an i-130 adjudicated at the NBC wow.gif

I was surprised too.  That gives me hope.

One question though.... she said she asked for an expedite but does not think that was the reason for the approval... I was wondering if they might be hoarding the files that requested expedites at the NBC and just adjudicating them there instead of transferring them???  Does that make sense??  Even though they aren't technically expedited.

There is no doubt that USCIS messed up here and someone needs to be fired over that person's incompetence. However, I do not agree with the generalizations about government jobs. The vast majority of government workers work hard and serve the public. Private companies make mistakes all the time. Yes, I know the response is that we find a diffrent company. But these solutions are not transferrable to government. Want to find a different country?

Don't get me wrong--I hate the USCIS for what they are doing to me and my wife. But I draw the line about making generalizations about all government workers or all of government.

OH GOOD LORD... really? I was trying to lighten it up a little. It was a joke.....    rofl.gif

Checking in to see how you all are holding up.. I look at the NOA2 approvals and I feel bad for all still waiting.. When we all filed in April the I-130 was taking 4-6 months except at certain major back logged local offices.. Now it's been 9 months.. There is no joke I can tell to ease the pain and it's not fair things are not completed in order.. Try to stay as positive as possible and I will pray for you all..

NOT WELL! ! ! ! !

Hi everyone! Just checking in: waiting for all of you to join us in the NVC topic... especially "lovemytico" because whenever I think of our april thread I think of you first. I called the NVC today for the first time to try to get my case # and the woman was super polite and friendly-- NVC has received my case but hasn't logged it yet, so should only be a few more days she told me.

Thanks !  I want to come over to your thread.. trust me.

cray5ol.gif I just got off the phone with my very frustrated husband.  He is so angry that this is all taking so long.  He gave up his city job to work on the family farm. He sold his car and motorcycle thinking it would be better to sell them  now while he has offers rather than try to sell later for a lower price.  Anyway, farming is slow since they are finished with harvesting the coffee.  He was just telling me he is going to look for work in the city because he doesn't have any income. He didn't think this process would take this long. His thought was to spend as much time with his family working on the farm while the papers are processing. Money is so tight now. And with his car and motorcycle being sold. He is kind of stuck way up in the mountain. The city is about 1.5 hours each way.  I feel bad because I am not really in the position to support him over there.   He asked me if I thought this would take another year or 2.  I feel really bad because I didn't think this part of the process would take this long. I feel like this is all my fault.   I contacted everyone I could think of to help. Even the new mayor in my little town.  Calling our attorney won't help because I always seems to have more info than he does.

Can someone tell me what exactly does "This I130 has been assigned to an officer" mean?   I received this from Senator Bob Casey's office on Dec 30th

Jennifer,

I did get an update on your pending I-130. It was transferred to the Texas Service Center. The TSC provided the following update to our office:

This I130 has been assigned to an officer. A decision or some type of action will be made within the next 30 business days.

Thank you,

Rachel

I have run out HOPE. ClockWatch2.gif  This is all so ridiculoous..  And the family of losers up the street from me have all married someone just for a greencard. One of them just became a US citizen and the other one just left for his country today for the first time since he received  his greencard. He will be staying for 3 months. His illegal GF just married an american the day before Thanksgiving for her greencard. and the sister got caught cheating on the victim she scammed for her greencard so I have no idea what her status is but she is still in the US. It all makes me so sick.   My husband can't even come to visitcrying.gif crying.gif   UGHHHHH Im sooooo mad

We were transferred from NBC to the TSC on December 13th. I'm amazed we were approved so quickly considering others who transferred there before us are still waiting.

I'm at TSC, they can approve me any time now... The wait is killing me

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsApril 2013 I-130 Filers

So I received an email today from my congressman's office in response to their last inquiry...here it is:

Thank you for your Wednesday, December 18, 2013, email on behalf of your constituent, #####, regarding his pending Form I-130, Petition for Alien Relative, he filed on behalf of #####.

U.S. Citizenship and Immigration Services (USCIS) records confirm that Mr. #### case is pending background check clearance. USCIS is committed to adjudicating immigration benefits in a timely manner while also ensuring public safety and national security. A small percentage of applications and petitions have unresolved background check issues that temporarily delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to speculate when the background check will be completed.

