I don't think the doc will be able to answer that for you over email. It depends on you. I had also had a booster in the past couple of years for MMR and tdap - therefore I thought I would be ok. Found I needed further boosters for both.

It is honestly easier to have a serology test done. Costs you nothing, can get it on medicare. You get a neat A4 sized record that is much easier than bringing baby record/etc.

I had also had chicken pox but had no proof so serology also confirmed this.

I'd wait though for a couple of months to get it done - I think the med results are valid for a year so between waiting for NOA 2, entering the country, getting married, then finally getting to AOS may take a while.

Hello, I just received my NOA-1 today in the mail. I know it will take many months to get approved but I don't want to be caught off guard when its finished. I don't want to scramble around gather all the supporting documents for the I-134. So I'm wondering when would be a good time? Would doing it now be to early? Like does the bank document and the letter from my employer have to be done with in a certain amount of time? Thank you for your help.


My fiance and co-sponsor only submitted a bank statement for when their accounts were opened and amount of deposits for the past 12 months. They also had a letter from their employers stating their terms of employment and salary.

Since neither of them are self-employed we did not submit tax returns.

The officer at the interview didn't ask me a thing about the affidavits.

I think it is a good idea to have the I-134 forms ready to be signed and dated once your NOA2 comes through - I guess having the bank statements/letter from employer looks better if it's as current as possible. Again, who even knows if they take any notice of these things.

I'd give it a couple of months :) Good luck with it all!

According to the i-134 instructions you only need to present tax returns if you are self employed. It's on page one of the i-134 instructions here--> http://www.uscis.gov.../i-134instr.pdf

I don't think you would have any problem being approved based on your current employment status - there are students here that apply for K-1's. As long as the co-sponsor makes above the threshold for the household size then you should be fine.

I used a co-sponsor since my fiance is just out of college and has only been working for a couple of months. The only supporting documents they submitted were letters from employer and bank statements.

You might want to check with the Canada regional forum.

I received my visa after a week and a half - and I'm thinking the only reason I got it back was because I emailed. Make sure you are contacting the Sydney IV Immigrant Visa email (the same one that they emailed your packet 3 & 4 from. I've always had really prompt responses from them through this email. After I sent them the email, they printed the visa and sent it out on the same day.

My question is do I need to send in proof of our relationship along with forms DS-156, DS-156k, and the documents on the check-list. I was also wondering if it was okay to just send in his immunization records as his "medical records" since these are the only records he has. Where should I put the two photos they request? There is only a spot on the DS-156, should I just put them in a plastic bag? Also Any good ideas on how to send off this stack of papers i.e. should I just stuff them in and envelope or partition them in some way, how did you guys do it? Sorry for all the questions, I just want to be as prepared as possible so this goes smoothly! Thanks for the help.

Only send what they require on the check list. The proof of ongoing relationship can be brought with him to the interview. There is no point sending it to the embassy in Sydney.

He needs to have an official medical conducted by a panel physician! Just sending his immunization records won't cut it. The official medical includes a physical/chest x-ray and blood test - also any immunizations he has missed. See here http://canberra.usem...structions.html

You need to also submit 2 copies of the DS-156, therefore there are two spots for the passport photos.

Hey everyone!!

Just a bit of confusion atm.


My fiance and I are in the finishing touches of our Visa. We've received packet 1 and packet 3...but no packet 2????? What exactly is packet 2???


Also, the police in Australia will not hand over a fingerprint check. They said that it has to be sent directly to the officials requesting it, I am curious to know that if the Police check, the medical examination and the visa documentation were to be sent separately would that be OK. I am thinking that they are expecting it all as one package.

What do you mean by packet 1 and 2? Are you referring to NOA's 1 & 2? The only things that you receive from the Sydney consulate is Packet 3 (which includes info on how to apply for the visa on the Sydney end) and Packet 4 (which is simply just your interview date and time).

Regarding your police check... it may depend on what state you are in. I live in NSW and the police had no problem forwarding the fingerprint/name check directly to my home address.

It is probably in your best interest to send all the forms/documentation together in one pack. Nothing can be processed until they receive all your paperwork anyway. Things may get lost/misplaced/never matched up etc.

I am in the same predicement as you. My fianance is from NY and I am from Sydney Australia. We would like to have a wedding service here in Australia but understand that we need to marry in the US first.

We are planning on having a civil ceremony in the US first and then applying for advance paraole to have a wedding service here. I sort of feel that if we leave it to long it defeats the purpose of having a wedding here if too much time has lapsed so that is partly the reason we want to apply ASAP for an AP document.

Hey guys, the US consulate comes under the DOS (Department of State) and so does the NVC (National Visa Center). When your case if forwarded from USCIS to NVC, all the relevant details are transferred too (this is why they ask for your and your fiances DOB and Name along with your email address when you call them to inquire about your case status).

