Until he/she becomes 18 years old, he/she can not sign SSN card, and you should be there for his/her SSN card replacement.

For specific question, it doesn't sound that your kid's presence is required, but I agree that it is better bring him/her to SSA office to do his/her replacement request since it is his/her card. whistling.gif

It may not be required by SSA procedure, but it is his/her card.
So do his/her due dilligence as a part of education. ^^

Nope.

If you married for 2 years when you petition for Greencard sponsorship for your spouse based on the spouse of US citizen condition, you will be easier to collect the proof for bona-fide marriage relationship.
Plus USCIS will give 10 year validity Green Card upon approval of the case instead of 2 year validity conditional green card, which will required to lift the condition on the time when you reach two year anniversary date from green card issurance using I-751 form.

I don't know whether this can be trusted or not.
As far as I know, this is average time from the case receipt to first interview.
But they are attacking the case from two batch.
One is from this March or later, which they process it ASAP.
But another one is from the case before this March or something like that, which was received last year, or early this year.
This was accumulated, so they are trying to process old, accumulated cases.

So people, who applied this year are seeing much faster processing, and some people, who applied a while ago, are seeing some "improvement" recently.

Each US embassy may have their own local rule for this one, so you may want to check US Embassy website in U.K.

If you want to stay in U.K. for more than 2 years, probably IR1 with DCF will be better option in my opinion.

If your husband is US Citizen, he has to file federal tax return for his income no matter where he lives.
It apply to Permanent Resident, too.

Tax report for income from anywhere in the world.

Actually,if you file from the UK (using a process known on VJ as Direct Consular Filing or DCF) the timeline is generally about 4-6 months. You will need to file an I-130 and G-325a's at first instance with London. It is fairly straightforward, and as said above will result in an IR-1 visa, and eventually another 10-year GC.

Actually you have a couple of options.

You can surrender your green card in US embassy when you are in U.K. if you are sure to stay there.
Probably you will know it for sure when you stay there for 6 months or so.

For temporary visit to U.S., you shouldn't have much of problem with VISA.
I don't know whether U.K. is a part of Visa Waiver Program or not.
But if UK is a part of VWP, you don't even need the VISA for short period of visit such as 90 days or less.

If you decide to come back to U.S. for permanent stay, you have three options.


1) Returning Alien processing from US Embassy in U.K.

There is special category for somebody, who give up permanent residency on his/her will, then decide to come back to U.S. as permanent resident again.


2) K3 visa (also known as Spouse Visa)

I believe it will use I-129F along with I-130.
It may make short for coming in U.S. for a couple of months faster than IR1 case, but sometimes not much different from IR1.

3) IR1

I-130 filing alone.
But you can use Direct Consular Filing (DCF) to facilitate your process, so there will be not much different from K3 visa, I think.


Big difference between K3 and IR1 is that K3 will come into U.S. first, then process rest of I-130 in the U.S.
But if you use DCF for IR1 case, there should not be big difference.

Returning Alien may be shortest, and K3/IR1 should be similar timeline if you use DCF.

Sometimes it happens.
They were expected to receive the case file from service center, but because of internal issue, they didn't receive it.

It depends on the officer, whom you are dealing with.
According to the rule, they can not make the decision until 3 year's anniversary passed.

Or they can deny the application.

So it is really up to interview officer how to handle the situation.

It all depends on USCIS adjudicator, whom you are dealing with.
Adjudicator is nice word for interview officer.

The reason for asking all your passports including current/expired is following.

- Current unexpired passport : check your birth info along with your identity in addition to driver license, and green card

- check the E/D record to confirm your in/out record for oversea travel

If interview officer needs to verify your oversea travel record, and he/she feel he/she need to verify details,
he/she can hold your case until he/she can verify your in/out record.

If someone doesn't care about those info, you will be fine.
But if someone care much about it, you might be in trouble.

Do you have the copy of every pages from your old/current passport ? At least every pages, which contains some visa stamps?

You can not get back to US without passport even though you have green card.
This was changed recently.

The main reason asking to bring all your expired/current passports is to verify your in/out record from visa stamps, which is critical for your N400 eligibility.

I wish you have luck to have Interview officer, who doesn't care much about it.

Usually there is email address or phone number to reach Immigration Visa department consular officer.
Ask your husband to contact consular officer directly to explain the reason.
Probably your husband may write the statement, notarize it, and send it to US embassy ASAP.

Usually they have same kind of screen as SS-5 form does.
So technically you can talk to officer over the window, and just go over each field for Question and answer session.
Then they can print out the receipt and give it to you.

But sometimes it takes more time, and possibly some typo.

So I prefer to fill out the form SS-5, and pass it to the officer.

It is not mandatory, but it is recommended.
It is for moral support, and prepared for just in case.
In very rare case, they ask US citizen spouse to verify whether he/she is real person or not. whistling.gif

USCIS doesn't give you the info what they will ask during the interview.

They can ask whatever, and if you can not provide satisfactory answer right away, they can hold your case until you provide the answer they want.

So it's better having over-prepared than hearing "sorry, we can not make the decision at this time because you don't have this and that information."

I recommend that you go through N400 what you did submit, and reviewing from USCIS officer's viewpoint.

You can go for finger print appointment.
Do you have the case number they gave when you called in?

Contact your congress man. They have people dedicated for this kind of issue.