If a background check reveals an issue that may impact an applicant?s eligibility for the requested immigration benefit, further inquiry is needed. The inquiry may include an additional interview and/or contact with another agency for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible.

USCIS realizes that Mr. #### may be frustrated by the progress of his case. However, the agency must balance individual inconvenience against broader issues of public safety and national security.

We hope this information is helpful. If we may be of further assistance, please let us know.

I know for a fact a background check can be done in a few minutes for US Citizens...sooooo they must be trying to check my wife, if in fact they are being honest and not just delaying. The Congressman's representative called TSC and they told her that my case is under review with an officer and it should conclude within two weeks. Notice the date USCIS was emailed and they just now responded? BS! ranting33va.gif  Anyway, I will start getting my next round of paperwork ready just in case we get approved. Anyone seen an accurate listing of how long NVC stage is taking? This is a good sign that I should be approved soon, I am just so fed up with them, that I haven't gotten excited today yet. Maybe tomorrow.

I don't believe the backgorund check malarkey.  That was done months ago...  I was also told my case was assigned to an officer last Monday.  Whatever that means...  And does being assigned and under review mean the same thing?  I haven't gotten excited either because I know its all ####### just to hold me off from calling again... Where is your file? TSC? in the same box as mine?

Well, can't send it "right away"  as my wife is still here in the US.  She has her birth certificate in Germany in her (go to the embassy" stack of paperwork.  So have to wait for her to get back.  Then she needs to make the copy, and I'm still deciding if we should pay for a translator or take our chances with my wife translating, as she probably speaks better english than me.  lol  Perhaps I will try mt congresswoman as well.  and fax it directly to her office with a copy of the I-130 instructions.

Knowing Texas, they have anybody with congressional support in a lost box. sad.png

well, I meant , it is something you can easily put  your hands on and send in.   I don't unerstand why they just can't get it at the NVC stage....  so dumb

That's horrible. We're likely going to go through the same thing. Our case was transferred to TSC as well and we did not include the beneficiary birth certificate. As you mentioned, it wasn't listed in the instructions. I'm wondering if we should just mail it in now before they issue the RFE. Will likely save us some time.

I wouldn't mail it until someone asks for it.  With all those files over there... just wait til its on someones desk and if you get an RFE, that person has it right there.  If you send it now, it will get lost for sure or never make it there and you'll just have to send it again. You also might get someone who doesnt even care about the BC for the beneficiary.   just my opinion.. do what you want... I just think its a ####### shoot . Some people get RFE's for the BC and others don't

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsApril 2013 I-130 Filers

Definitely agreed, Texas seems to be the main (only?) culprit behind the beneficiary birth certificate RFE. So sorry this happened to you. I'd be writing to the service center directly as well, quoting I-130 instructions, the whole nine yards. I don't understand why this service center is continually disregarding USCIS' specifications for the I-130 packet.

Glad we included my husband birth cert with our package.  Now if I could just get them to approve us.... Does anyone have any idea what " assigned to an officer" actually means? and how long does it take for someone to pick my file up and look at it and approve it after ebing assigned?  I could be assigned to the same officer for a month. Maybe each officer gets a batch of 500 assigned to them.  WHO FRIGGIN KNOWS?????  UGHHHH

So, I received the hard copy of my RFE:   It took 9 months for USCIS to tell me I need a copy of my wifes birth certificate.  NO WHERE in the I-130 instructions does it says that that must be submitted for your wife!!!  My wife finishes her vacation here next Sunday, in which she will go back make her copy, translate it and send it to me to fedex off to them.  My congressman will here about this!!!!

Oh Yeh, and this is with Texas.....which seems to be known for giving "needed birth certificate" RFE's.

wow, at least it is something you can send back right away.    Im still holding out for my approval...ClockWatch2.gif

Oh. That stinks. In my huiby's country it's good for 6 months. And it only took him 3 days to get it.

He can get it the same day but the 30 days really sucks.  I am almost positive they will ask him for another one to bring to the interview.

Once your approved by USCIS it takes about a month or more to get a case # from NVC so if you get working in your PCC now you will have it by the time you need it. smile.png. Good luck.

Thats why I asked if she received her NOA2. I thought I was missing something...     She needs to find out how long the police Cert is valid for from her country. If it is valid for 6 months or more, then she can request it now.  We have to wait... I would have been all over it a while ago but it costs about $40 and only good for 30 days for a cert that is a one liner...

