pay slips/tax returns, or do they need the birth certificates etc as well.

Just trying to organise it for them and make it as easy as possible for them to understand

His mail was going to his dads etc since he's been here, but we are using his sisters address as where we are staying, as thats where we will be staying. Plus his dad and mum arn't reliable to send us mail etc that arrives at their house.

Hubby is the USC and i am the AUstralian Citizen. We are both living in Australia, and hubby has been here for 5.5yrs. We have 2 kids togther and one more on the way.

WE are going to go the DCF route here in Australia. I'm sorting out the paperwork to get organised for the interview. WE are yet to file the initial petition, but will be after the new year.

We have a joint sponsor working on their I-864's to sponsor me.

My questions are:

1:-
Does he need to file an I-864 for me and one each of the kids? or just me?

2:- Part 3 Question 8:

In part 3 question number 8, Which box do i tick. Hubby dosn't meet the poverty guidelines, hence we are getting a joint sponsor. So what do i tick?

Part 3 Question 9:

In part 3 question 9 Do i put the kids in there?

We are hoping to put lodge the I-130 in about 2 to 3 weeks. I dont' want to waste a trip (as we have to take the kids with us), so i'm hoping i have everything we need for it.

How did you prove your relationship? We have birth certificates for us and the kids, marriage certificates etc taht they request. Is there anything else i can take to prove the relationship?

Or will being married for almost 6yrs, plus 2 kids and another on the way be enough, plus the paperwork they ask for?

Dear All, Need some advice...

I am about the send Packet 3 to the consulate, however I have confusion regarding sending of the medical reports. Can I open the Medical reports received from the doctor or should I send the unopened (sealed) envelope along with other documents forming packet 3 to the consulate. The doctor said i can open the envelope and send reports, however in one of the topics it said to send unopened envelope.

Also do we need to send passport size photos along with packet 3 or do we have to carry it with us during the interview.

Please, can someone enlighten me.

Hey Kitkat

The way it normally works is as follows:

1. Get an appointment.
2. Prior to the appointment, get the details of immunization records. If you don't have the records go to your GP and he will do a blood test to determine the immunization you have taken (it normally takes 3-4 days for the results, but it could vary). In case you haven't take any immunization shots, you can tell the GP to give you or Dr Waks clinic can give you.
3. The day of the appointment, the doctor will go through all the questions and procedure etc including the x-ray and blood test. The doctor won't be able to give you a conclusive result as the x-ray and blood examination won't be available. Please don't forget to carry a prepaid express envelope.
4. Once all the reports and results are ready (normally it takes 3-4 days after the examination), the doctor will either send you a white sealed envelope (consulate copy) along with a copy of the reports (for your reference) in the prepaid envelope (scenario 1) or the doctor will send the consulate copy directly to the consulate and send you a copy of the reports (scenario 2). If the scenario 1 happens you just need to mail the white sealed envelope to the US consulate (Sydney office).

That's all you need to do. When you go for the appointment, the doctor or the assistant will explain in detail what you require to do. So I suggest don't stress out.

I recently used Honolulu as my POE, and it was very quick, roughly 30-45 minutes. There was no one else in the queue except me.
One more advantage of flying Hawaii Airlines and using Honolulu as POE is that they allow 2 bags of 32kgs free of charge as Check-in baggage.

Considering that you are moving for good, you would be carrying lots of stuff.
The other thing is that the tickets are comparatively cheaper then all other airlines.

Wow thanks for that haza, it's good to hear your story about the differances. I've only heard negative so far from others how it's so hard there due to low wages, and i've heard some positives too.. Yet it dosn't cost you $500,000 for a 1960' s house, $700 a year to register your car, plus every other bill that comes in and is lot higher the your wages coming in.

I'd be interested to hear others opinions too. My family can't believe i want to raise my children over there. But at least you have some freedom, here your banned from so much, and they are hiking up the prices of everything but your wages.

So hopefuly in 2yrs time i'll find out what the usa is like to reside in. so far my longest stay was 6 weeks with my sister in law and dh's family.

I lived in Melbourne all of my life and it certainly was a culture shock when moving to the US. Americans have quite an outgoing culture and I’m not talking about going to the footy or to the pub or Sharon’s BBQ. It's a service oriented country. For example, a waiter works hard to satisfy a customer to get a tip. Unlike down under were the attitude of waiters is take it or leave it..

Most houses in the suburbs barely have any fences. Unlike Aus were someone would call Today Tonight if the neighbour dares cut down the 2 metre fence.

It's funny how so many people see Australia as this breathtaking and fruitful nation for all, when in reality as you mentioned yourself it is quite an unaffordable country to live in. The last job I had before I moved to the US was with Sensis. Hey, they are owned by Telstra so the money was fantastic. Yet as you know first hand, in Australia everything costs big $$$. Shopping, eating out, driving, general living expenses, travel, services etc are quite expensive, in comparison to the US. My fiancée frowns because I love shopping at Walmart. Americans don’t understand how luck they are to have a store which sells items at prices 3 to 10 times cheaper than Australia.. The only thing that is more expensive in the US is the cost of produce and meat, in the supermarket.

