All CR-1/IR-1/CR-2/IR-2 should have I-551 stamp in their passport at POE when they arrive.
When they take MBE with immigration visa, they will stamp I-551 info including A# for 1 year validity.
This is temp green card while waiting for plastic Green Card (I-551).

If you have expired Green Card, or don't have Green Card even though you are LPR, you can schedule Info-Pass with evidence, and they can put I-551 stamp for 1 year validity, which usaually happens when you renew your green card, or remove your condition.

So when somebody enter US with IR-1/IR-2/CR-1/CR-2, make sure that you have I-551 stamp in your passport before leaving immigration and customs area.

Usually ICE employee write down the A# by ommiting leading zero(0).

For an example, if A# is A000123456, they may write A123456.

It doesn't matter which form you used for federal tax return.

In order to qualify for I-864EZ, you should meet all following three conditions.

1) you are the petitioner of I-130
2) the relative you are sponsoring is the "only" person listed on the form I-130 petitions.
3) you use your income for quailifyng income, and it should be sufficient to meet the poverty guideline
your income should be shown as W-2, and coming from your salary and/or pension...

Otherwise, you have to use I-864 in most case.

For Q 19, if you use 1040, or 1040A, you can use gross income field from your tax return.
If you use 1040EZ, you can use "adjusted" gross income.

I have transcripts from the last three years that show my income was sufficiant. Most of the time I was 1099'ed at the end of the year though one job last year put me on payroll and I got a W2 form this year. For the last 3 years I have worked for two regular opperations. This year I have done some work with them, however one is done. So I have been working on various opperations while waiting for the next long term ride. I have wrote down the days worked and how much I was paid/owed. Currently, as of the end of may I have made about 12,000---which comes to 2,400/month or 28,800.

Any ideas,

I guess your tax documentation.

In addition to your personal income tax, you have tax document for your own company or freelancer to declare your income/activities to Federal/State every quarter, right ?

Also you may have to write your own statement to describe your income, nature of business with notarized.

Plus if you can get affadavit of support from your business client that you are freenlancer for their jobs, and proved the work performed for last year by yourself.

If you use NVC payment website, after your payment processed, NVC have additional links for DS-230 and supporting document.
So you have to download/read those from NVC website, and send the completed forms and supporting documents.
Even cover letter with bar code can be downloaded and/or emailed as PDF file.

Call them up and ask for live person for assistance for your case.
Then point out their mistake, and if they ask for proof, you can ask for fax number and mailing address.
Probably fixing the error can be taken up to one or two weeks ?

Don't abuse their email too much.
When you send DS-3032 via email, they will check it and respond to you within 7~10 days timeframe.
So wait for 7~10 days after sending email request.
You will get acknowledgement for email receipt for your email same day or next day.
Then you will get the response for the process within 7~10 days.

Make sure that you will send emails with plain text, not HTML format.

Just use the address from bar-code coversheet.

In my own experience, they forward the mail from 32 Rochester Ave to 31 Rochester Ave.
But as long as you have correct case number, and bar-code sheet, it will forward to right department/personal.

Or you can email "the choice of agent" to nvcinquiry@state.gov, I believe.

Make sure that you include NVC case #, Beneficiary name and DOB, Petitioner name and DOB, both beneficiary/petitioner's email and phone numbers.

I don't think you would get an interview date if the Embassay did not receive your case.



Actually NVC schedule the Interview first with US Embassy, then send the package via DHL.
In most case, NVC send out the package right after interview schedule confirmed.
But you know how beaurocractic world it is.
By simple mistake, some people's life may be screwed up.

Call NVC to verify when they sent out the package for your case.

Also I would recommend to carry copy of all documents you did submit to the interview just in case.
Including I-130/I-129F package and approval notice.

Sometimes some people misplace the case paperwork, so don't assume anything.
Be prepared for all kinds of "just in case".

Very fist wisdom to deal with immigration is, "Better be over-prepared than sorry!"

It depends.
If you have registered email address with NVC, they may send it via email.
But if you didn't, they will try to send it via snail mail.

If the US Embassy have contact info, you can contact them to verify whether they received it or not.
Sometimes DHL may forgot to scan the item or the problem with tracking system error.

Also if you are sure that your case is completed from NVC, and your paperwork was forwarded to US Embassy, you can contact US Embassy to check whether they have your interview scheduled and the paperwork was received, or not.
I would recommend to call US Embassy to confirm this because you may get feedback from US Embassy Consular officer for what may needed additionally on the top of all info you did submit.

Also sometimes USCIS outsourcing company makes mistakes to handling mailing.
And there is slight chance that when they forward the I-130 package from NSC or other service center to California Service Center, they make some mistake by placing the package mising or somewhere else.
If I remember correctly, last year or a couple of years ago, US CIS lost a couple of ten thousands petitioned paperwork from outsourced mail processing company or something like that.
When I looked at timeline, it seems they generated I-797 NOA1, and then deposit the check for processing fee at next day or so.

Every admittance as a Visitor is discretionary. A heavily pregnant female may well be questioned. Plus of course Airlines have heir own rules.


Some of them were discovered during POE immigration inspection.
I'm really curious what happened if woman deliver new baby up in the air ?
Technically airplane up in the air is not belong to specific country yet, so new baby will not get citizenship from the land they are born ?

You can add your Mom's info.

Also, you can submit the copy of all your pay stubs, W-2 form for Year 2008, along with your employment letter stating your annual salary and intention to employ you for permanent term.
Then add cover letter to explain that you start the work in the middle of the year, and that's why W-2 reported income is less than what it should be. And mention your employment verification letter for your job and salary info.

I think all together with your mom's support can do the job.

Better overprepared than sorry!

As other members said, grab all proofs for Tax Year 2008 federal tax return copy.
If they ask for it, you can just show it.
If you don't have it, and consular officer makes big deal about it, your case may be delayed for RFE.

Some people may just file for extension, and may not be ready for tax return copy until October.
But if you have all the info along with the proofs such as W-2 copy and right reason,
you may be fine to convince him/her.

I think they have access to the computer system, which can be access IRS tax information and border entry information.
Probably a couple of more systems.


Don't want to get to far off topic here but I think they would need a signed consent from the tax payer in order to access the IRS data base. I know that both the Department of Education, the VA and your Senator or Congressman can't acces tax records and I'm assuming the DOS and the USCIS cant legally access them either without a signed consent. A tax lein is a public record that shows up on a credit report but if the embassy is pulling credit reports of the sponsers then that might be new....


Even the credit report needs the person's consent.

Recently somebody who went for N400 interview had experienced that USCIS adjudicator "accidently" showed the computer screen while he/she inquired IRS record and IBIS record during the interview.

We signed so many paperworks during the process, so we never know whether we did sign for it or not. whistling.gif

NVC just check the paperwork by US Embassy's request.
NVC personal doesn't check IRS record or IBIS system for individuals.
But US consular officer and USCIS adjudicator may have IRS record and IBIS system via limited network access.
So they can find something...

Recently there was some report regarding this issue.
USCIS adjudicator shows the computer screen to check IRS tax info and IBIS information to interviewee.
