K-1 Fiance(e) Visa Process & ProceduresI-129F Previous filing
Hi everyone!

So me and my man are trying to be notoriously careful and do all the paperwork just right before we send our package in. Thing is, about a year ago we submitted the form I-129F two times but then it was that form and that form ONLY. See it was before I found visa journey and we knew about all the things we had to add to that form for a valid submission, so of course we got a letter back saying it was rejected. But the REASON as to why they sent it back (this is what the letter said) was that a signature was outside of one of the designated boxes...

Here's what I'm wondering:
Should we check the yes box on question 11. "Have you ever filed for this or any other alien fiancé(e) or husband/wife before?"
I'm guessing I should, since they'd look upon it as a submission (even though it was just the one form) and I need some help from all of you guys who's been through this.

Don't wanna send the papers in only to have them sent back... :(

Thank you so incredibly much for your help!!!

K-1 Fiance(e) Visa Process & ProceduresI-129F Wrong month!
Hello everyone, as always I wasn't really sure where to post this so I made a new little thread with my question hoping someone can help me out.

My fiancee and I got everything ready for our application and sent it in about three-four weeks ago. It's been accepted by the USCIS and all is well so far, but today I was going through one of our attachment sheets (regarding question 18 on I-129F) and realized we wrote that we met in MAY instead of APRIL. I had a breakdown and felt like this is gonna mess it all up...

My fiancee called the USCIS customer service and explained the situation, they told us to send them a letter letting them know what needs to be changed. But here's my question and what I'm worrying about like hell:

How bad will this stupid stupid stupid typo mess up our application? I'm so scared that somehow they'll reject us just because of this... guess I don't have the most optimistic of views when it comes to things like this.

So incredibly thankful for anyone sharing their knowledge on the subject.

K-1 Fiance(e) Visa Process & ProceduresDS-230: Employment
Hi everyone!

Received my checklist from the embassy yesterday and I just want to check some things with you guys.

Regarding question 32, employment: Is it the same procedure as with the G325A,
that if I was a student or unemployed at any time I need to write that under that question as to not leave any gaps in time?

Should/could you write more than one occupation to answer the question: "In what occupation do you intend to work..." ?
For example: Photography, retail?

And last but not least (seems kind of silly, but I wanna get this right) if there're any gaps in between my studies on question 33,
do I write worked/working/unemployed there as well?
And how far back in time should you go when it comes to "educational institutions attended"?
Do I need to list my pre-school or is it after High School that counts?

Thank you so much for taking the time to help me, it really means a lot and keeps me together.

K-1 Fiance(e) Visa Process & ProceduresAffidavit and evidence

It looks like they're suggesting an extra affidavit containing the information they list, a lot of which is already included in I-134. It wouldnt hurt to create such an affidavit as they suggest, but you still need the I-134. If you include the extra affidavit, just use their exact wording (i.e., "I am aware of my responsibilities under the Social Security Act, as amended . . ." and "I am willing to deposit a bond, if necessary, with the INS to guarantee . . ." and "I am a U.S. citizen by birth within the United States at {town}, {state}". Check the regional forums for examples that other people may have submitted.

Great! Then we'll add that as a document in addition to the I-134. :D

K-1 Fiance(e) Visa Process & ProceduresAffidavit and evidence

Any way you can post the form here? What embassy is it coming from? Usually the embassy wants the affidavit of support for K-1 visas (I-134 or I-864), and I haven't seen a request for the additional statement that they want. As far as the "statement concerning his/her status"--did you send his birth certificate or passport page already? Usually that's sufficient proof of status, but maybe they really do want you to write it out as you say.

Thank both of you for replying!

It's from the embassy in Sweden and yes we sent in a copy of his birthcertificate with the I-129F application.
I'm attaching a scanned copy of the information page I've been talking about.

Any thoughts?

K-1 Fiance(e) Visa Process & ProceduresAffidavit and evidence
Hello again dear visajourney-family!

First and foremost, this forum keeps me together in so many ways. Thank you all for helping out with answering my questions.

To make a long story short: Me and my fiance's application is approved, I got the checklist from the embassy a month or so ago and we have almost everything that we need to send it back in and ask for an interview. The last things needed now are regarding the affidavit and our proof of relationship.

