K-1 Fiance(e) Visa Process & ProceduresCan I file for K1 while I am not in my home country ?
Hi mark_wins thank you for your comments, The address I am going to use will be my mother in laws so I hope I can trust her blush.gif The relationship should be pretty easy to show I have made sure we have kept just about every thing from plane tickets from 7 years ago to phone records letters photo's so we have a good lits of things that we have been together and have a pretty good relationship.

The financials is the hard thing see my comment above about my girlfriend not filing her taxes in the US. We have plenty of money here in our joint AU bank are US bank account in the US is very low :-( If I sort the taxes out can I get a bank statement to show that we are financially stable and wont live off the state and that she will be able to support me.
My company here do not want to let me go so they are happy for me to work in the US remotely so i will have a job from day 1.

Thank for you help I have been reading the forums and guides and going through the paper work that is needed, as well as working how what I have to do to get married here. Every day I learn a new little bit of knowledge or hint about the whole process.

Today's tip is

All US citizen has to file for IRS-1040 regardless of where they live so that should be the proof for financial support. Of course if she doesn't make the 125% of poverty guideline then she will need to either get a co-sponsor or put up liquid assets.

My girlfriend for the last 6 years has not filed any US tax returns while she has been living and working here she has filed every single Australian tax return but did not know she had to report her foreign earning to the US

I have been trying to read Publication 54 (2007), Tax Guide for U.S. Citizens and Resident Aliens Abroad but I now have more questions than answers

At the moment is there any thing I can do for the CR-1 before I Marry as at the moment that looks my best bet might have to jump to the other forum if that seems the best route :-)

Have you considered getting married there and then moving to the US after? It would make it much easier since you could file and get a CR-1 Visa (she would havea green card when she entered the US). It is a much faster process.

How much faster do you think it would be also when I get to the US will I be able to work and travel ?

Hi Vika,
Thank you for your help it was very helpful how did you you let CIS know to send the forms to the Consulate in Indonesia ?

QUOTE
Once the approval came through we made sure CIS sent our case to the Consulate in Indonesia (not Ukraine)

Where it listed "Part A. Start Here. Information about you"

"Address (Number and Street)"

This is where he listed his US address as my fiancée has not lived in the US for 6 years (but she has been back 2 times) (she lived with her family back in the US am) i still able enter that address ?

Hi pushbrk sorry if my wording was incorrect I do understand that my fiancée (the us Citizen) has to file the forms for me and yes I will keep on reading the guides and dooing as much research as possible.

QUOTE
First, you can't file anything. US Citizens file visa petitions for their spouse or fiance(ee).

Definitely check into DCF. I'm not 100% sure how it works in Australia because each country has different rules but that would definitely ease the amount of time you may have to be apart.

Good Luck

Bex xxx

Sorry I guess I should read up but what is a DCF ?

I did read this on the following site

http://usaimmigratio...Fcountries.html

Australia*(Changed their policy and will now only accept Direct Processing of the Family-Based I-130 Petition in cases where the Petitioner is a resident and physically resides in the country for at least 6 months.)

Because I have so many questions is there any one that I can turn to eg help line visa services that might be in Australia that i can turn to for help and guidance ?

K-1 Fiance(e) Visa Process & ProceduresCan I file for K1 while I am not in my home country ?
I have been with my finance for 7 years now, for the last 6 years we have been together living/working in Australia on my 457 Business visa.

She is American and I am British

We feel that our time is up in Australia and its time to return home to friends and family and to get married. We want to move to the US and get married start a family and settle down :-)

I would like to leave Australia by the end of the year, Can I start filing any paper work here or doing any thing while I am here or do I have to wait until I am back in my home country England and she is in the US, I am worried if I go back to the Uk she would only be able to spend 3 months there and we would be split up again.

Would getting Married here help ?

Thank you for your help blink.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresName change ??
Hi there, I changed my name to my married name and filed my I-130 application under my Married name, making sure I sent in photo copies of the change of name cert etc with my application. I think it looks more favourably on you if you do oficially change your name because its just one more peice of info to show your relationship is legit. Just make sure you change over other things aswell like your drivers licence, passport, bank details etc. And ofcourse make sure you fill in your maiden name in the I-130 section which asks you to report previous names.

