My PD date is March 28th, NOA1is April 5, I was transferred last week to Cali.

When you check your case on the USCIS website, what is the date they use in their blub?  On such and such a date we recieved your case for BLAH BLAH BLAH...

 

That is the "so called PD date"    I am confused as to why you are using March 28th as your PD date and NOA1 date as April 5th.    PD and NOA1 are the same date

The food in china is so hot i can't believe it.  My wife can eat the hottes red pepper like candy. So I think my thanksgiving dinners will be hot when she gets here.  Her mom likes to cook for me when I'm there.  Its a totaly different way of cooking and eating.  I dont think I could get the fixings for a turkey dinner in her city and I'm not sure they would like it. 

When my husband lived here with me before we were even married, he ate Thanksgiving dinner with my family. It was new to him but he loved everything.  I can't cook the way I want at his house in CR because of the oven issue  but I will do my best to throw something together.  I know my husband is sick of eating rice everyday. It is his culture but he is a bit Americanized. He likes american food so much.   

 

I didn't know Chinese food is hot.   That's funny how we all have a different impression of other cultures.   When I think of Chinese food , I think of the corner take out...  LOL

 

It sucks that we all can't be with our spouses  on Thanksgiving

I think your right.  March up to the 20th?  and not a big percentage of the JV filers yet either.  Is it two (only) NOA2 for the transfers so far?

 

Do they put hot peppers on the Thanksgiving turkey dinners in CR?  I 've been meaning to ask you.

Costa Rican food is not hot...   HaHa  and really, Turkey is an American thing. Thanksgiving is an American Holiday.  My in-laws don't know it yet but I am cooking for them.  I would say not many people have Ovens over there so When I get there Thanksgiving day  we have to stop at the Walmart and pick up a precooked bird.  I have a suitcase full of American traditions that I know I can't get over there at the Pali or MegaSuper...  LOL

I am so confused, is there any system of who is being transferred? Some March and April filers are being transferred while others aren't.

I don't know of any April transfers.  Just Feb and March so far  unless I missed something... Correct me if I'm wrong

Its time to get this show on the road....   I wonder if they plan on transferring the April filers next month when everyone is on vacation..  It would be nice to see the Feb and March filers get some approvals so the hope isn't completely dead.

 

3 1/2 weeks and I'll be with my husband for 12 days.  at least I have something to look forward to... 

 

The holidays are a tough time of the year.  I know most of Costa Rica shuts down the last 2 weeks in December. Of course over here, everyone takes extended holiday vacations.  UGHHH what a big bummer. It is so hard to stay positive....

So if a MAY filer is being told they should see NOA2 around December/early Jan, April filers should be flooded with NOA2s around now. Ugh I'm kind of tired of every week something like this which gives so much hope and so much disappointment as the months roll on.

I just posted it because I just thought it was a good opportunity for a little laugh...  I was told the other day that Tier 2 is only a call center and they really don't know anything about whats going on.    The person I talked to seemed so irritated that I was asking questions. She talked to me like I was a total idiot and didn't have the ability to  understand her. When I finally had told her I already know the way this works and I went through this before, all she could say was "OH"   I knew what I was asking and I guess she was frustrated because she couldn't answer me.  

 

That so called "customer service" line is a joke...

NBC received my case for my husband's i130 on April 22nd of 2013, and

on October 29th of 2013 I opened my email and saw it!

 

Then I checked the USCIS website to make sure I wasn't going crazy and starting to see things.

When I realized this was true I had tears of happiness streaming down my face and I was at work so I couldn't post then but as soon as I got home I came to let all of you know that they must be working on April filers more, and that it seems like April filers aren't being transferred.

 

My case was at Lee Summit, MO and I never had a transfer.

 

I'm honestly in shock, I was preparing to wait a few more months from what I have been reading.

This gives me hope that all of you will get your approvals soon also!

Don't give up hope yet!