I find Americans are pleasant and courteous people (excluding some NY's, democrat party supporters and people from LA who can be full of BS). People from the south are generally really nice individuals, even though northerners hang shlt on them.. The thing about Australia is that be it Melbourne or Brisbane, generally the majority of AUS has the same type of culture / attitude. Whereas I feel that the US is really a large country made up of 50 smaller countries. One state can be completely different from the next.

I still joke with my fellow white collar mates about being the beggars down under. It’s a different ball game here. All of my tradie buddies in AUS have new cars, x houses, take multiple holidays every year and live a dam good life. While office workers bring their cut lunch to work to save money.. This is something you won't see in the US, let alone most other developed nation.

Overall there are a lot less handouts here. It's up to every individual to make something of them self. Down under the 'under-dog' is always nourished and taken care of, at the expense of other hard working people. This is not the case here.

Well I hope this enlightens you just a tad on the US vs AUS.

PS My parents are old school Europeans so they were shocked and scared about me living in the US. Well they are starting to get over it. Ironically, they didn't have much to say when i showed them the stats that Australia has the highest crime rate of any OECD country.

Hi All

Today I found out the case number has been allocated by NVC and the file has been forwarded to Sydney embassy. This was pretty cool considering the backlog at NVC, it took exact 1 month from issue of NOA2 to NVC issuing case number and forwarding the file to Sydney embassy.

My question is, after receiving packet 3 what documents are we supposed to forward along with form DS230. Does the police clearance and other documents have to be attached and sent with DS230 or do we have to only send DS230 immediately and other forms (DS156 & DS156K)and documents sent at a later date?

Is there any link or guidance issued by the embassy as what is sent at what point of time?

I put my address, i don't want them to send it to embassy directly.
I booked my medical BEFORE I knew my case number, but case number came before the medical date. i started the police check BEFORE I know the case number, i think.


Thanks for that. I went and got the police clearance done though it was bit messy, the constable wasn't aware of the procedure for the combined fingerprint check (name, date of birth and the fingerprint) as a result I ended up paying for 2 different checks (name/DOB and fingerprint), hopefully it all works out, however I will follow up with the Criminal Records Department from where it is issued.

mine asked me if i wanna send it to the embassy or another address. it is said on the paper form i think, NOT sure if it is also on the online form.

The online form gives a similar option. However when i spoke to this lady at the local police station she said it cant be sent to a personal address, it has to be sent directly to the embassy. My query is when you applied for the police clearance did you get it delivered to your address or to the embassy. If you did have it delivered to the embassy did you wait till you received your case number/packet 3 and then applied or did you forward it without the case number.

By the way I am from Sydney, NSW.

Hi All

We have applied for K-1, its been a while, we have got the NOA2 approval the file still hasnt been forwarded to NVC. We understand there is a backlog and all, but we are hoping to receive packet 3 by early next month.

I inquired with the my local police station for the finger print check and i was told that the clearance can be sent only to an organisation and not to a personal address. Is this true? Does the Australian Police Clearance have to be directly forwarded to the embassy or does it get sent to us and we then forward or carry it with us during the interview.

I was in the impression that the you apply for the pollice clearance, receive it and then send it to the embassy.

Can anyone enlighten me what the actual process is?

I believe it is code 35 but I figured I should check. There don't seem to be any guides covering this.

I have found a guide for Canada that covers it (code 35), but that doesn't exactly help :P

I recently got my police check done in NSW, it required completion of an online form where I specified Name and Fingerprint check, took a printout and then went to the local police station. There is no need for addressed envelope etc. The addressed envelope is if you want the fingerprints to be sent to some other countries police department etc.

I was faced with a similar situation (I was flying from SYD to SFO) last month, however I found an unbelievable deal with Hawaiian Airlines. They allow 2 bags (31kg) per ticket as normal baggage allowed and every extra bag (3rd bag onwards) was $100 (AUD) per bag. Also on comparison, Hawaiian Airlines was offering the cheapest ticket in comparison to all other airlines.

Also Honolulu as POE is a good option as there is hardly any queue and the custom officers are very friendly.

I would suggest wait for the case number as it does not take a long time to get the appointment. I got mine done in Sydney and was able to get the appointment within a weeks time.

Once you have the case number simply call up the doctor and schedule an appointment, its pretty straightforward. They will inform you what to bring along etc.

However what you can do at present while waiting for the case number is to call up the doctor and ask which vaccinations are required and accordingly get them sorted if you don't already have them.

Australia and New ZealandFiling Tax Return in US
Hi All

I have a question specifically for recent Australian residents who have moved to US in 2012 and will be filing US Joint Tax Return for 2012.

Did you include your Australian Income(January to ......) in the 2012 US tax return and then claim exclusion (Form 2555) or did you completely avoid including the Australian Income due to Australia-US Tax Treaty.

Also if you have already filed the tax return what provider did you use, H&R Block or Turbo Tax and which specific product did you use? I tried using the basic one from H&R Block, but was unable to do it correctly, and the online help provided was not very helpful.