In the documents sent to me regarding what an affidavit should include, it says:
"An expression of willingness to deposit a bond, if necessary, with the Immigration and Naturalization Service to guarantee that the applicant will not become a public charge and an acknowledgement that the sponsor is aware of his/her responsibilities. That the affidavit is binding upon to sponsor for three years and that the affidavit and supporting documentation may be made available to a public assistance agency."

I shortened it a little bit.
Question 1. Would a document (signed and dated, of course) saying something like this suffice?:

"I, name here, would be willing to deposit a bond, if necessary, to make sure that beneficiary's name here will not become a public charge in the United States of America. I realize that the affidavit is binding for three years and am more than willing to make affidavit and supporting documentation available to a public assistance agency, if needed."

Question 2. It also says "sponsor should include a statement concerning his/hers status in the United States." and then they specify things to include if you're an american citizen or if you were naturalized or an lawfully admitted alien. He's a citizen since he was born in the states. Do they want a document saying "I, name here, acquired my citizenship through birth in the US on date here, location here." ?

Sorry if I'm overthinking all this.

Question 3. We skype all the time, an hour a day at minimum. A Skype log list on all of those calls for a couple of months back will be very long and hard to get a good summary of. Would 4calls/month be enough and then maybe a letter going with it that explains it all?

Question 4. We don't talk a whole lot through e-mails. But we do text alot. Are they legit as evidence if you go through some of the apps they talk of in other forums (where you can apparently get all the information about who sent it to who etc.)? Guessing printscreens from my iPhone won't do?

Once again. Thank you all for taking the time to help me calm my nerves and figuring this whole thing out. It really means a lot.

K-1 Fiance(e) Visa Process & ProceduresPlace of birth - Big issue?
Hello again all visajourney members!

So, when my fiance and I filed our I-129F I thought "place of birth" meant the actual town your were born in. So that's what I answered on all those questions regarding myself. But I read somewhere that it's where your parents were registered (lived) when you were born, which in my case is NOT the same town.

We're getting all the papers together now to prepare for my interview and I'm just worrying (as usual) that this might be a problem at some point.

At the moment I'm preparing duplicate forms one with my first answer and then one with where my parents where living. In case they ask for either one I'll be prepared, right? But which one should I use?

I just feel kind of stupid and don't really know what to do! Will this be an issue? What should I do?

In my birthcertificate and passport my place of birth is the town my parents where living in when I was born, so does that take presidence somehow? Guess I should've thought of checking that earlier...

Please help a stressed out Swede? :bonk:

K-1 Fiance(e) Visa Process & ProceduresDS-156 problem
Hi everyone!

I see I'm not the only one who's had this problem. I tried finding a cure for the problem on forums, I tried doing it different times during the day and on different days of the week without any change.

What DID work however was to download the Safari web-browser and do it there instead of with Chrome, Firefox or Explorer.
Just wanted to share this in hope that it will help some of you!

You can download Safari here: http://www.apple.com/safari/

Hope it helps!

K-1 Fiance(e) Visa Process & Proceduresresidence on 325??

NO there are no 325 Forum JUST G325A Forms. Well I would say if you did not legally change your adress when you where in the US then put your home countries adress on the Petition.

Everyone, thanks for all the help. As a lot of other things you just have to take a chance and go with whatever you think is right.

I just use 325 as short for G325A since I assume everyone on this forum are in the process or has been through the process of applying for the K1 visa and consequently very well aware of the fact that there is only one form I could refer to when I write simply 325.

I also know that the US cares nothing for other countries laws/regulations/ways of determining for example residency (why would they in this case?)...like pointed out I've been studying etc in the US for more than 5 years and I'm pretty aware of the ways of government (pol. sci major/master). I simly used the Swedish way as an examlpe of the fact that if the US didn't recognize me as having residency, nor Sweden I would technically not have been living anywhere for a year.

Blah blah blah

Your advice was good though...I'm probably reading more into it than what it is.

Thanks!

K-1 Fiance(e) Visa Process & Proceduresresidence on 325??

Your resident address is where you live. So, if you lived in the U.S., you would need to list your U.S. address.
I don't think you need to worry about Swedish residency law, as Sweden is not processing your application.