Well for one my wife lives in the 2nd highest country with murder rate. But since then truce between gangs happened so I never worried but the bus she takes has been robbed twice with her on it. Gang members have started hanging out in her neighborhood. Her coworker was robbed at gun point for wedding ring. Her neighbor's house was robbed by gangs. Most recent friend of mine was robbed there and got stabbed also lost a eye.. Tier 2 told me that was 100% valid reasons so I filed.

BTW...The Ombudsman's office will not get involved with any case until the case is out of the current processing timeframe.

Why not we send individual emails to Ombudsman stating our plight about the long delay. If someone there is humane they might act.

 

 


Also if you look the time frames, i-130 petitions are the ones that are backed up forever. All those petitions for non-immigrants are taking very short time.


Don't hold your breath on the Ombudsman's office.. I placed a complaint on Sept 11th and then there was the shutdown... and then I called ( several times) and was told they are super behind in their processing and that mine will be looked at soon... And a few more phone calls later... today included,  All I get is a voice message asking for my name and number and they will get back to me shortly....

Hi everyone - so I finally tried the Tier 2 operator call, and got pretty much the same response as everyone else.  Both operators were perfectly nice, but can't say anything other than, "You haven't been transferred to a local office" (which is actually useful information) and the same "They're working on October 2012" that everyone else has gotten.

 

Obviously we all know that October 2012 aren't the only files getting approved right now, so my theory is that in order to avoid complaints, they are basing their standard processing times off of the OLDEST files that are currently being processed and not the AVERAGE age of the files being approved.  That gives the MSC the largest window of time before people can start complaining about being outside "standard processing times".  

 

Not that it makes it okay - and I'm just guessing - but I suspect that's the reasoning behind it.

 

It does start to make me really nervous that he won't get here before next summer - even though we are legally married, we are planning a family wedding ceremony for next June, and we had thought initially that there was no way this process would take longer than that.  Now it looks like our worst-case scenario might come true - and we have to start planning for it just in case.  Luckily, I am in a position to possibly take a month off in the summer (skype in for work meetings and such) and go be with him in Germany, which we might have to do if it comes to that.

 

Let's hope that it doesn't, and we all start to hear more April approvals soon.  And let's send some good thoughts to those poor people from October 2012 who might still be waiting for approvals!

I read somwhere that the Oct 2012 information was from the VSC... so in my mind, that doesn't even apply to the NBC.... They just took the oldest file in the pipeline and used that... It only really buys them time so they aren't flooded with inquiries because they are past the posted timeframe... That's it.

Off topic, but pertinent. I was hoping my wife will get over here by April next year, in time for filing taxes, and that she would have gotten a SSN by then. I think reaistically that is no longer going to happen. I would like to file joint taxes next year. My understanding is that I can get a tax ID number for her. Does anyone know how to do that, especally with the logistics of she being overseas and me being here? Thanks.

This is is unnecessary and rude! You have a right to your opinion, but we try to be supportive on this thread.  We are all going through the same process and there is nothing stopping someone from trying for an expedite.   If you have the right evidence to back up your case, then you might just get lucky and USCIS approves it.  

 

This person was asking for opinions, you could have simply said "no you won't" or "this is a bunch of....." and moved on.  No need to add the "I hope you don't get it".  How would you like it if I now told you "i hope it takes your petition another year to get through!"  Its just rude and childish.  Sad. 

I think the comment was fine..  They have a right to their opinion just as  you do.. You think it is rude, and thats fine... This is a public forum...  

 

I will add that it is kind of insensitive to post something about asking for an expedite due to stress when we are all in the same boat.  I think alot of people look at it like this....  WE ARE ALL SUPER STRESSED so if that is a reason to expedite, then we should all be approved. That poster was asking opinions and they got it.  I am very opinionated and I am not afraid to voice it... If you don't like it,  scroll right on by. Not everybody sees life through rose colored glasses. Some see it as it is.

