As long as new trip doesn't break residency requirement for N400, he will be o.k.

For fingerprint appointment, USCIS will normally allow walk-in after the scheduled appointment, which is missed by applicant, but it is varied from district office to DO.

For missing interview appointments, he can always to contact USCIS to reschedule it.
Even before the trip, he can mail to USCIS for the reqeust or notification for out-of-country trip schedule to avoid any scheduling during that period.
USCIS may loose the track of that request, but you can notify them for potential scheduling conflict. whistling.gif
Mail to the address appeared in NOA1, or call 1-800 number to ask "service request" for the case.

It might be confused for following situation.

If Alien got the green card through marriage-based case, he/she may not sponsor for another alien for green card unless it is passed 5 years since he/she was approved for marriage-based green card.
There are exections but it will be difficult because USCIS may consider immigration fraud possibility for such case.
It is explained in I-130 instructions.

But frequent marriage involved in green card may be considered as similar case such as fake marriage for immigration purpose.
So be careful!

The other minor thing is that you may have to check the local rule for marriage.
Some State may have the law that you can not marry within certain timeframe - normally 1 year - from when you got divorced.
That was from old days to identify parents when the woman may be pregnant around the time of divorce.

Probably the answer will be "No" Unless you have valid reason such as moving to another DO's jurisdiction.
Also it will create more delay because they have to transfer the case to new DO, and they may have problem such as lost in the mail for transfer.
So I do NOT recommend this at all.
3 months away will be much better that 5~6 month delay by case transfer to different DO.

In my case, I applied for both.
It costs $20 more, but since I had a habit to carry "Greencard" in my wallet, I asked for passport card, and carried in my wallet.
Technically if you have passport book, you don't need passport card.

But in reality, I'm not comfortable when I have nothing in my wallet for immigration status.
Yes, checking against social security number or driver license should show your US citizenship.
But I rather carry the proof by myself instead of depending on some computer, which may be screwed up.

Dealing with USCIS for more than 10 years left pretty much little belief in government system, I guess. whistling.gif

For short answer, you should have been 3 years since you have been Lawful Permanent Resident AND married to same US Citizen for last 3 years.

I'm not quite sure I understand this policy. How are these qualifications different than getting an H1-b visa, and then AOS to a Green Card? To me it sounds like if you do not have "quite" the skills of an H1-b worker, then join the Armed Forces for 3 years, risk your life, and get the AOS that way. I guess the question is, should the US Armed Forces allow non-US citizens fight for the US? Seems odd to me (from a national security perspective). Then again I'm from Sweden, a neutral country.


This is pilot program. There is the quota for the cap.
I think it is 1000 or 2000 per year.
Since military has troubles to find the solders for them, they are trying to have somebody in deseprate needs for Green Card or citizenship.
They did this for vietnam war, so they are trying to do same thing.
But some people have objection about this one for various reasons.

That's routine word USCIS is using for Interview.
In most case, it will be enough with initial interview, and no further interview is required.
But if USCIS adjudicator find some issue, or interviewee doesn't have the documentation USCIS adjudicator is looking for,
USCIS may schedule another interview. But it's very rare cases.
Oh, if you fail the civic and English test, you will get second interview, too. whistling.gif

One thing you may have to know for dual citizenship situation.
US is only country I know that you have to pay for taxes no matter where you earned.
That means that if you live in Spain as Spanish citizen, you still have to pay federal tax to IRS from oversea income.
If Spain and U.S. have tax treaty, you can get deducted the tax paid to Spain government from U.S. Federal Tax return.
OR you may have some standard deduction per tax treaty.

But you have to consult CPA for it, and have to report U.S. Federal tax return no matter where you live.

Yes, if only one of parents is US Citizen at child's birth, which is considered as natural born citizenship, he/she will get US citizenship at birth when his/her US Citizen parents have been lived in US at least for more than 7 years or something like that.

You can bring it to Interview.
Actually I did send only N400 application form. No copy of Green Card, no photos, no other documents.
I brought all of those to Interview, and it was fine.
I just checked N400 instructions, and I missed "Check with M-476".
But it was fine as long as you have those during the Interview.

I jus received my NOA today, mailed on 12/11/08 form zip code 75067 (Lewisville, TX). The address in the left states USCIS PO BOB 648005 Lee's Summit, MO 64002.

No received or priority date. No mention to how many days it will take or forward to NBC. The letter it self, indicates being sent from NBC

USCIS is working on migration plan from all Service Center Lockbox to new NBC facilities.
One in Arizona, and another in Texas.

So when they receive the N400 from Service Center, they are forwarding those to new NBC lockboxes.
It will cause probably 2 weeks delay or something like that.

After everything looks o.k., USCIS will change the address in N400 instructions to NBC lockboxes permanently.

If you can afford the immigration lawyer, you should do that.
If you didn't file I-130 for your wife yet, you can just put "Other - B2".
But as KyingSilva said, if you put B1 or B2, it is tricky.

If it is I-130 or something, usually they don't ask for more questions except the info you wrote.
But if you put other non-immigrant visa, they "may" ask for further information and you can NOT lie about that.

N400 application process should be supposed for your circumstance only.
Tricky part is being "Good Moral Character".

Probably it will be better to involve the lawyer to prepare bullet-proof defense for you. whistling.gif

For expired B2 visa holder, and already overstayed for a couple of years, I don't think there is any way to resolve the status except filing I-130 as spouse of US citizen.

You can file I-130 with expired I-94 info as spouse of Legal Permanent Resident, then you can upgrade her I-130 case to the spouse of US citizen when you get naturalized.

But nowadays everybody has different priority, and your wife's case may be getting into trouble, so it is recommended to have the lawyer if you didn't file I-130 yet.

Since it is free, if I were you, I will bring original.
They are asking to bring original when you have interview scheduled.

Yes, it is varies from DO to DO.
I had my oath ceremony from Milwaukee DO building, but they didn't pass out the flag.
They only distributed the booklet, and the copy of papers such as "Instructions of certificate signature", and others.

It is different from district office to district office.
Also it may be changed from day to day depending on judge's schedule, the location, and capacity of the location.
Some district office change the location from time to time.

But in most case, it is fine with bringing family together, and allows photo time, even camcorder recording.

If you are not sure, you should ask to Adjudicator at the end of your interview.

Everyone said the pledge of allegience and oath. Then they called out everyone's name, one by one to go up and pick up their certificate and then leave. (Without using any sound system so it became somewhat chaotic.) There was no opportunity for photos with the judge or even a darn flag in the lobby.

Quite anticlimactic. It is a waste of time for family to attend under these circumstances. Hopefully in other locations things are more hospitable,but you might want to check before investing half a day....

Did you declare those names in "othernames used" field?
If not, it may cause the problem with FBI namecheck since they have to go through FBI database for all kinds of combination for criminal/terrorist database records along with others.

If there is no issue from FBI namecheck by USCIS adjudicator, it may be enough with affidavit of support from your family to state those names are same, and notarized those affidavit of support documentation.

But if USCIS adjudicator may find out from interview, and he/she may think to run FBI namecheck again with the changes in name spelling, it may take extra time - maybe a couple of months? - to re-do FBI namecheck.

My assumption is that if he got married with her, and it took 2 years for processing, it's possible.
When he did interviewed with US Embassy if it passed 2 year's anniversary, they will give IR-1, which doesn't have any condition.
