Hi Everyone,

My wife went to her interview at the Stockholm embassy today. All paperwork was in order and they were satified with all of the basic documentation.

After many questions they gave her a denial based on 221g.

On the sheet they wrote that she needed to submit police records from Netherlands and Denmark. Although we provided police reports for all the places she has lived based on the requirements given by the embassy, they still requested these additional Documents. We are assuming that this is due to her ds230 bio-data showing that she has lived and studied in the Netherlands 2 different times for almost a year each time. The Danish police records were likely requested because although she hasn’t really lived there for any extended period of time, it is where her mother lives and where she is staying now unitl this visa is hopefully approved. The CO said he wanted these as a matter of his own discretion. My wife has never done anything wrong and we have no problems with submitting this information.

The CO actually kept her passport stating that he needed it so if approved he could mail it back to her in Denmark if approved. I know our case is a bit unique considering the extensive amount of traveling we do and variousl places we have lived due to our status as Erasmus masters students. I called Danish police and she can pick up a certified police certificate at any police station. I know that Dutch police certificates can only be requested by the consulate in the Netherlands. I called them and actually spoke to the person that handles this. She said that she had the request on the computer in front of her from Stockholm for the certificates for my wife and had already put in the request to the Dutch authorities. She said this process takes no more than 2 weeks. I thought the speed was amazing considering that I spoke to her no more than 45 minuted after my wife left her interview.

Is this anything we should be worried about? Is the fact they kept her passport a good sign, possibly indicating they will provide a fast return after receiving the requested documentation? This is of course very stressful for both of us.

Hi all,

My wife spoke with the embassy today and they said that they have received everything that they requested and need and that the application and her passport are sitting on the consulars desk for him to make his decision. I think and hope all will be fine and her passport and visa package will be sent out shortly.

However ones mind cant help but wander during times like this think of best and worst case scenerios.

Here is a question.

If for some reason he is not satisfied, what happens next. I understand that in the darker 221g cases the application is sent back to the uscis center where the petition was originally approved, people wait for a NOID etc. etc..

Since ours was filed directly with the consulate and they are the ones who initially approved the i-130, how would that next step work in our case?

The original denial letter read as follows:

Dear -------
this office regrets to inform you that it is unable to issue a visa to you because you have been found ineligble to receive a visa under the following section(s) of the immigtation and naturalization Act. X section 221(G) which prohibits the issuance of a visa to anyone who fails to present the documents requested in connection with this visa application.... etc. etc.. etc..et..
You have been founf indligible under there grounds becaise:
1. please obtain a police certificate from Denmark
2. Pending police certificate from the netherlands
3. Pending adminstrative processing.
once the above items are provided we will review your case. If all documents are in order your visa will be issued and mailed to you by registered mail.

A few days leter i got a call from the university in the netherlands that i was a visiting student at. The adminstrator told me that the US embassy in Sweden had called her inquiring if i was actually there and the requirements of my program, and asked her to read a list of all the students presumably to make sure that my wife was indeed doing the same program.

a couple of days after that i got an email from the embassy stating:
"Dear -----,
Our office would ar like to ask you to provide us with the following:
We would like you to fill out a new and updated version of the form G-325A. The version we received when you filed the I-130 petition does not state that you have been studying and residing in the Netherlands. Please remember to sign the form before you mail it to the embassy. Also, list the address/addresses where you were living while residing in the Netherlands. "

They also sent a similar letter to my wife stating:
"Dear ---,
We have received your Danish police certificate and we are still waiting for the Dutch police certificate.
Meanwhile our office would like you to fill out a new and updated version of the form G-325A. The version we received from you when your husband filed the petition does not state that you have been residing in the Netherlands and is also listing that you are residing in Norway at the moment.
Please remember to sign the form before you mail it to the embassy.""

This whole "residence over the last years" has been a bit confusing to us as our situation is unique as we are both graduate students and have spent 1-3 months several times at universities all over the world as part of our program but remaining remained as a full time student at our home university.

My wife and I both sent them a letter asking for clarification as it is difficule for us to inptepret what they want. We both received similar replies.

"Dear Mr. ---,
We are sorry about the confusion regarding the residency question. When we ask you to list where you have been residing we want you to list all addresses where you have been living. Residency in this context basically means where you spend the night even if it is for a 3-month exchange. So please list all addresses you have been living at no matter if you have been registered with the authorities in Sweden."

I guess my big question here is why exactly they would want a new copy of g325a? Wasent this step presumably over with when the i130 was approved and my wife scheduled for interview??

Please share any input you may have.

We got 221g after her interview on Feb 13. They received additional docs 21st. Visa approved March 26th and approval email sent today, March 27th.

approximately one month.

MAKE SURE YOU DONT GET A MIDDLE SEAT!!! Try to select a good seat online if u can. Otherwise call the airline. Go to seatguru.com and looking at the seating maps. Will tell u the good bad and ugly of most aircrart. Other than that, I always say as long as you have passport, creditcards and a phone, all will work out good on its own.

This is terrible. I am so sorry. Seems like a nightmare. You need to cut your losses now, no matter how difficult and kick him out. No one needs to deal with this SH!T. Also he has defrauded uscis and is likely to be permanently banned from entering the U.S. if you wanted to bring this to the attention of the authorities.

That is a terrible idea. He will have to answer questions about previous marriages and provide divorce certificates. You will be completely busted on that one.

Also, if we have to go through the K-3 route, we have booked our honeymoon at the end of July and we fly from detroit to seattle. If we had started the process for the K-3 would that mean that I wouldn't get to go on my honeymoon because I would have to enter the US? Should we then wait to file until after the honeymoon?

You will not be able to enter the u.s. once the k3 is processing until it is approved.

