I could be wrong, but I don't think it's going to be a huge issue. The divorce decree isn't critical for determining whether you're eligible for naturalization. Even if you never divorced and were still married, you'd be equally as eligible for naturalization.

Hypothetically, if you had re-married after the divorce and were applying for citizenship based on the marriage to the new spouse, then the divorce would be critical, because without a valid divorce, the validity of the new marriage would be in doubt. But that's not your case.

If I'm wrong and they really want to see an original which you don't have ready at the interview, they'll delay your approval and give you a chance to get the missing document. So if you're in a hurry and don't mind spending the money, you can order the document now, but if you want to save money and don't mind a (I suspect slim) chance of a delay, you can wait and see what they say at the interview.


From my experiece, and other people's story, USCIS requires "original" or "certified" divorce decree for multiple reasons.

1) checking marriage history, which is relevant to marriage-based case
2) Good moral character to see alimony and child support cases whether it has any issue or not

I saw the posting regarding 2), which USCIS officer gave hard time for divorce done from other country other than U.S.

OP said he have certified divorce decree, and sent N400 with the copy of certified divorce decree.
So as long as he carry the certified divorce decree for his interview, it will be fine.

It depends on USCIS interview officer.
Some may o.k. with the copy, but in most case, they want to see the certified or original divorce decree.

Certified divorce decree means the court decision copy plus cover letter saying this is certified.

So if you can bring the certified divorce decree for Interview, it will be fine.

Business casual will be good, but if you want to show respect to USCIS adjudicator, you may want to wear business formal dress code.
USCIS adjudicator is not supposed to judge you based on how you looks, but they are also a person.
So if they feel you dress nicely, they may feel better about you.

If it is single incident, honesty with detailed info along with how to present your case will be the key.
With same info, USCIS adjudicator will judge your "Good" moral character based on how you present the evidence with your personal opinion, I think.

One of my habit for this kind of thing was over-prepared.
But when I had interview with US Embassy Consular officer, I learned another thing.
Think from thier prospective.

They are dealing with paperwork all days.
If somebody dump meaningless document after document, they may be tired of the paperwork.

So after then, I keep over-prepared for paperwork, but I'm trying to submit necessary info only to them.
When they ask for something, I can give it to them from my bag or somewhere.
But don't make them feeling like trash can. whistling.gif

I think the reason why you guys seeing slow response is bad luck.

It may be one of following, or combinations.

1) USCIS is trying to consolidate the initial N400 processing from 4 regional service centers to single dedicated service center, which calls National Benefit Center(?), or called as Missouri Service Center (MSC) in the past.
So people is confusing who's handling what for normal things for new process in place.

2) USCIS new fiscal year start

Since USCIS is starting new fiscal year as of October 1, they may re-allocate their resource to others, which have new visa quota available.

3) vacations and holidays ?

Usually people have a habit to forget about their vacations until it hit the end of year holidays.



I think because of combination of 1) and 2), it is slow from service center, but as soon as the paperwork is in hand of District Office Adjudicator - Interview officer -, you may expect fast processing.

Anything USCIS does is a milestone. And yes cashing the check is a milestone


If you use personal check for payment, you will see the case number assigned to you in front of the returned check.
If you have internet banking, you can check it, so you can confirm two things - (1) USCIS recieved your case, and (2) you know the case number now. ^^
Usually they ommited "0" between first four characters and numbers, so you have to pad "0" between those to make up 13 digits.

Some people experienced the problem with mail delivery, so if you lost NOA1 in the mail delivery, you may not have any information to give USCIS when you want to check your case.

Cashing the check by USCIS means that USCIS received the case, and probably they entered your info to the system.

A couple of years ago, USCIS found that they dumped a couple of thousand people's file into dumpster or something like that. mad.gif

If I remember correctly, they cashed a couple of days after I received the passport.
I guess that the dept. of State doesn't need the money that much. whistling.gif

Some of benefits are limited to US citizen, and some have different between LPR and US citizen.
Also a lot of systems from different government agency cross-check with SSA for individual's immigration status.
For an example, some of local police, voting system, and/or DMV.