Well I guess the important thing was that when you are a student you are NOT considered a resident of the US. The same goes when you are in the US on a B2 visa..you are considered a visitor. However, as a student or a visitor you are bound to be staying somewhere but should this address be considered a residency in the application?

Yes I was talking about the G325..I hope there are no other 325s!!

K-1 Fiance(e) Visa Process & Proceduresresidence on 325??
Hi everyone,
Just finished preparing the 129 package and my fiance in the States is about to mail it out tomorrow. However, I have one last question and it's concerning the residence part of the 325A form. I've been in the States on a Student visa 1999-2004 and 2005-2006 on a B2 visa. Obviously I had an address in the States..or a couple...but was that considered my residence? According to Swedish law first it wasn't but then the law changed and they would no longer accept me as a resident in Sweden..but I know from filling out forms that I was not considered a resient of the US during this time either.

My question is: do I fill out the addresses I had in the States during my student years or do I only put my Swedish address??

Appreciate any help I can get!!

Thanks in advance ;)

K-1 Fiance(e) Visa Process & ProceduresAddress change after embassy interview, before POE
Thank you!
Just to be clear on this. I assume you are saying that I need to do the AR-11 IF I move once I have applied for the AOS, and before the AOS interview? It doesn't matter that the I-129 was filed on one address and the AOS will be filed with another one as long as I fill out the new and current address on my I-94? POE won't give me any ####### about that?

QUOTE (YuAndDan @ Jan 17 2008, 03:37 PM) <{POST_SNAPBACK}>
Nothing needs to be done until you arrive in the USA. When you enter the USA put the address that you will be residing at on the I-94 card that you will fill out and give to the officer at the POE.

Any time you move after entry to the USA you will need to file an AR-11, and anytime a sponsor who has filed an I-864 to support an immigrant moves they will file an I-865 to show their moving.

K-1 Fiance(e) Visa Process & ProceduresAddress change after embassy interview, before POE
Hi Everyone,
I have a small, but to me pretty complicated question regarding change of address. My fiance is moving as of today. I have recevied my K1 from the embassy but won't enter the US until February. Once I get there we are planning on getting married semi-soon and apply for AOS. What kind of address change do I have to do now? I figured t's smarter to do it now rather than after the AOS application is sent in. Techincally I don't have a case pending anywhere (I think) since my K1 was approved. However the visa does come with the requirement to get married withing 90 days...does that mean I have a pendning case, and in that case, with which department, the USCIS? If I don't have a pending case I shouldn't have to fill out an AR-11, but I read somewhere I still have to let the USCIS know about why whereabouts, as long as I'm a foregin citizen and in the US...but technically I'm not in the US yet. You see my problem? wacko.gif

Thankful for any help!!!

you still have a lot of time to obtain all the info you need! Good Luck!

K-1 Fiance(e) Visa Case Filing and Progress ReportsWooHooo!!! NOA1 Received

Thanks. It already feels way to loooooooooooooooooooooooooong. I would have been in this 'line' a month ago if the stupid international courier hadn't misplaced the package with her documentation. But hey, I am still happy. It is finally in.

So sorry about that, I know what you are talking about, like we paid this attorney $1700 for the K-1 visa we waited 3 almost 3 months and nothing happened, the we had to start all over again with a new attorney…

But there is always a happy ending.

Now that you have so much time on your hands try to get all the info about the interview medical and everything else always be a step ahead. So that when the day final comes you will now what do next.

K-1 Fiance(e) Visa Case Filing and Progress ReportsWooHooo!!! NOA1 Received

Hi Guys,

Just want to share this with everyone. I was a bit surprised to see how fast it was.

1.) Sent my I-129F on 4/20/10 to CSC
2.) CSC received my application on 4/21/10 and issused NOA1 same day!!!!!
3.) Check cashed on 4/22/10 (got the case no. from the posted check receipt from my bank online, loged in to USCIS and saw the NOA1 issued already on 4/21/10, NICE)
4.) NOA1 in hand on monday 4/26/10, less then a week after sending my application.

I knew NOA1 is ususally fast as its just an acknoledgement that USCIS have the application but I was still really surprised to see how fast this was.

I just hope the rest of the process goes this fast. I have waited long enough.

congrats!!! Posted Image