Yep, you need the original Police Certificate.  Costa Rica issues one the same day but its only good for 30 days.  My husband has the translator waiting so the minute he gets the police report he can just swing by the translators office and send it off to me the same day.  I asked my husband to include more passport photos just incase.

To top it all off I submitted my friend's papers for her husband at the end of may..she got transferred December 9 and approved two weeks later

well,  this is a new one.  I haven't heard of anybody getting transferred back.   Hopefully its another glitch in the system.  Maybe someone was working on your case and they pressed the wrong button.  Call your senators office and explain what happened. Tell them this in UNACCEPTABLE and you would like an explanation.  I made an inquiry through my senators office early Monday morning and by 11:30 am  I had a response.  They have to inquire directly to the TSC  .  I hope you get answers. This is nuts !!

was your friend transferred to Texas or to California?  CSC is going through them so fast.  its really not fair.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsApril 2013 I-130 Filers

On page 200, someone had posted contact information for service centers, including phone numbers. I tried calling all those numbers and they seemed to be direct lines for the service center directors. I will not waste my time calling USCIS NCSC tier-2 once my 60-day deadline hits in 12 days; the NSC director will hear from me directly.

I was checking some timelines and on page 1, I came across "burnabrenna" timeline who petitioned April 02 - about the same date as mine; the spouse entered US 11/29/13. How fair is it to the rest of us who are still waiting? What kind of unaligned stupid process is this? To make matter worst, USCIS has been approving petitions filed after ours from May, June,...

Congressmen offices are not worth more than tier-2. I have decided not to waste my time with them either. Politicians are a bunch of dirty, no good individuals. USCIS keeps telling my senator's office the same sh*t on every inquiry and I don't see how the senator's office can't notice that to note USCIS ineffectiveness and inability to process petitions as they should. I would think that the senator's office should be raising hell, but no, nothing is done because it doesn't affect them personally.

I am waiting for the next elections to help campaign against any bureaucrat who failed to actively help me through this mess. Congressmen are supposed to be there to assist constituents.

I suggest to all those whose 60-day is soon near to check page 200, post # 2993 and call the number posted that will connect you with the director of service center where your file is. I am sure after many calls, the line will probably be blocked or disconnected; hopefully the calls will drive them to act on our petitions. Tier-2 are USELESS ( One told me in November, my file had been assigned to someone and that I should hear something by Christmas. Christmas has come and gone - NOTHING).

Today marks 9 fu*k*ng straight months for me.

On the inquiry from my senator's office that told me I was transferred to the TSC, it said all further inquiries need to  be direct towards them from now on...  SO I wonder if calling the tier 2  idiots is even worth it.

A few posts back I  posted the contact info for all the service centers.  I would send an email directly to the service center asking for status. Include Case nmber and both names.   I sent an email a few days back and I revceived an automated repsonse right away.. If I don't hear anything next weem, I will send another email and ask for another inquiry.  I'll start telling each contact that that other contact told me some BS  and I'll ask confused.

I wonder if it has something to do with the region where you live and how they decide to process the files?   I am from Philadelphia.. Alot of Marchies are from NJ and NY.  Is that just a coincidence?

We have been approved!I just saw the mail. It came through on the 27th of December,2013. Didn't have internet access till now. All the best everyone. I so waited for this that it took away all the excitement. Anyway hubby is down and we having a mini vacation. Happy new year everyone. Will update my timeline when I get bak.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsApril 2013 I-130 Filers

Did you get a touch on your file when they "assigned" it?  Because mine hasn't been touched at all since it got scanned into NSC.  I am extremely doubtful that I will get an answer by Monday. Unless they decide to try to give themselves more time by sending me an RFE for something I undoubtedly have already sent them. But whatever, I'll take an RFE at this point if it means someone's actually dealing with my case. (When I told that last tier 2 that, he was horrified. Oh, no, RFE's are very bad. ####### EVER. RFE means someone's looked at my case. Besides, how is a possible 90 day delay any different than your answer of "You might be waiting over a year total." *%^*^$^%$@@#$%^&**~!)