I received my interview details today and they emailed me directly with those details.. So it could go either way

This wont be a problem at all.. I went to the US while my application was still pending and had no issues..

I was prepared and took a copy of the NOA1 and a letter from my employer stating the date of my return back to Australia.. They didnt even ask for any of it but just in case take these things with you if you can..

I would stick to your legal names on the application otherwise they may ask you for proof of your nick names such as a name change certificate or marriage certificate.. You could always just let them know on a cover letter that your short names are as per the email headers.. This is just my opinion so lets see what other posts you get.. good luck

She just does not understand the process and thinks there is a way around it all. She also spoke to an immigration lawyer who promised her that he could help her.. I think he is just after money.

ok so a friend of mine applied for a K1 visa and submitted all the paperwork and received a NOA1 she waited around 4 months and there was no response on approval. She had already booked her wedding for October this year and had family and friends flying over.

As she didnt have approval and against my advice she decided to enter the US on a visa waiver from Australia. She will still be married in October even though she did not attend an interview or obtain approval for the K1 visa.

My thoughts are that she is planning on submitting her paperwork again while in the US after she is married. My question is wont they know she already had a pending application and that she knew the correct process and still went ahead? Will the fact she had a pending application cause her damage or will it be ok?

Hi All.

My wife is a USC and we are both currently residing in Australia. We just received our NOA1 and I believe we may end up getting our NOA2 fairly quickly.

From what I can see on the timeline of others, the time frame (Visa in hand), for those who are auto expedited (USC living abroad) is around 6 months total.

I would prefer to give my employer some notice, and we would like to travel for a month or two in between our relocation.

What is the best way to do this? I imagine we will have to stay put in Australia between the NO2 and the interview given the amount of correspondence required.

Has anyone else done something similar? I don't mind taking an approximate guess at a finish date that has a few weeks leeway (ie. I receive my Visa a few weeks early, or a few weeks later than expected).

Thoughts?

Really? What is the purpose of the "Yes" check box then? Someone must have been drunk when they put these forms together.

I just received a response from the Sydney Consulate.

All applicants are required to submit an I-864, must also provide their petitioner’s tax returns from the most recent tax year unless they are not required to file. The only people not required to file are those whose total income, including that from foreign sources, is less than shown on the table (please refer to the attached “I-864 Tax Information”)

As we are unable to use petitioning relative’s Australian income earned to meet the poverty guidelines, we will need proof of assets.

Alternatively, if you are unable to provide enough assets to qualify, you should provide documentation for a Joint Sponsor (including but not limited to an I-864, 2011/2010/2009 U.S. Federal Tax Returns [including W2] and evidence of their U.S. citizenship or LPR status).


I'm not quite sure why the table amounts differ from the current I-864P, perhaps they are sending me old documentation.

I am still going to have the father-in-law fill out an I-864, and provide his IRS returns and birth certificate. I would rather be prepared in case they do not accept my foreign assets.

I called the NVC. I felt like I was asking for national secrets haha. They won't actually tell me/discuss the requirements with me!

My father in law is going to co-sponsor with my wife. However, the paperwork is mighty confusing (apart from the obvious IRS/identification).

Am I correct in understanding the I-864A is only required if you are a household member?

My wife (the USC) and I are currently living abroad. The father in law (intended co-sponsor), lives in the US. However, our intended US domicile is the address of the parents in law.

So, does that make our co-sponsor a joint sponsor, or a household member?

(or, if there is a guide that covers this situation, please point me to it! :))

I spoke to the in-laws, and they are more than happy to co-sponsor as expected so given the above, we may just go ahead and do that so as to avoid any delays in processing.

The I-864A instructions do not list a requirement for proof of identity for the sponsor. Will the co-sponsor be required to submit a birth certificate/passport copy or is the I-864A plus IRS returns sufficient?

Can the co-sponsors AOS packet be mailed separate to the primary sponsors AOS packet? I ask because, my wife and I are abroad. Mailing documents to Australia to mail them back to the US is getting annoying :)

No, not my employment income (well, of course it will when I get another job, niche telecommunications ftw, but I know that they are looking for guarantees).

To qualify on savings approximately $95,000 USD would be required. (Less if the cash was held in the US)


Source? I have quite a bit more than that, though it's all in my name. I don't own a home or anything like that. My primary asset is my savings.

My savings are in a term deposit, earning me around $18000AUD gross per year (which will continue after I relocate).

The parents in law (both USC), are more than happy to co-sponsor if required. However, I'm a grown #### man and I would prefer it if the affidavit was only tied to my wife and I.

I understand that. My question is that given she cannot meet the affidavit income requirements, can I meet them myself?

The I-864 Instruction Form states:

What If I Cannot Meet the Income Requirements?