Also when you need to update/renew your driver license, you may have to bring the certificate of naturalization, or US passport.

Don't forget to update I-9 for your employer, too.

For US passport, it took 6 days with regular service in November, 2008.

Since it is approaching to summer vacation, it will be slow for overloading with request for summer vacation.

It depends.
It depends on when you get your interview of the day, and whether you passed without a problem.
Oath schedule can be found by calling to federal court house if the judge is administrating the ceremony.
In very rare case, if the oath ceremony is administrated by local USCIS district office itself, you can get the schedule from very nice interview officer by calling USCIS customer service and asking the transfer the call to the case officer, who handles your case.

Who makes the laws of the land?
How many stars on the flag?

He did note that I was very early in applying for citizenship and he was surprized (it's a little over 3 years). He also asked for some current evidence of marriage (I nearly didn't bring any, since i submitted them with the application!) Luckily I had my vet bill from the night before and a current bank statement and voila - it was over!! I have my oath scheduled for December 11th so that'll be a nice early Christmas prezzie!

In a similar boat once - not for Naturalization but for AOS. It took so long to process my AOS (nearly 2 years) that my biometrics expired. I re-did my biometrics and when the processing was completed on the AOS, I was approved. It should be the same processing for naturalization - you need to keep the fingerprints valid so when the processing is complete they will send you your notification. Biometric - fingerprint - result should be returned to USCIS within same day or next day from FBI when you go to ASC for biometric appointment.
Having multiple biometric tests doesn't mean that you have to take another interview.

I think there is not much difference except the case that it requires additional check and/or documents.
It is really mattered with your FBI namecheck process result in most cases.
If you have NO HIT from FBI namecheck, it will be processed as fast as their resources are available.
In most cases, interview officer will depends on interview to review the cases.
If they catch something from interview, and you don't have proofs/evidences they request at the time,
it will be delayed.
But as long as you have evidences and/or proofs, it will be o.k.
If they see they need more time to check your background or something like that, it may be delayed.

But in most cases, it is delayed to wait for security clearance from FBI namecheck.

Processing time is varied from one case to other case.
Announced processing time by USCIS is average from N400 application to first interview date.
So actual processing time is different from announced version.

Also, I believe USCIS is attacking two different batches for N400 processing.

One is from the cases after March 2008 or something like that.
The other is for the cases before that time.

So if you look at recent cases, it will be much quicker.
But if you look at the filers from last year or early this year, you will see still some people waiting for interview and/or oath schedule.

Also it may be another consideration that USCIS did put much weight for N400 processing because of Presidential Election. whistling.gif

So some of us did get benefit from this year.

Probably warning is not counted for those question.

If you only have warnings, I would say No for tickets, citations, and other violations.

It really depends on interview officer.
Some asks for it, and others doesn't care if it is just traffic ticket.

Just in case, if you want to get the proof of conviction and payment confirmation,
you can get your Driving Record copy from DMV, and it will have the date and court information.
Then you can ask the court to provide the details of the case and payment confirmation.

The quick answer is that you don't need to worry at all about traffic tickets. Just overlook that you ever had them, since the fines were paid and they were both routine violations of traffic laws.


Usually they don't care about minor traffic tickets.
But it will be handy to have the copy of tickets and the receipt for payment.
If interview officer ask for it, you can just show it, and do not give a chance for them to delay your naturalization process.
I brought the ticket with payment, and he just checked it for payment.
Some people was delayed for oath ceremony because they didn't have payment record for speed ticket or something like that.
It depends on whom you are dealing with.
But for safety, if you have the ticket and the receipt, bring it with you.
And probably having DMV driving record copy will be handy, too.

I mailed N400 a couple of days before 90 days.
But luckily Priority date was entered after 90 day point.

But it really depends on whom you are dealing with.
Some interview officer may be very cautious about that, but others may not care about that.

So I think it is another case for "Your mileage may vary(YMMV)".

If I were you, I will sign the form and mail it out after 90 day checkpoint.

In my case, I thought it was o.k. before 90 day as long as it was received after 90 days.
But people's experience was so different.