IR-1 / CR-1 Spouse Visa Process & ProceduresProblem paying AOS online
Hi All,

My husband is a USC in Afghanistan with the US Marines, and all of his mail has been cut off, so I've been calling the NVC back and forth gathering Case numbers and IIN numbers because we have received no mail. Anyway I have our IIN and can successfully log in to the page which has our AOS invoice, but when I click to pay the fee nothing happens, the screen refreshes but remains exactly the same. Has anyone had the same problem or knows what I can do to fix this? Its already been 2 months since our NOA2, and with no actual hard copies of anything to go by other than reference numbers from calling the NVC themselves, im worried my case will get delayed :(

I have sent the ds-2030 6 times and no reply either but once i used the above method i got a reply very fast
I guess there is nothing wrong with appointing yourself but they really suggest that you appoint someone who lives in the US
You know we're almost done with NVC and neither I nor my wife have received any kind of paperwork from NVC in the mail till this moment :D
It's all through email.
I wish it goes fast for you
Good Luck

whatever!!! i copied what you wrote :D look up i put it wrong in all my posts
but we know what we're talking about!!

I wrote that bold so that maybe someone else might benefit from it theres a few people who might stress about what the heck a DS-2030 is haha :P I know you and I know what we mean haha. Ok well im going to try this method you suggested.. but you didnt answer my initial question, did you have to generate your own barcode when you scanned it? Thanks for your help I apreciate it.. and the fact that youve gotten that far without paperwork is a good thing to know :)

Hey Guys,

My case has now been with the NVC for almost 2 months and I still dont have any automated voice messages available!!!!
I havent had a reply after emailing out my DS-2030 which was 12 days ago now. Ive spoken to an operater about 4 times now.. getting ahead a little more each time. My husband and I havent received any paper work or emails either.. so we are working with Jame's shortcuts.. It doesnt help that hes on active military duty in Afghanistan, we probably will never get any mail, He hasnt gotten some of the letters i sent to him from way back in July if thats any sort of indication! :ot2:
Well I just thought I'd see how everyone else is going, and whether they are experiencing huge delays on automatic voice updates and email replies.. I wish I had known about getting our case expedited.. I guess theres no point because my Husband comes back in 3 weeks right?

I MEAN DS-3032!!!!

Thankyou! Samoray, but will I have to generate a barcode if I scan the DS-2030 and send it via email because I dont have the actual hardcopy sent from the NVC aparently. And I havent got an automatic reply that they received my emails which Ive sent no less than 4 times lol.. a little too devoted you think? hehe
My email format has been exactly as you pasted, except im wondering whether the delay is because I appointed myself as the choice of agent? I did this because again my husband isnt likely to get his normal mailing address returned to normal for a good few weeks when he gets back so I thought It would be a little bit more reliable if I had myself appointed! (My hubby has pretty much been the bystander responding to 'sign here' tabs along the way heheehe).

IR-1 / CR-1 Spouse Visa Process & ProceduresI went for my police check today :)
Hi all,

I went for my finger printing today at my local police station and they used a computerized system saying that they dont use the old-school black ink method anymore. Does anyone know if this is going to be a problem when I send this in with the NVC? Because some other guy was there at the police station going through the same immigrant process for Canada and he said they only accept ink prints over there. The Constable pretty much said to us.. 'too bad'!!!

Hey, dont rely on getting automatic return emails from NVC, because you typically wont get one. I have emailed them several times, and have had a reply from NVC in about 12-14 days without ever getting an automatic response. I sent my emails multiple times thinking it wasnt going through, and now im getting multiple replies (Another one this morning in fact).. so just be patient they are getting through.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 advice
I just want things to be consistent when I go for my consulate appointment.. Ill think Ill leave it out because I booked my trip for the maximum of three months that the waiver allows, but im expecting my interview back in Sydney to pop up with in that time providing we don't get any RFE'S etc.. So I might leave the states early which makes it difficult to put down an expected leave date.. I think Ill go with Samoray's suggestion about leaving it out haha

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 advice
Hi guys,

Im visiting the US in early December under the Visa waiver program because my hubby gets back from military service in Afghanistan then!! I know the risks involved but theres really nothing that could get in the way of stopping me from at least trying! ANYWAY.. We are at the point where we have both payed the IV fee at the NVC And i-864 bill.. and have to wait for the hub to get back to sign the forms and then we will be sending both the I-864 and DS-230 off whilst I am visiting in the states. Im just not sure what to put on the DS-230 when it asks for the date and return dates for previous entries into the states... should I include in that response the present entry date (providing I get let through LAX airport)? Or can I just let it be.. (ive already filled in the forms thats all).