 

  That person is fortunate enough to even have a job. The other poster was right about changing jobs if they can't handle the stress. Nursing and anyone who works at a hospital is stressful to begin with and they know that going into the job. Its a known fact that nurses get burnt out very fast.    Going through the immigration process on top of doing your everyday job is not a reason for expedite.(IMHO).. YES OR NO???   The rest of us are waiting just like them...  I personally went to my doctor just 2 days ago. he honestly told me my blood work shows my stress hormones are threw the roof and I better start yoga or something because it will kill me.  He asked me what makes me happy... I told him that would be my husband..   SOOOO, maybe I should ask for an expedite.  My stress actually is causing medical problems...  And I have never been sick in  my entire life... ( and I'm no spring chicken) 

 

Let people voice their opinion.  It is part of the stress of going through this god awful process.  Nobody misses their spouse more than the other.

 

Nobody is stopping that poster from filing an expedite.. I say go for it, but when you post on a public forum with a bunch of people who are  in line for the same thing, you have to expect that not everyone will agree...  

 

I see so many people complaining about the processing times on the all the threads.  And IMO it is a bit obnoxious to see every response telling people to goto a thread and join the campaign ( alright already... jeeze)     This is a long processes....  No you tube video or letter to your congressman will make the process go any faster. If Y'all think it will help, then by all means, Knock yourselves out..... if that is how you want to spend your time.

 

The first thing my lawyer told me was to disregard the BS about immigration online. He reminded me that the Immigration dept was created to keep people OUT. Everyone seems to think it is their right to have their spouse here. NO, its a priviledge.  That is why there is a process. It sucks that it takes so long.... and yes, we are free to marry whoever we want...  The USCIS did not tell you to marry a foreigner.  It is what it is.  You are also free to move to your spouses country if you don't like the process here. I can only assume that is the thought process at the USCIS  ( but again, only my opinion)  

 

 Me personally, I wouldn't EVER post my face or my children on the internet complaining about a government process especially while I was going through that process. They say to be careful what you post on the internet because it is there forever for all to see.  When we all sent our petitions in, we knew it would be long and uncertain. ( at least I did)

Just as I do when I see posts I don't like.    I kind of feel the same when I see so many whiners ( yes, I went there) posting the same things over and over again.. Based on what I've seen around VJ, you probably won't get an expedite on these grounds. I think they'd be more likely to suggest your wife is in the wrong profession if she can't manage her work alongside the immigration process, unfortunately.

from all that I have read about expedites, it really has to be something close to a death bed situation, but then again, there was an expedite approved and the girl posted that her reason was that she could not afford to pay her rent AND pay for the immigration process... ( which kind of floored me)

Most of the expedites I have seen lately have been for humaniterian reasons...  dangerous situation in the other country.

 

I don't think stress would count as a reason to expedite since childbirth is not... Not even a c-section.... Then again.. I saw a post recently about a woman who was having a hernia operation on Nov 1st and they approved the expedite....  I guess it all depends on who looks at your file and how caring and empathetic they are. 

 

Try it an see what happens. Worst they can say is No.   Then you can say you tried everything you could to get through this hell hole

Yeah, she works at more than one hospitals and we got the letter from all of them from her nursing managers.

what did the employer put in the letter?  Are they doctors stating a diagnosis or are they Leadership noticing her stress level?   Does she have any stress related illnesses that you have backed up?  Just curious

I finally made it to the end of this thread to make this post! My I130 petition for my husband was received on April 16, 2013 by USCIS. On October 18, 2013 we received our approval. Received my letter today confirming the approval. Now its off to NVS! We are relieved but I miss my hubby!! Haven't seen him since after our wedding in March! It's so expensive to fly there and I have three children prior to this marriage so I'm holding it down. I'm hopeful this process will move a long. It would be the best Christmas ever if he could be here by then!!! Congrats to others who have received their approvals!!