My interview was scheduled just 3 days after 5 year anniversary.

So you may have another problem by interview scheduled too early.

N400 case is NOT updated for CRIS (USCIS case online query system).
I got my certificate of naturalization, and it is still saying "Case received and pending" from CRIS.

This is a big risk to confidentiality of information if they allow anyone to randomly scan it. Based on my research, only few international airports in USA have this equipped today which has a special line for new passport holders where they can just zip through when they return to USA.

Actually it is international standard.
As far as I understand, if you know the person's passport name and DOB, you can read it whole content stored in the chip.
I don' think biometric data stored in the chip yet, but it is planned.
So far, I think all information from Passport identity information including photo are stored in the chip.

If you search for "RFID passport cover", you can find some, but I don't know which one is good.

That's great news. There seem to be so many ways to get a passport, but 6 working days is fantastic. How did you do it? Did it take a visit to the post office? Did you pay expedited? Or the regular fee? Which forms did you include and to what address did you post it? I think we will follow you lead as we would like to travel a couple of weeks after my wife's oath ceremony.

I used routine service from post office, and got same kind of processing time.
I guess the load for passport application center is low, or they improved the process.
Nowadays it will take less than 10 days for routine service, but it is not guaranteed. whistling.gif

I have read about a requirement for the applicant to reside within the state or district for 3 months prior to application. I am a little confused by this requirement. If ever we decide to move to another state, do I need to count 3 months of residence in that state before I start my application? or it really wouldn't matter, I can apply rightaway in that new state rightaway?


You may need to wait for 3 months.
Sometimes it is fine, but other times they may reject your application based on that.
When you deal with USCIS, it may be easier to follow their rule as it is said.
I think You don't want to have gray area for your N400 application.

It will be easier and safer to do it from one location.
If you move to other district office, there will be possibility that your case may be rejected and/or delayed because of 90 day resideny requirement.
Also there is more possibility that your application file may be lost because of inter-department mailing.

You may need to collect utility bills and/or bill statements from new residence after your move-in.

I got my certificate of naturalization in my hands for one and half months already. whistling.gif

CRIS case online query system is not relevant to N400 at all.

Probably you have to write it on IR1/CR1 forum.
But for your answer, your best bet is to contact your embassy to find out where your case is sitting at.
You can call them up, or if they have dedicated email for inquiry, you can ask your US citizen family to write the email to them.

Normally it will be cashed within 7 days upon receipt.
They may check a couple of things, but not all of them.
Such as eligibility of date and thing like that.

But sometimes they may hold the incoming mails for processing for one reason or another.
Such as transferring to other location...

Not really.
FBI Fingerprint result is only valid for 15 months.
And USCIS will receive FBI Fingerprint result within 24~48 hours, so it will not delay much for your process by taking second fingerprint.

The biometics appointment was in Buffalo, New York. I was suprised to see on the biometics notice that if I could not go to that appointment, that I could go instead any wednesday until mid-September. However, I had no reason for delaying.

I would recommend to reschedule both to the other day.
Oath Ceremony itself will take about 10~20 min.
But as you already know, you can not predict how long it's gonna be for waiting to make that happen.
Waiting line to get into the building, and submitting your signed Oath Letter...
Depending on the number of people taking the oath at the ceremony, this waiting can be easily from one hour to a couple of hours.

I applied US passport a month ago, and it only took 5~6 days with regular service.
If you need it quickly, you can ask for rush service, or you can stop by one of Passport Application Center.

Without US Passport, you will be in trouble.
Eventually they wlll let you in, but you will be educated, and/or got penalty with fine.

Don't make the trouble if you already know it.

Worst thing is...
Depending on Airline employee, they may not let you get on board without US Passport or US VISA.
They don't know nothing about the certificate of naturalization, and they can not identify whether it is real one or fake one.

Yes, it is normal.
Finally USCIS is migrating to National Benefit Center for central processing.
As a part of migration plan executed as of Dec 1st, they are forwarding the cases from all 4 service center lock boxes to new NBC facilities, one in Texas, and another in Arizona.
So if it is working out without problems, they will officially change the N400 lock boxes to those two locations.