It's up to you.
Most of cases I found is that interview officer may not look at the case until interview time comes.
Having tax transcripts will show that you paid the tax on time without any unpaid tax in file.
So it may prove that you are good moral character, who pay their due on time. whistling.gif
It is NOT required for 5 year residency condition, but it may be another proof that you are good citizen of society. innocent.gif
Therefore it is really up to you whether you want to send it along with application.

When you visit USCIS DO for fingerprint, they will hand out booklet for Civic test.
It includes audio CD.
For some reason, it doesn't work with my car audio, so I converted it to MP3 files, and use my MP3 player for study when I'm sitting in rest room or somewhere with nothing. ^^

It depends.
Biometric appointment can be done from Application Support Center (ASC), which can be same place as your local DO, or different location.

If your local DO has ASC located in same building, chances are good to have both biometric/interview at same place.
But if it is not, probably you may have to visit two different places.
Also, if the schedule for specific ASC is too busy, you may have to visit other ASC closed to you.

Interview officer will work from local District Office in most case.
But ASC may not be same as your local DO.

Sometimes ASC may be located in convenient place such as mall or something like that.

Let's look at their - Interview officer - viewpoint.
Tax transcripts - either tax return transcript or tax account transcript - consume less space, easy to read, and certified by IRS.
If you can, please use tax transcripts.
That will help interview officer and other USCIS people.
As otherpeople pointed out already, it is free, and it takes only 10 days for tax return transcript.
You can fax the request if you are tired of holding on phone line.
Tax account transcript will take more time. It said up to 30 days.
The difference between tax return transcript and tax account transcript is before/after IRS adjustification.
Tax return transcript is based on the info you submitted.
Tax account transcript is based on the info after IRS adjusted the number by IRS.
Tax return transcript will take up to 10 days, and tax account transcript will take up to 30 days.
If you are lazy enough not to request this kind of info, you can use your copy of tax return, but it may give big Sigh to interview officer when they look at the stack of papers.

Do you have the option to have the ticket not appear on your record? I'm not sure if it only applies to citizens, but I would think if you have a license then you should be able to do this if your state offers it. I received a ticket a month ago which cost $116. I paid $182 for their diversion program in which the ticket will not appear on my record if I stay ticket-free in the same county for the next 6 months. Might be worth checking into.

The reason i asked
I chose no to all tickets and so on on the N400 form.
My interview is next week so I am not sure if I have to chanfge that on the form now ont he day of the interview. Now if i pay by check could i bring the cancelled check to the interview or what should i do. I will mention as somebdy said. I guess I really messed up just a few days before my interview. I cannot believe this could affect alot.

Oh about answering the last question yes the cop said since i nnever got a ticket before he checked the option to have the ticket not show up DMV records. SO the question is what should I do if i got that option?

It's up to you.
Since you got ticket a couple of days ago, it may not register into DMV system at all.
It will be entered in DMV system after your court date specified in your ticket.

But if you want to be honest good moral citizen, when interview officer ask for it, you can show the ticket, and tell him I got this a couple of days ago. That's it.
Since it is not passed the date on the ticket, they should not ask for payment record.
Dollar amount for ticket and details should be in the ticket, so it should be fine.

But question is whether interview officer ask for past history from your DMV record or not.
If you can get DMV driving record, you may want to bring it with you, too.

Chances are that above notice may be sent from local DO.
Interview letter is usually sent from service center for initial interview.
You may want to check with USCIS whether they scheduled for initial interview, and sent interview letter.
Because two different unit working on their own time schedule, service center may send interview letter later than above notice mailing out.

So for answer to your question, you have to call USCIS to find out what's going on.



Very basic about dealing with USCIS is "Don't assume for anything!"
They may make mistake, or lost your file.
If you have any doubt, you have to check with them.
And if you have interview, you have to bring every documents and evidences with you.
When you get into interview place, they may say, "Oooops! we lost your file, so we can not process your case until we find it!"
So make the copy of everything you submitted, and keep the record of what you've sent.

Don't give any excuse for them to delay your case processing.

But also, don't make them overload with too much information, too.
They are human. So if you dump all of information to them, they may hate you because of the amount of waste you are dumping to them. ^^

So have everything in handy, so if they ask for it, you can be ready to present it without any hesistance.

3 year time clock will start from Green Card issurance.
Only good thing from your case is that probably you will receive 10 year Green Card since you managed 3 years for your marriage life, and you don't have to worry about lifting condition with I-751 with 2 year Green Card.

When you receive your green card, you will see date from "residenct since".
You can apply N400 when you keep marrying with same US citizen for the period, and 90 days prior to 3 year anniversary date from "residenct since" date.

It depends on each District Office.
Some DO has located to same building as court house, so when they perform oath ceremony, they do from court house.
In that case, because judge from court house has ability to perform oath and change the name legally, they could change legal name at the same time.
But some DO has located in different building than court house, or performs oath ceremoney in different location, it is not possible to do that.

During the interview, interview officer will confirm the question. When interview officer ask for confirmation, you can ask whether it can be done without delay or not. Then you can make final decision whether you want to change your legal name or not.

Ha, can only wonder if we would have requested a different field office if the one they sent us to was in hell. Probably not.

In that counterfeit version of St. Paul's interview form, did say to write to your IO with the address if you have any questions. So did drop her off a nice note, just asking where our oath letter is. Other letters to St. Paul resulted in no response, but at least trying, if you don't try, nothing will happen.


Probably you tried your congressman and things like that.

If USCIS schedule the oath ceremony for your wife in the meantime, you have to pay for legal fee and court cost.
But if the court is quicker than USCIS's action, USCIS should pay for those cost.