I agree with you  100%  and I am glad you said it !!   "criminals"   HOW THE FRIG  do you reward a criminal with a pathway to citizenship or priority processing when the citizens who followed the law BY THE BOOK get thrown aside?????..  And in my opinion, everyone on this forum should be against amnesty....  I don't care how long they are in the US ILLEGALLY...  go back to your country and file your papers just like the rest of us had to do... March first week filers are getting transfered to Local field offices as of today.

hmm, so the last 2 weeks were February, now March....  I hope April is waiting in line  or maybe they will just  decide to JUST PROCESS THEM THERE ! !  !!(sarcasm)   

 

 

Somebody should lose their job for the poor planning of this process.  This is not like missing a delivery date for a product... this is interferring with human lives...  downgrading the USC....  If this office is self funded and they are backlogged, it doesn't make sense that they aren't hiring enough people to take care of the pipeline.  or that they didn't foresee the future filings....  POOR POOR PLANNING...  I'm so disgusted.

Please ask them if we can file a class-action lawsuit against USCIS. How can they simply choose to ignore an I-129F petition for a K-3 visa? It was signed into law. Do they have any accountability whatsoever?

She was seriously on my last nerve ..... I had a very bad day and she topped it off.   

 

They can't ignore it...

 

 

There is so much different info about the K-3.  If my K-3 gets merged with my I-130 then great.... at least someone touched my file.  I have been reading alot about people calling tier 2 and them suggesting to file  K-3 since the I-130's are taking extra long....

Spoke to a woman at Toomey's office today. She told me my inquiry is that the wait is 6 months from the day of this notice....  Same ####### I was told 2 months ago...  She said approvals are taking 12 months and They aren't processing K-3s. They are merging files and approving together......

 

She told me the opposite of what we are learning here on VJ.. The funniest thing she said was that the USC's are given first priority.  Why is is such a friggin project to get information on your case?  I flat out told her the information she gave me was pure #######.... Why is it that everytime I call the USCIS, I get a different answer?  She had nothing to say.

OK NEED TO VENT..

 

I have been in contact with Senator Casey's office and senator Toomey's office. Both have done inquiries. ( not at the same time)  They both tell me to call back monthly and they wouldn' happily do another inquiry.

 

So, I couldn't do anything during the shut down so I waited. But I did leave at least 3 messages for Toomey's office since the shutdown ended and nobody has returned my call.  Today I get an email ( not a return call) saying she has been in meetings and she is almost sure the inquiry will say the same thing as before........

 

Well, to me, that said she is not concerned with helping me ( isn't that her job?)  so I sent a nasty email back saying it is obvious she is not interested in helping me and it would have been really nice to get a return call, not just an email.  She comes back with, " if you are not interested in working with our office, please let us know"  I will be available later this afternoon... 

 

 

Really?  

 

Who is above that office? The governor?

If you just choose the K-3 visa, there are spots there to fill in the tracking for both I-130 AND I-129f.  I dunno how it comes up in the charts tho.

When I choose K-3, I get an error that my I-130 dates are incorrect and it won't let me save it. And the K-3 info is not there to fill in.  Hopefully I can get it reset and I can start from scratch again.  It thinks I have 2 timelines...  hahahaa.

I had the same problem trying to add my k3.  In the end, it locked me out as I was using the same email address for both 130 and k3. Send a message to Captain Ewok or Kathryn41 on VJ Moderation Team.  My timeline now shows both 130 and 129f.

I can't figure out how to get the K-3 on my timeline either, so I'm just tracking it in my sig for now.  If it gets moved forward before the I-130 then I'll just change my timeline to K-3 to help the charts & lists.

I figured out why I can't do anything ........I had an account with a different email address. It wont let me update the email address even though the info on the timeline is my current info.  and I can't access the OTHER timeline that they say I have... So  I can't change mine  and I don't see a link for an admin help..

I-130 approved today, but I'm not sure how to advise you guys to think about it.  I am a USC living overseas, but I had also filed an expedite request last month, so I have no way of knowing what got it approved.