I looked outside, and it's pretty snowy. Hurray? I'm not sure. The kids weren't real keen on it last time. It took about 5 minutes before my youngest declared that she was cold and didn't like the snow. LOL

No, the last touch was Dec 3rd which I am pretty sure that is when it was scanned in at the TSC.  Thats why I have to laugh because they are all full of ######.   Time and Time again they give answers they think will satisfy us.  Its insulting.

I wish I knew what the process was for assigning a case to an officer.  Do they split the files up by date ?  Are the files sent to different file rooms where different officers have access to them, which means that my files is assigned?  Which really means its sitting in a slightly smaller black hole?

I hate my job, so a state of emergency is a happy thing !!!   The schools are already closed for tomorrow so it would be nice to get up and workout and not have to leave the house.  My kids don't go outside in the snow anymore. The 2 that are still home are 13 and 17.  One usually sleeps and the other texts and reads all day.  I'll have to insist that my youngest makes cookies...  LOL

I agree... an RFE would be fine with me. At least you know when they receive the ####### they asked for, your approval is close.  Not knowing anything really sucks.     The idiots who answer the phones have no clue what is good or bad..

I can't wait to take my husband sledding next year. He has seen snow when he was here for 3 years BUT he never went out to play in it !!

If am in their shoes I will not return either, who doesnt like the holiday seasons?

The USCIS has to have some kind of staff if they are open.  Im not saying they are productive.... but today and tomorrow are not  "offical" holidays so they have to have some sort of coverage.

All I have to say is, they better get their asses in gear and start catching up with the transfers that are about to be 60 days old...  Come on now.

Thank you, LoveMyTico. Just keep the good thoughts coming and when less expected it will show!

I actually had to just step back and forget about it for a while and then we got Transferred to Texas on the 29th of november and one month later the wonderful approval "arrived" _(well at least the e-mail).

I want to start get things ready for the next step now. Can anyone show me what thread should i move to now?

Last night my husbnad told me to stop checking my email. He said when I stop checking, that is when it will come.   But me being me...... I can't stop checking.

We were transferred 2 days before you.  So I can only hope that Texas is working on our file.  I know an officer was assigned to my case.. I just wish I knew when they will process it !  I am not a very patient person these days. I feel like my life is on hold because of this broken process.

I hope they are working today !

You can join the NVC thread. That thread has tons of info you will need.

I am so happy that i can't stop crying, even my cat is worried because i was laughing and crying at the same time. I am afraid i lost my mind, while waiting.

Don't give up, my visa companions, your approval will arrive soon.

Best wishes to you all!

That is good news from TSC.  You were transferred right around the same time as we were.  I hope someone picks up my file today !

I asked my lawyer about a backlog at the NVC and how can we speed it up.... this was his response.

Hi, Jen:

I've found it generally better to stand by and let them do their job.  They will get to it.

I checked the AILA message boards and I'm not coming up with an NVC backlog; that doesn't mean it doesn't exist.  But I'm not seeing the indications.  It could be that it's not a backlog at all; it could be business as usual.  8 weeks from start to finish at NVC not bad; also remember that sometimes NVC is waiting for the embassy to give them an appointment slot for the waiting beneficiaries.

Hang in there!

I'm thinking of you, too. So glad to hear that you've at least been assigned. Hopefully, we'll hear something tonight or tomorrow.

I have been a freak checking my email all afternoon. And I have been texting my husband all afternoon. I told him to make sure he leaves his cell phone on tonight incase I get an email later... He goes to bed a 9pm... ( hahaha 33 years old but acts like an 80 year old)    He told me he will sleep with the phone next to his head....

We all need to get approved and move on... This is so ridiculous

Yes, it does. That's why I've been trying to get the word out and contact everyone I can. Not much else I can do atm.

I just want you to know that I am thinking of you...  I had to stop following the other threads because I couldn't stand to watch approvals who filed after me...  I hope you hear something soon !

Yeah, if it's something that you already sent in or that isn't required initially I'd contact the ombudman.

I agree, And Kaylara.... my heart goes out to you.... you have been waiting so long....   Im sure it pisses you off to watch all this....

I hope it's something stupid. It says for "initial" evidence, not additional.  I turned in everything asked for initially.  Probably the spouses birth certificate or something they did not originally require.

Fingers Crossed!

OK Steve, you did break our pact though. We were supposed to get approved at the same time... LOL

I am so very happpy for you.. You actually heard something today  and we were just talking about it  !!   What luck...