Is there any way we can be together by September????

Are you saying he would take up residence in canada and keep going to school in the u.s? That one seems messy. He would definatly loose his resident status for tuition purposes, pell grants, federal loans etc.. I would assume. If he officially moved to canada and met the residency requiremens (6 months) you would file DCF. In our case DCF took just over 3 months from filing to visa.

Why is it so problematic for some of these companies to sign a simple letter saying someone is currently working there and has been for such and such time?

Isn't this site for information not assumptions? The interviewer will give the HIV positive person the waiver form at the interview and there IS hope! As of July 2008 Bush lifted the regulations with immigration services that denied immigrant admission into the U.S. due to HIV infection!!!!!!!!!!! And it is the ignorance of the public to the facts of how HIV is contracted that motivated the President to enlighten the immigration services to the myths that motivated public fear so that HIV positive foriegners are no longer discriminated against because of lack of public awareness of the risks of transmission of this disease. To be fully informed you can go to the CDC website and learn about the truth of HIV transmission. I don't know anything about immigrating on this type of waiver, I just want to wish you good luck and all the best to you! HIV infection is a serious condition and your husband do need to get good medical care. I just hope that things will run smoothly for you guys... No bumps on the road etc. I will keep you in my prayers! The love that you have for each other will make things feel a lot easier when times get hard. Never lose hope or faith in each other! I think that the major reason I was let in, was the fact that my husband is a vet.(USMC) Probable because many of the TSA people have a past in the military themselves... I don't know if it is easier now days to cross the border by car, than getting into the country through the airports? I doubt that.... It all depends on what mood the officer is! wink.gif Anything can happen... Might get lucky, might not.... For the people who can't take the risk, don't! There is always a chance you will get denied and possible banned for years. I will go to NY in April and hope for the best. But if that happens my husband will move to my country, so it's not a big deal for us really....

She will have documents from her employer that she is employed full time and she has approved vacation request.

Shows "strong ties" to the home country. Are you also including the return ticket? Something showing lease/rent/own home/apartment would be helpful



What if she gets denied entry and is asked to voluntarily withdraw her application for admission to the US? If in a year from now (hopefully) we file for her immigrant visa will she require a waiver then? Any suggestions please!

She will not need a waiver if she is denied entry under these circumstances. She didn't break any laws coming here, legally, (arrive at a POE, submit to inspection)



I would say go for it. She has a valid visitors visa. She has visited to the US before. It's up to the POE people, and if your truthful in your answers, straight forward with them, I think you would have no issues.


I don't think that I would give it a try. Things have really changed in the past 2-3 years... I think that I was about to get denied entry on my last visit. I was lucky enough to get "approved" and let in though!(I was asked where I work and if I have an apartment in Sweden etc)If you really don't want to move to Poland to be with your wife, don't risk it. That's my advice. I know that it different from case to case blah, blah.... But my answer is based on what I have experienced myself and to posts I've read here on VJ.

I remember back in 2007 when I and my soon to be husband were on our way to our wedding.... Well, the guy at the desk(JFK, NYC)was not sure if he would let me through or not. He didn't say this, but he asked me many q's about when I was going to return to my home country and lots of other things. I guess he thought I was going to stay in the US once I had married my then fiance.... And things got worse after this! I'm actually worried about next time I'm going over there. The last time I went to the US, this time to EWR, NJ. I REALLY thought "This is not going well. I will get denied entry and banned!" I was so scared..... The guy at the desk was asking me q's for 10 minutes, something that never happened to me before. He didn't even smile once! I think that he was waiting for me to give him a "wrong answer" to his questions.(September-08) I hope this won't happen again! I will go back to New York in 8 weeks(hubby's back from his deployment) and I'm already nervous! sad.gif

Hi.... I guess you should bring a print out of the approved ESTA application or at least, write down the application number.... They can still deny you entry to the US. Probable not, but if the officer happens to have a "bad day" anything is possible.... But you should not worry! I'm 99% sure they will let you into the country.(unless you lied on any of the ESTA application q's....)

Well this is what I found on FAQ's on the U.S. Embassy website(STOCKHOLM)...

"Q: I?d like to apply for a non-immigrant visa, file an application for returning resident status, obtain a travel letter because I lost my green card, apply for parole into the United States, apply as a follow-to-join refugees or asylee, or renounce my U.S. lawful permanent residence status. Must I travel to Stockholm for these services?

"A: No, the services listed in this question will continue to be carried out by the Embassies in Oslo or Copenhagen."



But... the K-1 is also listed under immigrant visas! I'm confused...

Bromma is the name of the airport closest to the embassy. (I'm not sure if there are any flights from Copenhagen to Bromma)

Arlanda airport is the major airport in Stockholm with many flights to choose from. It is very easy to get from Arlanda to Stockholm city! :)

National Visa Center (Dept of State)23 Days to Generate an NVC Case Number?

I spoke with an NVC operator, who told me that NVC received our case on September 12, four days after petition approval. She also told me, though, that it would take 23 days from the date of receipt for them to enter the case into their system and generate a number. Does it really take that long to generate a case number? Based on previous threads, I gathered that around July 2011, it was taking CSC a month to send approved petitions to NVC. But I've always thought that once NVC receives a case, it's entered into their system immediately. So I'm confused about the 23-day wait. Oh, and I'm also majorly disappointed!


My I-130 was approved on JULY 31, received at NVC on AUGUST 15(!) and I got my NVC case number just yesterday... (My service center was VSC) The backlog must be a major one! :o

We've been calling the NVC about 3 times a week, got a different answer every time... The day before I received the email with the case # and the invoice #, they had told my husband to "call back on Friday", something they have told us many times in these past 6 weeks! Well, we actually got a case number this time! Thank God!!!