If your income alone is not sufficient to meet the requirement for your household size, the intending immigrant will be ineligible for an immigrant visa or adjustment of status, unless the requirement can be met using any combination of the following:

  • Income from any relatives or dependents living in your household or dependents listed on your most recent Federal tax return who signed a Form I-864A;
  • Income from the intending immigrant, if that income will continue from the same source after immigration, and if the intending immigrant is currently living in your residence. If the intending immigrant is your spouse, his or her income can be counted regardless of current residence, but it must continue from the same source after he or she becomes a lawful permanent resident.
  • The value of your assets, the assets of any household member who has signed a Form I-864A, or the assets of the intending immigrant;
  • A joint sponsor whose income and/or assets equal at least 125 percent of the Poverty Guidelines. See question below for more information on joint sponsors.

Just being proactive while we wait for our NOA2.. and the I864 has me confused given our situation is a bit upside-down compared to the majority of immigrants I suppose.

My wife (USC, petitioner) moved to Australia to live with me as soon as she finished college. Currently a housewife in Australia (ie. no income!).

I do well for myself, and I have quite a bit in the bank (I know "well" and "quite a bit" is subjective, but I don't really want to put those details on here). The Australian bank accounts are still in my name because we saw no reason to change them over.

So my question is, will I (the immigrant), be able to carry the affidavit of support or will we need the parents in law to co-sponsor?

Well I've checked my wife's (USC) I-130 and that field was left blank.

I will report back with our experience. We are due for our NOA2 any day now if we do indeed get auto-expedited.

Pretty crazy if we do end up with a RFE, all of the information is repeated many times over the I-130 and G-325A's.

Though, that said, if the USCIS agents are anything like DIAC (Australian Immigration), they aren't too bright.

EDIT: LOL just got NOA2 via email, literally just now, no RFE.

Personally, I read this question as covering the event that the beneficiary has a spouse themselves. ie. Perhaps the USC is sponsoring their brother, who happens to be married.

The I-130 already covers the marital status of the USC, and the beneficiary and prior husband/wives of both, on page 1.

W2 sounds like the equivalent of the Australian "group certificate". ie. your total taxable income paid to you by your employer during your financial year, which you would use to complete your tax return (ie. 1040).

Hi All.

My father-in-law is trying to finalise his I-864 (my wife is the petitioner, he is the joint sponsor).

However I need some help regarding question #25, as I have no knowledge of US taxation!

He does not file the 1040EZ.

He files the 'long form' jointly with his wife (ie. my mother-in-law). Apparently, on the income tax form, you do not differentiate between the husband/wife, it's simply added together.

  • Does he include her income, or can he just separate the income and list what portion was his? How does this affect the 'proof' given his IRS returns evidently have a much higher total because of the joint income?
  • If he was to include her income, that would then involve an I-864A, correct? How does this impact question 1? Right now his I-864 has 1 checked as "d. I am the only joint sponsor".

4. How long has the USC been living abroad: 1 year.
5. Do you reside in the country legally: Yes.
6. What is the reason for your residence: Live closer to family.
7. Did you list your overseas address on I130? Yes
8. Did you send the package from abroad? Yes
9. Did you include evidence of your residence abroad in your I130 package? Not exactly. A receipt from the Hawaii Department of Health was included with our marriage certificate, which had our AU address on it.
10. Did you mention that you reside abroad in your cover letter? No.
11. Has your case been auto expedited? How long between NOA1 and NOA2? Yes. 14 days.
12. Which Service Centre? California

Wait what!?

Alright, I've been looking at the processing times for the I-130 and thinking *sigh*.

Though, somehow I completely missed this thread.

My wife is a USC, living in Australia with me (I am an Australian Citizen). We were married in Hawaii in January.

Our addresses on the I-130/G-325A was our Australian address. Am I to understand, we might have accidentally lined ourselves up for an expedited approval?

Hi all.

First of all, I apologise if I've broken any rules or missed anything as this is my first post.

My Fiance is an American, who is currently going through the process to migrate to Australia on a Prospective Marriage Visa. Once her Visa is approved, we have to get married within 9 months.

We are planning to get married in Hawaii. Being that she is an American, and we plan to marry in the US, will I need to go through the I-129F/K-1 process if we are not planning on migrating to the US? (ie. we plan to be in Hawaii for under two weeks to get married, then return to Australia). My Fiance has called the State Department, and was told that if we do not intend to migrate we should just say we're there for a holiday and not mention the intent to marry. Though, this sounds very dodgy to me so I am looking for some further information.

We obviously don't want to put ourselves in a risky situation, given that after a few years in Australia we might migrate back to the US.

Appreciate any information you might have.

was just about to post the same question thank you for the link,
I was told that before I requested a police certificate I had to have a case number.

One question that I wanted to know is I grew up in the UK and then moved to Australia and have been here for 6 years do I need a police certificate for both the UK and Australia ?