Cheers, Nicole

IR-1 / CR-1 Spouse Visa Process & ProceduresBefore I mail I-130...

@ Harpa
OK, I will use normal postal mail so address is correct. Thanks!

@ pushbrk
I will change my cover letter and application assembly according to your suggestions. I will also NOT include a CD but print the pictures accordingly. Thank you!

I still need to make sure I input my wife's Swiss address correctly... that's on me.

Now, I AM a Newb. I was using an immigration lawyer but I found him to be incompetent and wanting to overcharge. So, I have a couple more questions I'd really appreciate confirmation on.

1. I petition for the I-130 only, right? I don't petition for anything else until the I-130 gets approved? (doesn't matter if I went K-3 or CR1?)

2. Any estimate as to how long it will take for an I-130 to get approved?

Thank you all!

Yep your petition for I-130 is correct because you are already married right?
As for how long it takes.. I sent in my I-130 Back in the beginning of April. I received my NOA2 on the 28th of Sept.. so Thats a little over 5 months processing time.. I think the most recent timeline is about 5-6 months.. I kept checking online around the 4 month mark.. and found out the case was approved a month before the notice arrived in the mail.. which has definitely helped speed things up when you get to the NVC stage. Once you send in your I-130 and get your NOA1 you can use the receipt number to sign up at the USCIS for email updates and to check the status of your case. Good luck :)

K-1 Fiance(e) Visa Process & ProceduresQuestion about overall K1 visa approval
Not me, but one of my girlfriends was in a similar situation. You need to collect every single bit of evidence you have because the purpose is to check that you have a legitimate relationship. So this will include any photos.. photos of the two of you with friends, or even eachothers family, photos together etc...
as well as bank deposits to show your financial lies with eachother, emails, skype transcripts, receipts of things that you have bought for eachother (flowers or even skype credit, phone bills) these will be very important for the interview once you get to that stage.
As for your wait, I lodged my petition back on April 2nd and got my NOA2 on Sept 28th, which was just short of 6 months. So hold tight :) it will come

K-1 Fiance(e) Visa Process & ProceduresUSCIS said he CANNOT visit
Hey Guys,

I thought you might benefit from this, When I went to visit my Husband in May after receiving our NOA1 for the i-130 I had no problems entering the country. When I arrived at LAX they asked why I was there and I said to visit friends and family, they asked to see my return ticket. And wella. No drama whatsoever. I also had bought travel insurance to show that I was visiting temporarily.

I am also visiting America in 15 days. My case is now at the NVC I am going because my husband gets back from military service in Aghanistan and I wouldnt miss his return for anything! I will be taking my NOA2 with me and a letter from my employer. But I am not too worried, seriously honesty is the best policy and if you are legitimate you will have legitimate proof.

I changed My address online at the USCIS website and it was no problem whatsoever.
My husband also changed his address at one point by calling them. They are really helpful, we have gone through several addresses with the military and it hasn't caused any delays in our case at all.

K-1 Fiance(e) Visa Process & ProceduresAttorney vs. filing yourself
Hello, First time poster here!

After stressing with my finacee that we needed an attorney I did some research into attorneys that just do immigration stuff, and the prices I was quoted were astronomical! I felt at that time however that it needed to be done because I was so worried about making mistakes and having the petition process put back months (kinda on a timeframe here).

However we decided to go it alone and as i was looking for help on how to fill out the 325a form i came accross this site and boy did my worries ease. This site is perfect for people to be able to fill out and submit their own packages that I realised i was glad I didnt spend 2500 on a attorny for this.

Our package will be mailed next week (my half is on the way over) and I would recommend that as long as you follow the guides and have enough evidence you should be fine (just echoing other peoples opinions!)

Maybe a stupid question.

Iam currently in the early stages of the K1 visa process. Am i allowed to travel from Australia to America to visit my fiance for 3 weeks? I have a return ticket.

Iam booked to leave this Friday the 6th November, and just suddenly had a feeling that i cant visit him between now and when the visa gets approved.

Can i visit him while in the K1 visa process?

Your speedy replies are much appreciated.