Did you get a message about your alien number being updated?  I did with the I-129f NOA1  but nothing since then.  Still dont know what the alien number is.  I recieved a MSC number for both also.  There is more action on the VJ K3 charts lately.  I think because more people are Listing K3 on their timelines also.

NO,  no alien number... and I can't figure out how to get my K-3 on my profile and on my timeline..  I can change my profile to K-3 but the timeline doesn't give me the option to add the K3 info. I would love for it to be correct...  GRRRRR

 

 

I think the Alien number is for the beneficiary... not us.  My husband came here on a b2 visa..  I guess he either already has one or they didn't give him one yet.  Who knows?

What...they walked into the case file storage closet and suddenly realized there was no way humanly possible to process them all at one location in anyone's lifetime? *psha* FINALLY!  Hopefully dispersing the load will help speed things up.

 

I also just got notice that my K-3 petition was received and its off to the NBC hopefully to join my file and get put in someone's hands! We'll see! 

I just got notice of my K3 receipt today  too !   10/16   and 10/19 for last updated.. It has an MSC number but according to the USCIS where you can check your case, Only 2 service centers are in the drop down for K3's.  I hope that is good news...    I want mine to goto TEXAS..  NOW ! ! ! !

Hi I am Sandra (the beneficiary) My Husband is an USCitizen, we filled the I-130 in April. Got our NOA1 on the 15th of April. Since then, only misinformation from USCIS. Since August  we kept calling them and got always the same answer, that our case was being processed and that we were going to get the letter in 30 days.

And now the last Info is that our case has been in the NBC since the beginning and it might take around 6 more months the top to get processed.

I wanted to know if there is more on our situation? Or are your processes being solved normally?

 

ps:At the current moment I am living in Portugal by myself, and my husband has returned to the US.

that's all we can do right now.

Try not to  listen too much to the operators when you call.  They are reading off a script.  They are basically covering their asses.  Of course they will tell you 6 more months.. it buys them time... it makes it so they don't have to be held to any kind of "out of compliance" complaint

 

There have been some April filers who have been approved in the last week or so.  Keep a watch on Igor's list.  Keep your timeline up to date. 

 

And just hang out here.  It is fun to see all the approvals come through.

I received an email today at 5pm before I was leaving for work that my case has been approved finally!!!  I was feeling that I will break down if the petition won't be approved in time...but i feel so relaxed and happy now... Yaayyyy!!!!

I have a new job, and im confused what should i put on my W2. Single or married ? We only have marriage certificate from Bosnia, and my wife still leaves there, and she never entered USA. I did send that certificate with my I-130 of course.

it depends on what you want deducted from your pay.. You can put whatever you want..  I always put single.. I like getting a refund

Yesterday the lady told him they are updating the nbc processing time soon... And that he should call back within a week... The first one urged him to call by the end of October if we didn't hear anything by then) wink.png Iam holding to that !!!! smile.png

Yep, I was told by a tier 2 person about 3 weeks ago to expect something around HALLOWEEN.... to me, that is the end of Oct/early Nov.

 

That is what I am holding on to...  I'll be in Costa Rica for Thanksgiving and the first week of Dec.  I hope I will have some thing to celebrate while I am with my adorable husbandheart.gif heart.gif

What they are saying basically is that filing the k3 would be useless at this point since they would reach the nvc at the same time and hence the i129f would be cancelled! Good for those who filed it long time ago though..wink.png
However, I really think the 11 months processing time is the max timeframe they are given to us... Not meaning that we would all wait 11 months.. I really believe we would see more approvals of April filers by the end of this month and the coming month inchallah smile.png that's how I see the whole situation myself smile.png

Its all a matter of opinion. I disagree that the K-3 is a waste of time...

 

If the K-3 brings attention to my I-130.... YAY ME....  They can't ignore it... it has to be routed like any other file.... so whatever happens ... happens.   and I don't think my attorney is in the business of steering clients in the wrong direction... just sayin....
