I entered the U.S. last december on a B1/B2 and brought lots of documents with me: employment letter, bank statements, professional I.D., I also brought our NOA2. I was not asked to show any document at the POE. and was granted 6 months to stay in the U.S. But I have never stayed in the U.S. longer than 1 month, as I always have to come back to work.

They canceled my B1/B2 visa! At that time I had a Portuguese passport because I’m Portuguese. they asked me way are you traveling with a Portuguese passport if you live in Sweden? And I tried to explain that I have being living in Sweden for 15 years and that I have the right to keep my Portuguese citizenship. So now I have a new Swedish passport!
I should be able to travel under the waiver program! And I’m traveling with my family!
I do have everything else but not a job at the moment!

I had the B1/B2 visa! What they told me last time I tried to go back was that I had to stay in my country longer than 12 months because I was in USA for 11 months!


The right question is, did you get an extension to stay passed the date stamped on the I-94? For what I know (and have experienced every time I've traveled to the U.S.) the longest you are allowed to stay when using a B1/B2 visa is 6 months. If you stayed 11 months you had to apply for an extension (permission to stay longer than 6 months). If not you did not apply for an extension, you overstayed.

There is a difference between the validity of the I-94 and the validity of the B1/B2 Visa. The I-94 is the form that establishes the basis of your admission into the U.S. and says how long you can stay in the U.S. (it is stamped by the POE officer after you are admitted into the U.S.) Visa is the document that allows to travel to the U.S. and can be valid up to 10 years. The validity of the I-94 is different that the validity of the Visa itself. You can't stay in the U.S. after the date stamped on the I-94, eventhough your visa is or might be still valid. For example, my tourist visa is good for 10 years that does not mean I can stay 10 years with that visa in the U.S. no0pb.gif

POE officers would question your intent if they notice you've spent more time in the U.S. than in your home country for the last year. When did you go back home? If it has not been a year since you went back, I suggest you don't make this trip yet. And also, I suggest you find out if you did overstay, if you did not file for an extension most likely you did overstay.

Hi you!
Yes I did get a extension for another 6 month’s! So I never OVERSTAYED in USA.
The poed officers in Miami told me the same thing that you mention before, that I have to spend more time in my country!
The last time I tried to enter USA was 14 month’s ago!
I’m just so confused because I hear deferent things all the time!
The other thing is, Will this affect my K1?

What was the reason you were denied twice if your didnt overstay? If your going to attempt to make the trip i would make sure you take plenty proof of any ties to your home country eg- mortage payments, letter from employer, bank statements but its down to the border patrol officer at the end of the day.


I got denied the first time because I had told that I had boyfriend!

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 1.A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).2.Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy. 3.Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).4.I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.5.You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form. 6.A copy of the NOA2 that you received in the mail.7.Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

Hi all,

I've noticed that in various topics people make reference to the USC being present at the fiance's embassy interview. That stage is a ways off for me, but is that necessary/recommended in all cases? I seem to see plenty of cases where the USC is not present. I ask because I work in academia and I suspect my fiance will get his interview over the summer or fall, and it would be a bit complicated to travel to Scandinavia for this one event. Any explanation, reassurance, or opinions will be mightily appreciated.

My interview was in Stockholm Sweden, I went there by myself even though me and my fiancé (at that time) ware over a 1and half apart from each other.

You just need to have proof that you DO have a relationship and be able to answer the questions!

Really could not decide where the best place to put this this question would be.


My wife (conditional green card) and I work in International Development.
We recently got a new 2 year assignment with the United Nations in Nicaragua. We were considering getting a reentry permit. We realized that if you are a conditional resident the permit is only good until the conditional green card expires.
We will be leaving in mid May. This would mean that the reentry permit would expire before even one year has passed, and considering she can be outside of the U.S. legally on her green card for longer than the reentry permit is valid, it does not seem to make much sense to pay for one.

We will file our i-751 from Nicaragua and come back to the U.S. before the year out of the country is up.

1. Is there any reason for us to apply for an reentry permit in our situation?

2. When we file the i-751 and get the year extension, would it make sense then to file for a reentry permit, and would it likely be valid for 2 years or just until the end of the year extension of i-751 being approved?

3. Considering the type of work we do there is a good chance that depending on our assignments we might not be in the U.S. for more than a few weeks or a month each year, for the next 5 or 6 years.
As long as we enter at least once a year to keep her visa valid and have good evidence of our field assignments with the United Nations, should we anticipate any problems?

4. If we decided to go the route of reentry permits now or after i-751 is approved, might there be a limit on how many they would grant us? I know that this up to the discretion of the issuing officer, but I would think that special attention and consideration would be paid to folks in our situation, especially working for the UN.

5. I know that some people say that it is advisable to make sure to enter the U.S. at least once every 6 months but it seems like many of the people concerned about that are those that do not want to "reset" the clock for their naturalization, which is not a concern of ours.

Sorry for all the questions. I have actually talked to a USCIS officer (not the call center people) twice in the past two days and although they gave me good info, I am still not sure the best route for us to take.

Thanks. But the fact that her departure was not officially recorded will not be a problem? I have read in several places that it could be a problem if this is the case.

For example, here is a section from the us embassy website in sweden. I have seen the text in other places as well.

it indicates that you need to send in evidence proving that you left before your visa expires. Obviously if she is coming next week there is not time to send anything in. Just hoping and assuming that her passport stamps will suffice.

Hey all,

When my wife was in the U.S. for a month last summer she was not asked to return her i94w and didnt understand it was important.

She is coming to chicago next week with her CR1. Anything she should be concerned about? The Embassy of course had her passport for over a month during the DCF process and never mentioned anything about it.

She has plenty of stamps in her passport showing that she left well before her visa waiver would have run out such as entry into denmark and 3 month visa on arrival from when we were working in Kenya. Surely this is more than enough evidence if someone stresses on her. No?