K-1 Fiance(e) Visa Process & ProceduresStatus has NOT been updated on USCIS??

The email was sent to him because his info was on the I-129F. Happened to me too. No issue. Get him to forward you to email and follow the instructions there.

P3 is not sent in the mail. It is ONLY the email. So you MUST go to the links that were included in the email sent to your fiance. If those links don't work let me know because the site was recently updated. I would HOPE they updated themselves but you never know.

The only reason I have an NVC date is because my fiance was sent the NVC letter. Don't worry about the other dates. Your case is your own. Just go to the P3 links, send them the docs they want (first they need you to send them the DS230 (part 1 only) ASAP) then when you get the rest of the documents forward them with DS-1076 to tell them you're ready for interview then they'll email you P4. now they should also have included an email update form with P3 so you can be emailed stuff instead of your fiance. I sent this with the DS-230(1).

Good luck and congrats on your approval and now P3 <img src="http://www.visajourn...#>/biggrin.gif" style="vertical-align:middle" emoid=":D" border="0" alt="biggrin.gif" />

**Edit - your case number was sent (via post) to your fiance. It should also be included in the P3 email by memory.

Thanks guys... Your help is very much appreciated. Starting to stress here a little.

thanks so much for your help.

K-1 Fiance(e) Visa Process & ProceduresStatus has NOT been updated on USCIS??
My finace rcvd an email today from the Sydney US Consulate letting us know they have rcvd our approved petition and for us to go ahead with downloading the initial instructions for packet 3.

This email was not sent to me, only him. And i have not yet rcvd anything in the mail here in sydney, and also i checked my status on the USCIS website and it has not changed since Feb 22 when our petition got approved.

I have noticed throughout other peoples timelines that they have dates for when the NVC sent their approved petitions, also when the petition has been touched. Where are people finding this information? the USCIS website doesnt tell me if my petition is touch/sent rcvd. It has only done this for NOA1/ADDITIONAL EVIDENCE/NOA2.

Any help much appreciated.

K-1 Fiance(e) Visa Process & ProceduresCancelling K1 approved petition
Anyones help is very much appreciated on this topic.

My approved petition has arrived here in Sydney, and the US Consulate has given me the go ahead to start "packet 3".

My fiance is in the military and has been under alot of stress, he has been through 3 serious facial operations within the past few months. His face keeps getting infected and the infection has ate away into his nasal canal. He is now seeking medical help elsewhere.
He can not ingage in any physical training, the pain is too bad. Their may be a possiblity he can get out on medical benifits, or the possability he may deploy in August or soon afterwards gathering he has recovered from surgery.
If he was to deploy in August, (not too far away) i would have to have my visa approved here, head to the states get married get green card approved all before he deploys..whats the chance of that? very slim chance, plus i dont want to have to rush.

On top of this the military is causing alot of stress on him in other areas. So we dont know if he will deploy? stay on rear detachment? or get out on a medical discharge?

The stress is brewing for both us and our families. We dont want this stress on us when we have just got married, thats not good for any relationship. We did not expect the visa to take this long but time has dragged on and it just happens to be that the visa is moving and the military is causing us stress.

What im trying to say is.....the stress the military has on him and the rushing to do this, is not how we want it to be, there is just way too much going on. If we were to cancel my K1, does it stop us from applying for it again or other visas for america or australia? Do i write to the USCIS and let the know its military/deployment related. I dont want them to think we just havent worked out...Just bad timing and no control over what has been thrown at us.

Our love is stronger than ever right now, but the military is not giving us answers.

Your help is very much appreciated.

K-1 Fiance(e) Visa Process & Procedurescancel I 129 F approved petition
All your help is much appreciated.

I-129F petition was approved on the 22nd Feb 2010, due to lack of time and my fiance deploying we had to extend the petition for 4 months, which would mean it would have expired on 22nd June 2010.

Things have turned around not for the good with us, and i want to withdrawl my petition. I have not sent any of packet 3 to the consulate, last thing that was done was the extension. Im gathering it would have expired?? Im going overseas to asia in 3 weeks, to get myself back on track, will i have trouble exiting Australia or entering Indonesia as i have not cancelled/withdrawn my petition?
I if i was to just leave the petition and ignore it what would happen? Does the consulate austomatically withdraw it? if so do they advise me of this?

Thanks in advance for all your help.
